Pursuant to the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia signed on June 1, 1998 (hereinafter referred to as the "Agreement");isigned on June 1, 1998 (hereinafter referred to as the "Agreement"); “October 10, 2005 (hereinafter referred to as the "Protocol");

Pursuant to the Protocol implementing the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia signed on October 10, 2005 (hereinafter referred to as the "Protocol");intention The Minister of Transport issues the Circular guiding the implementation of certain provisions of the Agreement and Protocol on road transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating functions, tasks, organization, and staffing.onconstruction and publication of load orders and speed orders on national railways, urban railways running concurrently with national railways, and dedicated railways.

At the proposal of the Department of Science and Technology, organize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular.The Director of the Department of International Cooperation and the Director General of the Vietnam Highway Administration,policies hereby issue this Circular guiding the implementation of certain provisions of the Agreement and the Protocol implementing the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia.

FOR THE MEANSi1. Supplementing Point 6a following Article 6 of Circular No. 02/2019/TT-BVHTTDL dated July 5, 2019 of the Minister of Culture, Sports and Tourism on the procedures for legal expertise regarding copyright and related rights as follows:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular guides the implementation of certain provisions of the Agreement and the Protocol implementing the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia.

Article 2. Applicability

This Circular applies to organizations and individuals involved in road transport activities of people and goods crossing the border between Vietnam and Cambodia.

Chapter II

PAIRS OF BORDER GATES AND REGULATIONS FOR VEHICLES, DRIVERS, PASSENGERS ON THE VEHICLE

Article 3. Pairs of border gates

Article 4. Regulations for vehicles

1. Vehicles of Vietnam implementing the Agreement are vehicles with Vehicle Registration Certificates and license plates issued by the competent authority of the Socialist Republic of Vietnam. Vehicles include commercial and non-commercial vehicles.

2. Commercial vehicles include:

a) Passenger buses operating on fixed routes, passenger transportation by contract, tourist transportation: having 10 seats or more (including the driver);

b) Taxis: having 5 seats (including the driver);

c) Cargo vehicles: trucks, tractor units, trailers or semi-trailers attached to tractor units. A truck or tractor unit connected to a trailer or semi-trailer is considered one vehicle.

3. Non-commercial vehicles not exceeding 9 seats (including the driver) include:

Official vehicles under the use of agencies and organizations including:

Vehicles of central agencies of the Party, National Assembly and Government, offices of Ministries, agencies equivalent to Ministries; agencies under the Government, agencies under Ministries, agencies equivalent to Ministries, agencies under agencies under the Government;

Vehicles of diplomatic agencies, embassies, international organizations, non-governmental organizations headquartered in Vietnam;

Vehicles of political organizations, political-social organizations, mass organizations at central and local levels;

b) Self-driven vehicles by foreigners: vehicles used by persons holding passports issued by third countries (not Vietnamese or Cambodian passports);

c) Fire engines, ambulances.

4. Commercial vehicles must be equipped with vehicle tracking devices, have a valid usage period, and display current regulations' identification marks and signs.

5. Vehicles when exiting or entering through border gates must be subject to management, inspection, control, and supervision by specialized state management agencies at the border gate according to the laws of each contracting party.

Article 5. Duration and Scope of Operation of Vehicles

1. For each trip, vehicles are permitted to remain on the territory of the other Contracting Party for no more than thirty days from the date of entry. In cases where the prescribed period has been exceeded due to valid reasons (natural disasters, accidents, unrepaired damage), an extension will be granted, with each extension not exceeding ten days from the expiry date of departure.

2. Scope of operation: vehicles are permitted to operate in provinces and cities of the other Contracting Party and to pass through border gates as specified in Article 3 of this Circular.

3. Vehicles are not permitted to transport goods or passengers between two points within the territory of the other Contracting Party (except in cases where permission is granted by the competent authority of the other Contracting Party).

