CIRCULAR

Regulations on training, enhancement, knowledge updating, and issuance of appraisal practice certificates

Pursuant to the Price Law on June 19, 2023;

Pursuant to Decree No. 14/2023/NĐ-CP dated April 20, 2023 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Finance;

At the proposal of the Director of the Price Management Department;

The Minister of Finance issues this Circular to regulate training, enhancement, knowledge updating, and issuance of appraisal practice certificates.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular regulates training, enhancement, knowledge updating, and issuance of appraisal practice certificates for price appraisers and state price appraisal staff.

Article 2. Applicability

This Circular applies to individuals who wish to take the examination to obtain a Price Appraiser Card; holders of a Price Appraiser Card; price appraisers; state price appraisal staff; organizations conducting training, enhancement, and knowledge updating on price appraisal; state management agencies on price appraisal; other relevant agencies, organizations, and individuals involved in training, enhancement, and knowledge updating on price appraisal (hereinafter referred to as training, enhancement, and knowledge updating).

Article 3. Principles of Training, Enhancement, and Knowledge Updating

1. The curriculum, content, and duration of training, enhancement, and knowledge updating must be appropriate for the participants in the training, enhancement, and knowledge updating classes as stipulated in this Circular.

2. The content of training, enhancement, and knowledge updating must ensure continuous updates, improve quality, and meet the requirements of the participants in the training, enhancement, and knowledge updating classes.

3. Training, enhancement, and knowledge updating shall be organized in a centralized form. In cases of emergency situations, accidents, disasters, natural calamities, epidemics, or other necessary circumstances, the Ministry of Finance will announce that training, enhancement, and knowledge updating can be conducted through online forms.

4. The organization of training, enhancement, and knowledge updating must comply with the provisions of this Circular.

Article 4. Requirements for Training Organizations

When organizing training, enhancement, and knowledge updating, training organizations must meet the following requirements:

1. Have a teaching staff participating in training, enhancement, and knowledge updating who meet the following criteria:

a) Hold a bachelor's or postgraduate degree in a relevant field corresponding to the lecture topic;

b) Have at least five years of work experience directly related to the lecture topic;

c) Individuals who have participated in research, teaching related to the lecture topics at educational institutions or those who have worked in state management related to prices, appraisals, or domestic and foreign experts, price appraisers with appropriate qualifications and professional reputation as stipulated in this Circular.

2. Have plans, contents, curricula, and materials for training, enhancement, and knowledge updating that comply with the provisions of Articles 10, 11, 15, 16, and 20 of this Circular.

3. Must ensure material facilities serving the training, enhancement, and knowledge updating activities, including classrooms, desks, blackboards, teaching aids, and other necessary equipment (owned or leased). In cases where training, enhancement, and knowledge updating are conducted through online forms, material facilities (owned or leased) must be ensured to conduct such training, enhancement, and knowledge updating.

Article 5. Rights and responsibilities of training, upgrading, and updating knowledge units

1. Rights of training, upgrading, and updating knowledge units

a) Enrolling students and proactively implementing training, upgrading, and updating knowledge activities in accordance with the prescribed subjects under this Circular;

b) Collecting service fees from participants. The level of service fee collection for training, upgrading, and updating knowledge shall be decided by the head of the training, upgrading, and updating knowledge unit. The collection, management, utilization, and settlement of revenue from service fees for training, upgrading, and updating knowledge shall comply with the relevant laws;

c) Issuing Certificates of appraisal valuation vocational training, State Appraisal Valuation Upgrading Certificates, and confirming completion of knowledge updates on appraisal valuation vocational matters as stipulated in this Circular.

2. Responsibilities of training, upgrading, and updating knowledge units

a) Adhering to regulations on training, upgrading, and updating knowledge; assessing and evaluating learning outcomes, issuing Certificates of appraisal valuation vocational training, State Appraisal Valuation Upgrading Certificates, and confirming completion of knowledge updates on appraisal valuation vocational matters as stipulated in this Circular;

b) Strictly complying with reporting systems as stipulated in this Circular;

c) Implementing the process of collecting student feedback on class quality using the Evaluation Form as specified in Appendix I attached to this Circular;

d) Bearing full responsibility under the law for the accuracy and legality of training, upgrading, and updating knowledge results and certificates or confirmations issued by their own unit;

đ) Reissuing certificates or confirming completion of knowledge updates due to incorrect student information or non-compliance with certificate models prescribed by the Ministry of Finance, or in cases of loss or damage at the request of the student;

e) Not issuing certificates or confirming completion of knowledge updates to individuals not listed in the enrollment list, or those who participated in classes but did not meet the requirements as stipulated in this Circular;

g) Fully retaining all relevant files concerning the organization of training, upgrading, and updating knowledge as stipulated in Article 7 of this Circular;

h) Providing complete, accurate, and timely information, documents, and reports as required by competent state agencies regarding the organization of training, upgrading, and updating knowledge;

i) Being subject to inspection by the Ministry of Finance in the implementation of the provisions of this Circular.

