Circular No. 38/2010/TT-BQP on the List of Procurement and Production of Materials, Means, and Equipment for the People's Army and Militia Self-Defense Forces to Fulfill Civil Defense Tasks

Article 1. Scope of Regulation

This Circular stipulates the list of procurement and production of materials, means, and equipment for the core forces to fulfill civil defense tasks under the People's Army and Civil Defense Self-Defense Forces.

Article 2. Applicability

This Circular applies to agencies and units of the military and Civil Defense Self-Defense Forces performing civil defense tasks.

Article 3. Materials, Means, and Equipment Ensuring the Fulfillment of Civil Defense Tasks Managed by the Ministry of National Defense

Types of materials, means, and equipment ensuring the fulfillment of civil defense tasks for the core forces managed by the Ministry of National Defense shall be implemented according to Decision No. 46/2006/QĐ-TTg dated February 28, 2006 of

Article 4. Materials, Means, and Equipment Ensuring Civil Defense Tasks for Units of the People's Army, including:

1. Specialized vehicles for X-ray photography and detection.

2. Signal guidance sets.

3. Excavator vehicles.

4. Ground-penetrating radar.

5. Jamming vehicles.

6. Bomb transport vehicles.

7. Kits of chemical reagents for laboratory analysis.

8. Complete sets of medical equipment for regional hospitals and field hospitals.

9. Mobile pressurized chambers.

10. Fixed pressurized chambers with two compartments and high-pressure compartments.

11. Fixed decompression chambers.

12. Level 4, level 3, and level 2 safety suits.

13. Complete sets of pharmaceutical and intravenous fluid production workshops.

14. Complete sets of medical equipment calibration and repair workshops.

15. Remote-controlled explosive devices.

16. Systems of field construction equipment.

17. Rapid bridge-building equipment.

18. Anti-miring equipment.

19. Camping tents.

20. Combat medicines.

21. Sets for protection against nuclear weapons.

22. Sets for protection against chemical weapons.

23. Sets for protection against biological weapons.

24. Mobile ambulance vehicles with two bridges.

25. Mobile surgical vehicles.

26. Mobile testing vehicles.

27. Mobile X-ray vehicles.

28. Mobile oxygen generation and high-pressure compression systems.

Article 5. Materials, Means, and Equipment Ensuring Civil Defense Tasks for Units of the Civil Defense Self-Defense Forces, including:

1. Shovels.

2. Pickaxes.

3. Spades.

4. Hatchets.

5. Various types of ropes.

6. Pincers.

7. Various types of planks and boards.

8. Various types of packaging.

9. Iron cages.

10. Flashlights and batteries.

11. Safety helmets.

12. Crowbars.

13. Hand drills.

14. Portable power drills.

15. Hand saws.

16. Portable power saws.

17. Protective clothing.

18. Fire extinguishing tools.

19. Elephant foot tampers.

20. Buckets and containers.

21. Stretchers.

22. First aid kits.

23. Individual face masks.

24. Gloves and boots.

25. Simple gas masks.

Article 6. Procurement and Production of Materials, Means, and Equipment Ensuring Civil Defense Tasks

1. Procurement of materials, means, and equipment ensuring civil defense tasks

a) Annually and during each period, based on the needs for procurement of specialized materials, means, and equipment to ensure the civil defense tasks of the military forces, proposals and budgets for procurement must be prepared and submitted to the competent authority for approval;

b) Based on their assigned functions and tasks, local military agencies at all levels advise the People's Committees at the same level to develop plans for procurement and production of materials, means, and equipment to ensure the civil defense tasks of the forces under their command and the Civil Defense Self-Defense Forces, which are then submitted to the Chairperson of the People's Committee at the same level for approval.

2. Production of materials, means, and equipment ensuring civil defense tasks

a) Utilize the dual-use capabilities of national defense factories and domestic production facilities to produce specialized materials, means, and equipment for the military units performing civil defense tasks. The production plan must be coordinated with relevant agencies inside and outside the military and submitted to the competent authority for approval;

b) The production of samples of materials, means, and equipment for the Civil Defense Self-Defense Forces when performing civil defense tasks is the responsibility of the Ministry of National Defense;

c) Local military agencies at all levels, in collaboration with relevant functional agencies, advise the People's Committees at the same level to develop plans and utilize existing materials and means at the site to promptly ensure the civil defense tasks of military units and the Civil Defense Self-Defense Forces when situations arise.

