CIRCULAR

Guidelines for building a safe, healthy, friendly educational environment;

preventing and combating school violence in vocational education institutions

Pursuant to the Law on Vocational Education dated November 27, 2014;

Pursuant to Decree No. 14/2017/NĐ-CP dated February 17, 2017, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

Pursuant to Decree No. 80/2017/NĐ-CP dated July 17, 2017 of the Government on the safe, healthy, friendly educational environment and prevention and combat of school violence;

Pursuant to Decree No. 15/2019/NĐ-CP dated February 1, 2019 of the Government detailing certain provisions and measures for implementation of the Vocational Education Law;

At the proposal of the Director General of the General Department of Vocational Education;

The Minister of Labor, Invalids and Social Affairs issues this Circular guiding the construction of a safe, healthy, friendly educational environment and prevention and combat of school violence in vocational education institutions,

 

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular guides the construction of a safe, healthy, friendly educational environment and prevention and combat of school violence in colleges, secondary vocational schools, public and private vocational training centers, and those with foreign investment (hereinafter referred to collectively as vocational education institutions) and related organizations and individuals.

Article 2. Applicability

1. This Circular applies to vocational education institutions and related organizations and individuals.

2. This Circular does not apply to teacher training colleges and secondary teacher training schools.

Chapter II

BUILDING A SAFE,

HEALTHY AND FRIENDLY EDUCATIONAL ENVIRONMENT

Article 3. Guidelines for building a safe, healthy, friendly educational environment in vocational education institutions

1. Ensuring security and order; food safety; safety against accidents and injuries; fire and explosion safety; disaster and natural calamity safety in vocational education institutions shall implement the following:

a) Ensuring security and order, internal affairs in vocational education institutions.

b) Having plans to prevent fires and explosions, respond to abnormal weather phenomena, natural disasters (rainstorms, floods,...), and prevent epidemics according to regulations.

c) Ensuring food and water safety; preventing food poisoning and food safety incidents in vocational education institutions.

d) Ensuring safety for students and trainees during study and physical education, sports, cultural, and artistic activities; preventing harassment and sexual assault against students and trainees.

đ) Coordinating between the institution and local authorities in ensuring security and safety for students and trainees and vocational education institutions.

2. Establishing and strictly implementing a Code of Conduct in vocational education institutions

a) Based on the general Code of Conduct stipulated in Article 4 of this Circular, vocational education institutions shall establish a Code of Conduct suitable to the actual situation at their units.

b) The Code of Conduct of vocational education institutions must be widely consulted with management staff, teachers, workers, and students before issuance.

c) The head of the vocational education institution is responsible for disseminating the Code of Conduct to all management staff, teachers, workers, and students so that they know and comply with it.

d) The Code of Conduct of vocational education institutions must be posted on bulletin boards, notice boards, and websites of the vocational education institutions.

đ) Regularly inspecting the implementation of the Code of Conduct in the unit. Periodically surveying opinions from management staff, teachers, workers, and students regarding the implementation of the Code of Conduct.

3. Establishing communication channels in vocational education institutions.

a) Building and effectively utilizing the electronic information portal of the vocational education institution, enhancing information exchange with management staff, teachers, workers, and students of the vocational education institution and other related individuals about cultural behavior.

b) Setting up suggestion boxes and publicizing hotlines to receive information reflecting on the safe, healthy, friendly environment and prevention of school violence in vocational education institutions.

c) Handling information quickly and effectively. Ensuring the confidentiality of personal information provided by the person according to the law.

d) Organizing meetings and exchanging information with the families of students and trainees.

4. Organizing experiential and extracurricular activities for students and trainees

a) Vocational education institutions organize experiential, extracurricular activities, life skills education, charity activities, community service activities, cultural, artistic, and sports activities for students and trainees according to current regulations, suitable to the capacity of the vocational education institution and the needs of students and trainees.

b) The activities mentioned in Point a Clause of this paragraph must be planned by semester or academic year before organization.

c) The activities mentioned in Point a Clause of this paragraph must comply with the law, be appropriate to the age and psychology of students and trainees, and not violate the customs and traditions of the nation, region, or locality.

d) Encouraging students and trainees to participate in experiential, extracurricular activities, life skills education, charity activities, community service activities, cultural, artistic, and sports activities and other activities related to building a safe, healthy, friendly educational environment and prevention of school violence.

5. Implementing school health work and assisting students and trainees

a) Organizing management, protection, and care activities for the health of management staff, teachers, workers, and students according to regulations.

b) Implementing hygiene and disease prevention measures and regimes required by health authorities or higher-level management agencies.

c) Organizing health communication and education activities for students and trainees.

d) Ensuring conditions for first aid and timely support for victims when accidents and injuries occur in vocational education institutions.

6. Enhancing information exchange and closely coordinating with functional agencies, local authorities, and mass organizations in the area to ensure:

a) Security, order, and safety of vocational education institutions.

b) Safety of lives, bodies, dignity, honor, and privacy of management staff, teachers, workers, students, and trainees.

c) Safety for educational activities and cultural social exchanges.

