PROVISIONS ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE LEGAL AFFAIRS DEPARTMENT

At the proposal of the Director of the Cinema Department.

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 185/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;
Pursuant to Decree No. 122/2004/NĐ-CP dated May 18, 2007 of the Government stipulating the functions, tasks, powers, and organization of legal affairs departments of ministries, ministerial-level agencies, agencies under the Government, specialized agencies under provincial People's Committees directly under the Central Government, and state-owned enterprises;
Considering the proposal of the Head of the Legal Affairs Department and the Head of the Organization and Cadres Department,
The Legal Affairs Department is an agency of the Ministry of Culture, Sports and Tourism with the function of advising the Minister to implement state management through law in the fields of culture, family, physical education and sports, and tourism; organizing the implementation of legislative work, reviewing, systematizing, inspecting normative legal documents, popularizing and educating the law, and inspecting the implementation of laws in the fields under the Ministry’s state management.

DECISION:

Article 1. Position and Functions

1. In legislative work:

Article 2. Tasks and Powers

a) Taking the lead and coordinating with relevant agencies and units in forecasting annual and long-term legislative programs and implementing them upon approval by the Minister;

b) Taking the lead and coordinating or participating in drafting normative legal documents according to the Minister's assignment;

c) Reviewing or contributing opinions on draft normative legal documents and international treaties prepared by agencies and units under the Ministry before submitting to the Minister;

d) Taking the lead and coordinating with relevant agencies and units in preparing files for draft normative legal documents for the Minister to direct the organization of contributions, opinions, and submission to the Ministry of Justice for review and to the Government and Prime Minister;

đ) Taking the lead and coordinating with relevant units in assisting the Minister to contribute opinions on draft normative legal documents and draft international treaties sent for comments by other ministries, ministerial-level agencies, agencies under the Government, or localities.

2. In the work of reviewing and systematizing normative legal documents:

a) Taking the lead and coordinating with relevant agencies and units in organizing the review and systematization of normative legal documents related to the Ministry's management fields;

b) Submitting to the Minister proposals for handling the results of reviewing normative legal documents.

3. In the work of inspecting normative legal documents and inspecting the implementation of laws:

a) Taking the lead and coordinating with relevant agencies and units in inspecting normative legal documents as prescribed;

b) Reporting to the Minister the results of inspecting normative legal documents and making recommendations for handling as prescribed;

c) Taking the lead and coordinating with functional agencies in inspecting the implementation of laws in the fields under the Ministry's authority; monitoring and urging the implementation of laws, summarizing practical experiences in enforcing laws in the fields of culture, family, physical education and sports, and tourism.

4. In the work of popularizing and educating the law:

a) Taking the lead and coordinating with relevant agencies and units in organizing the popularization and education of the law;

b) Serving as the permanent member of the Interagency Coordination Council for Popularizing and Educating the Law of the Ministry, assisting the Minister in directing the popularization and education of the law within the sector.

5. Participating in opinions on the handling of violations of the law in the sector.

6. Providing professional guidance on legal affairs for agencies, units, and enterprises in the cultural, sports, and tourism sectors.

7. Monitoring and implementing international cooperation on law in the fields of culture, family, physical education and sports, and tourism.

8. Participating with agencies and units managing public services in the fields of state management of the Ministry.

9. Taking the lead and coordinating with relevant agencies and units in guiding units in the sector to implement normative legal documents on culture, family, physical education and sports, and tourism; providing legal advice within the scope of the Ministry's responsibility.

10. Advising the Minister to manage the publishing activities of publishers and agencies and units under the Ministry in accordance with the law.

11. Implementing administrative reform contents according to the Ministry's program and plan; managing cadres and civil servants, implementing systems and policies for cadres and civil servants in the Department; managing assets assigned.

12. Performing other tasks assigned by the Minister.

2. Professional civil servants.

The Head of the Legal Affairs Department is responsible for assigning cadres and civil servants according to their positions and professional standards; establishing and promulgating the Rules of Operation of the Department.

This Decision takes effect 15 days from the date of publication in the Official Gazette and replaces Decision No. 30/2004/QĐ-BVHTT dated June 18, 2004 of the Minister of Culture and Information stipulating the functions, tasks, powers, and organizational structure of the Legal Affairs Department of the Ministry of Culture and Information, Decision No. 389/QĐ-TCDL dated October 28, 2003 of the Director General of the National Tourism Administration stipulating the functions, tasks, powers, and organizational structure of the Legal Affairs Department of the National Tourism Administration, and Decision No. 1919/2003/QĐ-UBTDTT dated November 17, 2003 of the Chairman of the State Sports Committee stipulating the functions, tasks, powers, and organizational structure of the Legal Affairs Department of the State Sports Committee.

Article 4. Effectiveness

The Head of the Legal Affairs Department, the Director of the Office, the Head of the Organization and Cadres Department, the Head of the Planning and Finance Department, the Heads of subordinate agencies and units of the Ministry, and related organizations and individuals are responsible for implementing this Decision./.

The Head of the Legal Department, the Director of the Office, the Head of the Organization and Cadres Department, the Head of the Planning and Finance Department, the Heads of subordinate agencies and units under the Ministry, and related organizations and individuals are responsible for implementing this Decision./.