3. Budget Estimates for Procurement and Production of Materials, Means, and Equipment Ensuring Civil Defense Tasks

a) The budget estimates for procurement and production of materials, means, and equipment for civil defense tasks for military units and the Civil Defense Self-Defense Forces are carried out in accordance with Clause 2, Article 7 of the Joint Circular No. 43/2009/TTLT-BQP-BTC-BKH&ĐT-BLĐTB&XH dated July 31, 2009 of the Ministry of National Defense, Ministry of Finance, Ministry of Planning and Investment, and Ministry of Labor, Invalids and Social Affairs guiding the implementation of certain provisions of Decree No. 117/2008/NĐ-CP dated November 14, 2008 of the Government on Civil Defense;

b) Military agencies and units only prepare requirements, estimates, and organize production and procurement for those materials and means specified in Article 4 of this Circular that have not yet been allocated and provided by the Ministry of National Defense to military agencies and units for management;

c) Annually, based on the needs for materials and means to ensure the civil defense tasks of the Civil Defense Self-Defense Forces, local military agencies prepare budget estimates for production and procurement, which are then submitted to the People's Committee at the same level for decision.

Article 7. Management of procurement and production of materials, means, and equipment to ensure civil defense forces

1. The General Staff assists the Ministry of National Defense in coordinating with the General Department of Technical Services, the General Department of National Defense Industry, and related agencies to manage the procurement and production of materials and means to equip agencies and units of the military tasked with civil defense duties within their assigned areas.

2. Commanders of agencies and units of the military tasked with civil defense duties shall manage the materials and means provided according to their functions, tasks, and granted authorities.

3. Local military agencies at all levels shall take the lead and coordinate with relevant functional agencies to advise People's Committees at the same level on building plans and organizing the implementation of management work for procurement, production, and exploitation of sources of materials and means to ensure forces tasked with civil defense duties under their authority.

Article 8. Inspection of procurement and production of materials, means, and equipment to ensure civil defense forces

1. Annually and periodically, the permanent office of civil defense under the Ministry of National Defense shall advise the Ministry of National Defense to inspect the management of materials and means equipped for agencies and units of the military and self-defense militia tasked with civil defense duties.

2. Local military agencies at all levels shall cooperate with related agencies to advise the Chairmen of People's Committees at the same level on planning and organizing regular and spot inspections regarding the management and use of materials and means provided for forces tasked with civil defense duties under their authority.

Article 9. Responsibilities of agencies and units

1. General Staff Department

a) Direct the permanent office of civil defense under the Ministry of National Defense, and coordinate with related agencies both inside and outside the military to develop proposals and projects and implement procurement and production of materials, means, and equipment to ensure agencies and units of the military tasked with civil defense duties.

b) Assist the Ministry of National Defense in coordinating with related agencies both inside and outside the military to organize inspections and urge the implementation of proposals and projects concerning the provision of materials, means, and equipment for agencies and units of the military tasked with civil defense duties that have been approved by competent authorities.

2. Departments and agencies directly under the Ministry of National Defense

a) Coordinate with the permanent office of civil defense under the Ministry of National Defense to advise the Ministry of National Defense on procurement and production of materials and equipment for agencies and units of the military and self-defense militia according to their assigned functions and tasks.

b) Direct subordinate agencies and units to research, build, and implement proposals and projects on procurement and production of materials, means, and equipment for agencies and units under their management tasked with civil defense duties.

Article 10. Responsibilities of central ministries and departments and People's Committees at all levels

1. Responsibilities of central ministries and departments

a) Approve plans and allocate budget funds for procurement and production of materials and means to ensure civil defense duties for self-defense forces under their authority and direct registration, management, and use.

b) Direct the Military Command under their authority to coordinate with functional agencies under their ministry or department to build plans and implement procurement and production of various types of materials and means to ensure self-defense forces tasked with civil defense duties.

2. Responsibilities of People's Committees at all levels

a) Approve plans and allocate budget funds to ensure procurement and production of materials and means for forces under their authority and self-defense militia tasked with civil defense duties; direct registration, management, and use.

b) Direct local military agencies to take the lead and coordinate with related sectors to build plans for procurement and production of various types of materials and means to ensure civil defense of their locality and implement them.

Article 11. Effective Date

This Circular takes effect from June 25, 2010.

Article 12. Implementation Organization

1. The Chief of General Staff, Heads of Departments, Chiefs of Agencies and Units under the Ministry of National Defense; Commanders of Military Regions, Corps, Services, Arms; Chairmen of People's Committees at all levels; Commanders of local military agencies at all levels are responsible for organizing the implementation of this Circular.

2. The General Staff shall take the lead in directing the permanent office of civil defense under the Ministry of National Defense and agencies and units assisting the Head of the Ministry of National Defense to monitor, urge, guide, and inspect the implementation.

3. During the process of implementing procurement and production of materials and means as stipulated in Articles 4 and 5, adjustments and supplements will be made to suit the needs of task execution and economic and social development in each locality; if there are difficulties in implementation, agencies, units, and localities are advised to report to the Ministry of National Defense./.
