MINISTER OF INFORMATION AND COMMUNICATIONS

BASED ON THE GOVERNMENT DECREE NO. 187/2007/NĐ-CP OF DECEMBER 25, 2007 ON THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF INFORMATION AND COMMUNICATIONS;

Pursuant to Decision No. 191/2004/QĐ-TTg dated November 8, 2004 of the Prime Minister on the establishment, organization, and operation of the Vietnam Public Telecommunications Service Fund;

Pursuant to Decision No. 74/2006/QĐ-TTg dated April 7, 2006 of the Prime Minister approving the program for providing public telecommunications services until 2010;

Pursuant to Circular No. 67/2006/TT-BTC dated July 18, 2006 of the Ministry of Finance guiding the financial management system of the Vietnam Public Telecommunications Service Fund;

After receiving the opinion of the Ministry of Finance (Letter No. 7532/BTC-TCNH dated June 30, 2008) on the subsidy standard for providing public telecommunications services;

At the proposal of the Director of the Planning and Finance Department.

DECISION:

Article 1. Issued together with this Decision:

1. The subsidy standard for maintaining and developing the provision of public telecommunications services for the period 2008-2010 (Annex 1).

2. List of areas applying the subsidy standard prescribed in Clause 1 of this Article for counties and communes in regions provided with public telecommunications services (Annex 2).

Article 2. Adjustment of the subsidy standard:

Based on the actual situation regarding the development and maintenance of public telecommunications service provision throughout the country, the Ministry of Information and Communications will decide to apply adjustment factors to the subsidy standards during each period, with the maximum adjustment range (increase or decrease) not exceeding 10% of the subsidy standards issued together with this Decision.

Article 3. Provisions on application:

1. The subsidy standard for maintaining and developing the provision of public telecommunications services issued together with this Decision shall be applied in the following cases:

a) Preparing plans for the provision of public telecommunications services; determining the budget estimate for implementing the plan; paying subsidies to telecommunications enterprises providing public telecommunications services under the government's procurement method; tendering for the provision of public telecommunications services.

b) Paying the volume of telecommunication products and services provided by telecommunications enterprises according to the requirements of the government.

2. For new service volumes, fixed telephone subscriber maintenance, individual and household Internet subscribers from the beginning of 2008 to the date this Decision takes effect, the subsidy standard issued together with Decision No. 17/2007/QĐ-BBCVT dated June 15, 2007 of the Minister of Posts and Telecommunications (now the Ministry of Information and Communications) shall be applied.

Article 4. This Decision shall take effect fifteen days from the date of publication in the Official Gazette.

Article 5. The Head of the Office, Directors of the Planning and Finance Department, Directors of the Telecommunications Department; Chairman of the Management Board, Director of the Supervisory Board, Director of the Vietnam Public Telecommunications Service Fund; Chairmen of the Board of Directors, General Directors, Directors of telecommunications enterprises; Directors of Provincial Departments of Information and Communications and Heads of related units are responsible for implementing this Decision./.
