DECISION OF THE MINISTER OF FINANCE

Regulations on the tasks, powers, and organizational structure of the Departments and Offices under the National Reserve Administration

 under the Ministry of Finance

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decision No. 270/2003/QĐ-TTg dated December 24, 2003 of the Prime Minister stipulating the functions, tasks, powers, and organizational structure of the National Reserve Administration under the Ministry of Finance;

 At the proposal of the Director of the National Reserve Administration and the Heads of the Cadre and Civil Servant Department;

DECISION:

Article 1. These regulations on the tasks, powers, and organizational structure of the Departments and Offices under the National Reserve Administration are hereby promulgated together with this Decision.

Article 2. This Decision takes effect from the date of signature. All previous decisions issued by the Director of the National Reserve Administration regarding the functions, tasks, powers, and organizational structure of the Departments and Offices under the National Reserve Administration are repealed.

The Director of the National Reserve Administration, the Heads of the Cadre and Civil Servant Department, the Financial Management and Administrative Affairs Department, and the Office of the Ministry of Finance shall be responsible for implementing this Decision.

REGULATIONS ON TASKS, POWERS AND ORGANIZATIONAL STRUCTURE

OF THE DEPARTMENTS AND OFFICES UNDER THE NATIONAL RESERVE ADMINISTRATION

 (Issued together with Decision No. 40/2004/QĐ-BTC dated April 20, 2004 of the Minister of Finance)

 I. SPECIFIC TASKS

1. POLICY DEPARTMENT

1.1. Submit to the Director the annual legislative program of the Administration; organize its implementation or urge relevant units within the Administration to implement it after approval;

1.2. Take the lead in researching and drafting normative legal documents on national reserve management;

1.3. Organize the review and summary of the implementation of normative legal documents on national reserves to propose amendments, supplements, or new drafts that are suitable to reality and enhance the effectiveness of national reserve activities; organize the dissemination, education, and promotion of laws throughout the National Reserve Administration;

1.4. Review the legality of draft normative legal documents prepared by other Departments;

1.5. Serve as the focal point to assist the Director in providing comments on normative legal documents and policy mechanisms as assigned by the Ministry;

1.6. Take the lead in coordinating with related units to inspect compliance with the national reserve management regulations by ministries, sectors, and localities entrusted by the Government to manage national reserve goods; conduct inspections and audits of national reserve management at subordinate units of the Administration; propose measures to handle violations according to the law;

1.7. Draft modernization programs and capacity enhancement plans for the National Reserve Administration to improve administrative efficiency, submit them to the Director for approval, and organize their implementation after approval;

1.8. Assist the Director in handling complaints and denunciations in accordance with the law;

1.9. Perform other tasks assigned by the Director of the National Reserve Administration.

2. PLANNING AND COMBINED DEPARTMENT

2.1. Research and draft strategies, planning, and development plans for national reserves, strengthen national reserve plans during each period, and organize their implementation after approval;

2.2. Aggregate and draft five-year and annual national reserve plans (including basic construction investment plans, warehouse repair plans, technical infrastructure maintenance plans). Based on approved plans, allocate and assign annual plans to subordinate units and guide and direct the implementation of approved plans;

2.3. Lead and coordinate with the Warehouse Management Department and other sectors assigned to manage national reserve goods to propose the mobilization and utilization of the national reserve fund annually and in emergencies; organize guidance and direction for units to implement the withdrawal of the national reserve fund according to the law;

2.4. Research or coordinate with related agencies and units to draft normative legal documents on financial management systems, mechanisms for purchasing, selling, importing, exporting, tendering national reserve goods, determining prices, price ranges, import and export costs, storage costs, management fees, and insurance fees;

2.5. Coordinate with related agencies in building budgets and allocation plans for additional central government funds for national reserves; examine and approve documents submitted by the Director of the National Reserve Administration to the Ministry for the issuance of additional national reserve funds and audit, consolidate final accounts of state budget expenditures for national reserve import and export activities of agencies directly managing national reserves as assigned by the Government and Prime Minister;

