Regarding the application of financial mechanisms for the Telecommunications Agency

Pursuant to the Law on Thrift and EconomyPursuant to Decree No. 16/2015/ND-CP dated February 14, 2015 of the Government stipulating the self-management mechanism of public service units;

PURSUANTand the Law on Fees and ChargesPursuant to Decree No. 120/2016/NĐ-CP dated August 23, 2016 of the Government detailing and guiding the implementation of certain provisions of the Law on Fees and Charges dated November 25, 2015;

PURSUANTThe Prime Minister promulgates this Decision on the application of financial mechanisms for the Telecommunications Agency under the Ministry of Information and Communications. and Charges;

Pursuant to Decree No. 16/2015/ND-CP dated February 14, 2015 of the Government stipulating the self-management mechanism for public service units rural area issues Circular guiding on the organization and operation of Management Councils in public service units under the Ministry of Agriculture and Rural Development.autonomy of public service units with establishment in the field of economic services and other services;

This Decision takes effect from December 1, 2017 and applies from the 2017 budget year.The Ministers of Information and Communications, Finance, Planning and Investment, Home Affairs and the heads of relevant agencies are responsible for implementing this Decision./.

At the proposal of the Minister of Information and Communications;

The Telecommunications Agency shall apply the financial autonomy mechanism like an economic public service unit or another self-financing public service unit in accordance with Decree No. 16/2015/NĐ-CP dated February 14, 2015 of the Government stipulating the autonomy mechanism of public service units and Decree No. 141/2016/NĐ-CP dated October 10, 2016 of the Government stipulating the autonomy mechanism of public service units in the economic sector and other services, and the guiding documents for the implementation of these Decrees.

Article 1. The Telecommunications Agency may use retained fee revenue to fund its activities, including: investment expenses; expenses for purchasing, major repairs of assets, machinery, and equipment; supplementary income for employees; special tasks expenses according to the functions, duties, and powers of the Telecommunications Agency.

Article 2. This Decision takes effect from November 15, 2017 and applies from the 2017 budget year; it replaces Decision No. 35/2011/QĐ-TTg dated June 27, 2011 of the Prime Minister stipulating the functions, duties, powers, and organizational structure of the Telecommunications Agency under the Ministry of Information and Communications.

Article 3. The Ministers of the Ministries of Information and Communications, Finance, Planning and Investment, Home Affairs, the Director of the Telecommunications Agency, and the Heads of related agencies are responsible for implementing this Decision./.