Article 6. Regulations on Documents of Vehicles

When exiting, entering through border gates, and circulating, vehicles must have valid documents together with their English translations or certified translations in the language of the destination country (except when the documents are printed in both Vietnamese and Khmer or Vietnamese and English or Khmer and English) to present to specialized state management agencies at border gates and authorities upon request, specifically:

1. For commercial passenger-carrying vehicles

a) Vehicle registration certificate;

b) Safety technical inspection and environmental protection certificate;

c) Vietnam-Cambodia Combined Transport Permit;

d) Passenger list (for fixed route passenger-carrying vehicles as stipulated in Appendix 1a issued along with this Circular; for contractual passenger-carrying vehicles and tourist passenger-carrying vehicles as stipulated in Appendix 1b issued along with this Circular). Specifically, for fixed route passenger-carrying vehicles, the passenger list must be confirmed by the bus station (in Cambodia, if there is no bus station, it must be confirmed by the pick-up and drop-off location). The passenger list does not apply to passenger-carrying vehicles using taxis;

đ) Passenger transport contract (for contractual passenger-carrying vehicles);

e) Compulsory third-party civil liability insurance certificate;

g) Declaration form for temporary import-re-export or temporary export-re-import of road transport vehicles.

2. For commercial cargo-carrying vehicles

a) Vehicle registration certificate;

b) Safety technical inspection and environmental protection certificate;

c) Vietnam-Cambodia Combined Transport Permit;

d) Cargo delivery note;

đ) Customs declaration for goods;

e) Compulsory third-party civil liability insurance certificate;

g) Declaration form for temporary import-re-export or temporary export-re-import of road transport vehicles.

3. For non-commercial vehicles

a) Vehicle registration certificate;

b) Safety technical inspection and environmental protection certificate;

c) Vietnam-Cambodia Combined Transport Permit;

d) Compulsory third-party civil liability insurance certificate;

đ) Declaration form for temporary import-re-export or temporary export-re-import of road transport vehicles.

Article 7. National Identification Mark of Vehicles

1. The national identification mark for Cambodia is KH; the national identification mark for Vietnam is VN. The national identification mark is issued by the licensing authority together with the issuance of the Combined Transport Permit. Vietnamese vehicles must affix the national identification mark on the front and rear windows of the vehicle.

2. The model of the national identification mark for Vietnam is specified in Appendix 2 issued along with this Circular.

Article 8. Regulations for Drivers and Persons on Board

1. Drivers controlling vehicles exiting, entering through border gates must have a passport or international travel documents consistent with international treaties that both countries are members of, and visas issued by the competent authority (except in cases of visa exemption) together with a national or international driving license appropriate to the type of vehicle they control.

2. Persons on board vehicles exiting, entering through border gates must have a passport or international travel documents consistent with international treaties that both countries are members of, and visas issued by the competent authority (except in cases of visa exemption).

3. Drivers controlling vehicles, persons on board vehicles when exiting, entering through border gates must comply with the management, inspection, supervision, and monitoring by specialized state management agencies at border gates according to the laws of each Contracting Party.

Chapter III

INTERNATIONAL ROAD TRANSPORT PERMIT VIETNAM - CAMBODIA

Article 9. Subjects eligible for issuance of the Vietnam-Cambodia International Road Transport Permit

The subjects eligible for issuance of the Vietnam-Cambodia International Road Transport Permit are enterprises and cooperatives of Vietnam that must meet the following conditions:

1. Engaging in domestic transportation business for at least three years; not declared bankrupt or not in a state of bankruptcy declaration.

2. For transport managers: must have a bachelor's degree or higher in economics or engineering fields and have a continuous work experience of at least three years at the enterprise or cooperative engaged in transportation business.

3. For passenger transport: must register and implement passenger transport service quality levels from three stars upwards according to the standards issued by the Ministry of Transport.

Article 10. Provisions on Issuance of the Vietnam International Road Transport Permit - 3. Trapeing Phlong (Kông Pông Chàm)

1. Authority issuing the Vietnam-Cambodia International Road Transport Permit: Vietnam Highway Corporation.

2. Documents for application for the Vietnam-Cambodia International Road Transport Permit:

a) Application form for the Vietnam-Cambodia International Road Transport Permit according to the model attached as Appendix 3 to this Circular;

b) Certified copy or copy with original for comparison of the Business License for Motor Vehicle Transportation (for enterprises and cooperatives required to have such a license under regulations) or Business Registration Certificate with registered transportation business (for enterprises and cooperatives not required to have a Business License for Motor Vehicle Transportation under regulations);

c) Business plan for Vietnam-Cambodia International Road Transport according to the model attached as Appendix 4 to this Circular;

d) Certified copy or copy with original for comparison of the financial statements of the enterprise or cooperative for the three most recent consecutive years confirmed by local financial authorities or auditing units;

đ) Certified copy or copy with original for comparison of the educational certificates of the transport manager and labor contracts with the enterprise or cooperative (except when the transport manager holds one of the following positions: Enterprise Director, Cooperative Director, Chairman of the Management Board of the Cooperative, Cooperative Leader);

e) Service quality registration for passenger transport (for enterprises and cooperatives engaged in passenger transport).