Article 6. Reporting System for Training, Upgrading, and Updating Knowledge Activities

1. Training, upgrading, and updating knowledge units shall report periodically every quarter on the organization of training, upgrading, and updating knowledge on appraisal valuation of their own unit according to the following contents:

a) Report title: Report on the organization of training, upgrading, and updating knowledge on appraisal valuation Quarter I/II/III/IV;

b) Required report content: Decision to open each class; Decision recognizing the achievement of each class; List of students achieving the requirements of each class and receiving certificates or confirmation of completing knowledge updates according to the Model specified in Appendix II attached to this Circular; Schedule of each class including content and program;

c) Reporting entity: Training, upgrading, and updating knowledge units on appraisal valuation;

d) Receiving agency: Price Management Department;

đ) Method of sending and receiving reports: Delivering directly to the agency's office; or sending through postal services; or sending via email to [email protected] (scanned copy); or through specialized information reporting software system when it is established and operational;

e) Deadline for submitting reports: No later than the last day of the first month of the quarter immediately following the reported quarter;

g) Frequency of reporting: Quarterly;

h) Data closing date for reports: Last day of the reported quarter;

i) Report format: Specified in Appendix III attached to this Circular.

2. Training, upgrading, and updating knowledge units shall report annually on the organization of training, upgrading, and updating knowledge on appraisal valuation of their own unit according to the following contents:

a) Report title: Report on the situation and direction of training, upgrading, and updating knowledge activities in the year;

b) Required report content: Situation of organizing training, upgrading, and updating knowledge on appraisal valuation during the reported year;

c) Reporting entity: Training, upgrading, and updating knowledge units on appraisal valuation;

d) Receiving agency: Price Management Department;

đ) Method of sending and receiving reports: Delivering directly to the agency's office; or sending through postal services; or sending via email to [email protected] (scanned copy); or through specialized information reporting software system when it is established and operational;

e) Deadline for submitting reports: No later than January 31 of the year following the reported year;

g) Frequency of reporting: Annually;

h) Data closing date for reports: Last day of the reported year;

i) Report format: Specified in Appendix IV attached to this Circular.

3. Training, upgrading, and updating knowledge units shall submit ad hoc reports when requested by competent state agencies regarding the situation of organizing training, upgrading, and updating knowledge on appraisal valuation.

4. Training, upgrading, and updating knowledge units on appraisal valuation shall be responsible for the accuracy and truthfulness of the reports stipulated in Clause 1, Clause 2, and Clause 3 of this Article.

Article 7. Archiving training, enhancement, and knowledge update records

1. Training, enhancement, and knowledge update records stored at the Ministry of Finance include:

a) Quarterly reports on the organization of training, enhancement, and knowledge updates on valuation from the training, enhancement, and knowledge update units sent to the Ministry of Finance;

b) Annual reports on the operation situation and direction of training, enhancement, and knowledge updates from the training, enhancement, and knowledge update units sent to the Ministry of Finance;

c) Unexpected reports on the organization of training, enhancement, and knowledge updates on valuation from the training, enhancement, and knowledge update units sent to the Ministry of Finance.

2. Training, enhancement, and knowledge update records must be stored at the training, enhancement, and knowledge update units including:

a) Documents specified in Article 6 of this Circular;

b) Exams of trainees for valuation business training and state valuation enhancement;

c) Quality assessment forms for training, enhancement, and knowledge updates;

d) Other related documents (if any).

3. The storage form can be paper or electronic data. The retention period is ten (10) years for training organization records and five (5) years for enhancement and knowledge update organization records. The head of the valuation training, enhancement, and knowledge update unit shall be responsible for organizing the preservation, storage, and destruction of records in accordance with the law on archives.

Chapter II

TRAINING ON VALUATION BUSINESS

Article 8. Training Objectives

1. Individuals who wish to take the examination to obtain a valuation certificate.

2. Other subjects with a need to participate in valuation business training classes.

Article 9. Training Units

The following units that meet the requirements stipulated in Article 4 of this Circular may organize valuation business training:

1. Higher education institutions with majors in valuation training at the bachelor's level as prescribed by the law on education and training.

