CIRCULAR

Regulations on National Vocational Skill Certificates, Issuance and Management and Issuance

Grounds: Employment Law dated November 16, 2013;

This Circular guides the establishment of plans and the organization of implementation of working hours and rest time for workers engaged in seasonal production work and piecework manufacturing.on1. Workers who enter into fixed-term employment contracts with durations from twelve to thirty-six months and indefinite-term employment contracts performing the following work:iPursuant to the request of the Director General of the Department of Vocational Education;

Article 3. The form and content of national vocational skill certificates are in Model 01 attached to this Circular.

Article 4. The number of a national vocational skill certificate includes: serial number, regional code, and year of issuance.

Article 5. The method of numbering and regional code of a national vocational skill certificate is specified in Model 02 attached to this Circular.

Article 5. Authority for Recognition and Issuance, Exchange, Reissuance of National Vocational Skill Certificates

The Ministry of Labour, Invalids and Social Affairs is the agency responsible for recognizing and issuing, exchanging, reissuing, and revoking and recalling national vocational skill certificates.

Article 6. Dossier for Application for Recognition and Issuance of National Vocational Skill Certificates

Article 4. Provisions on the serial number on the National Vocational Skill Certificate

1. The dossier for application for recognition and issuance of national vocational skill certificates for workers who have successfully completed the assessment and certification process includes:

a) A request for recognition and issuance of a national vocational skill certificate by the vocational skill assessment organization according to Model 01, Appendix 03 issued with this Circular;

ISSUANCE OF NATIONAL VOCATIONAL SKILL CERTIFICATES

b) The decision of the head of the vocational skill assessment organization recognizing the results of the assessment panel, accompanied by a summary of the test scores of the knowledge and practical tests of the workers participating in the assessment and certification process, signed by all members of the assessment panel confirming the assessment results;

c) A list of applicants for recognition and issuance of national vocational skill certificates for those who meet the requirements according to Model 02, Appendix 03 issued with this Circular, attached with each person's name a color photo on a white background measuring 3 x 4 cm in the format of a citizen identification card.

2. The dossier for application for recognition and issuance of a national vocational skill certificate for individuals who won medals at World Skills Competitions, ASEAN Skills Competitions, and first, second, or third place awards at National Skills Competitions organized by the competition organizing committee shall be carried out according to Model 01, Appendix 04 issued with this Circular.

The dossier for exchanging a national vocational skill certificate stipulated in Article 3 of this Circular for individuals who have been issued a national vocational skill certificate before May 15, 2015, includes:

1. An application form for exchanging a national vocational skill certificate according to Model 02, Appendix 04 issued with this Circular and a color photo on a white background measuring 3 x 4 cm in the format of a citizen identification card;

2. The national vocational skill certificate already issued and a copy of the citizen identification card or passport still valid for comparison.

The dossier for exchanging a national vocational skill certificate stipulated in Article 3 of this Circular for individuals who have been issued a national vocational skill certificate before May 15, 2015, includes:

A national vocational skill certificate will be reissued in cases where there is a request to modify some information recorded on the certificate due to changes or corrections in the household registration of the certificate holder or if the certificate has been damaged, torn, deteriorated, or lost. The dossier for application includes:

1. An application form for reissuing a national vocational skill certificate according to Model 02, Appendix 05 issued with this Circular and a color photo on a white background measuring 3 x 4 cm in the format of a citizen identification card;

Article 7. Application Documents for National Vocational Skill Certificate Exchange

2. The national vocational skill certificate already issued (except in cases where the certificate has been lost) and a copy of the citizen identification card or passport still valid for comparison;

3. In cases of changes or corrections in the household registration, a certified copy of the household registration with the changed or corrected information must be submitted, or a copy of the household registration (presented with the original for verification when submitting directly).

2. National vocational skill certificate that has been issued and a copy of the person's valid identity card or passport for verification.

