Issuing the List of Objects Subject to Plant Quarantine Risk Analysis Before Importing into Vietnam

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development and Decree No. 75/2009/NĐ-CP dated September 10, 2009 of the Government amending Article 3 of Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Plant Protection and Quarantine Ordinance No. 36/2001/PL-UBTVQH10 promulgated by the President on August 8, 2001;

Based on Decree No. 02/2007/NĐ-CP dated January 5, 2007 of the Government on Plant Quarantine;

Considering the proposal of the Director of the Plant Protection Department;

The Minister of Agriculture and Rural Development hereby issues the List of Objects Subject to Plant Quarantine Risk Analysis Before Importing into Vietnam as follows:

Article 1. Issuing the List of Objects Subject to Plant Quarantine Risk Analysis Before Importing into Vietnam (hereinafter referred to as objects), including:

1. Live plants and plant parts used for cultivation;

2. Fresh fruits;

3. Grasses and grass seeds;

4. Beneficial organisms and other living organisms that pose a risk of harming plant resources;

5. Round wood and sawn wood not yet treated under plant quarantine;

6. Other objects with a high risk of carrying pests regulated by Vietnam.

Article 2. The objects specified in Article 1 above must undergo pest risk analysis when the object being imported falls into one of the following cases:

1. First time imported into Vietnam;

2. New origin;

Article 3. The objects specified in Article 1 above must review and reassess the results of the pest risk analysis when the object being imported falls into one of the following cases:

1. There is scientific and practical evidence of the outbreak of plant quarantine pests or regulated pests but not plant quarantine pests on the object in the exporting country;

2. Discovery of plant quarantine pests of Vietnam on the imported object or regulated pests but not plant quarantine pests of Vietnam on imported plant material;

3. The exporting country implements new pest management measures.

Article 4. Other objects not specified in Article 1 above, if found to have plant quarantine pests of Vietnam upon importation, must undergo pest risk analysis.

Article 5. The Minister of Agriculture and Rural Development decides to exempt pest risk analysis for objects in special cases.

Article 6. Effectiveness

1. This Circular takes effect from September 27, 2012.

2. This Circular abolishes Decision No. 34/2007/QĐ-BNN-BVTV dated April 23, 2007 of the Minister of Agriculture and Rural Development on the issuance of the List of Objects Subject to Plant Quarantine Risk Analysis Before Importing into Vietnam.

During implementation, if there are difficulties or obstacles, agencies, organizations, and individuals should promptly report to the Ministry of Agriculture and Rural Development (Plant Protection Department) for consideration and resolution./.
