Regulations on managing commune-level radio stations applying information technology and telecommunications

Pursuant to the Law on Information Technology dated June 29, 2006;
Pursuant to the Law on Telecommunications dated November 23, 2009;
||| Pursuant to the Cybersecurity Law dated November 19, 2015;
Pursuant to Decree No. 85/2016/NĐ-CP dated July 1, 2016 of the Government on ensuring the security of information systems according to levels;
Pursuant to Decree No. 17/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;
Pursuant to Decision No. 52/2016/QĐ-TTg dated December 6, 2016 of the Prime Minister promulgating the Regulation on grassroots information activities;
Implementing Decision No. 135/QĐ-TTg dated January 20, 2020 of the Prime Minister approving the Project to enhance the effectiveness of grassroots information activities based on the application of information technology;
At the proposal of the Director of the Grassroots Information Department;
The Minister of Information and Communications issues this Circular stipulating the management of commune-level radio stations applying information technology and telecommunications.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates the management of commune-level radio stations applying information technology and telecommunications including: Basic components and technical requirements; connection models and data sharing requirements; information security; responsibilities of agencies and organizations managing commune-level radio stations applying information technology and telecommunications.
This Circular does not regulate the activities of wired radio stations and wireless FM radio stations.
Article 2. Applicability
This Circular applies to agencies, organizations, and individuals related to commune-level radio stations applying information technology and telecommunications.
Article 3. Explanation of Terms
1. Commune-level radio stations applying information technology and telecommunications are commune-level radio stations using methods to transmit sound signals and data over telecommunications infrastructure and the Internet. Commune-level radio stations applying information technology and telecommunications are part of the information-based radio transmission system at the provincial level.
2. The information-based radio transmission system at the provincial level is an information system deployed at the commune, ward, and town levels and centrally managed at the provincial level, consisting of two components: The provincial information source system and commune-level radio stations applying information technology and telecommunications.
3. The provincial information source system is an information system established to provide information sources for commune-level radio stations applying information technology and telecommunications at the provincial level. The provincial information source system also has the function of collecting, summarizing, analyzing, managing data, and evaluating the effectiveness of grassroots information activities to serve local administrative management work.
4. The central information source system is an information system established to provide information sources for commune-level radio stations applying information technology and telecommunications nationwide. The central information source system also has the function of collecting, summarizing, analyzing, managing data, and evaluating the effectiveness of grassroots information activities to serve national administrative management work.
Source information is digital news provided by central, provincial, and district-level agencies and organizations and managed and stored on the information source system.
Chapter II
LIST OF BASIC COMPONENTS AND TECHNICAL REQUIREMENTS FOR COMMUNE-LEVEL RADIO STATIONS APPLYING INFORMATION TECHNOLOGY AND TELECOMMUNICATIONS
Article 4. List of basic components
1. Hardware equipment includes:
a) Radio transceiver units applying information technology - telecommunications technology;
b) Equipment for managing, storing information, and producing radio programs;
c) Speakers;
d) Microphones;
đ) Other equipment and materials.
2. Software includes:
a) System software serving the operation of radio transceiver units applying information technology - telecommunications technology;
b) Software of the radio broadcasting system applying information technology - telecommunications technology at provincial level and centrally governed cities.
Article 5. Technical requirements
1. The hardware equipment of village-level radio stations applying information technology - telecommunications technology must meet the basic technical requirements set out in Appendix 01 issued together with this Circular.
2. The system software serving the operation of radio transceiver units applying information technology - telecommunications technology must meet the basic requirements for information security set out in Appendix 02 issued together with this Circular.
3. The software of the radio broadcasting system applying information technology - telecommunications technology at provincial level and centrally governed cities:
a) Must meet the basic functional requirements set out in Appendix 03 issued together with this Circular and other guidelines of the Ministry of Information and Communications;
b) Must meet the basic requirements for information security set out in Appendix 04 issued together with this Circular.
4. Based on actual needs, village-level radio stations applying information technology - telecommunications technology may upgrade to meet the information dissemination and propaganda tasks of the locality but must ensure the requirements stipulated in Clauses 1, 2, and 3 of this Article.
Article 6. Connection requirements for radio stations applying information technology - telecommunications technology with wired radio stations and wireless FM radio stations
In cases where it is necessary to connect radio stations applying information technology - telecommunications technology with existing wired radio stations and wireless FM radio stations, automatic integration equipment must be used to meet the basic technical requirements set out in Appendix 01 issued together with this Circular.
Chapter III
CONNECTION MODEL AND DATA SHARING REQUIREMENTS FOR VILLAGE RADIO STATIONS APPLYING INFORMATION TECHNOLOGY - TELECOMMUNICATIONS TECHNOLOGY
Article 7. Connection model
Village-level radio stations applying information technology - telecommunications technology must comply with the connection model set out in Appendix 05 issued together with this Circular.
Article 8. Data sharing requirements
Data shared for village-level radio stations applying information technology - telecommunications technology must meet the basic requirements set out in Appendix 05 issued together with this Circular.
