Pursuant to Decree No. 199/2013/NĐ-CP dated November 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Implementing Decision No. 372/QD-TTg dated March 14, 2014 of the Government Chairman regarding the recognition and announcement of localities meeting the new rural standards;

At the proposal of the Director of the Office of the National Steering Committee for New Rural Development and the Director of the Legal Department,

The Minister of Agriculture and Rural Development issues this Circular guiding the procedures, formalities, and files for recognizing and announcing communes, districts, and provinces meeting the new rural standards.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. Scope of regulation: This Circular guides the procedures, formalities, and files for recognizing and announcing communes, districts, and provinces meeting the new rural standards.

a) Communes, districts, and provinces nationwide implementing the National Target Program on Building New Rural Areas;

b) State agencies, organizations, households, and individuals related to the procedures, formalities, and files for recognizing and announcing communes, districts, and provinces meeting the new rural standards.

Article 2. Implementation Principles

1. The evaluation, recognition, and announcement of communes, districts, and provinces meeting the new rural standards must be carried out regularly and continuously every year, ensuring transparency, democracy, clarity, adherence to procedures and formalities, and close cooperation among relevant agencies, organizations, and individuals.

2. The re-evaluation and re-recognition of communes, districts, and provinces meeting the new rural standards shall be conducted five years after they have been recognized as meeting the new rural standards from the date of the competent authority's decision recognizing them as meeting the new rural standards.

3. Communes, districts, and provinces recognized as meeting the new rural standards must meet the conditions stipulated in Decision No. 372/QD-TTg dated March 14, 2014 of the Government Chairman.

Article 3. Method for determining the level of achievement of criteria for the purpose of recognizing communes meeting the new rural standards

The level of achievement of each criterion within the commune area for the purpose of recognizing communes meeting the new rural standards is determined by the People's Committee of the province based on actual conditions of the locality, in accordance with Circular No. 41/2013/TT-BNNPTNT dated October 4, 2013 of the Ministry of Agriculture and Rural Development on guiding the implementation of the National Criteria for New Rural Areas.

PROCEDURES, FORMALITIES, AND FILES FOR RECOGNIZING COMMUNES, DISTRICTS, AND PROVINCES MEETING THE NEW RURAL STANDARDS

Section 1:

PROCEDURES, FORMALITIES, AND FILES FOR RECOGNIZING

COMMUNES MEETING THE NEW RURAL STANDARDS

Article 4. Registration of communes meeting the new rural standards

1. The People's Committee of the commune (hereinafter referred to as the People's Committee of the commune) registers the commune as meeting the new rural standards before December 10 of the year immediately preceding the year of assessment. The People's Committee of the district, city directly under the province, or provincial capital city (collectively referred to as the People's Committee of the district-level) will only confirm registration for communes that have achieved at least 14 criteria up to the registration date and have the necessary conditions to strive to achieve the standard in the year of assessment.

2. The People's Committee of the commune submits directly or sends via postal service the registration document for the commune meeting the new rural standards (two copies according to Model 1.1 attached as Appendix I of this Circular) to the People's Committee of the district-level for confirmation.

3. Within five days from the date of receipt of the commune's registration, the People's Committee of the district-level responds in writing to the People's Committee of the commune about the result of confirming the registration of the commune meeting the new rural standards; clearly stating the reasons for communes not confirmed in the registration of the commune meeting the new rural standards.

Article 5. Recognition of Communes Meeting New Rural Standards

The procedures and formalities for recognizing communes meeting new rural standards include the following steps:

1. The People's Committee of the commune organizes self-assessment of the results of implementing criteria to meet new rural standards.

2. The People's Committee of the district organizes verification and proposes examination for recognition of communes meeting new rural standards.

3. The People's Committee of the province organizes review, and the Chairman of the People's Committee of the province decides on the recognition of communes meeting new rural standards.

Article 6. Self-Assessment of Results of Implementing Criteria to Meet New Rural Standards

The People's Committee of the commune organizes self-assessment of the results of implementing criteria to meet new rural standards (before September 1st each year) as follows:

1. Organizing self-assessment:

The People's Committee of the commune establishes an Assessment Team (comprising members representing the commune Steering Committee, commune Management Board, and village development boards) to assess the actual level of achievement of each criterion; the commune Management Board builds a report assessing the level of achievement of each criterion, reporting to the People's Committee of the commune.

