DECISION OF THE MINISTER OF FINANCE

Regarding the functions, tasks, authorities, and organizational structure of the National Reserve Area under the National Reserve Administration

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, authorities, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, authorities, and organizational structure of the Ministry of Finance;

Pursuant to Decision No. 270/2003/QĐ-TTg dated December 24, 2003 of the Prime Minister stipulating the functions, tasks, authorities, and organizational structure of the National Reserve Administration under the Ministry of Finance;

At the proposal of the Director of the National Reserve Administration and the Head of the Personnel Department.

DECISION:

Article 1. The National Reserve Area is an organization directly subordinate to the National Reserve Administration with the function of directly managing national reserve goods; implementing inspection and supervision of the activities of units managing national reserve goods within its jurisdiction as assigned by the Director of the National Reserve Administration.

The National Reserve Area has legal personality, has its own headquarters, seal, and is allowed to open accounts at the State Treasury in accordance with the provisions of the law.

Article 2. The National Reserve Area has the following tasks:

1. Developing long-term plans, five-year plans, annual plans, and annual budget estimates for submission to the Director of the National Reserve Administration and implementing such plans after approval;

2. Organizing the purchase, sale, import, and export of reserve goods according to the plan assigned in accordance with the regulations of the State and the National Reserve Administration;

3. Organizing the export of national reserve goods for relief, rescue, international aid, or other purposes to ensure accuracy, timeliness, quantity, quality, and effectiveness; coordinating with local functional agencies to inspect and supervise the use of national reserve funds in accordance with the State's regulations;

4. Organizing the management, preservation, and protection of national reserve assets and goods in accordance with the regulations of the State and the National Reserve Administration; implementing anti-fraud measures, confidentiality, fire prevention, and flood control measures;

5. Strictly managing and using resources effectively; implementing financial management, pricing, fees, accounting, and settlement in accordance with the law;

6. Implementing statistical work, information, and regular and urgent reports on the activities of the National Reserve Area in accordance with the regulations of the National Reserve Administration;

7. Organizing internal inspections and audits of the management of national reserve goods; handling or reporting violations related to the management of national reserve goods to the Director of the National Reserve Administration for appropriate action in accordance with the law;

8. Participating in the inspection of organizations managing national reserve goods within its jurisdiction regarding compliance with the management regulations of national reserve goods as assigned by the Director of the National Reserve Administration;

9. Organizing the application of scientific and technological advancements into the management and preservation of national reserve goods in accordance with approved programs and plans; implementing administrative reforms in purchasing, selling, exporting, and importing national reserve goods;

10. Organizing public reception, complaint, and accusation resolution work in accordance with the law;

11. Managing the organizational structure, staffing, cadres, civil servants, officials, and labor force of the unit; organizing training and capacity building for the cadre team in accordance with state regulations and the分级任务如下:

12. The Director of the Regional National Reserve shall sign guiding documents, explanations, and responses to issues related to the assigned functions and tasks or documents authorized by the General Department Director of the National Reserve Department.

13. Propose or participate in drafting legal normative documents on national reserve management.

14. Have the right to interact with relevant agencies and units to organize the implementation of assigned tasks.

15. Perform other tasks assigned by the General Department Director of the National Reserve Department.

Article 3. Organizational structure of the Regional National Reserve

The office assisting the Director of the Regional National Reserve includes the following business units:

1. Technical Storage Room;

2. Planning and Warehouse Management Room;

3. Finance and Accounting Room;

4. Organization and Administrative Room.

Maintain the operation of the Central Warehouses under the Regional National Reserve; the General Department Director of the National Reserve Department shall develop plans to gradually reorganize the Central Warehouses according to the network planning for national reserve warehouses stipulated in Decision No. 02/QD-BTC dated January 7, 2004, and submit it to the Minister of Finance for approval.

Specific duties and powers of units under the Regional National Reserve are defined by the General Department Director of the National Reserve Department.

Article 4. Leadership of the Regional National Reserve.

The Regional National Reserve has a Director and Deputy Directors. The Director of the Regional National Reserve is responsible to the General Department Director of the National Reserve Department for all activities of the Regional National Reserve.

The Director of the Regional National Reserve is appointed or relieved from duty by the Minister of Finance upon the recommendation of the General Department Director of the National Reserve Department.

Deputy Directors of the Regional National Reserve are appointed or relieved from duty by the General Department Director of the National Reserve Department upon the recommendation of the Director of the Regional National Reserve and are accountable to the Director of the Regional National Reserve for their assigned tasks.

Article 5. Operating funds of the Regional National Reserve are provided from the budget of the National Reserve Department and are consolidated into the overall budget of the National Reserve Department.

Based on the assigned political tasks, the National Reserve Department annually allocates staffing quotas and salary funds to the Regional National Reserve based on the total staffing quota and salary fund of the Department.

Article 6. This Decision takes effect from the date of signing. Decisions previously issued by the General Department Director of the National Reserve Department regarding the functions, duties, powers, and organizational structures of subordinate Reserve Bureaus are hereby abolished.

The General Department Director of the National Reserve Department, the Director of the Regional National Reserve, the Director of the Cadre and Civil Servant Affairs Department, the Director of the Financial and Administrative Management Department, and the Head of the Ministry of Finance's Office are responsible for implementing this Decision./.