Chapter IV
INFORMATION SECURITY FOR PROVINCIAL AND CENTRALLY GOVERNED CITY RADIO BROADCASTING SYSTEMS APPLYING INFORMATION TECHNOLOGY - TELECOMMUNICATIONS TECHNOLOGY
Article 9. Ensuring information security
1. Provincial and centrally governed city radio broadcasting systems applying information technology - telecommunications technology must ensure information security in accordance with the provisions of the Law on Ensuring Information System Security Levels; Decree No. 85/2016/ND-CP dated July 1, 2016 of the Government on Ensuring Information System Security Levels; Circular No. 03/2017/TT-BTTTT dated April 24, 2017 of the Minister of Information and Communications detailing and guiding certain provisions of Decree No. 85/2016/ND-CP dated July 1, 2016 of the Government on Ensuring Information System Security Levels.
2. Provincial and centrally governed city radio broadcasting systems applying information technology - telecommunications technology must have a plan to ensure information security that meets the minimum security requirements at Level 2 as prescribed in Circular No. 03/2017/TT-BTTTT dated April 24, 2017 of the Minister of Information and Communications detailing and guiding certain provisions of Decree No. 85/2016/ND-CP dated July 1, 2016 of the Government on Ensuring Information System Security Levels and National Standard TCVN 11930:2017 on Information Technology - Security Techniques - Basic Requirements for Information System Security Levels.
Article 10. Information Security Monitoring
The information technology - telecommunications broadcasting system of provinces and centrally governed cities must have an information security monitoring plan that complies with the provisions set out in Circular No. 31/2017/TT-BTTTT dated November 15, 2017, issued by the Minister of Information and Communications on information system security monitoring activities.
Article 11. Information Security Inspection and Evaluation
1. The information technology - telecommunications broadcasting system of provinces and centrally governed cities must carry out information security inspection and evaluation in accordance with the provisions set out in Circular No. 03/2017/TT-BTTTT dated April 24, 2017, issued by the Minister of Information and Communications detailing and guiding certain articles of Decree No. 85/2016/NĐ-CP dated July 1, 2016, of the Government on ensuring information system security according to levels.
2. The information technology - telecommunications broadcasting system of provinces and centrally governed cities at level 3 or higher must conduct information security inspection and evaluation before putting it into operation.
Article 12. Information Security in Connection and Data Sharing
Central-level information systems and provincial-level information systems when connecting and sharing data with each other or with other components must have measures to ensure data security that meet the requirements for information security stipulated in Circular No. 03/2017/TT-BTTTT dated April 24, 2017, issued by the Minister of Information and Communications detailing and guiding certain articles of Decree No. 85/2016/NĐ-CP dated July 1, 2016, of the Government on ensuring information system security according to levels and National Standard TCVN 11930:2017 on information technology - security techniques - basic requirements for information system security according to levels.
Chapter V
RESPONSIBILITIES OF AUTHORITIES AND ORGANIZATIONS MANAGING COMMUNITY RADIO STATIONS APPLYING INFORMATION TECHNOLOGY - TELECOMMUNICATIONS
Article 13. Responsibilities of the Ministry of Information and Communications
1. Organize guidance and inspection of relevant agencies and units in implementing regulations on community radio stations applying information technology - telecommunications.
2. Organize provision of information and management of content of community radio stations applying information technology - telecommunications nationwide.
3. Take the lead and coordinate with people's committees at all levels in implementing information reporting and statistical systems on community radio stations applying information technology - telecommunications.
Article 14. Responsibilities of the People's Committee of Provinces
1. Organize construction and management of information technology - telecommunications broadcasting systems of the locality in accordance with this Circular and guidance from the Ministry of Information and Communications.
2. Organize provision of information and management of content of community radio stations applying information technology - telecommunications in the locality.
3. Implement information reporting and statistical systems on community radio stations applying information technology - telecommunications of the locality in accordance with guidance from the Ministry of Information and Communications.
Article 15. Responsibilities of the People's Committee of Districts
1. Organize construction and management of community radio stations applying information technology - telecommunications of the locality in accordance with this Circular and guidance from the competent state management agency at a higher level.
2. Organize provision of information and management of content of community radio stations applying information technology - telecommunications in the locality.
3. Implement information reporting and statistical systems on community radio stations applying information technology - telecommunications of the locality in accordance with guidance from the competent state management agency at a higher level.
Article 16. Responsibilities of the People's Committee at the commune level
1. To build, directly manage, operate, and run the activities of the commune-level radio station applying information and communication technology in accordance with this Circular and the guidance of the higher-level state management agency.
2. To ensure material conditions and technical equipment of the commune-level radio station applying information and communication technology comply with the provisions of this Circular.
3. To implement regular or ad hoc reporting on the activities of the commune-level radio station applying information and communication technology as required by the higher-level state management agency.
Chapter VI
IMPLEMENTING PROVISIONS
Article 17. Implementation Provisions
1. This Circular takes effect from January 18, 2021.
2. In cases where the commune-level radio station applying information and communication technology has been invested but does not comply with the provisions of this Circular, within twelve months from the date this Circular takes effect, relevant agencies and organizations shall apply, upgrade, and complete to ensure compliance with the provisions of this Circular.
Article 18. Implementation Organization
1. The Director of the Basic Information Agency under the Ministry of Information and Communications, the Heads of agencies and units under the Ministry of Information and Communications, the Directors of Provincial Departments of Information and Communications, and related agencies, organizations, and individuals are responsible for implementing this Circular.
2. During the implementation of this Circular, if there are any issues, agencies, organizations, and individuals shall promptly reflect them to the Ministry of Information and Communications (Basic Information Agency) for consideration and resolution./.
