Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Customs Law dated June 23, 2014;

Pursuant to the Law on the Capital City promulgated on November 21, 2012;

Pursuant to Decree No. 08/2015/NĐ-CP dated January 21, 2015 of the Government detailing and providing implementation measures for the Law on Customs regarding customs procedures, inspection, supervision, and control;i customs proceduresi inspection, supervision, and control of customs;

Pursuant to Decision No. 47/2014/QĐ-TTg dated August 27, 2014 of the Prime Minister promulgating the Management Regulation for Inland Container Depots;

At the proposal of the Minister of Finance;

The Prime Minister issues this Decision to regulate the transfer of customs checkpoints for imported goods to process customs procedures at the ICD My Dinh inland container depot, Hanoi city. inland container depot (ICD) My Dinh, Ha Noi city.

Article 1. Scope of Regulation

This Decision regulates the transfer of customs checkpoints for imported goods to process customs procedures at the ICD My Dinh inland container depot, Hanoi city.

Article 2. Applicability

1. The declarant of customs is an organization or individual implementing export, import, transit of goods and performing customs procedures at the ICD My Dinh inland container depot.

2. Customs authorities, customs officers.

Other state agencies in coordinating to manage customs matters.

4. Businesses operating the ICD My Dinh inland container depot.

Businesses operating transportation that comply with the provisions of Article 5 of this Decision.

6. Other Relevant Organizations and Individuals.

Article 3. Imported goods transferred to the ICD My Dinh inland container depot

1. Imported goods passing through international border gates, international railway stations, international airports, and seaports may be transferred to the ICD My Dinh and Long Bien inland container depots for customs procedures if they belong to the List of imported goods required to undergo customs procedures at the port of entry (annexed to Decision No. 23/2019/QĐ-TTg dated June 27, 2019 of the Prime Minister), except for goods such as: aircrafts, yachts; gasoline types; explosive precursors, industrial explosives according to the List prescribed by the Ministry of Industry and Trade; waste materials according to the List prescribed by the Prime Minister.

2. The transfer of imported goods as stipulated in Clause 1 of this Article must comply with the provisions of Articles 4, 5, and 6 of this Decision.

Article 4. Route, transportation time on the road, and storage time of goods at the ICD My Dinh inland container depot

1. The route and transportation time of goods are declared by the declarant of customs and approved by the customs authority where the goods are transported from. The maximum transportation time shall not exceed 48 hours from the moment the goods pass through the customs surveillance area at the checkpoint.

2. The maximum storage time for goods to complete customs procedures at the ICD My Dinh inland container depot is 30 days from the moment the goods arrive at the depot, except in cases where the goods need to wait for specialized inspection results or are being processed by competent authorities.

3. Goods that have been transferred to the ICD My Dinh inland container depot shall not be further transferred to other locations to perform customs procedures.

2. The maximum storage time for goods to complete customs procedures at the ICD My Dinh inland container depot is 30 days from the moment the goods arrive at the depot, except in cases where the goods need to wait for specialized inspection results or are being processed by competent authorities.

3. Goods that have been transferred to the ICD My Dinh inland container depot shall not be further transferred to other locations to perform customs procedures.

Article 5. Responsibilities of businesses engaged in transportation

1. To arrange means of transport meeting the requirements of customs supervision.

2. Means of transport carrying goods must be equipped with satellite GPS tracking devices and connected to the customs authority where the goods are transported from and to, to monitor the transportation process.

3. To notify the My Dinh ICD Customs Sub-Department, Hanoi City immediately after goods are loaded onto the means of transport for transportation through the customs surveillance area at the port of entry for goods that require actual inspection, storage, or specialized inspection.

4. To transport goods along the registered route and within the registered time, which has been approved by the customs authority where the declaration form was submitted.

5. In case of force majeure resulting in damage to the condition of goods, customs seals, or failure to transport goods along the specified route, schedule as stipulated in Clause 1 of Article 4 of this Decision, after applying necessary measures to limit and prevent losses, immediately report to the customs authority where the goods are transported from and to for handling; in case immediate reporting to the customs authority is not possible, report to the nearest police, border guard, or maritime police authority for confirmation and cooperation in resolution.

Article 6. Responsibilities of the business operating the My Dinh Inland Container Depot (ICD)

1. Ensuring the conditions for inspection and supervision by customs authorities as prescribed by law.

3. Connecting the enterprise's goods management information system with the customs authority to manage goods entering, exiting, or being stored at the My Dinh ICD.

4. Reporting periodically on a monthly basis to the customs authority where the goods are transported from and to regarding the situation of goods that have been transferred from the border gate to the My Dinh ICD.

2. Only allowing the removal of goods from the My Dinh ICD area for consignments that have been decided by the customs authority to be cleared for import, released from storage, or moved to specialized inspection locations in accordance with the provisions of the law.

3. Connecting the enterprise's goods management information system with the customs authority to manage goods entering, exiting, or being stored at the My Dinh ICD.

4. Reporting periodically on a monthly basis to the customs authority where the goods are transported from and to regarding the situation of goods that have been transferred from the border gate to the My Dinh ICD.

Article 7. Customs procedures for imported goods transferred from the border gate to the My Dinh ICD

Customs procedures for imported goods transferred from the border gate to the My Dinh ICD shall be carried out in accordance with the provisions of the Customs Law, Decree No. 08/2015/NĐ-CP dated January 23, 2015 of the Government detailing and guiding the implementation of the Customs Law on customs procedures, inspection, supervision, and customs control, and related guiding documents.

Article 8. Effective Date

This Decision takes effect from October 5, 2017.

Article 9. Implementation Provisions

The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally-administered city People's Committees, and organizations and individuals mentioned in Article 2 are responsible for implementing this Decision./.
