OF THE MINISTRY OF FINANCE NUMBER 3856/BTC-HCSN DATED MARCH 24, 2006 ON THE REGIME AND POLICY FOR TRANSFERRED STAFF

On January 26, 2006, the Government Office issued Letter No. 527/VPCP-VX "on the implementation of Decision No. 269/2005/QĐ-TTg dated October 31, 2005 of the Prime Minister on the allowance for service," informing the Prime Minister's agreement in principle to retain the level of service allowance for staff transferred from positions with higher service allowances to positions with lower service allowances and certain regimes and policies for staff transferred according to the requirements of the Party and the State.

Implementing the Prime Minister's directive; after receiving the opinions of the Ministry of Home Affairs (Letter No. 519/BNV-TL dated March 7, 2006) and the Central Organization Committee (Letter No. 8432/CV-TCTW dated February 27, 2006), the Ministry of Finance guides the implementation of retaining the level of service allowance and certain regimes and policies for staff transferred according to the requirements of the Party and the State as follows:

1. Staff within the scope of leadership and management cadre rotation in accordance with Resolution No. 11-NQ/TW dated January 25, 2002 of the Politburo, who are transferred from positions with higher service allowances to positions with lower service allowances, shall retain their service allowance and current benefits.

Specifically, the allowances stipulated in Article 6 of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the salary regime for cadres, civil servants, public officials, and armed forces (excluding allowances exceeding the ceiling and occupational seniority allowances) shall be implemented according to regulations for the place, profession, and job of the transferred staff.

2. The retention period for the aforementioned benefits shall be calculated during the transfer period in accordance with Resolution No. 11-NQ/TW dated January 25, 2002 of the Politburo and shall end when the transfer period expires and the transferred staff is assigned new tasks.

3. It is requested that the heads of relevant agencies and units take responsibility for organizing the implementation and ensuring favorable conditions for cadre rotation work.During the implementation process, if there are difficulties or obstacles, it is requested that the agencies and units promptly report to the Ministry of Finance, the Central Organization Committee, and the Ministry of Home Affairs for consideration and specific guidance.
