Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 185/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

Considering the proposal of the Director of the Ministry's representative office in Ho Chi Minh City, the Department Head of the Cadre and Civil Servant Affairs Department,

DECISION:

Article 1. Position and Functions

The Ministry of Culture, Sports and Tourism's representative office in Ho Chi Minh City (hereinafter referred to as the Representative Office) assists the Minister in overseeing, summarizing the situation in the fields of culture, family, physical education, sports, and tourism; it is authorized by the Minister to coordinate with subordinate agencies under the Ministry to implement state management functions within the provinces and centrally-run cities from Ninh Thuan southward, including: Ninh Thuan, Binh Thuan, the eastern region of southern Vietnam, the western region of southern Vietnam, and Ho Chi Minh City (collectively referred to as the southern region).

The Representative Office has its own seal, bank accounts at the State Treasury and banks.

Article 2. Tasks and Powers

1. Submit to the Minister long-term plans, five-year plans, and annual plans for the organization and operation of the Representative Office, and organize their implementation after approval.

2. Summarize, monitor, and urge the implementation of policies, programs, and work plans of the Ministry in subordinate agencies and units within the area; propose solutions and report regularly to the Minister for timely guidance.

3. Coordinate with Departments, Bureaus, the Office, the Inspectorate, and General Departments according to the Minister’s classification in directing, guiding, and inspecting the activities of provincial Cultural, Sports, and Tourism Departments in the southern region.

4. Participate in organizing measures to prevent, stop, and handle superstitious practices, outdated customs, obscene cultural products, and violations of laws in the fields of culture, family, physical education, sports, and tourism.

5. Carry out tasks assigned by the Minister in the southern region according to the following specifics:

a) In the field of culture:

Participate in state management of cultural heritage; performing arts; cinema; fine arts, photography, exhibitions; copyright and related rights concerning literary and artistic works; libraries; advertising; community culture; ethnic culture and propaganda.

b) In the field of family:

Participate in state management of family affairs, participate in promoting moral values, lifestyle, and behavior in Vietnamese families.

c) In the field of physical education and sports:

Participate in state management of physical education and sports for all people; high-performance sports and professional sports.

d) In the field of tourism:

Participate in state management of tourism resources, tourism planning, tourist areas, tourist sites, tourist routes, tourist cities, tour guides, tourism business, and tourism promotion.

6. Coordinate in implementing the Ministry's competition and reward plan in the southern region.

7. Participate in inspection and audit teams organized by the Ministry in the southern region regarding cultural, family, physical education, sports, and tourism sectors.

8. Serve as the liaison point for the Ministry to communicate and interact with provincial People's Committees, domestic and foreign organizations located in the southern region.

9. Attend meetings of ministries, sectors, and localities held in the southern region upon delegation by Ministry leadership or by heads of departments, bureaus, and general departments.

10. Organize services for Ministry leadership and working groups of the Ministry during their operations in the southern region according to the Ministry's schedule.

11. Coordinate with representative offices of other ministries, sectors, associations, and local departments to implement assigned tasks.

12. Manage and utilize funds according to annual budgets and other income sources as prescribed by law.

13. Implement administrative reforms according to the Ministry's program and plan, manage organizational structures, staffing, files, and implement regulations and policies for civil servants and employees under the management of the Representative Office as prescribed by law and by the Minister.

14. Manage assets, use, preserve, and exploit material facilities and equipment suitable for the Representative Office's functions and tasks as prescribed by law.

15. Perform other tasks assigned by the Minister.

Article 3. Organizational Structure

1. Director and Deputy Directors.

2. Specialized functional departments:

a) Operations and Consolidation Department;

b) Administrative and Organization Department;

c) Management Department;

d) Accounting and Finance Department.

The Director of the Representative Office is responsible for defining specific functions and tasks for subordinate departments; arranging and assigning civil servants according to structure, positions, and professional standards; drafting and promulgating the organizational and operational regulations of the Representative Office.

Article 4. Effectiveness

This Decision takes effect fifteen days after its publication in the Official Gazette. Previous regulations contrary to this Decision are abolished.

 Article 5. Responsibility for Implementation

The Director of the Representative Office, the Chief of the Office, the Heads of the Cadre and Civil Servant Affairs Department, the Planning and Finance Department, the Heads of agencies and units under the Ministry, and relevant organizations and individuals are responsible for implementing this Decision./.
