CIRCULAR

Regulations on standards and quotas for the use of area of public works in the vocational education sector

Pursuant to the Vocational Education Law on November 27, 2014; November 2014;

Pursuant to the Law on Management and Use of State Property dated June 21, 2017;Pursuant to Decree No. 14/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - Invalids and Social Affairs;

Pursuant to Decree No. 152/2017/NĐ-CP dated December 27, 2017 of the Government stipulating standards and quotas for the use of office space and facilities for public services;The Minister of Labor - Invalids and Social Affairs issues this Circular on standards and quotas for the use of area of public works in the vocational education sector.Pursuant to the request of the Director General of the Department of Vocational Education;

This Circular stipulates standards and quotas for the use of area of public works in the vocational education sector.Public vocational education institutions, including: Colleges, technical schools, and vocational training centers. Article 3. Area of public works in vocational education institutionsThe area of public works in vocational education institutions includes areas of various types of buildings as follows:

At the proposal of the Director General of the Vocational Education Department,

a) Rooms for theoretical classes in basic science subjects, fundamental technical subjects, specialized subjects, and technical drawing;

b) Lecture halls;

Article 2. Applicability

c) Preparation rooms for teaching;

d) Examination rooms;

đ) Rest rooms for teachers;

g) Auditoriums (over 100 seats);

h) Dormitories;

i) Dining halls (kitchens);

k) Areas for physical training and sports;

l) Areas of rooms and zones for practical, experimental, and laboratory activities for each training program and profession.

e) Library Science;

Article 4. Principles of application of standards and quotas

1. The standards and quotas prescribed in this Circular shall be applied based on the principles set forth in Article 4 of Decree No. 152/2017/NĐ-CP dated December 27, 2017 of the Government on standards and quotas for the use of office space and facilities for public services.

2. Authorities and persons with the authority to decide on allocation, construction investment, procurement, leasing, and utilization of the area of public works in the vocational education sector shall base their decisions on the scale of training, fields of study, nature of work of positions, needs for use, capacity of the state budget, existing land fund, and degree of autonomy of public vocational education institutions to ensure economy and efficiency.

Article 5. Standards and quotas for the use of area of public works in vocational education institutions

1. Detailed standards and quotas for the use of area of public works in vocational education institutions are specified in the Appendix attached to this Circular.

2. The content of standards and quotas for the use of area of rooms and zones for practical, experimental, and laboratory activities for each field of study and profession shall be implemented according to the regulations of the Ministry of Labor - Invalids and Social Affairs on infrastructure standards for organizing training for each field of study at different levels.

3. The detailed areas specified in this Circular are maximum areas and are calculated based on clear dimensions as prescribed by law.

1. For new construction projects, renovation, upgrading of vocational education institutions, or budget-funded leasing of public works that comply with relevant laws and are approved before this Circular takes effect, the area will not be reassessed according to the standards and quotas prescribed in this Circular.

2. Ministries, central agencies, People's Committees of provinces and centrally-administered cities that have issued standards and quotas for the use of area of public works consistent with this Circular shall continue to implement the standards and quotas they have issued.

1. This Circular takes effect from February 10, 2019.

2. The Minister, Heads of ministries equivalent to ministries, Heads of government agencies, Leaders of central agencies of political-social organizations with vocational education institutions; Chairpersons of People's Committees of provinces and centrally-administered cities; Directors of the Office of the Ministry, General Directors of the Vocational Education Training Administration; Heads of vocational education institutions, Heads of related agencies and units are responsible for implementing this Circular.

3. In the course of implementation, if there are difficulties, agencies and organizations are requested to report to the Ministry of Labor - Invalids and Social Affairs for research and resolution./.

Article 6. Transitional Provisions

1. For new construction investment projects, renovation, upgrading of vocational education facilities, or budget-funded leasing of public works that comply with relevant legal provisions and were approved before this Circular takes effect, the area shall not be re-determined according to the standards and norms stipulated in this Circular.

2. Ministries, central agencies, People's Committees of provinces and centrally governed cities that have issued standards and norms for the use of public work areas in accordance with this Circular shall continue to implement them in accordance with the standards and norms already issued.

Article 7. Implementation Provisions

1. This Circular takes effect from February 10, 2019.

2. The Minister, Heads of ministries equivalent to ministries, Heads of government agencies, Leaders of central agencies of political-social organizations that have vocational education facilities; Chairpersons of People's Committees of provinces and centrally governed cities; Directors of the Ministry's Office, General Directors of the Vocational Education General Department; heads of vocational education facilities, Heads of related agencies and units are responsible for implementing this Circular.

3. In the course of implementation, if there are difficulties, agencies and organizations are requested to report to the Ministry of Labor, Invalids and Social Affairs for study and resolution./.