Article 8. Application dossier for reissuing national vocational skill certificates

The national vocational skill certificate shall be reissued in cases where there is a request to amend certain contents recorded on the previously issued certificate due to changes or corrections in the person's civil status registration, or because the previously issued certificate has been damaged, deteriorated, or lost. The application dossier includes:

1. Application form for reissuing the national vocational skill certificate according to Model 02, Appendix 05 promulgated together with this Circular and one (1) color photograph measuring 3 x 4 cm against a white background in the format of an identity card of the person;

2. The national vocational skill certificate that has been issued (except in cases where the previously issued certificate has been lost) and a copy of the person's valid identity card or passport for verification;

3. In cases involving changes or corrections to civil status registration, a certified copy of the civil status registration containing the changes or corrections must be submitted, or a copy of the civil status registration (the original must be presented for verification if submitted directly).

Article 9. Procedures for Recognition and Issuance, Replacement, and Reissuance of National Occupational Skill Certificates

1. The procedures for recognition and issuance of national occupational skill certificates to workers who have successfully completed the assessment for such certificates shall be carried out as follows:

a) The organization conducting the occupational skill assessment shall submit one set of application files in accordance with Clause 1, Article 6 of this Circular or send them via postal service to the Ministry of Labor, Invalids, and Social Affairs;

b) Within ten working days from the date of receipt of the application files, the Ministry of Labor, Invalids, and Social Affairs shall be responsible for reviewing the application files, deciding on the recognition and issuance of the national occupational skill certificate; if not recognized, a written response must be provided along with the specific reasons.

2. The procedures for recognition and issuance of national occupational skill certificates to individuals who have won medals at World Skills Competitions, ASEAN Skills Competitions, or first, second, or third place awards at National Skills Competitions shall be carried out as follows:

a) The competition organizing body shall submit one set of application files in accordance with Clause 2, Article 6 of this Circular or send them via postal service to the Ministry of Labor, Invalids, and Social Affairs;

b) Within five working days from the date of receipt of the application files, the Ministry of Labor, Invalids, and Social Affairs shall be responsible for reviewing the application files and deciding on the recognition and issuance of the national occupational skill certificate.

3. The procedures for replacement and reissuance of national occupational skill certificates for cases stipulated in Articles 7 and 8 of this Circular shall be carried out as follows:

a) Individuals requesting to replace their national occupational skill certificate or those requesting reissuance of their national occupational skill certificate shall submit one set of application files in accordance with Article 7 or Article 8 of this Circular or send them via postal service to the Ministry of Labor, Invalids, and Social Affairs;

b) Within fifteen working days from the date of receipt of the application files, the Ministry of Labor, Invalids, and Social Affairs shall be responsible for reviewing the application files and replacing or reissuing the national occupational skill certificate; if not replaced or reissued, a written response must be provided along with the specific reasons.

Article 10. Revocation and Recovery of National Occupational Skill Certificates

1. The National Occupational Skill Certificate that has been issued shall be revoked or recovered in the following cases:

a) Misrepresentation of information in the application dossier for issuance, renewal, or reissuance of the National Occupational Skill Certificate;

b) Forgery of documents or texts included in the application dossier for issuance, renewal, or reissuance of the National Occupational Skill Certificate.

2. When violations of the provisions of Clause 1 of this Article are discovered, the Minister of Labor, Invalids, and Social Affairs shall issue a decision to revoke and recover the national occupational skill certificate that has been issued.

Article 11. Responsibilities of Applicants for Recognition and Issuance, Replacement, and Reissuance of National Occupational Skill Certificates

Applicants for recognition and issuance, replacement, and reissuance of national occupational skill certificates shall bear legal responsibility for the accuracy of the contents in the application files submitted to the competent authority for issuing national occupational skill certificates in accordance with this Circular.

Chapter IV

MANAGEMENT OF NATIONAL OCCUPATIONAL SKILL CERTIFICATE ISSUANCE

Article 12. Publicizing Information on Issuance, Renewal, Reissuance, and Revocation of National Occupational Skill Certificates

1. Within ten days from the date of the decision on recognition and issuance, replacement, and reissuance of national occupational skill certificates or revocation and recovery of national occupational skill certificates that have been issued, the Ministry of Labor, Invalids, and Social Affairs shall publicly announce on its website the list of individuals who have been issued, replaced, or reissued certificates or whose certificates have been revoked and recovered.

