Pursuant to Decree No. 36/2012/NĐ-CP dated April 18, 2012, of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Based on Decree No. 83/2012/NĐ-CP dated October 9, 2012, of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Inspectorate;

Considering the proposal of the Organization and Cadre Affairs Department Director and the Legal Affairs Department Director,

DECISION:

Article 1. This Decision promulgates the "Regulations on Functions, Tasks, Powers, and Organization and Operation of the Supervision, Audit, and Post-Investigation Handling Department" attached hereto.

Article 2. This Decision takes effect from the date of issuance.

Article 3. The Director of the Office, the Directors of the Organization and Cadre Affairs Department and the Supervision, Audit, and Post-Investigation Handling Department, and the Heads of units under the Government Inspectorate shall be responsible for implementing this Decision./.

REGULATIONS

FUNCTIONS, TASKS, POWERS AND ORGANIZATION AND OPERATIONS OF THE SUPERVISION, AUDIT, AND POST-INVESTIGATION HANDLING DEPARTMENT

Chapter 1.

FUNCTIONS, TASKS, AUTHORITIES, AND WORKING PRINCIPLES

Article 1. Position and Functions

The Supervision, Audit, and Post-Investigation Handling Department has the function of assisting the Government Inspector General to supervise and inspect the activities of inspection teams; audit draft inspection conclusions prepared by inspection teams; monitor, urge, and inspect agencies, organizations, and individuals in implementing inspection conclusions, recommendations, and decisions on handling inspections issued by the Government Inspectorate and the Prime Minister regarding cases reported by the Government Inspectorate.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Take the lead in drafting and submitting to the Government Inspector General for issuance of legal normative documents on supervision and inspection of inspection teams' activities; post-inspection urging, inspection, and handling activities; and guidance and inspection of ministries, sectors, and localities in their implementation.

2. Assist the Government Inspector General in supervising inspection teams of the Government Inspectorate according to the Regulation on Supervision and Inspection of Inspection Teams' Activities of the Government Inspectorate.

3. Assist the Government Inspector General in inspecting the activities of inspection teams to examine and clarify complaints or signs of law violations related to the Chief Inspector or members of the inspection team for handling in accordance with the law.

4. Audit draft inspection conclusions prepared by inspection teams before the Government Inspector General signs and issues the inspection conclusion.

5. Monitor, urge, and inspect agencies, organizations, and individuals in implementing inspection conclusions, recommendations, and decisions on handling inspections issued by the Government Inspectorate and the Prime Minister regarding cases reported by the Government Inspectorate.

6. Study and propose inspections and audits to clarify contents implemented by inspection teams of the Government Inspectorate that show signs of lacking accuracy and legality.

7. Summarize the results of implementing inspection conclusions, recommendations, and decisions on handling inspections conducted by the Government Inspectorate.

8. Summarize practical experience; participate in theoretical and operational research on inspections, complaint resolution, prevention, and anti-corruption efforts; propose amendments and supplements to mechanisms, policies, and laws.

9. Perform administrative reform tasks, international cooperation, and scientific research as assigned by the Government Inspector General.

10. Manage civil servants and assets allocated in accordance with the law and the delegation of the Government Inspector General.

11. Perform other tasks assigned by the Government Inspector General.

Article 3. Principles of Operation

1. The Supervision, Audit, and Post-Investigation Handling Department operates under a chief executive system, ensuring democratic centralism, transparency, and openness in accordance with the law; emphasizing individual responsibility and discipline, leveraging strengths and initiative, creativity in the work of officials and civil servants, and effectiveness in departmental operations.

2. When directly participating in supervising and inspecting the activities of inspection teams, resolving complaints, and handling appeals, staff members of the Department must comply with the "Regulation on Supervision and Inspection of Inspection Teams' Activities" issued by the Government Inspector General.

Chapter 2.

