ON THE MANAGEMENT OF SAMPLE MONEY AND COMMEMORATIVE MONEY
Based on the Law on the Organization of the Government dated December 25, 2001;
Pursuant to the Law on the State Bank of Vietnam No. 46/2010/QH12 dated June 16, 2010;
At the proposal of the Governor of the State Bank of Vietnam,
The Prime Minister issues this Decision on the management of sample money and commemorative money.
Chapter 1.
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decision stipulates the design, printing, minting, storage, transportation, delivery, issuance, sale of sample money and commemorative money by the State Bank of Vietnam.
Article 2. Applicability
1. The State Bank of Vietnam (hereinafter referred to as the State Bank).
2. Credit organizations, foreign bank branches.
3. National Treasury; agencies, organizations, individuals related thereto.
4. Money-printing and minting facilities.
Article 3. Explanation of Terms
1. "Sample money" means paper money and metal coins issued by the State Bank that meet all technical standards and quality requirements like those types of money officially circulated by the State Bank. Sample money serves as a standard for comparison in the issuance process and is used for research, museum purposes, introduction, collection, commemoration, and does not have value as a means of payment in circulation.
2. "Commemorative money" means symbolic money without value as a means of payment, issued for the purpose of collection and commemoration.
Chapter 2.
SAMPLE MONEY
Article 4. Sample Money
1. Based on the purpose and need for use, the Governor of the State Bank shall submit to the Prime Minister the quantity and types of sample money to be printed or minted.
2. The design, printing, and minting of sample money shall be carried out according to regulations applicable to the design, printing, and minting of money; specifically, sample paper money shall bear the words "Sample Money" or "Specimen", along with two rows of representative serial numbers (in positions corresponding to those on regular paper money), consisting of two letters and the digits "0". On the front side of the sample paper money, an additional row of serial numbers will be printed in the white margin area to facilitate the management of sample money.
Article 5. Recipients of Sample Money
Based on the purpose and need for use and the quantity of sample money printed or minted, the Governor of the State Bank shall issue sample money to the following recipients:
1. Functional units under the State Bank.
2. Credit organizations, foreign bank branches, National Treasury.
3. Units under relevant Ministries and sectors involved in combating counterfeit money.
4. Foreign organizations and individuals.
Article 6. Exchange of Damaged Sample Money
Sample money that is torn, damaged during use by recipients under Clause 1, Clause 2, and Clause 3 of Article 5 of this Decision shall be subject to examination and exchange by the State Bank. The exchange shall be conducted at the same denomination and type, and no fee shall be charged.
Article 7. Storage, Delivery, Transportation of Sample Money
1. The delivery, storage, and transportation of sample money within the State Bank system, credit organizations, and foreign bank branches shall be carried out in accordance with legal provisions applicable to the delivery, storage, and transportation of money.
2. If recipients under Clause 1, Clause 2, and Clause 3 of Article 5 of this Decision lose sample money, in addition to the organizations being responsible for material compensation, individuals tasked with storing sample money shall also be subject to disciplinary and administrative penalties as prescribed. The amount of material compensation equals the face value of the lost sample money. Subsequently, the State Bank may consider reissuing sample money to the using unit.
Article 8. Recovery of Sample Money
The State Bank shall recover part or all of the sample money that has been issued in the following cases:
1. After the Prime Minister decides to suspend circulation of one or more types of currency, within thirty days from the date the State Bank announces it, the State Bank branch in provinces and cities shall recover all the sample money issued to credit organizations, foreign bank branches, and the National Treasury on its territory. The State Bank branch in provinces and cities and the State Bank Trading Department may retain one set of sample money for local use, and the remainder must be submitted to central treasuries.
2. Other entities that have been issued sample money shall surrender it upon written request from the State Bank.
Chapter 3.
COMMEMORATIVE MONEY
Article 9. Organization of Designing, Printing, Minting, and Issuing Commemorative Money
1. The State Bank organizes or collaborates with domestic and foreign partners to design, print, mint commemorative money. Partners of the State Bank must be organizations operating in the fields of printing and minting currency; trading and crafting precious metals; trading in commemorative money or other souvenir items.
2. For topics related to historical events, political events, or significant national events, the State Bank shall submit the design model regarding the topic, size, weight, illustration, pattern, and other characteristics of commemorative money to the Prime Minister for approval. The partner designing, printing, and minting commemorative money shall follow this approved design model.
3. When issuing commemorative money, the State Bank shall announce through mass media the policy of issuing commemorative money.
4. The Governor of the State Bank shall consider issuing commemorative money to organizations and individuals both domestically and internationally.
Article 10. Preservation, Handover, and Transportation of Commemorative Money
The preservation, handover, and transportation of commemorative money by the State Bank shall be carried out according to the provisions of the law applicable to the preservation, transportation, and handover of currency.
Chapter 4.
PROVISIONS ON THE SALE OF SAMPLE MONEY AND COMMEMORATIVE MONEY
Article 11. Sale of Sample Money and Commemorative Money
1. The State Bank shall organize the sale of commemorative money in accordance with contracts with domestic and foreign partners as stipulated in Clause 1 of Article 9 of this Decision.
2. Based on the purpose and usage needs of organizations and individuals and the current quantity of sample money and commemorative money, the Governor of the State Bank shall decide the amount of sample money and commemorative money to be sold to organizations and individuals.
3. In each period, the Governor of the State Bank shall determine the method and price of selling sample money and commemorative money. For sample money, the selling price shall not be lower than its face value.
Article 12. Accounting for Sample Money and Commemorative Money
1. The State Bank branch in provinces and cities, the State Bank Trading Department, credit organizations, foreign bank branches, and the National Treasury shall organize accounting for sample money and commemorative money in accordance with the regulations of the State Bank of Vietnam.
2. All revenues and expenditures in managing sample money and commemorative money shall be recorded in the business revenues and expenditures of the State Bank.
Chapter 5.
IMPLEMENTING PROVISIONS
Article 13. Implementation Provisions
This Decision takes effect from December 12, 2012. Previous regulations contrary to this Decision are abolished.
1. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of provincial People's Committees under the central government, and related agencies, units, and individuals are responsible for implementing this Circular.
Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairmen of People's Committees of centrally governed cities and provinces, relevant organizations, units, and individuals are responsible for implementing this Decision./.