Article 4. General Rules on Conduct in Vocational Education Institutions

1. General Conduct Rules

a) Strictly comply with legal provisions regarding the rights and obligations of citizens, officials, civil servants, teachers, workers, students, and trainees in vocational education institutions.

b) Build a healthy, positive lifestyle, showing concern, sharing, and helping others in both daily life and study at vocational education institutions.

c) Protect and maintain the landscape of vocational education institutions; create a safe, friendly, green, clean, and beautiful educational environment.

d) Officials, teachers, and staff must wear appropriate attire for the educational environment. Students and trainees must wear neat and clean attire as prescribed by the vocational education institution. Parents of students and visitors to the vocational education institution must wear appropriate and courteous attire.

đ) Do not smoke, consume alcoholic beverages, or use other prohibited stimulants within vocational education institutions as stipulated by law and internal regulations of the institution.

e) Do not disseminate, promote, or comment on information or images that violate the Party's guidelines, state policies and laws, customs, or adversely affect the educational environment in any form.

g) Do not deceive, slander, provoke conflicts, harass, coerce, threaten, or use violence against others.

h) Do not harm one’s own health, honor, dignity, or those of colleagues (classmates) and others. Do not damage the reputation of the collective.

2. Conduct of Management Staff

a) Towards other management staff: Use proper language, respect each other's positions and responsibilities; cooperate, be friendly, share responsibilities. Do not offend, cause division, or shirk responsibility.

b) Towards teachers and workers: Communicate properly, seriously, encourage, set a good example, accompany them in their work. Show concern for protecting the reputation, honor, and dignity of individuals, and promote their capabilities. Do not exhibit arrogance, create difficulties, offend, show bias, seek personal gain, shirk responsibility, cover up violations, or blame others.

c) Towards students and trainees: Use standard, understandable language, show respect. Treat everyone fairly, equally, with tolerance, responsibility, love, kindness, and respect differences. Listen attentively and encourage appropriately. Do not offend, coerce, oppress, abuse, or show discriminatory attitudes, cover up violations of students and trainees.

d) Towards visitors for official business: Respectful, courteous, proper communication. Show concern, listen attentively, and be ready to support, cooperate, and share. Do not offend, create difficulties, or cause inconvenience.

3. Conduct of Teachers and Workers

a) Towards management staff: Respectful, courteous, proper communication. A respectful attitude, open-mindedness, compliance with directives and management according to regulations. Do not offend, cause division, or cover up misconduct of management staff.

b) Towards colleagues: Use proper language, cooperate, be friendly, show respect. Do not offend, cause division, or shirk responsibility.

c) Towards students and trainees: Use standard, respectful language, exemplary behavior. Provide appropriate praise or criticism based on the individual and circumstances. Treat everyone fairly, equally, with tolerance, responsibility, love, kindness, and respect differences. Show concern, listen attentively, and encourage appropriately. Do not engage in offensive behavior, speech, causing harm, abuse, or harassment, or display oppressive, discriminatory attitudes, or cover up violations of students and trainees.

d) Towards visitors for official business: Proper language, respectful, courteous, friendly, ready to guide and assist. Do not have an offensive attitude or create difficulties or inconvenience.

4. Conduct of Students and Trainees

a) Towards management staff, teachers, and workers: Respectful, polite, honest, and sharing. Adhere to school rules and regulations and legal provisions. Do not fabricate information, offend the spirit, honor, or dignity of others, or engage in violent behavior.

b) Towards other students and trainees: Use proper language, be friendly, honest, cooperative, helpful, and respectful of differences. Do not curse, insult, discriminate, offend, or engage in violent behavior that causes division; do not fabricate information or incite cliques. Do not spread information to defame or adversely affect the honor and dignity of other students and trainees.

c) Towards visitors for official business: Respectful, polite.

Chapter III

PREVENTION AND COMBAT OF SCHOOL VIOLENCE

Article 5. Guidelines for promoting education on a safe, healthy, friendly learning environment and preventing school violence

1. Content of promotion

a) The Party's guidelines and policies, laws of the State, traditions, national pride. Contents of ideological and political education, awareness of law compliance, education on benevolent, tolerant, and responsible lifestyles towards oneself, family, community, society, and the country. Examples of individuals and groups who have successfully built a safe, healthy learning environment and prevented school violence.

b) Reflecting the aspirations, emotions, and responsibilities of students and trainees towards a safe, healthy, friendly learning environment and preventing school violence or human behavior in social relationships.

c) Knowledge and skills regarding: The dangers and consequences of school violence; responsibility for detecting, reporting, and denouncing acts of school violence; measures and skills to prevent school violence; intervention skills appropriate to one's ability when school violence occurs; skills to prevent and combat personal harm, and self-protection skills in society and online environments.

d) Criticizing deviant, negative, competitive, playful, hedonistic behaviors, or violent and gender inequality behaviors in vocational education institutions.

