Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Article 1. Other types of artistic performances

Considering the proposal of the Director of the Performing Arts Administration and the Head of the Cadre and Civil Servant Organization Department,

DECISION:

Article 1. Position and Functions

The Performing Arts Administration is an agency under the Ministry of Culture, Sports and Tourism with the function of advising the Minister to implement state management over performing arts, production, distribution of audiovisual recordings of music and dance performances; it is entrusted by the Minister with the responsibility to direct and guide the development of the performing arts industry nationwide in accordance with the Party's guidelines and State laws.

The Performing Arts Administration has its own seal and bank account at the National Treasury.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Drafting legal normative documents for submission to the Minister regarding professional performing arts activities; fashion shows; beauty pageants; production, import and export, and distribution of audiovisual recordings of music and dance performances.

2. Drafting strategies, plans for the long-term, five-year, and annual development of performing arts for submission to the Minister.

3. Implementing, guiding, and inspecting the implementation of legal normative documents; strategies, and planning for state-owned performing arts institutions after approval by the Prime Minister; promoting, disseminating, educating about laws, and providing information on state management of performing arts.

4. Drafting regulations on conditions for domestic organizations and individuals to engage in joint ventures, partnerships, and cooperation with foreign entities in performing arts; plans for funding and commissioning new works, programs, and performances using state budget funds for performing arts activities for submission to the Minister.

5. Issuing performance permits for artistic units; art training facilities; professional associations; central economic and social organizations. Guiding and inspecting the issuance of performance permits for artistic units and professional associations by provincial Departments of Culture, Sports and Tourism.

6. Issuing distribution permits for audiovisual recordings of music and dance performances for central organizations. Guiding and inspecting the issuance of distribution permits for audiovisual recordings of music and dance performances by provincial Departments of Culture, Sports and Tourism.

7. Issuing control labels for the distribution of audiovisual recordings of music and dance performances nationwide.

8. Issuing professional practice cards to artists and performers who meet the conditions for professional performing arts activities.

9. Suspending performances, revoking or recommending competent authorities to revoke performance permits; professional practice cards of artists and performers; fashion show permits; decisions organizing beauty pageants that violate legal provisions.

10. Suspending the distribution and circulation of audiovisual recordings, musical works, songs, programs, and plays containing content contrary to the Party's guidelines and State laws.

11. Developing plans for cooperation and exchanges in performing arts with countries and international organizations and implementing them after approval.

12. Proposing to the Minister to dispatch artists, groups, and performing arts troupes to perform abroad or participate in international arts competitions and festivals.

13. Reviewing the content and quality of artistic programs involving foreign elements as decided by the Minister.

14. Reviewing programs and projects funded by foreign entities in the field of performing arts and organizing their implementation as decided by the Minister.

15. Organizing or coordinating the organization of performing arts activities and cultural service activities as decided by the Minister.

16. Directing central artistic units to research, collect, preserve, and promote traditional national arts; absorbing the best of world arts to create programs and plays serving audiences both domestically and internationally.

17. Implementing scientific research plans, applying technological advancements, training and professional development plans in performing arts; participating in establishing professional job standards and technical ranks for performing arts staff.

18. Coordinating to establish operational mechanisms for public service organizations, fees, and charges in the field of performing arts for approval by authorized bodies and organizing their implementation according to regulations.

19. Assisting the Minister in managing the content of performing arts-related associations and non-governmental organizations in accordance with the law.

20. Drafting and implementing preventive measures against violations of laws related to performing arts activities; beauty pageants; fashion shows; distribution, import and export, and circulation of audiovisual recordings of music and dance performances for submission to the Minister.

21. Inspecting, coordinating audits; recommending corrective actions and resolving complaints and reports according to the law.

22. Recommending rewards and disciplinary actions for units and individuals involved in performing arts activities according to the law.

23. Implementing administrative reforms according to the Ministry's program and plan.

24. Managing organizational structures, staffing, implementing policies and systems for civil servants and employees within the scope of the Bureau's management; managing finances, assets, and other resources allocated according to the law and the Minister's delegation.

25. Performing other tasks assigned by the Minister.

Article 3. Organizational Structure

1. Director and Deputy Directors.

2. Specialized departments:

a) Office;

b) Accounting and Finance Department;

c) Art Department;

d) Performance Management and Audiovisual Recording Department.

3. Affiliated institutions:

a) Performing Arts Journal;

b) Performing Arts Organization Center.

The Director of the Performing Arts Administration is responsible for specifying the specific functions and tasks of the departments and affiliated institutions; arranging and deploying cadres, civil servants, officials, and workers according to the appropriate structure and professional standards; developing and promulgating the Rules on the organization and operation of the Bureau.

Article 4. Effectiveness

This Decision shall take effect fifteen days after its publication in the Official Gazette and shall replace Decision No. 40/2004/QĐ-BVHTT dated June 28, 2004 of the Minister of Culture, Sports and Tourism on the functions, tasks, powers, and organizational structure of the Performing Arts Administration.

Article 5. Responsibility for Implementation

The Director of the Performing Arts Administration, the Head of the Office, the Heads of the Cadres and Civil Servants Organization Department, the Planning, Finance Department, and the Heads of agencies and units under the Ministry, and related organizations and individuals are responsible for implementing this Decision./.