2. Soliciting opinions:

a) The People's Committee of the commune sends the report on the implementation results of the commune's criteria to solicit participation opinions from the All-Vietnam Association for Small and Medium Enterprises at the commune level and its member organizations;

b) The report on the implementation results of the commune's criteria is announced publicly at the People's Committee of the commune's office, village cultural houses, and on the commune's radio system for 20 days; during this period, the People's Committee of the commune assigns the commune Management Board to coordinate with village development boards to organize meetings in villages to solicit opinions, requiring that at least 70% of household representatives in the village must attend the meeting and record the minutes of the meeting detailing the results of household representatives agreeing or disagreeing (by voting or ballot) with the commune's implementation results, to be sent to the People's Committee of the commune;

c) The People's Committee of the commune supplements and completes the report on the implementation results of the commune's criteria after receiving participation opinions from the All-Vietnam Association for Small and Medium Enterprises at the commune level and its member organizations, and at least 80% of household representatives in the commune have participated in village meetings and voted or balloted in agreement with the commune's implementation results.

3. Completing the dossier:

a) The People's Committee of the commune convenes a meeting (comprising members of the commune Steering Committee, commune Management Board, and village development boards) to discuss and vote on the proposal to examine the recognition of the commune meeting new rural standards; complete the dossier for examining the recognition of the commune meeting new rural standards when the result of the consensus of representatives at the meeting must reach 90% or more, submitting to the People's Committee of the district before September 25th each year;

b) The dossier for examining the recognition of the commune meeting new rural standards submitted directly or via postal service for verification (two sets of dossiers) includes:

The report of the People's Committee of the commune proposing verification and examination for recognition of the commune meeting new rural standards (original - according to Model No. 2.1 in Appendix II issued together with this Circular);

The report on the implementation results of new rural criteria in the commune (original - accompanied by detailed tables of the implementation results of new rural criteria - according to Model No. 3.1 in Appendix III issued together with this Circular);

The consolidated report on the participation opinions of commune organizations and people regarding the implementation results of new rural criteria in the commune (original - according to Model No. 4.1 in Appendix IV issued together with this Circular);

The minutes of the meeting (comprising members of the commune Steering Committee, commune Management Board, and village development boards) proposing examination for recognition of the commune meeting new rural standards (original - according to Model No. 5.1 in Appendix V issued together with this Circular);

c) The entity receiving the dossier: The Agriculture and Rural Development Office, or the Economic Office, or the Office coordinating the National Target Program on Building New Rural Areas under the People's Committee of the district (hereinafter referred to collectively as the district-level steering office).

Article 7. Organization for review and proposal to recognize communes meeting new rural standards

1. Review organization:

a) The People's Committee at the district level shall establish a Review Team (comprising members who are representatives of heads of specialized agencies at the district level responsible for each new rural standard) to review and assess the actual degree of achievement of each standard for each commune; the Standing Office of the Program at the district level shall prepare a report on the results of reviewing the dossier and the degree of achievement of each standard for each commune, to be reported to the People's Committee at the district level;

b) Within 15 days from the date of receipt of the dossier requesting recognition of communes meeting new rural standards submitted by the People's Committee of the commune, the People's Committee at the district level shall respond in writing to the People's Committee of the commune regarding the results of the review and specific assessment of the actual degree of achievement of each standard for each commune; clearly stating the reasons why the commune has not been proposed for recognition as meeting new rural standards.

2. Soliciting opinions:

a) The People's Committee at the district level shall compile a list of communes meeting the conditions to propose for recognition as meeting new rural standards and announce it at least three times through local broadcasting and television means (if available) to solicit public opinion within the district;

b) The People's Committee at the district level shall send the report on the results of reviewing the dossier and the degree of achievement of each standard for each commune to solicit opinions and incorporate the opinions of the Vietnam Fatherland Front at the district level, its affiliated organizations, and the People's Committees of communes within the district to complete the report on the results of reviewing the dossier and the degree of achievement of each standard for each commune meeting the conditions to propose for recognition as meeting new rural standards.

3. Completing the dossier:

a) The People's Committee at the district level shall convene a meeting (comprising members of the Steering Board of the National Target Program on New Rural Development at the district level) to discuss and vote on the proposal to recognize communes meeting new rural standards for each commune that meets the conditions; complete the dossier proposing recognition of communes meeting new rural standards when the result of the consensus of representatives at the meeting must reach 90% or more, to be submitted to the People's Committee at the provincial level before October 20th each year;

b) The dossier proposing recognition of communes meeting new rural standards submitted by the People's Committee at the district level shall include (one set of dossier):

The request for examination and recognition of communes meeting new rural standards from the People's Committee at the district level (original - according to Model No. 2.2 in Appendix II issued together with this Circular);

Report on the review of the dossier and the results of achieving each new rural standard for each commune (original - accompanied by a detailed table assessing the degree of achievement of each new rural standard for each commune - according to Model No. 6.1 in Appendix VI issued together with this Circular);