3. Provisions on handling applications:

a) Enterprises and cooperatives submit one set of documents to the Vietnam Highway Corporation. In case additional or amended documents are required, the Vietnam Highway Corporation will notify directly (for applications submitted in person) or in writing within a maximum period of two working days from the date of receipt of the documents the contents that need to be supplemented or amended;

b) Within two working days from the date of receiving complete and compliant documents, the Vietnam Highway Corporation issues the Vietnam-Cambodia International Road Transport Permit to enterprises and cooperatives. If refusal to issue is made, it must be replied in writing and the reasons clearly stated;

c) The acceptance of documents and delivery of results shall be conducted at the headquarters of the issuing authority, through postal services, or by other appropriate means.

4. Enterprises and cooperatives pay the fee for issuance of the Vietnam-Cambodia International Road Transport Permit according to the regulations of the Ministry of Finance.

5. The validity period of the Vietnam-Cambodia International Road Transport Permit is five years but does not exceed the validity period of the Business License for Motor Vehicle Transportation.

6. The format of the Vietnam-Cambodia International Road Transport Permit is specified in Appendix 5 attached to this Circular.

7. When the Vietnam-Cambodia International Road Transport Permit expires, enterprises and cooperatives prepare an application for reissuance of the Vietnam-Cambodia International Road Transport Permit according to the provisions of Clause 2 of this Article. In case the Vietnam-Cambodia International Road Transport Permit is lost or damaged (in case of loss, the reason must be clearly stated), enterprises and cooperatives prepare an application for reissuance of the Vietnam-Cambodia International Road Transport Permit according to the provisions of point a of Clause 2 of this Article. Expired or damaged Vietnam-Cambodia International Road Transport Permits must be returned to the Vietnam Highway Corporation together with the application for reissuance of the Vietnam-Cambodia International Road Transport Permit.

8. Enterprises and cooperatives that have been issued the Vietnam-Cambodia International Road Transport Permit before the effective date of this Circular continue to use it until its expiration and must register to implement passenger transport service quality levels according to the provisions of Clause 3 of Article 9 of this Circular.

Article 11. Revocation of the Vietnam-Cambodia International Road Transport Permit

1. Enterprises and cooperatives shall have their Vietnam-Cambodia International Road Transport Permit revoked when they violate any of the following cases:

a) Intentionally providing false information in the application dossier for the Vietnam-Cambodia International Road Transport Permit;

b) Not operating international road transport between Vietnam and Cambodia continuously for one year;

c) Operating a type of transport not in accordance with the Vietnam-Cambodia International Road Transport Permit;

d) When the Business License for Motor Vehicle Transport or the Business Registration Certificate is revoked by the competent authority;

đ) When management agencies at border gates propose revocation due to violations related to cross-border activities and import-export operations at border gates;

e) Failing to meet any of the conditions stipulated in Article 9 of this Circular.

2. Procedure for revoking the Vietnam-Cambodia International Road Transport Permit:

a) The General Department of Transportation of Vietnam issues a Decision to revoke the Vietnam-Cambodia International Road Transport Permit and notifies the decision to revoke the permit to the Department of Transportation and relevant agencies for coordination in implementation;

b) Enterprises and cooperatives return the Vietnam-Cambodia International Road Transport Permit and the Vietnam-Cambodia Combined Transport Permit to the General Department of Transportation of Vietnam and immediately cease all Vietnam-Cambodia international road transport business activities upon the effective date of the revocation decision.

3. Enterprises and cooperatives violating Clause 1 of this Article will not be issued a new permit within one year from the date of revocation.

Chapter IV

VIETNAM-CAMBODIA COMBINED TRANSPORT PERMIT FOR VEHICLES FOR MEANS OF TRANSPORT

Article 12. Vietnam-Cambodia Combined Transport Permit for Vehicles

1. The Vietnam-Cambodia Combined Transport Permit for Vehicles is issued to commercial vehicles belonging to enterprises and cooperatives that have been granted the Vietnam-Cambodia International Road Transport Permit, allowing multiple trips, each not exceeding 30 days, valid for one year from the date of issuance but not exceeding the validity period of the Vietnam-Cambodia International Road Transport Permit.

