Pursuant to the Law on Organization of the Government dated December 25, 2001;

Based on the Land Law dated November 26, 2003;

Pursuant to the Forest Protection and Development Law dated December 3, 2004;

Pursuant to Resolution of the National Assembly No. 57/2006/QH11 dated June 29, 2006;

Considering the proposal of the Government Office,

DECISION:

Article 1. Organizing the review and inspection of the current status of land planning, planning, and utilization management for the 2006-2010 period nationwide, including the review and inspection of the current status and management work of agricultural land planning, planning, and utilization for the 2006-2010 period generally and specifically paddy fields, ensuring the following objectives and requirements:

1. Strictly managing the national agricultural land fund, especially paddy fields and food crops to ensure national food security and stabilize and develop the country's economy and society.

2. Using agricultural land resources for their intended purposes, protecting agricultural production land from pollution by hazardous industrial waste, preventing desertification, soil degradation, and flooding caused by non-agricultural production activities; ensuring that agricultural land has the necessary conditions to produce clean food and meet domestic consumption needs and export demands.

3. Minimizing the conversion of paddy fields to non-agricultural uses. Not approving plans to convert specialized paddy fields to non-agricultural production and service activities in areas where other types of land can be utilized.

In cases where it is necessary to convert agricultural land, especially paddy fields, to non-agricultural uses or for projects affecting adjacent agricultural production areas, measures must be taken to ensure efficient land use and safety for agricultural production during project implementation. At the same time, provincial People's Committees must report to the Prime Minister before approving such projects.

Article 2. The content of the review and inspection of the current status of land planning, planning, and utilization management for the 2006-2010 period nationwide, including the review and inspection of the current status of agricultural land planning, planning, and utilization management for the 2006-2010 period generally and specifically paddy fields.

1. Entrusting the Ministry of Natural Resources and Environment to lead and coordinate with the Ministry of Agriculture and Rural Development, the Ministry of Finance, the Ministry of Planning and Investment, the Government Office, the General Statistics Office, and inviting the Economic Committee of the National Assembly to participate in forming a working group to implement the following tasks:

- Based on Resolution No. 57/2006/QH11 dated June 29, 2006 of the National Assembly on the plan for land use for the 2006-2010 period nationwide and the Government's resolution on adjusting the land use planning until 2010 and the five-year plan (2006-2010) for each province, the working group will conduct inspections and comparisons with reports on the review and inspection of the current status of land planning, planning, and utilization management for the 2006-2010 period, including the review and inspection of the current status of agricultural land planning, planning, and utilization management for the 2006-2010 period generally and specifically paddy fields in each province; summarizing the results and reporting to the Prime Minister.

- The working group will select key provinces for agricultural production in the three regions (North, Central, South), choosing five provinces per region; coordinating with the People's Committees of these provinces to conduct reviews and inspections of the current status of land planning, planning, and utilization management for the 2006-2010 period, including the review and inspection of the current status of agricultural land planning, planning, and utilization management for the 2006-2010 period generally and specifically paddy fields.

Particularly, it is necessary to review and inspect the current status of land planning, planning, and utilization management for the 2006-2010 period, including the review and inspection of the current status of agricultural land planning, planning, and utilization management for the 2006-2010 period generally and specifically paddy fields at the district and commune levels in these key provinces, serving as a basis for comparison with the overall review and inspection results nationwide, and reporting to the Prime Minister for submission to the National Assembly.

2. Resolutely reclaiming land due to violations of land laws.

- Provincial People's Committees have the responsibility to inspect the land use situation of agencies, units, enterprises, and investment projects under their jurisdiction, identify and resolutely reclaim land areas that have been allocated or leased but not used or used late compared to project schedules, inefficiently used, or used for improper purposes; in cases with valid reasons, decisions to extend the usage period should be made and publicly announced.

- Ministries, ministerial-level agencies, government agencies, economic groups, and State-owned corporations have the responsibility to review the land areas allocated or leased by the state to subordinate agencies, units, and enterprises under their management, and proactively transfer unused or poorly utilized land areas to provincial and centrally-administered city authorities. Ministries and sectors shall not interfere in local authorities' land reclamation actions concerning units under their jurisdiction that violate land management and utilization laws.

Article 3. Entrusting the Ministry of Planning and Investment (General Statistics Office) with the responsibility to determine, classify criteria, select samples, and prepare statistical tables to serve the specific review and inspection work on the implementation of agricultural land planning, planning, and utilization management in accordance with the content and requirements stipulated in this Decision..

Article 4. The Chairperson of the People's Committees of provinces and centrally governed cities shall direct all levels and sectors within their respective provinces and cities to strictly review and inspect the actual status of land planning, plans, and usage for the five-year period from 2006 to 2010, including the review and inspection of the actual status of agricultural land management, planning, and usage for the five-year period from 2006 to 2010, generally and specifically for irrigated rice fields under their local jurisdiction, in comparison with Resolution No. 57/2006/QH11 dated June 29, 2006 of the National Assembly on the land use plan for the five-year period from 2006 to 2010 nationwide and the Government's Resolution on the land use plan for the five-year period from 2006 to 2010 for each province and city; report to the Ministry of Natural Resources and Environment for consolidation and reporting to the Prime Minister.

The Chairperson of the People's Committees of provinces and centrally governed cities shall be responsible for coordinating with the Working Group to strictly implement the contents of this Decision.

Article 5. Time of Implementation:

The Minister of Natural Resources and Environment shall direct the strict and urgent implementation of the contents of this Decision, summarize and report to the Prime Minister in the third quarter of 2008.

Article 6. The Ministry of Planning and Investment and the Ministry of Finance shall balance and supplement the budget to ensure the implementation of the contents of this Decision.

Article 7. This Decision shall take effect from the date of signing.

The Ministers of Natural Resources and Environment, Agriculture and Rural Development, Planning and Investment, Finance, Heads of ministerial-level agencies equivalent to ministries, and agencies directly under the Government, and the Chairpersons of the People's Committees of provinces and centrally governed cities shall be responsible for enforcing this Decision./.