ORGANIZATIONAL STRUCTURE, RESPONSIBILITIES, AND SCOPE OF WORK HANDLING

Article 4. Organizational Structure and Staffing

1. The organizational structure of the Department for Supervision, Audit, and Post-Investigation Handling includes:

a) The leadership of the Department consists of the Director and Deputy Directors.

b) Departments under the Department:

- The Department for Supervision, Audit, and Post-Investigation Handling of Economic Sectors and Localities in Region 1 (referred to as Business Affairs Department I);

- The Department for Supervision, Audit, and Post-Investigation Handling of Internal Affairs, Comprehensive Economy, and Localities in Region 2 (referred to as Business Affairs Department II);

- The Department for Supervision, Audit, and Post-Investigation Handling of Cultural, Social, and Localities in Region 3 (referred to as Business Affairs Department III).

2. Specific tasks and authorities of each department shall be defined by the Director.

3. The staffing of the Department for Supervision, Audit, and Post-Investigation Handling shall be decided by the Chief Inspector General based on the proposal of the Director of the Department for Organization and Cadres and the Director of the Department for Supervision, Audit, and Post-Investigation Handling.

Article 5. Responsibilities and Scope of Work of the Director

1. Lead, direct, and organize the implementation of the Department's tasks as stipulated in Article 2 of this Regulation and other tasks assigned by the leadership of the Inspectorate General; bear responsibility before the law and the Chief Inspector General for the results of the assigned work.

2. Delegate tasks, coordinate activities, and monitor the implementation of tasks by Deputy Directors, departments under the Department, and staff members within the Department.

3. Propose the dispatch of civil servants to participate in supervising and inspecting the activities of inspection teams of the Inspectorate General, after consultation with the Director of the Department for Organization and Cadres.

4. Coordinate with the Director, Bureau Chiefs, and heads of other units under the Inspectorate General to handle issues related to the Department's functions and tasks and implement the common tasks of the agency as stipulated in the Inspectorate General's Working Regulations.

5. Manage cadres and civil servants and assets allocated according to the law and the delegation of the Chief Inspector General; maintain work discipline, manage, evaluate, and implement commendation and reward systems, policies, and regulations for cadres and civil servants within the Department; develop and implement cadre planning, training, and development plans for cadres and civil servants within the Department.

6. Perform tasks delegated by the Chief Inspector General; sign on behalf when authorized to issue certain documents within the authority of the Chief Inspector General as stipulated in the Inspectorate General's Working Regulations.

7. Fully comply with information and reporting systems as prescribed by the Inspectorate General. Report promptly to the Inspectorate General's leadership on the results of work and propose issues requiring resolution, mechanisms, policies, programs, and work plans that need revision and supplementation to meet the requirements of the Inspectorate General and the Government.

8. Perform other tasks assigned by the Chief Inspector General.

Article 6. Responsibilities and Scope of Work of Deputy Directors

1. Assist the Director in managing and operating the Department's work; directly manage some areas of work according to the Director's assignment. When necessary, a Deputy Director may be entrusted by the Director to oversee the Department's activities.

2. Carry out tasks and authorities within the scope assigned and delegated by the Director. Report to the Director on the situation and results of the assigned and delegated tasks.

3. Bear personal responsibility before the Director, the Inspectorate General's leadership, and the law for proposals, progress, quality, and effectiveness of tasks performed, content, form, format, procedures, and processes for issuing documents and handling assigned tasks.

4. Sign on behalf of the Director for documents authorized by the Director.

Article 7. Responsibilities and scope of work for the Head of Department and Deputy Head of Department

1. The Head of Department directly leads, directs, manages, and oversees the activities of the Department and is responsible to the Director of Bureau, the Deputy Director in charge, and the law for the performance of assigned tasks.

2. The Deputy Head of Department assists the Head of Department and is responsible to the Head of Department, Bureau Leadership, and the law for the field of work assigned; performs other tasks directly assigned by Bureau Leadership; when necessary, may be delegated by the Head of Department to manage the activities of the Department.

3. Specific tasks of the Head of Department and Deputy Head of Department within the Bureau shall be assigned by the Director of Bureau.

Article 8. Responsibilities and scope of work for officials and civil servants under the Bureau

1. Adhere to labor discipline, regulations of the Government Inspectorate, and the Bureau.

2. Proactively study and advise on the specialized field assigned; resolve assigned tasks according to prescribed procedures, formalities, and deadlines. Report promptly to the direct supervisor when encountering difficulties or new issues during task execution.

