Pursuant to Decree No. 49/2003/NĐ-CP dated May 15, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
Pursuant to Decision No. 389/BYT-QĐ dated May 17, 1980 of the Minister of Health on the establishment of the Ho Chi Minh City Dental Institute and Decision No. 2218/QĐ-BYT dated June 18, 2003 on renaming the Ho Chi Minh City Dental Institute to the National Odonto-Stomatology Hospital in Ho Chi Minh City;
At the proposal of the Director of the Department of Organization and Cadres of the Ministry of Health;

Pursuant to …;

Article 1. The attached Decision promulgates the Regulations on the Organization and Operations of the National Odonto-Stomatology Hospital in Ho Chi Minh City.

Article 2. This Decision takes effect from the date of signature and issuance. All previous regulations contrary to this Decision are hereby abolished.

Article 3. The following officials are responsible for implementing this Decision: the Heads of the Office, Inspectorate, Department of Organization and Cadres, other Departments, relevant Bureaus under the Ministry of Health, the Director of the National Odonto-Stomatology Hospital in Ho Chi Minh City, and the Heads of related units.

 

 

CHARTER

ORGANIZATION AND OPERATIONS OF THE NATIONAL ODONTO-STOMATOLOGY HOSPITAL IN HO CHI MINH CITY
(Issued pursuant to Decision No. 3959/2004/QĐ-BYT dated November 9, 2004 of the Minister of Health)

Chapter 1.

GENERAL PROVISIONS

Article 1. The National Odonto-Stomatology Hospital in Ho Chi Minh City (formerly known as the Ho Chi Minh City Dental Institute) was established according to Decision No. 389-BYT/QĐ dated May 17, 1980 of the Minister of Health, reorganized according to Decree No. 49/2003/NĐ-CP dated May 15, 2003 of the Prime Minister, and renamed according to Decision No. 2218/QĐ-BYT dated June 18, 2003 of the Minister of Health. The hospital is a public service unit directly under the Ministry of Health, having legal personality, seal, and bank account as prescribed by law, with its headquarters located in Ho Chi Minh City.

Article 2. Party and mass organizations within the hospital:

1. The Communist Party organization within the hospital leads the hospital's activities according to the functions and tasks of the Party organization, Party directives, resolutions, and state laws.

2. Other political and social organizations, occupational social organizations within the hospital are established and operate under the leadership of the Party in accordance with the law, responsible for coordinating with the administration to fulfill the hospital's political tasks and perform the functions and tasks of mass organizations and occupational social organizations as determined.

Chapter 2.

FUNCTIONS, TASKS, POWERS, AND SERVICE OBJECTIVES OF THE HOSPITAL

Article 3. The National Odonto-Stomatology Hospital in Ho Chi Minh City has the function of examining, providing emergency care, treating, preventing diseases, and restoring functions for children and adults at the highest specialized level; conducting scientific research; training personnel; directing lower levels; and international cooperation in the field of odonto-stomatology.

Article 4. The hospital has the following tasks:

1. Examining, providing emergency care, treating, and restoring functions in the field of odonto-stomatology for children and adults at the highest level.

a. Receiving examinations, providing emergency care, inpatient and outpatient treatments for cases exceeding the treatment capacity of provincial hospitals. Patients seeking examination and treatment upon request, including foreign patients.

b. Participating in medical and forensic examinations as prescribed by law.

c. Restoring functions for children with congenital malformations or acquired diseases after treatment at the hospital and in the community.

2. Preventing dental diseases - Directing lower levels in technical expertise:

a. Developing and directing the network of odonto-stomatology facilities in southern provinces and centrally-administered cities from Da Nang to Ca Mau according to the Ministry of Health's directives.

b. Formulating plans for preventing dental diseases and community dental programs to be submitted to the Minister of Health for approval.

c. Organizing the implementation of programs to strengthen oral health and national school dental programs.

d. Formulating guidelines for treating dental and maxillofacial diseases to be submitted to the Minister of Health for approval and directing lower levels to implement them in accordance with regulations.

đ. Assisting lower levels in improving the quality of emergency care, diagnosis, and treatment of diseases within the scope of specialization in local areas.

e. Organizing educational and communication activities through mass media to promote oral health care and services for the people.