2.6. Lead research and drafting of programs, projects, and plans for modernizing the warehouse system and technical infrastructure serving preservation work within the National Reserve Administration. Organize basic construction investment management and guide land management and architectural structures of units within the Administration according to regulations;

2.7. Coordinate with related agencies to organize inspections of price and fee regulations for units managing national reserve goods;

2.8. Organize statistical work, regular and special reports on the management of national reserve goods across the sector and evaluate the effectiveness of national reserve management and usage according to state regulations;

2.9. Perform other tasks assigned by the Director of the National Reserve Administration.

3. TECHNOLOGY AND PRESERVATION DEPARTMENT

3.1. Develop technology and scientific preservation strategies for national reserve goods for each period and organize their implementation after approval;

3.2. Draft preservation plans for national reserve goods, equipment and technical assurance plans, research and technology preservation plans; organize and guide the implementation of these plans for subordinate units of the Administration after approval;

3.3. To主持或与相关机构合作研究、制定国家储备物资的质量标准、技术标准、程序、规范和保管期限,由国家储备局及其直接管理的部门负责;

3.4. 研究或与相关机构合作制定在国家储备物资保管和管理工作中经济和技术定额,由国家储备局及其直接管理的部门负责;

3.5. 管理国家储备局的科学研究和技术保护工作;向局长提出将先进的保护技术应用于国家储备物资保管工作的决定建议;

3.6. 主持或与有关单位合作根据国家规定对国家储备局的研究计划进行审查;

3.7. 主持与相关机构合作指导和监督执行国家关于质量标准、技术标准、程序、规范和保管期限的规定,适用于各国家储备机构;

3.8. 执行国家储备局局长分配的其他任务;

4. 储存货物管理部门

4.1. 制定购买、销售、进口、出口、轮换和内部调拨国家储备物资的计划,适用于各地区国家储备机构;

4.2. 与计划综合部合作,指导各地区国家储备机构按照国家储备局局长的决定实施国家储备物资的发放、救援、国际援助或其他目的的出库;

4.3. 指导、监督各地区国家储备机构按照国家和国家储备局的规定执行管理、进口、出口、购买和销售国家储备物资的工作;

4.4. 指导各单位执行国家和国家储备局规定的防火、防爆、防洪、确保国家储备物资的安全措施;

4.5. 组织实施国家储备物资采购和销售的招标工作,由国家储备局作为项目负责人;

4.6. 定期和不定期地组织统计国家储备物资的购买、销售、进口、出口和库存情况,适用于各地区国家储备机构;

4.7. 执行国家储备局局长分配的其他任务;

5. 财务会计部门

5.1. 汇总并编制年度国家预算草案,并为直属单位分配预算方案;

5.2. 向局长提交全系统资产采购、设备和技术物资的需求报告;

5.3. 组织审核直属单位的投资和建设资金结算;

5.4. 组织实施并指导直属单位按照国家规定执行财务管理和会计制度;

5.5. 监督检查本局分配给各单位的资金使用情况,确保符合目的、有效且遵守国家规定;

5.6. 按法律规定履行三级预算单位的任务;

5.7. 组织会计核算和内部审计工作;审核并检查结算报告,提交局长审批后发布年度结算通知;汇总全系统的年度结算报告;

5.8. 按规定定期和在特殊情况时组织国有资产、国家储备物资的清查工作;跟踪检查使用情况,提交局长处理损坏、损失的物资和处理国家储备物资的债务问题;

5.9. 执行国家储备局局长分配的其他任务;

6. 组织人事部门

6.1. 研究制定国家储备局在各个时期的组织结构规划和发展人力资源的战略和方案;

6.2. 向局长提交关于职能、任务、权限和直属单位组织结构规定的草案;

6.3. 指导、监督直属单位执行职能、任务、权限、组织结构、干部管理、公务员、职员工资、培训和提升工作;

