Regulations on functions, tasks, powers, and organizational structure

of the Management Board of Vietnam Ethnic Village - Tourism

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 36/2012/NĐ-CP dated April 18, 2012, of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 76/2013/NĐ-CP dated July 16, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

At the proposal of the Minister of Culture, Sports and Tourism,

The Prime Minister issues this Decision to stipulate the functions, tasks, powers, and organizational structure of the Management Board of Vietnam Ethnic Village - Tourism.

Article 1. Position and Functions

1. The Management Board of Vietnam Ethnic Village - Tourism is an organization under the Ministry of Culture, Sports and Tourism, implementing state management functions directly over the Vietnam Ethnic Village - Tourism in accordance with the law.

2. The Management Board of Vietnam Ethnic Village - Tourism (equivalent to a General Department) has legal personality, uses a seal bearing the National Emblem, opens accounts at the State Treasury and banks; it is the central planning and budget unit (Class I budget unit), authorized to collect and spend budget funds within investment development areas, administrative and public services, target programs, and other areas as prescribed by law.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

The Management Board of Vietnam Ethnic Village - Tourism shall perform the following tasks and powers:

1. Drafting and submitting to the Minister of Culture, Sports and Tourism for submission to the Prime Minister to decide on approval or issuance:

a) Master plans and medium- and long-term development plans for the Vietnam Ethnic Village - Tourism;

b) Mechanisms and preferential policies for the Vietnam Ethnic Village - Tourism suitable to actual development conditions during each period.

2. Submitting to the Minister of Culture, Sports and Tourism for approval or issuance:

a) Group A investment projects funded by the state budget within the Vietnam Ethnic Village - Tourism in accordance with the law;

b) Regulations on organization and operation; management and exploitation regulations for the Vietnam Ethnic Village - Tourism.

3. Regarding planning management:

a) Directing the preparation, approval, management, and supervision of detailed planning for functional zones within the Vietnam Ethnic Village - Tourism;

b) Issuing, adjusting, revoking construction planning certificates for projects within the Vietnam Ethnic Village - Tourism.

4. Regarding investment and construction management:

a) Directing and organizing the implementation of construction projects funded by the state budget within the Vietnam Ethnic Village - Tourism in accordance with the law;

b) Deciding on investments for Group B and C projects using state budget funds within the Vietnam Ethnic Village - Tourism; applying and deciding on the selection of units participating in the construction of the Vietnam Ethnic Village - Tourism through BOT, BTO, BT models;

c) Issuing, reissuing, extending, adjusting, and revoking permits and certificates as follows in accordance with the law:

- Investment certificates for projects investing in the Vietnam Ethnic Village - Tourism including projects that have been approved by the Prime Minister for investment orientation;

- Business registration certificates for organizations and individuals establishing and managing enterprises within the Vietnam Ethnic Village - Tourism;

- Construction permits for projects within the Vietnam Ethnic Village - Tourism;

- Work permits for foreigners and overseas Vietnamese coming to work and invest in the Vietnam Ethnic Village - Tourism;

- Other permits and certificates as prescribed by law.

d) Managing and utilizing ODA funds invested in the Vietnam Ethnic Village - Tourism in accordance with the law.

5. Regarding land management and use:

a) The Management Board of Vietnam Ethnic Village - Tourism is allocated land (including water surface land according to approved planning) once for building and developing the Vietnam Ethnic Village - Tourism; it can transfer land, water surface land with payment and without payment; lease land, water surface land, transfer land use rights, water surface land use rights, and certify land use rights for investors in accordance with the Land Law;

b) Cooperating with local authorities and relevant agencies to organize compensation, land clearance, and land management (including water surface) within the Vietnam Ethnic Village - Tourism;

c) Directing and approving detailed land and water surface use plans for allocated areas within the Vietnam Ethnic Village - Tourism in line with the overall planning of the Vietnam Ethnic Village - Tourism approved by the Prime Minister;

d) Approving land prices within the framework set by competent state agencies; organizing bidding for land use rights within the Vietnam Ethnic Village - Tourism.

6. Regarding natural resource and environmental management and protection:

a) Approving environmental impact assessment reports for investment projects within the Vietnam Ethnic Village - Tourism in accordance with the law;

b) Managing and inspecting the implementation of environmental protection measures; handling violations of environmental protection laws within the Vietnam Ethnic Village - Tourism in accordance with the law.