2. Units with functions of training and enhancing valuation business under the Ministry of Finance.

3. Professional associations on valuation.

Article 10. Forms of Organization, Content, and Training Program for Valuation Business

1. Valuation business training classes are organized in concentrated sessions continuously for one period or multiple periods but not exceeding three (3) months for one class and must ensure sufficient teaching and learning time, content, and program as prescribed in Clause 2 of this Article.

a) Valuation business training class includes five (5) subjects: Laws applicable in the field of valuation; Principles of market price formation and Basic principles of valuation; Real estate valuation; Tangible asset valuation 1 (Machine and equipment valuation); Tangible asset valuation 2 (Intangible asset and other tangible asset valuation);

b) Enterprise valuation business training class includes the subjects specified in point a of this clause and two (2) additional subjects: Corporate financial analysis; Enterprise valuation;

c) The duration of a training class specified in point a of Clause 2 of this Article is 116 hours, while the training class specified in point b of Clause 2 of this Article is 160 hours, excluding review time and examination results as prescribed in Article 11 of this Circular;

d) Trainees who have achieved satisfactory results in the training class specified in point a of Clause 2 of this Article are allowed to supplement their studies to complete the program of the training class specified in point b of Clause 2 of this Article.

3. A maximum of 150 trainees per valuation business training class.

4. The training organization unit shall compile training materials for valuation business according to the framework program for training and enhancement on valuation as prescribed in Appendix V issued together with this Circular; at the same time, they are responsible for updating new contents and regulations related to the field of prices and valuation during the teaching process.

Article 11. Examination and Assessment of Learning Results

1. At the end of the professional appraisal training course, the training unit must organize an examination and assessment of learning results. The content of the examinations must reflect the basic knowledge of each subject in the curriculum:

a) For the training classes specified in points a and b, Clause 2, Article 10 of this Circular, the examination will be conducted through two (2) written tests; the common knowledge test lasts for 120 minutes, while the professional knowledge test lasts for 150 minutes;

b) For trainees as stipulated in point d, Clause 2, Article 10 of this Circular, they must complete one (1) written test lasting 150 minutes for additional subjects.

2. Marks for the examinations will be scored on a scale of ten (10). A test with less than five (5) marks is considered to not meet the requirements.

3. Trainees who do not attend at least eighty percent (80%) of the time allocated for each subject according to the regulations will not be allowed to participate in the examination and assessment of learning results for that subject and must retake the missing subject.

4. In cases where trainees cannot attend the examination and assessment of learning results due to maternity leave, accidents, illness, or other special reasons (as evidenced by a hospital certificate), the trainee must submit a request for postponement of the examination and obtain approval from the Head of the Training Unit.

5. Trainees whose test scores do not meet the requirements and those who have not taken the test due to special reasons as stipulated in Clause 4 of this Article have the right to retake each test once. The time for organizing the retake for these trainees shall be decided by the Head of the Training Unit but shall not exceed six (6) months from the date of completion of the training class.

Article 12. Certificate of Professional Appraisal Training

1. Trainees who achieve a score of five (5) or higher on each test are deemed to have met the requirements of the course and are eligible to receive a Certificate of Professional Appraisal Training for Assets or a Certificate of Professional Appraisal Training for Enterprises, depending on the program they participated in.

Trainees who have been issued a Certificate of Professional Appraisal Training for Assets may supplement their studies to complete the program specified in point b, Clause 2, Article 10 of this Circular to obtain a Certificate of Professional Appraisal Training for Enterprises.

2. The Head of the Training Unit (or a deputy authorized by the Head of the Training Unit) signs and issues the Certificate of Professional Appraisal Training. The Certificate of Professional Appraisal Training shall follow the Model prescribed in Appendix VI attached to this Circular and must bear the learner's photograph seal.

3. The Certificate of Professional Appraisal Training for Assets is one of the conditions for registering to take the examination for obtaining an Appraisal License in the field of asset appraisal. The Certificate of Professional Appraisal Training for Enterprises is one of the conditions for registering to take the examination for obtaining an Appraisal License in the field of asset appraisal or for registering to take the examination for obtaining an Appraisal License in the field of enterprise appraisal.

The Certificate of Professional Appraisal Training is also a condition for officials, civil servants, employees, and workers under the management and use authority of the entity establishing the Appraisal Board to participate in the Appraisal Board as stipulated in Article 60 of the Price Law.

