Decision No. 40/2007/QĐ-BGTVT on announcing the waters of seaports within the jurisdiction of Thua Thien Hue Province and the management area of the Thua Thien Hue Maritime Port Office.

Article 1.

1. Now announcing the waters of seaports within the jurisdiction of Thua Thien Hue province, including:

a) The waters before the wharves and piers of the Thu An Seaport: Thu An, Thu An Oil.

b) The waters before the wharves and piers of the Chan May Seaport: Chan May, Alcan Vietnam.

c) The waters of the port channel, branch port channels, pilot station areas, quarantine zones, anchorage areas, transshipment areas, and typhoon shelters of the seaports specified in points a and b of this clause.

2. The waters before other wharves and berths, anchorage areas, transshipment areas, and storm shelters shall be announced in accordance with the provisions of the law.

Article 2.

The scope of the waters of seaports within the jurisdiction of Thua Thien Hue province is measured according to the highest tide level, specifically defined as follows:

1. Thu An Seaport:

a) The boundary towards the sea: limited by straight lines connecting points TA1, TA2, TA3, and TA4, with the following coordinates:

TA1: 16^°35’00” N, 107^°35’58” E;

TA2: 16^°37’30” N, 107^°36’07” E;

TA3: 16^°35’43” N, 107^°40’20” E;

TA4: 16^°34’00” N, 107^°38’30” E.

b) The boundary towards the mainland: limited from point TA4 running along the coast northward and along the shore of Tam Giang Lagoon to point TA5 with the following coordinates: 16^°33’24” N, 107^°38’38” E. From point TA5 continuing with straight lines connecting points TA6, TA7, and TA8 with the following coordinates:

TA6: 16^°33’06” N, 107^°38’25” E;

TA7: 16^°33’05” N, 107^°38’06” E;

TA8: 16^°33’53” N, 107^°37’17” E.

From point TA8 running along the coast northward to point TA1.

2. Chan May Seaport:

a) The boundary towards the sea: limited by straight lines connecting points CM1, CM2, CM3, and CM4, with the following coordinates:

CM1: 16^°20’40” N, 107^°57’00” E (West Chan May Cape);

CM2: 16^°22’38” N, 107^°57’51” E;

CM3: 16^°22’38” N, 108^°01’54” E;

CM4: 16^°20’42” N, 108^°01’06” E (East Chan May Cape).

b) The boundary towards the mainland: limited from point CM1 running along the Chan May Bay shoreline southward to point CM4.

Article 3.

Pilot station areas, quarantine zones, anchorage areas, transshipment areas, and typhoon shelters for vessels entering seaports within the jurisdiction of Thua Thien Hue province are defined as follows:

1. Pilot Station and Quarantine Area:

a) Thu An Seaport: the water area limited by a semicircle facing north with a radius of 1.5 nautical miles, with the center located at the following coordinates: 16^°35’48” N, 107^°37’36” E.

b) Chan May Seaport: the water area limited by a circle with a radius of 1 nautical mile, with the center located at the following coordinates: 16^°21’17” N, 108^°00’00” E.

2. Anchorage areas, transshipment areas, and storm shelters:

a) Thu An Seaport:

- Position TA9 and TA10: for all vessels, at the positions with the following coordinates:

TA9: 16^°33’30” N, 107^°38’03” E;

TA10: 16^°33’54” N, 107^°37’42” E.

- Areas TA11 and TA12: for vessels with a deadweight tonnage up to 3,000 DWT, limited by two circles with a diameter of 250 meters, with centers at the following positions:

TA11: 16^°33’50” N, 107^°37’02” E;

TA12: 16^°33’55” N, 107^°37’10” E.

- Areas TA5 and TA6: for vessels with a deadweight tonnage up to 2,000 DWT, limited by two circles with a diameter of 220 meters, with centers at the following positions:

TA13: 16^°33’48” N, 107^°37’36” E;

TA14: 16^°33’42” N, 107^°37’42” E.

- Areas TA15 and TA16: for vessels with a deadweight tonnage up to 1,500 DWT, limited by two circles with a diameter of 200 meters, with centers at the following positions:

TA15: 16^°33’33” N, 107^°37’53” E;

TA16: 16^°33’30” N, 107^°37’59” E.

- Area TA17: for vessels with a deadweight tonnage up to 1,000 DWT, limited by a circle with a diameter of 180 meters, with the center at the following position: 16^°33’26” N, 107^°38’05” E.

- Areas TA18, TA19, and TA20: for vessels with a deadweight tonnage up to 500 DWT, limited by three circles with a diameter of 140 meters, with centers at the following positions:

TA18: 16^°33’23” N, 107^°38’11” E;

TA19: 16^°33’23” N, 107^°38’16” E;

TA20: 16^°33’22” N, 107^°38’22” E.

b) Chan May Seaport:

- For vessels with a deadweight tonnage of 3,000 DWT or more at position CM5 with the following coordinates: 16^°19’55” N, 107^°59’54” E.

- For vessels with a deadweight tonnage under 3,000 DWT at position CM6 with the following coordinates: 16^°19’35” N; 108^°00’23” E.

3. Other anchorage areas, transshipment areas, and typhoon shelters: as decided by the Director of the Vietnam Maritime Administration.

Article 4.

The Thua Thien Hue Port Office has the responsibility:

1. To perform its duties and powers as prescribed by the Vietnam Maritime Code and related laws concerning maritime activities in the waters of seaports within the jurisdiction of Thua Thien Hue province.

2. Based on actual conditions regarding weather, waves, drafts, and vessel tonnage, designate specific locations for vessels to pick up pilots, undergo quarantine, anchor, transship, and avoid typhoons within the areas defined in Article 3 of this Decision, ensuring maritime safety, maritime security, and environmental protection.

Article 5.

Outside the waters of seaports within the jurisdiction of Thua Thien Hue province defined in Articles 2 and 3 of this Decision, the Thua Thien Hue Port Office also has the responsibility to manage state affairs concerning maritime safety and maritime security in the territorial waters of Thua Thien Hue province.

Article 6.

1. This Decision takes effect fifteen days after its publication in the Official Gazette.

2. Repeal Decision No. 3522/2002/QĐ-BGTVT dated October 29, 2002 of the Minister of Transport on the waters of seaports within the jurisdiction of Thua Thien Hue province and the responsibility area of the Thua Thien Hue Port Office, and any previous regulations that conflict with this Decision.

The Head of the Ministry’s General Office, the Inspector General of the Ministry, Heads of Departments under the Ministry, Directors of the Vietnam Maritime Administration, Directors of the Vietnam Inland Waterway Administration, Directors of the Thua Thien Hue Department of Transport, Directors of the Thua Thien Hue Port Office, Heads of agencies, organizations, and individuals concerned are responsible for implementing this Decision./.
