Pursuant to the Law on Product and Goods Quality dated November 21, 2007;

Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing a number of articles of the Law on Product and Goods Quality;

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Transport;

At the proposal of the Director of the Department of Science and Technology and the Director of Vietnam Vehicle Inspection Agency;

The Minister of Transport issues this Circular specifying the List of products and goods with potential to cause safety hazards under the responsibility of the Ministry of Transport for state management.

Article 1. Scope of Regulation

This Circular stipulates on:

1. The List of products and goods with potential to cause safety hazards (hereinafter referred to as Group 2 products and goods) under the responsibility of the Ministry of Transport for state management.

2. Harmonized System (HS) codes for the List of Group 2 products and goods.

Article 2. Applicability

This Circular applies to:

1. Organizations and individuals, both domestic and foreign, engaged in production, business, design, construction, and installation of Group 2 products and goods under the responsibility of the Ministry of Transport for state management.

2. Organizations and individuals related to activities of managing and assessing quality of Group 2 products and goods under the responsibility of the Ministry of Transport for state management.

Article 3. List of Group 2 Products and Goods Under State Management Responsibility of the Ministry of Transport

The List of Group 2 products and goods under the responsibility of the Ministry of Transport for state management, attached to this Circular, includes two appendices:

1. Appendix 1: List of Group 2 products and goods with HS codes that must be certified and declared as compliant.

2. Appendix 2: List of Group 2 products and goods with HS codes that must be declared as compliant.

Article 4. Effective Date

1. This Circular takes effect from February 1, 2017.

2. This Circular replaces Circular No. 63/2011/TT-BGTVT dated December 22, 2011 of the Minister of Transport on the List of products and goods with potential to cause safety hazards under the responsibility of the Ministry of Transport for state management.

Article 5. Responsibilities for Implementation

1. Departments and General Departments under the Ministry shall be responsible for:

a) Implementing this Circular;

b) Reviewing the list of products and goods within their respective areas of management and submitting it to the Ministry for review and amendment.

2. The Department of Science and Technology shall be responsible for compiling proposals from Departments and General Departments to advise on amendments and supplements to the list.

3. During implementation, if any difficulties arise, agencies, organizations, and individuals shall promptly report them to the Ministry of Transport for review and resolution.

4. In cases where legal regulations, technical standards, or technical norms cited in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new documents./.