4. Cases of reissuing Certificates due to loss, damage caused by natural disasters, enemy actions, or other force majeure reasons shall be reviewed and decided by the training unit, but it must clearly state that the Certificate is a reissued one and bear responsibility under the law for such reissuance.

Chapter III

STATE APPRAISAL TRAINING

Article 13. Recipients of training

1. State asset valuation officers.

2. Other subjects within state agencies and individuals requiring state asset valuation training.

Article 14. Training Units

Units under the Ministry of Finance with the function of training and providing asset valuation business training that meet the requirements stipulated in Clause 2 of Article 4 of this Circular shall organize state asset valuation training.

Article 15. Forms of Organization, Content, and Program of State Asset Valuation Training

1. A state asset valuation training class must be organized as a continuous period, ensuring sufficient teaching and learning time, content, and program as prescribed in Clause 2 of this Article.

2. The duration of a training class is set at 40 hours, excluding review and examination time as prescribed in Article 16 of this Circular.

3. A state asset valuation training class may have a maximum of 150 trainees.

4. The unit organizing state asset valuation training must compile training materials according to the framework curriculum for asset valuation training as specified in Appendix V attached to this Circular; simultaneously, they are responsible for updating new contents and regulations related to the price and asset valuation fields (including state asset valuation) during the teaching process.

Article 16. Examination and Evaluation of Learning Outcomes

1. At the end of the state asset valuation training class, the training unit must organize an examination and evaluation of learning outcomes. The examination will be conducted through one (1) essay (either subjective or multiple choice, decided by the head of the training unit) within a maximum of 150 minutes covering both general knowledge and specialized knowledge. The examination content must reflect the basic knowledge of each topic in the training program.

2. The examination score is graded on a scale of ten (10). An examination score below five (5) points is considered unsatisfactory.

3. Trainees who do not ensure a minimum attendance rate of eighty percent (80%) of the required time for each topic as stipulated must retake the missed topics and are not eligible to participate in the examination and evaluation of learning outcomes.

4. In special cases where trainees cannot attend the examination and evaluation of learning outcomes, they must submit a request for postponement of the examination and obtain approval from the head of the training organization unit.

5. Trainees with unsatisfactory examination scores and those unable to attend the examination due to special reasons as stipulated in Clause 4 of this Article have the right to retake the examination once. The time for organizing the retake examination for these trainees is determined by the head of the training unit but shall not exceed six (6) months from the date of completion of the training class.

Article 17. Certificate of State Asset Valuation Training

1. Trainees with examination scores of five (5) points or higher are deemed to have met the course requirements and are entitled to receive a Certificate of State Asset Valuation Training.

2. The head of the training unit (or a deputy authorized by the head of the training unit) signs and issues the Certificate of State Asset Valuation Training. The Certificate of State Asset Valuation Training follows the Model specified in Appendix VI attached to this Circular and must bear the trainee's photograph stamp.

3. Cases of reissuing Certificates due to loss, damage, destruction by natural disasters, enemy actions, or other force majeure reasons are reviewed and decided by the training unit, but must clearly indicate that it is a reissued certificate and bear responsibility under the law for such reissuance.

4. Holders of the Certificate of State Asset Valuation Training are eligible to participate in asset valuation boards as stipulated in Article 60 of the Price Law.

Members of state asset valuation boards are responsible for proactively updating their professional knowledge in asset valuation through their official duties and through at least one of the following methods:

a) Participating in annual conferences disseminating legal documents on asset valuation or asset valuation training sessions organized by the Ministry of Finance. Minimum participation time: one conference/year;

b) Participating in annual asset valuation knowledge training classes organized by units as stipulated in Article 14 of this Circular. Minimum participation time: one class/year.

Chapter IV

UPDATING KNOWLEDGE ON ASSET VALUATION BUSINESS

Article 18. Subjects for Knowledge Update

1. Appraisers, except in cases where the appraisal appraiser card has been issued for less than one year as of the date of registration to practice.

2. Other subjects with requirements.

Article 19. Units for Knowledge Update

1. Centers with functions to train appraisal skills under the Ministry of Finance and professional associations on appraisal that meet the organizational training, development, and knowledge update requirements stipulated in Clause 4 of this Circular shall organize knowledge updates on appraisal skills.

2. Prior to opening the first knowledge update class on appraisal skills in a year, units specified in Clause 1 of this Article must send a notification letter to the Ministry of Finance regarding their own knowledge update on appraisal skills.