2. Information published on the website must ensure accuracy and be regularly updated; it must be easy to manage, access, and search.

Article 13. Reporting on Issuance, Renewal, Reissuance, and Revocation of National Occupational Skill Certificates

1. At the end of June and December each year, organizations conducting occupational skill assessments shall report statistical data on workers who have successfully completed the assessment for national occupational skill certificates and received such certificates according to each level of occupational skill proficiency to the Ministry of Labor, Invalids, and Social Affairs for consolidation.

2. At the end of December each year or at any time upon request, the Ministry of Labor, Invalids, and Social Affairs shall be responsible for consolidating and announcing the situation regarding the issuance, replacement, reissuance, and revocation and recovery of national occupational skill certificates.

Article 14. Responsibilities of the Ministry of Labor, Invalids and Social Affairs

1. Organize the acceptance of dossiers for issuance, renewal, or reissuance of National Occupational Skill Certificates; check, compare, and accurately record all contents on the National Occupational Skill Certificate.

3. Accurately and completely record all contents in the business management books and manage, store the business management books related to issuing, renewing, reissuing national vocational skill certificates in accordance with the laws on archives.

5. Perform other tasks as prescribed in this Circular.

2. Organize the printing and management of national vocational skill certificate blanks; prescribe reporting forms, business management books related to issuing, renewing, reissuing, and delivering national vocational skill certificates.

4. Establish an information network system connected to organizations assessing vocational skills; build a national database management system for issuing national vocational skill certificates and an electronic reporting system suitable for practical conditions, ensuring convenience for processing and searching.

Article 15. Responsibilities of the organization assessing vocational skills

1. Decide to recognize the assessment results of the Examination Board in accordance with Clause 1 of Article 26 of Decree No. 31/2015/NĐ-CP dated March 24, 2015 of the Government detailing certain provisions of the Law on Employment regarding the assessment and issuance of national vocational skill certificates.

2. Accurately and completely record the contents in the list proposing recognition and issuance of national vocational skill certificates for those who meet the requirements according to Model 02, Appendix 03 issued together with this Circular; for individual information of each person, verify and cross-check with their identity cards or passports.

||| 3. Bear legal responsibility for the accuracy of the content in the dossier submitted to the competent authority for issuing national vocational skill certificates as stipulated in this Circular.

4. Accurately and completely record the contents in the transfer and delivery book of national vocational skill certificates and manage, store the transfer and delivery book of national vocational skill certificates in accordance with the laws on archives.

||| 5. Carry out the transfer and issuance of national vocational skill certificates to the certificate recipients and perform other tasks as stipulated in this Circular.

Chapter V

IMPLEMENTING PROVISIONS

Article 16. Effective Date

||| This Circular takes effect from December 5, 2015.

Article 17. Responsibility for Implementation

1. The Director of the General Department of Vocational Training, the Head of the Legal Department, and the Inspector General of the Ministry within their assigned functions, tasks, and authorities shall be responsible for coordinating with units under the Ministry and relevant agencies to organize the implementation and inspect, audit the proposal for issuing, renewing, and reissuing national vocational skill certificates at vocational skill assessment organizations nationwide.

2. Provincial Departments of Labor, Invalids and Social Affairs under centrally-administered cities shall be responsible for organizing inspections and audits of the proposal to recognize and issue national vocational skill certificates for workers participating in the assessment and issuance of national vocational skill certificates that meet the requirements at vocational skill assessment organizations within their jurisdiction.

IF THERE ARE ANY DIFFICULTIES DURING THE IMPLEMENTATION, THEY ARE REQUESTED TO REPORT PROMPTLY TO THE MINISTRY OF LABOR, INVALIDS, AND SOCIAL AFFAIRS FOR REVIEW AND RESOLUTION./.