2. The Vietnam-Cambodia Combined Transport Permit for Vehicles is issued to non-commercial vehicles for a single trip and has a validity period not exceeding 30 days from the date of issuance.

3. Fire trucks and ambulances are exempted from the Vietnam-Cambodia Combined Transport Permit when crossing the border between the two countries.

4. The model of the Vietnam-Cambodia Combined Transport Permit (including the Vietnam-Cambodia Combined Transport Permit book for commercial and non-commercial vehicles and the Vietnam-Cambodia Combined Transport Emblem) is specified in Appendix 6a, Appendix 6b, and Appendix 6c attached to this Circular.

5. The Vietnam-Cambodia Combined Transport Emblem must be affixed in the upper right corner of the front windshield (viewed from inside the vehicle).

Article 13. Application Dossier for Issuance of the Vietnam-Cambodia Combined Transport Permit

1. For Commercial Vehicles

a) An application form for the Vietnam-Cambodia Combined Transport Permit as specified in Appendix 7a attached to this Circular;

b) Vehicle registration certificate and lease contract for the vehicle with financial leasing organizations or asset leasing organizations if the vehicle does not belong to the transport business entity. In the case where the registered vehicle belongs to a cooperative member, there must be a vehicle registration certificate and a service contract between the member and the cooperative specifying that the cooperative has the rights, responsibilities, and obligations to manage, use, and operate vehicles owned by cooperative members;

c) Certificate of technical safety inspection and environmental protection;

d) A copy of the approval document for route operation, replacement vehicle document, or additional vehicle document from the route management agency, and passenger pick-up and drop-off contracts at bus stations in Vietnam and bus stations or pick-up/drop-off points in Cambodia (for vehicles operating fixed-route passenger transport services between Vietnam and Cambodia).

2. For Non-Commercial Vehicles

a) An application form for the Vietnam-Cambodia Combined Transport Permit as specified in Appendix 7b attached to this Circular;

b) Vehicle registration certificate, in cases where the vehicle does not belong to an organization or individual, a contract between the organization or individual and a financial leasing organization or an organization or individual with asset leasing functions as prescribed by law must be attached;

c) Certificate of technical safety inspection and environmental protection;

d) Decision on dispatch for work by the competent authority (except for vehicles driven by foreign nationals themselves).

3. Documents specified in Points b, c of Clause 1 of this Article and Points b, c, d of Clause 2 of this Article must be certified copies or copies accompanied by original documents for verification.

Article 14. Provisions on Issuing the Vietnam-Cambodia Combined Transport Permit

1. Provisions on handling applications:

a) Organizations and individuals submit one set of application documents to the issuing authority. In cases where additional or amended information is required, the issuing authority will notify directly (for applications submitted in person) or in writing the necessary additions or amendments within a maximum period of two working days from the date of receipt of the application;

b) Within two working days from the date of receiving complete and compliant application documents, the issuing authority shall issue the Vietnam-Cambodia Combined Transport Permit; in case of refusal to issue, a written response must be provided with clear reasons stated;

c) The acceptance of applications and issuance of results shall be conducted at the issuing authority's office, through postal services, or by other appropriate means.

2. Organizations and individuals pay the fee for issuing the Vietnam-Cambodia Combined Transport Permit in accordance with the regulations of the Ministry of Finance.

3. When the Vietnam-Cambodia Combined Transport Permit expires, organizations and individuals shall prepare an application to reissue the permit in accordance with Article 13 of this Circular. In cases where the permit is lost or damaged (in cases of loss, a document explaining the reason must be provided), organizations and individuals shall prepare an application to reissue the Vietnam-Cambodia Combined Transport Permit in accordance with Clause 1, Article 13 (for commercial vehicles) or Clause 2, Article 13 (for non-commercial vehicles) of this Circular. Expired or damaged permits for commercial vehicles shall be returned to the issuing authority along with the application for reissuance of the Vietnam-Cambodia Combined Transport Permit.

Article 15. Issuing Authority for the Vietnam-Cambodia Combined Transport Permit

1. The General Department of Transportation of Vietnam issues the Vietnam-Cambodia Combined Transport Permit for the following types of vehicles:

a) Official vehicles under the use of agencies and organizations including:

Vehicles of central agencies of the Party, National Assembly, and Government, offices of Ministries, agencies equivalent to Ministries, agencies under the Government, agencies under Ministries, and agencies equivalent to Ministries under the Government;

Vehicles of diplomatic agencies, embassies, international organizations, and non-governmental organizations headquartered in Hanoi;

Vehicles of political organizations, political-social organizations, mass organizations, and central public service organizations.

b) Commercial vehicles.

