REGARDING THE ESTABLISHMENT OF THE LEGAL PUBLISHING HOUSE

THE MINISTER OF JUSTICE

- Based on the Law on Publishing dated July 7, 1993;

- Based on Decree No. 62/2003/NĐ-CP dated June 6, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

- Based on Decision No. 2440/QĐ-BVHTT dated August 8, 2003 of the Minister of Culture, Sports and Tourism regarding the establishment of the Legal Publishing House;
Considering the proposal of the Director of the Cadre and Civil Servant Organization Department of the Ministry of Justice,

DECISION:

Article 1. The Legal Publishing House under the Ministry of Justice is hereby established.

The English name of the Legal Publishing House is Judicial Publishing House, abbreviated as JPH. The Legal Publishing House is a self-financing public service unit with legal personality, its own seal and bank account, located at No. 56-58-60 Tran Phu Street, Ba Dinh District, Hanoi. The Legal Publishing House is directly managed by the Ministry of Justice and is subject to state management in publishing by the Ministry of Culture, Sports and Tourism.

Article 2. The Legal Publishing House has the following objectives: to propagate the Party's policies and the State's laws on the legal sector; to provide professional guidance; to disseminate legal knowledge and education, and to provide legal assistance in order to contribute to enhancing the effectiveness of the legal sector's operations and building a socialist rule-of-law state in Vietnam. The target audience of the Legal Publishing House includes:

1. Staff, civil servants, and judicial positions working in agencies, organizations, and mass organizations within the legal sector and legal departments of central ministries, sectors, and mass organizations;

2. Lecturers, students, and trainees in specialized law schools, the Training Institute for Judicial Positions, and various strata of the people.

Article 3. The Legal Publishing House has the following tasks and powers:

1. To develop long-term and annual publication plans, submit them to the Minister of Justice for approval, and implement these plans;

2. To publish the following specialized legal books, materials, and publications:

a) Materials to propagate the Party's policies and the State's laws on the legal sector; to disseminate legal knowledge and provide legal assistance to various strata of the people;

b) Materials to guide professional matters for agencies and organizations such as civil enforcement agencies, notary offices, judicial appraisal organizations, legal aid centers, auction service centers, legal departments of ministries, sectors, and mass organizations;

c) Materials to guide professional skills and practice for bar associations, commercial arbitration centers, legal consulting companies, judicial staff at commune, ward, and town levels, and social organizations operating in the legal field under the jurisdiction of the legal sector;

d) Research works and specialized studies on domestic and international laws serving learning and research purposes;

đ) Textbooks, course materials, and lecture collections for lecturers, students, and trainees in specialized law schools and the Training Institute for Judicial Positions;

e) Other publications such as postcards, paintings, photographs, calendars, etc., containing content to propagate, disseminate, and educate about the law.

3. To cooperate, form joint ventures, and establish partnerships with domestic and foreign organizations and individuals in publishing and distribution activities in accordance with the law;

4. To manage the staff, collaborators, budget, and assets of the Legal Publishing House in accordance with the law;

5. To perform other tasks assigned by the Minister.

Article 4. The Legal Publishing House consists of the Director, Deputy Directors, the Editorial Board, and specialized Departments. The Director of the Legal Publishing House is responsible for coordinating with the Director of the Cadre and Civil Servant Organization Department to draft the Regulations on the Organizational Structure and Operations of the Legal Publishing House for promulgation by the Minister.

This Decision shall take effect from the date of signature.

The Heads of the Office, the Heads of the Cadre and Civil Servant Organization Department, the Planning and Finance Department, the Director of the Legal Publishing House, and the Heads of units under the Ministry of Justice shall be responsible for implementing this Decision./
