DECISION OF THE PRIME MINISTER
Regarding the establishment of the Steering Committee for Managing Rice Export Activities and Fertilizer Import Activities
PRIME MINISTER
Pursuant to the Government Organization Law dated September 30, 1992;
To assist the Prime Minister in managing business activities related to rice export and fertilizer import pursuant to Decision No. 12/1998/QĐ-TTg dated January 23, 1998,
DECISION:
Article 1. The Steering Committee for Managing Rice Export Activities and Fertilizer Import Activities (hereinafter referred to as the Steering Committee) shall be established.
Article 2. The contents of the Steering Committee's activities are stipulated in the "Regulation on the Operation of the Steering Committee for Managing Rice Export and Fertilizer Import Activities 1998-1999" attached hereto.
Article 3. This Decision takes effect from the date of signature until March 31, 1999. Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, and Chairpersons Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).Local People's Committees of provinces and centrally-administered cities are responsible for implementing this Decision./.
REGULATIONS
ON THE CONTENTS OF THE STEERING COMMITTEE'S OPERATIONS FOR MANAGING
RICE EXPORT AND FERTILIZER IMPORT ACTIVITIES IN 1998-1999
(Attached to Decision No. 39/1998/QĐ-TTg dated February 18, 1998)
In order to gradually overcome limitations and promptly address emerging issues in rice export and fertilizer import activities, the Steering Committee for Managing Rice Export Activities and Fertilizer Import Activities (hereinafter referred to as the Steering Committee) is established with participating components and main tasks as follows:
I. ON MANAGING RICE EXPORTS:
1. Based on the quota approved by the Prime Minister and assigned by the Minister of Trade under Decision No. 89/TM-XNK dated January 26, 1998, monitor the signing of contracts and delivery progress in accordance with domestic and international market conditions, ensuring national food security and effective exports.
2. Provide general guidance and regularly inform about markets and customers.
3. Monitor price fluctuations of rice on the world market to form and announce a guiding price framework for various types of exported rice every ten days, consistent with domestic rice prices.
4. Supervise and urge major enterprises to strictly follow the Prime Minister's directives regarding the purchase of agricultural products from farmers.
Guide enterprises to comply with regulations on rice export as stipulated in Decision No. 12/1998/QĐ-TTg dated January 23, 1998 of the Prime Minister; handle or recommend the Prime Minister to handle enterprises violating these regulations according to the law.
5. Coordinate and allocate quotas to major enterprises participating in implementing contracts agreed upon by the Government when necessary.
Recommend that the Chairpersons of provincial people's committees coordinate quotas among enterprises within their provinces and the Minister of Trade coordinate quotas among enterprises and provinces assigned quotas under Decision No. 89/TM-XNK dated January 26, 1998 of the Ministry of Trade to ensure the common interests of the State and effective rice exporting enterprises.
II. ON MANAGING FERTILIZER IMPORTS:
1. Based on the import quota for various types of fertilizers approved by the Prime Minister and assigned by the Minister of Trade under Decision No. 89/TM-XNK dated January 26, 1998, monitor and urge goods to arrive on time, in quantity, type, and region as directed.
2. Determine the end-of-season inventory to guide and urge the signing of contracts and the delivery of goods for the upcoming production season, ensuring supply-demand balance in each region.
3. Monitor global market price trends and announce the price of various types of imported fertilizers from different regions every ten days to guide enterprises to import timely and effectively.
4. Urge and inspect fertilizer-importing enterprises and build a convenient distribution network for fertilizers beneficial to farmers.
5. Recommend that the Chairpersons Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).of provincial people's committees coordinate import quotas among enterprises within their provinces and the Minister of Trade coordinate import quotas among enterprises and provinces assigned import quotas under Decision No. 89/TM-XNK dated January 26, 1998 of the Ministry of Trade to ensure the common interests of the State and effective fertilizer importing enterprises.
6. Handle issues arising during the implementation of fertilizer imports under the continuous storage warehouse plan permitted by the Prime Minister under Decision No. 12/1998/QĐ-TTg dated January 23, 1998.
III. MEMBERS OF THE STEERING COMMITTEE:
The Steering Committee for Managing Rice Export Activities and Fertilizer Import Activities includes the following components:
1. Comrade Nguyen Xuan Quang, Deputy Minister of Trade,
Chairman.
2. Deputy Chairpersons Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).of people's committees of An Giang, Dong Thap, Tien Giang, Kien Giang, Can Tho provinces, members.
3. Chairman of the Vietnam Association of Import and Export Grains, Member.
4. Ministry of Agriculture and Rural Development, Ministry of Finance, State Bank of Vietnam, Government Office, Government Price Board, General Customs Department, each agency sends one department-level officer as a member.
5. The Steering Committee establishes a Permanent Management Team working at the Ministry of Trade's office in Ho Chi Minh City to assist the Steering Committee in handling daily issues in managing rice exports and fertilizer imports. The head of the Permanent Management Team is responsible for reporting updates to the Steering Committee Chairman and members of the provinces.
IV. PRINCIPLES OF OPERATION OF THE STEERING COMMITTEE:
1. Members of the Steering Committee work under the principle of democratic discussion to examine and handle or recommend handling issues related to rice exports and fertilizer imports.
After each meeting of the Steering Committee, a resolution must be passed by the Steering Committee members.
2. Members of the Steering Committee are responsible for implementing assignments and issues agreed upon in the resolutions of meetings.
V. LIVING REGIME AND REPORTING:
1. The Steering Committee convenes regular meetings once a quarter in the first month of each quarter (extraordinary meetings may be held if necessary) to assess the performance of enterprises, set directions for operations, and address emerging issues. If there are issues beyond the capacity of the Steering Committee and the authority of relevant ministries and sectors, the Chairman reports to the Prime Minister for advice.
2. Monthly, the Steering Committee Chairman reports to the Prime Minister on the situation of rice exports and fertilizer imports and any emerging issues related to management mechanisms outside the scope of Decision No. 12/1998/QĐ-TTg dated January 23, 1998 of the Prime Minister./.