2. Local Departments of Transportation issue the Vietnam-Cambodia Combined Transport Permit for non-commercial vehicles of agencies, organizations, and individuals belonging to the remaining categories located within their jurisdiction.

3. Local Departments of Transportation at border gates adjacent to Cambodia, as stipulated in the Agreement, in addition to issuing permits according to Clause 2 of this Article, also issue permits for non-commercial vehicles of organizations and individuals located in other provinces of Vietnam passing through border gates under their management.

Article 16. Revocation of the Vietnam-Cambodia Combined Transport Permit

1. Enterprises and cooperatives have their Vietnam-Cambodia Combined Transport Permit revoked when they violate any of the following circumstances:

a) Not complying with the contents recorded in the Vietnam-Cambodia Combined Transport Permit or violating regulations on transport operation management;

b) Not operating combined transport between Vietnam and Cambodia within three months from the date of issuance of the permit;

c) Not operating combined transport between Vietnam and Cambodia continuously for six months with three trips or more (a trip includes both outbound and return journeys);

d) Not reporting combined transport operations between Vietnam and Cambodia as prescribed in Article 21 of this Circular;

đ) Having their Vietnam-Cambodia International Road Transport Permit revoked.

2. Enterprises and cooperatives that violate Clause 1 of this Article will not be issued new permits for vehicles within a six-month period from the date of revocation.

3. Permits already issued to enterprises and cooperatives before this Circular takes effect remain valid until the expiration date of the permit.

4. Procedure for revoking the Vietnam-Cambodia Combined Transport Permit:

a) The issuing authority issues a Decision to revoke the permit and notifies relevant authorities to coordinate implementation;

b) Enterprises and cooperatives return the permit to the issuing authority and immediately cease all Vietnam-Cambodia transport business activities upon the effective date of the revocation decision.

Article 17. Extension of Cambodia-Vietnam Combined Transport Permit and Time for Circulation in Vietnam for Cambodian Vehicles

1. The objects eligible for extension: Cambodian vehicles whose combined transport permit has expired or have exceeded the time limit for circulation in Vietnam due to valid reasons (natural disasters, accidents, unrepaired damage) shall be extended, with each extension not exceeding 10 days from the date of expiry of the stay period.

2. Authority to extend: Provincial Departments of Transportation where the vehicle encountered difficulties.

3. Documents for extension include: Original Cambodia-Vietnam Combined Transport Permit; certified copy or copy accompanied by the original for verification of the vehicle registration certificate; application for extension according to the form at Appendix 8 issued together with this Circular.

4. Provisions on handling applications

a) Organizations and individuals submit one set of documents directly to the local Department of Transportation where the vehicle encountered difficulties;

b) Within one working day from the date of receiving complete documents in accordance with regulations, the Department of Transportation extends the Cambodia-Vietnam Combined Transport Permit for Cambodian vehicles, which will be recorded in the extension section of the Cambodia-Vietnam Combined Transport Permit; if the extension is not granted, a written response stating the reasons must be provided immediately upon receipt of the application.

Chapter V

PROVISIONS ON FIXED ROUTE PASSENGER TRANSPORT BETWEEN VIETNAM AND CAMBODIA BY MOTOR VEHICLES

BY MOTOR VEHICLES BETWEEN VIETNAM AND CAMBODIA

Article 18. Registration for Operating Fixed Route Passenger Transport Between Vietnam and Cambodia by Motor Vehicles

1. Enterprises and cooperatives meeting the current conditions for operating motor vehicle transportation may register to operate fixed route passenger transport between Vietnam and Cambodia by motor vehicles.

2. The application for operating a route includes:

a) Application for registration of fixed route passenger transport between Vietnam and Cambodia by motor vehicles according to the form prescribed in Appendix 9 issued together with this Circular;

b) Certified copy or copy accompanied by the original for verification of the vehicle registration certificate and lease contract with organizations or individuals providing financial leasing or asset leasing if the vehicle does not belong to the transportation business unit. In cases where the registered vehicle belongs to a cooperative member, there must be a certified copy or copy accompanied by the original for verification of the vehicle registration certificate and service contract between the member and the cooperative, stipulating that the cooperative has the right, responsibility, and obligation to manage, use, and operate motor vehicles owned by cooperative members;

c) Plan for operating fixed route passenger transport between Vietnam and Cambodia by motor vehicles according to the form prescribed in Appendix 10 issued together with this Circular.