đ) Contents aimed at enhancing the understanding of managers, teachers, staff, and students about: Sovereignty over seas and islands, territorial integrity; struggle against the "Peaceful Evolution" strategy, refuting false information from hostile forces and opportunistic political elements; not being incited or drawn into activities that destabilize politics and social security.

2. Forms of Promotion

a) Promoting through mass media, information systems of vocational education institutions, and social networks.

b) Through regular classes, conferences, seminars, training sessions, and extracurricular activities.

c) Through specialized talks and forums on culture and society.

d) Through cultural, artistic, sports competitions, or knowledge contests related to relevant fields.

Article 6. Integration of Ideological Political Education, Morality, and Lifestyle

1. Vocational education institutions organize the integration of content on building a safe, healthy, friendly learning environment and preventing school violence into ideological political education, moral education, and lifestyle activities during the first and last weeks of each semester or other extracurricular educational activities.

2. Vocational education institutions are responsible for integrating and incorporating educational content on ensuring a safe, healthy, friendly learning environment and preventing school violence into primary, secondary, and college curricula with appropriate time allocations.

Article 7. Prevention of School Violence

1. Educating and equipping students, trainees, managers, teachers, and staff of vocational education institutions and their families with knowledge and skills to prevent and combat student and trainee abuse; school violence on online platforms; educating and counseling students and trainees on self-protection knowledge and skills.

2. Vocational education institutions regularly monitor, statistically analyze, and evaluate groups at risk of school violence. Establish mechanisms for cooperation with competent authorities and procedures for handling school violence incidents.

3. Establish communication channels between vocational education institutions and families of students and trainees, and related organizations and individuals to promptly prevent and handle school violence incidents.

Article 8. Support when there is a risk of school violence

1. Timely detect students at risk of school violence through management measures, monitoring, and information channels.

2. Assess the level of risk and forms of violence that may occur to take specific preventive and support measures for students.

3. Organize meetings, understand, and warn students about the potential risks of school violence. Advise necessary measures for students to prevent and avoid school violence.

4. Closely coordinate with the families of students and relevant organizations and agencies in supporting students at risk of school violence.

Article 9. Handling when school violence occurs

1. Take immediate isolation and control measures against individuals causing school violence to prevent them from continuing to cause unwanted consequences.

2. Contact and report immediately to the competent authority to handle the incident according to regulations. In cases where the incident exceeds the capacity of vocational education institutions to resolve, promptly notify the authorities or competent agencies to cooperate in handling according to the law.

3. Conduct a preliminary assessment of the extent of harm to the victim. Immediately implement assistance and medical care measures for the victim. Monitor, assess, and take practical protective measures to ensure the safety of the victim in subsequent periods.

4. Promptly notify the family of the victim to coordinate in handling the situation.

Chapter IV

IMPLEMENTATION

Article 10. Responsibilities of the General Department of Vocational Education

1. Direct and guide the organization to build a safe, healthy, friendly educational environment; prevent and combat school violence in vocational education institutions.

Article 11. Responsibilities of the Department of Labor, Invalids and Social Affairs

1. Advise the People's Committee of the province/city directly under the central government to direct, guide, urge, and inspect the implementation of regulations concerning a safe, healthy, friendly educational environment, and prevention of school violence in vocational education institutions within their jurisdiction.

2. Inspect the implementation of this Circular in vocational education institutions within the province/city directly under the central government; compile and report on the implementation in the annual summary report; submit special reports when requested by higher-level management authorities.

Article 12. Responsibilities of vocational education institutions

1. Establish a safe, healthy, friendly educational environment, and prevent school violence in accordance with the guidelines set forth in this Circular, ensuring practicality and effectiveness.

2. Organize propaganda about a safe, healthy, friendly educational environment, and prevention of school violence within vocational education institutions.

3. Develop and implement a Code of Conduct for the institution in accordance with Clause 2, Article 3, and Article 4 of this Circular.

4. Incorporate content on building a safe, healthy, friendly educational environment, and preventing school violence into the common activities of the institution as stipulated in Article 6 of this Circular.

5. Report on the implementation of this Circular in the annual activity summary report submitted to higher-level management authorities; submit special reports as required by competent authorities.

6. The leadership of vocational education institutions shall be responsible before higher-level management authorities and the law if they fail to fulfill their responsibilities leading to incidents of school violence or social evils in the vocational education institutions under their management.

7. Fulfill other tasks as required.

Article 13. Responsibilities of students in vocational education institutions

1. Actively, conscientiously, and responsibly study to improve their qualifications and awareness about building and protecting a safe, healthy, friendly educational environment, preventing and combating school violence, and participating positively in preventive activities and assistance when school violence occurs within the institution.

2. Proactively identify and promptly report to management staff, teachers, and employees of the vocational education institution regarding cases of harm, violence, or violations of the law within the institution.

Chapter V

IMPLEMENTING PROVISIONS

Article 14. Effective Date

1. This Circular takes effect from February 15, 2020.

2. Any difficulties encountered during implementation should be reported to the Ministry of Labor, Invalids and Social Affairs for guidance and resolution./.
