RESOLUTION

On the supervision program of the National Assembly for 2005

NATIONAL ASSEMBLY OF THE SOCIALIST REPUBLIC OF VIETNAM

Pursuant to Article 84 of the Constitution of the Socialist Republic of Vietnam promulgated in 1992, amended and supplemented by Resolution No. 51/2001/QH10 dated December 25, 2001 of the National Assembly, Session 10, Term X;

Pursuant to the Law on the Supervisory Activities of the National Assembly;

Based on the proposal of the National Assembly's Ethnic Council, the National Assembly's Committees, the National Assembly's Delegations, and the Central Committee of the Fatherland Front of Vietnam, the report of the National Assembly's Standing Committee, and the opinions of the National Assembly deputies;

RESOLVES

Article 1. In conjunction with reviewing reports from the Government, the Supreme People's Court, the Supreme People's Procuracy, questioning and answering questions, the National Assembly will conduct supervision on the following matters at its sessions:

1. The implementation of the National Assembly's resolution on the Dung Quat oil refinery project (at the seventh session);

2. The issuance of regulatory legal documents by the Government, the Prime Minister, Ministries, agencies equivalent to ministries, the Supreme People's Procuracy, and the Supreme People's Court (at the eighth session);

Article 2. The National Assembly's Standing Committee is tasked with conducting supervision on the following matters and reporting the results to the National Assembly:

1. The implementation of health policies for the people (to be reported to the National Assembly at the seventh session);

2. The results of implementing support policies for developing agriculture and rural areas from 2001 to the present (to be reported to the National Assembly at the eighth session);

Article 3. The Ethnic Council and the National Assembly's Committees are tasked with conducting supervision on the following matters and reporting the results to the National Assembly:

1) The implementation of the State Budget Law 2002 from when the Law took effect until before the 2006 state budget draft was prepared;

2) The results of implementing the Program for Developing Economically and Socially Disadvantaged Communes, Mountainous Areas, Remote and Hard-to-Reach Areas (Program 135);

3) The implementation of labor, vocational training, employment, and sending workers abroad policies;

4) Management, protection, and enhancement of cultural heritage values;

5) The enforcement of intellectual property rights in the country;

6) Management and implementation of tasks ensuring security and social order at some border gates, national borders, and strategic key areas;

7) The implementation of policies towards overseas Vietnamese and foreigners living and working in Vietnam;

8) The implementation of the National Assembly's Standing Committee's resolution on compensating losses to those wrongfully convicted due to the actions of authorities in criminal proceedings;

Article 4. Based on the National Assembly's supervision program and according to their duties and powers as prescribed by law, the National Assembly's Standing Committee, the Ethnic Council, and the National Assembly's Committees shall proactively build and implement their own supervision programs;

Article 5. Pursuant to the contents stipulated in Articles 1, 2, and 3 of this Resolution and actual conditions, the National Assembly's Delegations and National Assembly deputies shall proactively select topics to build their supervision programs, carry out supervision at local levels, and report the results of supervision as required;

Article 6. The National Assembly's Standing Committee is tasked with directing the implementation of the National Assembly's supervision program; coordinating and harmonizing the supervision activities of the Ethnic Council and the National Assembly's Committees; guiding the National Assembly's Delegations and National Assembly deputies in carrying out supervision activities; directing the work of ensuring the implementation of the National Assembly's supervision program; and directing supervisory agencies to follow up and compile the results of handling recommendations;

Article 7. Relevant agencies and organizations shall create favorable conditions for National Assembly bodies, Delegations, and deputies to carry out supervision; proactively prepare reports and provide necessary materials upon request of the National Assembly's Standing Committee, the Ethnic Council, the National Assembly's Committees, the National Assembly's Delegations, and National Assembly deputies; seriously address recommendations and report the results to supervisory agencies;

Article 8. The National Assembly's Standing Committee shall review the comprehensive report on the supervision activities of National Assembly bodies and Delegations every six months and annually; compile and report the results of implementing the National Assembly's supervision program for 2005 at the eighth session of the National Assembly;