3. Provisions on handling applications:

a) Enterprises and cooperatives submit one set of documents to the route management agency. If additional or amended documents are required, the route management agency will notify directly (for direct submissions) or in writing the contents requiring supplementation or amendment to enterprises and cooperatives within a maximum of two working days from the date of receipt of the documents;

b) Within two working days from the date of receiving complete documents in accordance with regulations, the route management agency issues a document approving the operation of the route. If approval is not granted, a written response stating the reasons must be provided;

c) Submission of documents and issuance of results shall be conducted at the headquarters of the route management agency, through postal services, or by other appropriate means.

4. The document approving the operation of the route takes effect from the date of signature and has a validity period according to the validity of the Vietnam-Cambodia International Road Transport Permit. After 60 days from the date of issuing the approval document, if the enterprise or cooperative does not put the vehicle into operation, the approval document becomes invalid. The document approving the operation of the route follows the form prescribed in Appendix 11 issued together with this Circular.

5. Fixed route passenger transport between Vietnam and Cambodia by motor vehicles must start and end (on Vietnamese territory) at bus stations from type 1 to type 4 or bus station type 5 located in poor districts as defined by the Government.

6. Vehicles operating fixed route passenger transport between Vietnam and Cambodia by motor vehicles must have a dispatch order. The dispatch order is issued for each trip of the outbound and return journey (in case the trip spans multiple days) or daily (in case multiple trips are carried out in a day). The dispatch order is printed by the enterprise or cooperative according to the form prescribed in Appendix 12 issued together with this Circular. The dispatch order must be numbered sequentially by year for management purposes.

7. The authority managing fixed route passenger transport between Vietnam and Cambodia by motor vehicles: Vietnam Highway Administration.

Article 19. Supplementing and Replacing Means of Exploiting Fixed Bus Passenger Transport Routes between Vietnam and Cambodia

1. Enterprises and cooperatives currently operating on the route have the right to supplement and replace means of transport.

2. The application for supplementing means of transport shall be made in accordance with Clause 2 of Article 18 of this Circular.

3. The application for replacing means of transport shall be made in accordance with Points a and b of Clause 2 of Article 18 of this Circular.

4. The procedures for handling applications, the validity of documents for supplementing and replacing means of transport, dispatch orders, and the approving authority for supplementing and replacing means of transport shall be carried out in accordance with Clauses 3, 4, and 7 of Article 18 of this Circular. The approval document for supplementing and replacing means of transport for exploiting the route shall be in the form prescribed in Appendix 13 issued together with this Circular.

Article 20. Ceasing to Exploit the Route, Adjusting Frequency of Vehicle Runs on Fixed Bus Passenger Transport Routes between Vietnam and Cambodia

1. Ceasing to exploit the route.

a) Enterprises and cooperatives currently exploiting fixed bus passenger transport routes between Vietnam and Cambodia must notify in writing according to the form prescribed in Appendix 14 issued together with this Circular to the route management authority at least 15 days before ceasing exploitation of the route;

b) Within the latest two working days from the date of receipt of the request to cease exploitation of the route, the route management authority shall issue an approval document to cease exploitation of the route according to the form prescribed in Appendix 15 issued together with this Circular and publicly announce it so that other enterprises and cooperatives can apply to exploit the route;

c) Five working days after ceasing exploitation of the route, enterprises and cooperatives must return the approval for exploitation of the route, National Distinction Mark, and International Combined Transport Permit of vehicles ceasing exploitation of the route to the Vietnam Road Administration.

2. Adjusting frequency of vehicle runs on the route

a) At least ten days before adjusting the frequency of runs on the route, enterprises and cooperatives must notify in writing according to the form prescribed in Appendix 16 issued together with this Circular to the route management authority;

b) Within the latest two working days from the date of receipt of the request, the route management authority shall issue an approval document to adjust the frequency of vehicle runs on the route according to the form prescribed in Appendix 17 issued together with this Circular;

c) At least three days before implementing the adjustment of the frequency of runs, bus stations are responsible for publicly announcing the information at the station;

d) In case of vehicles ceasing exploitation of the route, within the latest five working days, enterprises and cooperatives must return the National Distinction Mark and International Combined Transport Permit of vehicles ceasing exploitation of the route to the Vietnam Road Administration.