Article 20. Forms of Organization, Content, Materials, and Duration of Knowledge Updates on Appraisal Skills

1. The knowledge update class on appraisal skills shall be organized in a continuous period and must ensure sufficient time, content, and materials as prescribed in Clauses 2 and 3 of this Article and the annual content update guidelines announced by the Ministry of Finance. Each knowledge update class shall not exceed 150 participants.

2. Content of Knowledge Update

a) Legal provisions on prices, appraisals, and other relevant laws related to appraisal activities in Vietnam and internationally;

b) Appraisal skills, experiences, scenarios, and professional ethics;

c) Other knowledge and information related to appraisals.

3. Knowledge update materials shall be compiled by the unit organizing the knowledge update class and must contain basic contents as prescribed in Clause 2 of this Article. The unit organizing the knowledge update is responsible for regularly updating new contents and regulations related to the price and appraisal fields during the teaching process.

4. The minimum annual duration of knowledge update is 20 hours/year for asset appraisal and 24 hours/year for business appraisal. In cases where participants have attended knowledge update classes but have not met the required number of hours, they must attend additional classes from the same knowledge update unit to make up the required hours, but not exceeding two classes/year.

Article 21. Confirmation of Completion of Knowledge Update on Appraisal Skills

1. Participants who have attended the required number of hours of knowledge update as stipulated in Clause 4 of Article 20 of this Circular shall be confirmed to have completed the knowledge update on appraisal skills in the field of asset appraisal or business appraisal.

The head of the knowledge update unit (or a deputy authorized by the head of the knowledge update unit) shall sign and issue the confirmation of completion of knowledge update on appraisal skills.

2. The confirmation of completion of knowledge update on appraisal skills stipulated in Clause 1 of this Article is one of the conditions for appraisers to register to practice appraisal in the field of asset appraisal or business appraisal from the date of issuance of the confirmation of completion of knowledge update on appraisal skills until December 31 of the following year.

3. In cases where appraisers participating in the ASEAN Appraiser Conference obtain a certificate of attendance at the conference, such certificate shall replace the confirmation of completion of knowledge update on appraisal skills when registering to practice appraisal.

Chapter V

IMPLEMENTATION

Article 22. Responsibilities of the Ministry of Finance in managing training, upgrading, and updating knowledge on valuation

1. Receiving and compiling data and reports on training, upgrading, and updating knowledge on valuation activities from training units, upgrading units, and knowledge updating units.

2. Announcing the direction of content for updating knowledge on valuation practices for the upcoming year before December 31 each year.

3. Periodically or unexpectedly, the Ministry of Finance (Price Management Department) will conduct inspections on the organization of training, upgrading, and updating knowledge on valuation by training, upgrading, and knowledge updating units; handling violations according to the provisions of the law.

Article 23. Transitional Provisions

1. The training certificate and upgrading certificate for specialized valuation business issued in accordance with Decision No. 87/2008/QD-BTC dated October 22, 2008, of the Minister of Finance shall be recognized as the training certificate for valuation business operations in accordance with this Circular.

2. The training certificate for valuation business, and the upgrading certificate for specialized valuation business issued in accordance with Circular No. 204/2014/TT-BTC dated December 23, 2014, of the Minister of Finance on training and upgrading specialized valuation business and Circular No. 11/2019/TT-BTC dated February 20, 2019, of the Minister of Finance amending and supplementing some articles of Circular No. 204/2014/TT-BTC shall be recognized as the training certificate for valuation business operations and the upgrading certificate for state valuation in accordance with this Circular.

3. Training and upgrading classes on valuation that have class opening decisions made before the effective date of this Circular shall continue to implement training, upgrading, and issuing training certificates and upgrading certificates in accordance with Circular No. 204/2014/TT-BTC dated December 23, 2014, of the Minister of Finance on training and upgrading specialized valuation business and Circular No. 11/2019/TT-BTC dated February 20, 2019, of the Minister of Finance amending and supplementing some articles of Circular No. 204/2014/TT-BTC.

Article 24. Effective Date

1. This Circular takes effect from July 1, 2024.

2. Circular No. 204/2014/TT-BTC dated December 23, 2014, of the Minister of Finance on training and upgrading specialized valuation business and Circular No. 11/2019/TT-BTC dated February 20, 2019, of the Minister of Finance amending and supplementing some articles of Circular No. 204/2014/TT-BTC dated December 23, 2014, of the Minister of Finance on training and upgrading specialized valuation business shall cease to be effective from the date this Circular takes effect.

3. During implementation, if there are difficulties or obstacles, please promptly report them to the Ministry of Finance for research and appropriate amendments and supplements.
