CIRCULAR
Regarding import under tariff quotas for the year 2011 with a rate of
customs duty of 0% for goods originating from Laos

Pursuant to Decree No. 189/2007/NĐ-CP dated December 27, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Agreement between the Ministry of Industry and Trade of the Socialist Republic of Vietnam and the Ministry of Commerce of the Lao People's Democratic Republic on goods enjoying preferential tariff rates under the Vietnam-Laos Agreement, signed on January 17, 2009;
Pursuant to the Agreement between the Ministry of Industry and Trade of the Socialist Republic of Vietnam and the Ministry of Industry and Trade of the Lao People's Democratic Republic on the adjustment and supplementation of the Agreement between the Ministry of Commerce of the Socialist Republic of Vietnam and the Ministry of Commerce of the Lao People's Democratic Republic on goods enjoying preferential tariff rates under the Vietnam-Laos Agreement, signed on October 29, 2010;
Implementing the Prime Minister's directive at Document No. 8339/VPCP-QHQT dated November 16, 2010 regarding the implementation of the Vietnam-Laos Agreement on preferential goods;
The Minister of Industry and Trade hereby stipulates the import under tariff quotas for the year 2011 with a customs duty rate of 0% for goods originating from Laos as follows:
Article 1. List of goods and quantity of tariff quota imports in 2011
Apply the tariff quota for import in 2011 for two groups of goods originating from Laos including: rice and other cereals, tobacco leaves and stems with a customs duty rate of 0% (zero percent). The commodity codes and total quantity of tariff quotas for the groups of goods enjoying a preferential customs duty rate of 0% are set forth in Appendix No. 01 attached hereto.
Article 2. Conditions for enjoying the customs duty rate within the tariff quota of 0%.
1. Goods imported must have a Certificate of Origin in Form S (C/O Form S) issued by the competent authority of the Lao People's Democratic Republic in accordance with regulations and cleared through the border gates listed in Appendix No. 02 attached hereto. Import procedures for goods shall be handled at the customs office where the import procedures are carried out according to the principle of automatic retroactive reduction (the total quantity of imported goods enjoying a customs duty rate of 0% is reduced by the quantity already imported for each item).
2. Vietnamese traders may import rice and other cereals under the tariff quota. For tobacco leaves and stems, only traders holding import licenses for tobacco raw materials under the tariff quota issued by the Ministry of Industry and Trade in accordance with Circular No. 04/2006/TT-BTM dated April 6, 2006 of the Ministry of Commerce (now the Ministry of Industry and Trade) are permitted to import; the quantity imported shall be deducted from the tariff quota import license issued by the Ministry of Industry and Trade.
Article 3. Effectiveness
This Circular takes effect from January 17, 2011 and ceases to be effective after December 31, 2011.