3. Scientific Research:

a. Studying the changing health status and disease patterns of the population in the field of odonto-stomatology. Proposing strategic directions, community intervention plans, and treatment guidelines to improve preventive measures, treatment quality, and the quality of dental healthcare services serving the health of the population.

b. Researching and applying advancements in clinical, paraclinical, and maxillofacial surgery techniques in the field of dentistry.

c. Researching domestic materials, tools, and medications used in specialization. Conducting quality control of products used in the field of odonto-stomatology according to the Ministry of Health's directives.

d. Cooperating with other specialties in the implementation of related scientific research topics.

đ. Participating in the development of hospital technical procedures in the field of odonto-stomatology to be submitted to the Ministry of Health for approval.

4. Training specialized personnel in odonto-stomatology.

a. The hospital serves as a practical training base for undergraduate and postgraduate doctors specializing in odonto-stomatology; dental nursing, dental prosthetic technician training at secondary, college, university, and postgraduate levels.

b. Participating in teaching and training secondary, college, university, and postgraduate human resources in odonto-stomatology both domestically and internationally.

c. Organizing refresher courses and updating knowledge in odonto-stomatology for hospital staff and lower-level staff in southern provinces and centrally-administered cities from Da Nang to Ca Mau.

d. Cooperate with training institutions to compile, print, and distribute materials according to the hospital's training program, information, and scientific proceedings.

5. Hospital management.

a. Manage and utilize effectively the hospital’s resources regarding human resources, finance, infrastructure, and medical equipment in accordance with current regulations.

b. Organize the implementation of state regulations on hospital budget revenue and expenditure, gradually accounting for income and expenses in compliance with legal provisions.

c. Generate additional funding for the hospital from healthcare services: patient fees, health insurance, product quality assessment, domestic and international investment projects, etc.

6. International cooperation.

a. Actively seek and exploit sources of aid, investment, and establish cooperative relationships in medical treatment, scientific research, staff training, provision of medical equipment, and basic construction with organizations both domestically and internationally, including non-governmental organizations, to develop joint venture and partnership projects with countries and international organizations, and submit them for approval by the Minister of Health and organize their implementation in accordance with state regulations. Take advantage of foreign assistance in terms of material, technology, and knowledge to continuously develop the hospital.

b. Develop plans for outbound and inbound delegations under the hospital's international cooperation program; send staff for study and research abroad and receive foreign experts, lecturers, and students to exchange experiences and learn at the hospital; manage outbound and inbound delegations in accordance with legal regulations.

c. Organize and manage international conferences, seminars, and courses within the scope of the hospital's specialized field in accordance with legal regulations and the Ministry of Health.

The hospital complies with legal regulations concerning cooperation with foreign entities.

Article 5. The hospital has autonomy within the scope of its assigned functions, tasks, and authorities as stipulated by the Ministry of Health, and is responsible before the Minister of Health and the law for its activities.

Article 6. The target population served by the hospital includes:

1. Patients, including foreigners, in the specialty of Oral and Maxillofacial Surgery and emergency patients not belonging to this specialty as prescribed by law.

2. Individuals coming to study and conduct scientific research in the specialty of Oral and Maxillofacial Surgery.

Chapter 3.

||| STAFF AND ORGANIZATION OF THE HOSPITAL

Article 7. The number of hospital beds will be adjusted based on actual needs.

Article 8. The leadership of the hospital consists of the Director and Deputy Directors.

1. The Director and Deputy Directors of the hospital are appointed and relieved of their positions by the Minister of Health, and such actions are carried out in accordance with the procedures and formalities set forth by the Ministry of Health.

2. The Director of the hospital is responsible before the Minister of Health and the law for the hospital's activities.

3. Deputy Directors assist the Director with certain tasks assigned by the Director and are accountable to the Director for the tasks delegated to them.

Article 9. The Scientific and Technical Council of the Hospital:

1. The Scientific Council advises the hospital Director on the development direction of the specialty, scientific research, and staff training. Specific tasks of the Council are defined by the hospital Director.

2. The organization and operation of the Scientific Council are implemented in accordance with the regulations of the Ministry of Science and Technology and the Ministry of Health.

Article 10. The Drug and Treatment Council:

The organization and operation of the Drug and Treatment Council are carried out in accordance with the regulations of the Ministry of Health.

