Circular No. 38/2025/TT-BTC amends and supplements certain Articles of Circular No. 22/2021/TT-BTC dated March 29, 2021, issued by the Minister of Finance, concerning the establishment, tasks, powers, and operational mechanisms of the Lottery Supervisory Council.

Amending and supplementing some articles of Circular No. 22/2021/TT-BTC dated March 29, 2021 of the Minister of Finance on the establishment, tasks, powers, and operational mechanism of the Lottery Supervisory Council
Citing Government Decree No. 30/2007/NĐ-CP dated March 1, 2007 on lottery business and Government Decree No. 78/2012/NĐ-CP dated October 5, 2012 amending and supplementing some articles of Government Decree No. 30/2007/NĐ-CP dated March 1, 2007 on lottery business;

Pursuant to the Decree No. 29/2025/NĐ-CP dated February 24, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Citing Government Decree No. 122/2017/NĐ-CP dated November 13, 2017 on certain special contents regarding financial management mechanisms and assessment of business operations for lottery enterprises; Securities Trading Exchange and Vietnam Securities Depository;

The Minister of Finance issues this Circular to amend and supplement some articles of Circular No. 22/2021/TT-BTC dated March 29, 2021 of the Minister of Finance on the establishment, tasks, powers, and operational mechanism of the Lottery Supervisory Council.

At the proposal of the Director of the Department of Financial Institutions;

Article 1. Amend Clause 1 of Article 13 of Circular No. 22/2021/TT-BTC dated March 29, 2021 of the Minister of Finance on the establishment, tasks, powers, and operational mechanism of the Lottery Supervisory Council as follows:

"1. Establish and dissolve the Lottery Supervisory Board at some commune-level areas. The composition of the Lottery Supervisory Board at some commune-level areas includes representatives of the Lottery and Construction Company and representatives of commune-level agencies (People's Committee, Police, Vietnam Fatherland Front). The tasks and powers of the Lottery Supervisory Board at some commune-level areas are stipulated in the operational regulations of the Lottery Supervisory Council."

Article 2. Replace the phrase "Lottery Supervisory Board at some district-level areas" with the phrase "Lottery Supervisory Board at some commune-level areas" in Clause 1, Clause 4, Clause 6 of Article 15; Point c of Clause 1 of Article 16; Clause 1, Clause 2, Clause 5 of Article 17 of Circular No. 22/2021/TT-BTC dated March 29, 2021 of the Minister of Finance on the establishment, tasks, powers, and operational mechanism of the Lottery Supervisory Council.

2. The People's Committee of the province directs the Lottery Supervisory Councils of the provinces and cities to establish the Lottery Supervisory Board at some commune-level areas based on the actual conditions of the lottery business operations of the Lottery and Construction Company to ensure the supervision of lottery activities in accordance with the law.
