Guidelines for types of natural disasters and dangerous diseases supported under Decision 142/2009/QD-TTg dated December 31, 2009 of the Prime Minister

Pursuant to Decree No. 01/2008/ND-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; and Decree No. 75/2009/ND-CP dated September 10, 2009 of the Government amending Article 3 of Decree No. 01/2008/ND-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Decision 142/2009/QD-TTg dated December 31, 2009 of the Prime Minister on mechanisms and policies to support seeds, livestock breeds, and aquaculture species to restore production in areas affected by natural disasters and diseases;
The Ministry of Agriculture and Rural Development hereby provides specific guidelines for types of natural disasters and dangerous diseases eligible for support under Decision 142/2009/QD-TTg dated December 31, 2009 of the Prime Minister on mechanisms and policies to support seeds, livestock breeds, and aquaculture species to restore production in areas affected by natural disasters and diseases, as follows:
Article 1. Types of Natural Disasters and Dangerous Diseases Eligible for Support Policies for Seeds, Livestock Breeds, and Aquaculture Species
1. Types of Natural Disasters Causing Direct Damage to Crops, Livestock, and Aquaculture
a) Typhoons, floods, flash floods, inundation, drought, and saltwater intrusion.
b) Severe cold spells.
2. Types of Dangerous Diseases Affecting Crops, Livestock, and Aquaculture
a) Types of Dangerous Diseases Affecting Crops Include:
- Brown Planthopper;
- Dwarf Disease, Black Streaked Dwarf Disease, and Curl Dwarf Disease;
- Sugarcane Mosaic Disease and Dragon's Breath Disease.
b) Types of Dangerous Diseases Affecting Livestock Include:
- Avian Influenza;
- Foot-and-Mouth Disease;
- Swine Blue Ear Disease.
c) Types of Dangerous Diseases Affecting Aquaculture Include:
- White Spot Syndrome in Giant Tiger Prawn and Whiteleg Shrimp;
- Taura Syndrome in Whiteleg Shrimp;
- Yellow Head Disease in Giant Tiger Prawn and Whiteleg Shrimp.
Article 2. Competent Authority to Announce Types of Natural Disasters and Dangerous Diseases Eligible for Support Policies for Seeds, Livestock Breeds, and Aquaculture Species
1. Natural Disasters
The Chairman of the People's Committee of the province or centrally governed city shall issue a decision to announce the occurrence of a specific type of natural disaster within their jurisdiction as a basis for implementing the support policy.
2. Dangerous Diseases
a) For Crops and Livestock
The competent state authority shall announce the occurrence of a disease within their specific jurisdiction according to the laws on plant protection and veterinary medicine as a basis for implementing the support policy;
b) For Aquaculture
The Chairman of the People's Committee of the province or centrally governed city shall announce or confirm the occurrence of a specific type of aquatic disease within their jurisdiction as a basis for implementing the support policy.
Article 3. Effectiveness
This Circular takes effect 45 days from the date of issuance. During implementation, if new types of natural disasters and dangerous diseases causing damage to crops, livestock, and aquaculture are discovered, they should be reported to the Ministry of Agriculture and Rural Development for timely research, amendment, and supplementation to serve as a basis for localities to implement.
Article 4. Responsibilities for Implementation
The Director of the Ministry's Office, the General Directors of the Water Resources Administration, Fisheries Administration; the Directors of the Crop Production Department, Animal Husbandry Department, Plant Protection Department, and Veterinary Medicine Department; the Heads of units under the Ministry related to this matter; and the Departments of Agriculture and Rural Development of provinces and centrally governed cities are responsible for enforcing this Circular./.