6.4. 制定各职位的专业标准、年度编制和工资计划及分配方案,经局长批准后组织实施;

6.5. 根据财政部部长的分级管理权限,执行干部、公务员、职员的规划、任命、再任命、免职、纪律处分、调动、退休、离职和政策解决工作;

6.6. 制定年度培训和提升计划,经局长批准后组织实施;向局长提交干部、公务员、职员参加学习、提升和研究的申请,按财政部部长的分级管理权限;

6.7. 按规定定期和不定期地统计组织人事、培训和工资工作;

6.8. 按国家和财政部的规定管理干部、公务员、职员的档案;

6.9. 指导并组织实施全系统的内部政治保卫工作;

6.10. 执行国家储备局局长分配的其他任务;

7. 办公室

7.1. 制定国家储备局的工作规则、机关内规和年度、半年度、季度、月度工作计划,供领导审议批准;

7.2. Monitor, inspect, urge units within the Bureau to implement the work program, comply with the Bureau's working regulations, and report as required; periodically or urgently report to the Director of the Bureau on the implementation status of tasks by units under and affiliated with the Bureau;

7.3. Review the form and content of draft documents prepared by units before submitting them to Bureau leadership; organize the storage of Bureau files and documents in accordance with regulations; guide the implementation of regulations on confidentiality, administrative procedures, document management, and record-keeping for units within the Bureau;

7.4. Schedule the work calendar for Bureau leadership. Take the lead and coordinate with relevant departments to prepare content and necessary materials, physical conditions for meetings with units, morning briefings, mid-term and final review conferences; organize minutes and file records of meetings and work sessions;

7.5. Organize an information network to serve operational management and direct activities of the Bureau; directly manage and maintain the operation of the information technology network throughout the Bureau; implement unified IT applications throughout the Bureau; gradually improve the efficiency of IT services supporting the Bureau's management work;

7.6. Develop rules, guidelines, and directives for managing and using the information technology network; stipulate data processing, provision, and reporting regimes for units to the Bureau through the wide-area information network;

7.7. Coordinate with Departments and Trade Union organizations to implement material incentive policies for officers and civil servants under the Bureau as prescribed;

7.8. Take the lead in coordinating with Departments to develop plans and programs for international cooperation in the Bureau's management areas to be submitted to the Director of the Bureau and implemented after approval by competent authorities;

7.9. Be responsible for organizing the management of assets, machinery, transportation means, office premises; ensure physical and technical conditions for the Bureau's operations;

7.10. Manage and issue "National Reserve Bulletin"; direct, guide, monitor, and inspect comprehensive competition and reward work; carry out information and propaganda work throughout the Bureau;

7.11. Perform other tasks assigned by the Director of the National Reserve Bureau;

II. LIMITATIONS

1. Have the right to request units under and affiliated with the Bureau to report situations, provide relevant data and materials to serve the assigned professional tasks;

2. Have the authority to sign documents providing guidance and explanations, and organize the implementation of issues within the assigned professional scope according to the division of responsibilities by the Director of the National Reserve Bureau;

III. ORGANIZATIONAL STRUCTURE

1. Departments and Offices under the National Reserve Bureau operate under a specialist system;

2. The National Reserve Bureau's Office organizes an Information Technology Department. Specific tasks of the Information Technology Department are defined by the Director of the National Reserve Bureau;

3. Departments and Offices are directed by the Department Heads and Deputy Directors. Assistant Department Heads and Deputy Deputy Directors support the Department Heads and Deputy Directors;

4. Department Heads and Deputy Directors are accountable to the Director of the National Reserve Bureau for the tasks assigned to them;

5. Appointments and dismissals of leadership positions in Departments and Offices are carried out in accordance with the regulations of the Minister of Finance;

6. Staffing of Departments and Offices is determined by the Director of the National Reserve Bureau within the total staffing quota allocated./.