7. Organizing management and exploitation:

a) Uniformly managing exploitation, business, service activities, and use of investment facilities within the Vietnam Ethnic Village - Tourism; directly exploiting, operating, and using facilities invested by the state and those assigned by the Ministry of Culture, Sports and Tourism;

b) Cooperating with local authorities and related agencies, project sponsors to ensure security, order, fire prevention and fighting, and cultural practices during the construction and management, exploitation of facilities within the Vietnam Ethnic Village - Tourism.

8. Collecting, managing, and using various fees and charges in accordance with the law.

9. Organizing cultural, information, scientific research, collection, conservation, dissemination, and promotion of ethnic cultural values.

10. Cooperate, joint venture, and associate with organizations and individuals both within and outside the country in areas related to investment, construction, and management, exploitation of the Vietnam Ethnic Cultural Village; be permitted to hire foreign consultants to provide investment promotion advisory services, strategic investment advisory services, construction, and development advisory services for the Vietnam Ethnic Cultural Village in accordance with the provisions of the law.

11. Organize investment promotion, trade, tourism, publicity, and introduction activities domestically and internationally to attract investment capital for the Vietnam Ethnic Cultural Village project through appropriate forms in accordance with the law; accept applications, resolve difficulties and issues arising during operations at the Vietnam Ethnic Cultural Village within their authority.

12. Manage and organize training for human resources serving the operation and development of the Vietnam Ethnic Cultural Village.

13. Manage organizational structure, staffing, civil servants, public officials, and employees; implement salary systems and incentive policies, rewards, and disciplinary measures for civil servants, public officials, and employees under the management of the Vietnam Ethnic Cultural Village Management Board in accordance with the law; develop and submit to the Minister a proposal to determine job positions and the structure of civil service grades of the Vietnam Ethnic Cultural Village Management Board.

14. Organize and coordinate with state management agencies in inspection, supervision, handling complaints, accusations, anti-corruption, thrift, and the handling of violations of laws on planning, investment, environment, land, and other fields at the Vietnam Ethnic Cultural Village in accordance with the law.

15. Manage and utilize financial resources and assets allocated in accordance with the law.

16. Report periodically to the Minister of Culture, Sports and Tourism, relevant Ministries, and agencies on the implementation of planning, construction, and development plans for the Vietnam Ethnic Cultural Village.

17. Perform other tasks and powers assigned by the Minister of Culture, Sports and Tourism in accordance with the law.

7. Ethnic Villages Management Board.

9. Vietnam Village Magazine.

The units specified from Clause 1 to Clause 6 of this Article assist the Director in performing state management functions; the units specified from Clause 7 to Clause 9 are subordinate units of the Vietnam Ethnic Cultural Village Management Board. The Director of the Vietnam Ethnic Cultural Village Management Board decides to establish Investment and Construction Boards to implement investment projects in accordance with the law.

Based on requirements and actual conditions, the Director of the Vietnam Ethnic Cultural Village Management Board shall submit to the Minister of Culture, Sports and Tourism for decision within their authority or for the Minister to submit to the Prime Minister for decision to establish new administrative organizations and affiliated public service units of the Vietnam Ethnic Cultural Village Management Board in accordance with the law.

The Director of the Vietnam Ethnic Cultural Village Management Board shall define the functions, tasks, powers, and organizational structures of assisting organizations and subordinate units.

Staffing of the administrative machinery of the Vietnam Ethnic Cultural Village Management Board is assigned by the Minister of Culture, Sports and Tourism within the total administrative staffing of the Ministry of Culture, Sports and Tourism.

Public service staffing of the Vietnam Ethnic Cultural Village Management Board is decided by the Director of the Vietnam Ethnic Cultural Village Management Board.

Article 4. Leadership

1. The Vietnam Ethnic Cultural Village Management Board has a Director and not more than three Deputy Directors.

2. The Director and Deputy Directors are appointed, relieved, transferred, or reassigned by the Minister of Culture, Sports and Tourism in accordance with the law.

3. The Director of the Vietnam Ethnic Cultural Village Management Board is responsible before the Minister of Culture, Sports and Tourism and the law for all activities of the Vietnam Ethnic Cultural Village Management Board. Deputy Directors are responsible before the Director and the law for the areas of work they are assigned.

Article 5. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from September 1, 2014.

2. This Decision replaces Decision No. 95/2008/QĐ-TTg dated July 10, 2008 of the Prime Minister stipulating the functions, tasks, powers, and organizational structure of the Vietnam Ethnic Cultural Village Management Board.

3. The Minister of Culture, Sports and Tourism, Ministers, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairmen of Provincial People's Committees directly under the Central Government, and the Director of the Vietnam Ethnic Cultural Village Management Board are responsible for implementing this Decision./.