Article 11. Other councils of the hospital are established upon the request of the Director and operate in accordance with legal regulations.

Other units of the hospital will be established by the Minister of Health when there is a need, based on the proposal of the hospital Director.

Article 13. Hospital employees are recruited and appointed to ranks in accordance with legal regulations.

Article 14. Hospital employees must meet the standards specified for their rank, fulfill assigned duties, respect patients, protect the legitimate rights and interests of patients and the hospital, participate actively in hospital activities, continuously study and improve their moral qualities and professional skills.

Article 15. Hospital employees have the right to ensure conditions for professional activities, be assigned to work in their specialty according to their capabilities, choose treatment methods for patients, receive advanced training, be promoted to higher ranks when eligible, and enjoy benefits as prescribed by law; they are protected by law while performing their duties and responsibilities.

Chapter 4.

FINANCE AND ASSETS OF THE HOSPITAL

Article 16. The hospital is a secondary budget unit, receiving operational funds as a public service institution, managing finances independently with its own account. The hospital must comply fully with state regulations on financial accounting.

Article 17. Sources of operational funds for the hospital include:

- State budget allocation

- Revenue from patient fees, health insurance, healthcare services provided on demand, scientific research and technical services, and product quality assessment.

- Training programs tailored to the requirements of organizations and individuals in specialized fields as prescribed by law.

- Revenue from foreign aid, international cooperation, individuals, and charitable organizations.

- Other sources of revenue as prescribed by law.

Article 18. Hospital expenditure items.

- Salaries and allowances

- Recurrent expenditures

- Hospital development expenditures

- Expenditures for commendation and awards

- Other expenditures as prescribed by law.

Article 19. MANAGEMENT OF ASSETS, EQUIPMENT, AND BASIC CONSTRUCTION:

1. Annually, the hospital shall allocate recurrent funds to maintain, repair, inspect medical equipment, renovate, upgrade, and expand its physical facilities.

2. Investment funds for purchasing equipment and constructing basic infrastructure must be established as projects and comply with state regulations.

3. Assets, equipment, and investment funds from any source must be managed and utilized in accordance with current financial and asset management regulations of the state and the Ministry of Health.

Article 20. Financial income and expenditure management:

1. Annually, the hospital must prepare budgets for income and expenditure and manage the use of each existing funding source. The hospital director is responsible for reporting consolidated budgets and final accounts quarterly and annually to the Ministry of Health;

2. The hospital implements financial transparency in accordance with the law;

Chapter 5.

RELATIONSHIP WITH UNITS INSIDE AND OUTSIDE THE HEALTH SECTOR

Article 21. The hospital is subject to comprehensive management and direction by the Minister of Health and is responsible for its own activities.

Article 22. The hospital serves as the technical guidance authority for hospitals and dental institutions in southern provinces and cities directly under the Central Government from Da Nang to Ca Mau. The hospital collaborates with agencies, units, and individuals within and outside the health sector from central to local levels to fulfill assigned functions and tasks.

Article 23. The hospital may collaborate with foreign organizations and individuals in fields specified in its functions and tasks and must comply with relevant laws.

Article 24. The hospital is subject to territorial administrative management by the People's Committee of Ho Chi Minh City in accordance with the law and has the responsibility to proactively coordinate with localities and social organizations to provide oral health care services to the population.

Chapter 6.

INSPECTION AND AUDIT

Article 25.

1. The hospital organizes self-inspection and supervision according to assigned levels and state regulations.

2. The hospital is subject to inspection, audit, and supervision by the Ministry of Health.

Chapter 7.

REWARD AND VIOLATION HANDLING

Article 26. Individuals and collectives of the hospital that perform well and make significant contributions to the cause of oral health care for the people and to the hospital will be rewarded in accordance with the law.

Article 27. Individuals or groups that violate the provisions of this Charter will be disciplined, administratively sanctioned, or criminally prosecuted, and if damage is caused, they must compensate in accordance with the law, depending on the nature and severity of the violation.

Chapter 8.

FINAL PROVISIONS

Article 28. This Charter consists of 8 chapters and 28 articles.

During implementation, based on the proposal of the Hospital Director, this Charter may be reviewed and amended by the Minister of Health to suit actual conditions./.