Chapter VI

IMPLEMENTING PROVISIONS

Article 21. Reporting System

By the 20th day of January and July each year, Vietnamese enterprises and cooperatives engaged in transportation to Cambodia must report the situation of transportation activities between Vietnam and Cambodia for the first six months and the whole year to the Vietnam Road Administration and the local Department of Transportation. The report format for passenger transportation results is prescribed in Appendix 18 issued together with this Circular, and the report format for cargo transportation results is prescribed in Appendix 19 issued together with this Circular.

Article 22. Implementation organization

1. Vietnam Highway Administration

a) Organizing and guiding the operation of means of transport crossing the land border between Vietnam and Cambodia;

b) Taking the lead and coordinating with relevant agencies in inspecting and handling commercial and non-commercial vehicles of Vietnam and Cambodia operating across the border between the two countries;

c) Implementing administrative procedures under the national single-window mechanism;

d) Announcing the list of means of transport granted International Combined Transport Permits for Vietnam - Cambodia to the Cambodian Transport General Department and related agencies for coordinated management;

đ) Developing, deploying, and guiding the implementation of software for managing cross-border road transport operations between Vietnam and Cambodia;

e) Publicly announcing on the website of the Vietnam Road Administration: the list of enterprises and cooperatives granted international road transport permits for Vietnam - Cambodia; the number of issued and revoked International Combined Transport Permits for Vietnam - Cambodia; the list and order of received applications and types of transport requesting International Combined Transport Permits for Vietnam - Cambodia;

g) Taking the lead in coordinating with relevant agencies to organize annual meetings with the Cambodian Transport General Department and related Cambodian agencies to exchange and resolve issues related to cross-border road transport between the two countries;

h) Printing and issuing the National Distinction Mark, International Road Transport Permits for Vietnam - Cambodia, International Combined Transport Permits for Vietnam - Cambodia, and passenger lists;

i) Inspecting, supervising, and handling violations of regulations on international road transport business between Vietnam and Cambodia according to the law within their authority;

k) Reporting periodically every six months, annually, or urgently to the Ministry of Transport on the management and issuance of International Road Transport Permits for Vietnam - Cambodia and International Combined Transport Permits for Vietnam - Cambodia.

2. Departments of Transportation of provinces and centrally-administered cities

a) Organizing the dissemination and implementation of this Circular to organizations and individuals related to the area;

b) Managing international road transport activities between Vietnam and Cambodia within the local area and within their authority;

c) Reporting periodically every six months and annually to the Vietnam Road Administration on the organization and management of international combined transport activities between Vietnam and Cambodia for monitoring, summarizing, and reporting to the Ministry of Transport. The report format is prescribed in Appendix 20 issued together with this Circular.

3. During the implementation process, if any difficulties arise, organizations and individuals should contact the Vietnam Road Administration for guidance and resolution. If the difficulties exceed their authority to resolve, the Vietnam Road Administration will report to the Ministry of Transport for instructions on implementation.

Article 23. Effectiveness of Implementation

1. This Circular takes effect from December 1, 2015.

2. This Circular replaces Circular No. 10/2006/TT-BGTVT dated November 1, 2006 guiding the implementation of certain provisions of the Agreement and Protocol to implement the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia; and Circular No. 18/2010/TT-BGTVT dated July 7, 2010 guiding the implementation of certain provisions of the Agreement and Protocol to implement the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia for non-commercial vehicles.

3. Article 2 of Circular No. 24/2011/TT-BGTVT dated March 31, 2011 amending and supplementing certain provisions of Circular No. 258/1998/TT-BGTVT dated August 18, 1998 guiding the implementation of the Protocol of the Ministry of Transport of Vietnam and the Ministry of Communications of China to implement the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China; and Circular No. 10/2006/TT-BGTVT dated November 1, 2006 of the Ministry of Transport guiding the implementation of certain provisions of the Agreement and Protocol to implement the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia is hereby repealed.

Article 24. Responsibility for Implementation

The Director of the Office, the Inspector General, the Heads of Departments, the Directors of the Vietnam Highway Administration, the Directors of Provincial Departments of Transport under central cities and provinces, relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
