DECISION
Regarding the establishment of the Management Board for the Red River - Thai Binh Delta Basin Planning

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to Decree No. 73/CP dated November 1, 1995 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Water Resources Law on May 20, 1998 and Decree No. 179/1999/NĐ-CP dated December 30, 1999 of the Government stipulating the implementation of the Water Resources Law;
At the proposal of the Director of the Water Resources Management and Hydrotechnical Works Bureau and the Organization and Cadre Affairs Department,
DECISION:
Article 1. Establish the Management Board for the Red River - Thai Binh Delta Basin Planning to implement the content of basin planning management according to Article 64 of the Water Resources Law, specifically as follows:
- Preparing, submitting for approval, and monitoring the implementation of the Red River - Thai Binh Delta Basin Plan to ensure unified basin planning management with administrative jurisdictions;
- Coordinating with relevant agencies of ministries, sectors, and localities in basic investigations, inventory, assessment of water resources in the Red River - Thai Binh Delta Basin, and in preparing, submitting for approval, and monitoring the implementation of branch river basin plans within the Red River - Thai Binh Delta system;
- Proposing solutions to resolve disputes over water resources in the Red River - Thai Binh Delta Basin.
Article 2. The Management Board for the Red River - Thai Binh Delta Basin Planning includes the following members:
- Chairman: Deputy Minister of Agriculture and Rural Development;
- Vice-Chairman: Director of the Water Resources Management and Hydrotechnical Works Bureau;
- Members: Leaders of the Water Resources Management and Hydrotechnical Works Bureau, Flood Control and Dyke Management Bureau, and the Institute of Hydrotechnical Planning.
- Leaders of the Departments of Agriculture and Rural Development in provinces and cities within the Red River - Thai Binh Delta Basin shall be members.
- Invite leaders of relevant bureaus and departments under the Ministries of Science and Technology, Environment, Industry, Fisheries, Construction, Transportation, Health, National Defense, and the General Administration of Meteorology and Hydrology to serve as members;
Article 3. The Management Board for the Red River - Thai Binh Delta Basin Planning has its Office located at the Institute of Hydrotechnical Planning, which is a public service entity responsible for implementing specific tasks as prescribed in Article 1 of this Decision. The Director of the Institute of Hydrotechnical Planning concurrently serves as the Head of the Office of the Management Board for the Red River - Thai Binh Delta Basin Planning.
The Office of the Management Board for the Red River - Thai Binh Delta Basin Planning shall use a separate seal according to the prescribed model.
The staffing of the Office of the Management Board for the Red River - Thai Binh Delta Basin Planning shall be included in the staffing of the Institute of Hydrotechnical Planning.
The operating funds of the Management Board for the Red River - Thai Binh Delta Basin Planning and its Office shall be allocated from the annual budget of the Institute of Hydrotechnical Planning.
Article 4. Entrust the Water Resources Management and Hydrotechnical Works Bureau to take the lead in coordinating with the Organization and Cadre Affairs Department and the Institute of Hydrotechnical Planning to draft the operational regulations of the Management Board for the Red River - Thai Binh Delta Basin Planning, and submit them to the Minister of Agriculture and Rural Development for approval.
Article 5. THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER THE DATE OF SIGNATURE.
The Heads of the Office of the Ministry, the Organization and Cadre Affairs Department, the Water Resources Management and Hydrotechnical Works Bureau, the Flood Control and Dyke Management Bureau, the Institute of Hydrotechnical Planning, the Directors of the Departments of Agriculture and Rural Development in provinces within the Red River - Thai Binh Delta Basin, and the Heads of units under the Ministry related to this matter are responsible for implementing this Decision./.