3. Adhere to speaking discipline, Code of Conduct for officials and civil servants in the Inspection sector, Work Regulations, Office Culture Rules of the Government Inspectorate, and other regulations concerning officials and civil servants; implement reporting systems, file management systems as stipulated by the Government Inspectorate. Be personally responsible to the Head of Department, the Director of Bureau, and the law regarding proposed opinions, progress, quality, effectiveness of task execution, content, form, format, procedure, and formalities of issued documents and the process of resolving assigned tasks.

4. Officials and civil servants under the Bureau who are tasked with supervising and inspecting the activities of inspection teams must strictly implement the Supervision and Inspection Regulation for Inspection Team Activities; regularly report to the Director of Bureau on the progress and results of supervision and inspection.

Chapter 3.

WORK RELATIONSHIP OF THE BUREAU

Article 9. Implementing the directives of the Government Inspectorate's leadership

The Bureau is subject to leadership and direction from the Chief Inspector General, Deputy Chief Inspector General; it has the responsibility to earnestly perform assigned tasks, promptly report to the Inspectorate General Leadership on the results of task execution as prescribed; when necessary, propose recommendations to the Inspectorate General Leadership regarding issues that need resolution during task execution.

Article 10. Relations with departments, bureaus, and units under the Government Inspectorate

1. The relationship between the Bureau for Supervision, Evaluation, and Post-Inspections and other bureaus, departments, units under the Inspectorate General is one of coordination, exchange, and mutual support to effectively complete tasks.

2. Coordination with other bureaus, departments, units in performing tasks shall be carried out in accordance with the Working Regulation of the Inspectorate General issued by the Chief Inspector General.

Article 11. Relationship with Sectoral, Ministry, and Local Inspectors

1. Guide, inspect, and monitor the implementation of supervision and inspection of inspection team activities, post-inspection handling by Sectoral, Ministry, and Local Inspectors; quarterly, proactively coordinate with relevant departments to follow up on areas and sectors working with Sectoral, Ministry, and Local Inspectors to fully understand their general activities and specific supervision and inspection of inspection team activities, post-inspection handling.

2. Promptly reflect to the Chief Inspector General or Deputy Chief Inspector General in charge any requests or recommendations from Sectoral, Ministry, and Local Inspectors for the Inspectorate General Leadership to consider and resolve.

Article 12. Work relations between the Department's leadership and the Party committee and leadership of mass organizations

1. The Department's leadership shall create conditions for the Party organization and mass organizations to operate in accordance with their charters, purposes, and objectives; coordinate with the Party committee and leadership of mass organizations to create conditions for Party members, officials, and civil servants within the Department to study and improve their political and professional qualifications, work effectively and at high quality; ensure democratic regulations in the operation of the agency, build office culture and administrative discipline.

2. The Department's leadership shall be responsible for providing full and timely information about the Department's activities and the rights of officials and civil servants to the Party committee and leadership of mass organizations; seek opinions from the Party committee and leadership of mass organizations before making decisions on matters related to political ideological education leadership, internal protection, strengthening unity, caring for the lives of officials and civil servants within the Department; and organizational and personnel work within the Department.

Chapter 4.

IMPLEMENTATION

Article 13. Responsibility for Implementation

1. The Director, Deputy Directors, Heads, and Deputy Heads of the Department of Supervision, Audit, and Post-Audit Handling, as well as all officials and civil servants of the Department, shall be responsible for implementing this Regulation.

2. Matters related to the functions, tasks, powers, and organization of the Department that are not covered in this Regulation shall be implemented according to the Working Regulations of the Government Inspectorate, the Supervision and Inspection Regulations for the Inspection Delegation, and current laws and regulations regarding inspection, complaints, denunciations, and anti-corruption.

4. Based on current regulations and this Regulation, the Director of the Department of Supervision, Audit, and Post-Audit Handling shall be responsible for formulating and promulgating the Working Regulations of their unit.

Article 14. Amendment and Supplement to the Regulation

The Director of the Department of Supervision, Audit, and Post-Audit Handling and the Director of the Department of Organization and Cadres shall be responsible for monitoring, inspecting, and urging the implementation of this Regulation; compiling comments and promptly researching proposals for supplementing and amending the Regulation in accordance with the requirements of the Department of Supervision, Audit, and Post-Audit Handling and the Government Inspectorate.