Report summarizing the opinions of agencies, organizations, and people in the district participating in the review of the degree of achievement of each new rural standard for each commune (original - according to Model No. 7.1 in Appendix VII issued together with this Circular);

Minutes of the meeting (comprising members of the Steering Board of the National Target Program on New Rural Development at the district level) proposing recognition of communes meeting new rural standards (original - according to Model No. 5.2 in Appendix V issued together with this Circular);

(Attached to the dossier submitted by the People's Committee of the commune for review as stipulated in point b, Clause 3, Article 6 of this Circular);

c) The entity receiving the dossier: The Standing Office of the National Target Program on New Rural Development under the People's Committee at the provincial level (hereinafter referred to as the Standing Office of the Program at the provincial level).

Article 8. Organization of assessment and recognition of communes meeting new rural standards

1. Organizing the review:

a) The People's Committee of the province/city directly under the central government (hereinafter referred to as the provincial People's Committee) shall establish an Assessment Team (consisting of representatives from provincial departments and agencies responsible for each new rural standard) to assess the level of achievement of each criterion for each commune within the province; the provincial program's permanent office shall prepare a report on the results of assessing the files and the level of achievement of each new rural standard for each commune within each district (based on documents from provincial departments and agencies confirming the level of achievement of the criteria they are responsible for), and report to the provincial People's Committee;

b) Within 15 days (from the date of receiving the file requesting recognition of communes meeting new rural standards from the district People's Committee), the provincial People's Committee shall respond in writing to the district and commune People's Committees regarding the results of assessing the level of achievement of each new rural standard for each commune within each district; clearly stating the reasons why a commune has not been recognized as meeting new rural standards.

2. Organization of recognition:

a) The provincial People's Committee shall convene a meeting (comprising members of the Steering Committee for the National Target Program on New Rural Development at the provincial level) to discuss and vote on recognizing communes as meeting new rural standards; the provincial program's permanent office shall complete the file requesting recognition of communes as meeting new rural standards when the result of the consensus opinion of the delegates at the meeting must reach 90% or more, and submit it to the Chairman of the provincial People's Committee for consideration and decision;

b) The Chairman of the provincial People's Committee shall decide to recognize communes as meeting new rural standards within the province before November 10th each year.

Article 9. Model certificate of recognition of communes meeting new rural standards

The model Certificate of Recognition of Communes Meeting New Rural Standards is attached as Appendix IX issued together with this Circular.

Section 2

PROCEDURES, FORMALITIES, AND FILES FOR RECOGNIZING

 COUNTY MEETING NEW RURAL STANDARDS

Article 10. Registration of counties meeting new rural standards

1. The People's Committee of the county shall register the county as meeting new rural standards before December 15th of the year immediately preceding the evaluation year, the provincial People's Committee shall only confirm for counties that have 50% of their communes meeting the standards up to the registration time and have sufficient conditions to strive to meet the standards in the evaluation year.

2. The People's Committee of the county shall submit directly or send via postal service the registration document for the county meeting new rural standards (two copies according to Form No. 1.2 in Appendix I issued together with this Circular) to the provincial People's Committee for confirmation.

3. Within five days (from the date of receipt of the registration from the county People's Committee), the provincial People's Committee shall respond in writing to the county People's Committee regarding the results of confirming the registration of the county meeting new rural standards; clearly stating the reasons for counties that have not been confirmed for registration as meeting new rural standards.

Article 11. Recognition of counties meeting new rural standards

The procedures and formalities for recognizing counties meeting new rural standards include the following steps:

1. The People's Committee of the county shall organize self-assessment of the results of implementing the county new rural standards.

2. The provincial People's Committee shall organize verification and propose recognition of the county as meeting new rural standards.

3. The Ministry of Agriculture and Rural Development shall organize the review of the file, and submit to the Prime Minister for consideration and decision on recognizing the county as meeting new rural standards.

Article 12. Organization of self-assessment of the results of implementing the county new rural standards

The People's Committee of the county shall organize self-assessment of the results of implementing the county new rural standards as follows:

1. Organizing self-assessment:

a) For communes meeting new rural standards: The county People's Committee shall compile a list of communes meeting new rural standards within the county that have been decided to be recognized by the Chairman of the provincial People's Committee;

b) For communes not yet meeting new rural standards: The county People's Committee shall establish an Assessment Team (consisting of representatives from county specialized agencies responsible for each new rural standard) to specifically evaluate the actual level of achievement of each criterion for each commune within the county; the county program's permanent office shall prepare a report on the implementation of the county new rural standards, and report to the county People's Committee.

2. Soliciting opinions:

a) The county People's Committee shall submit the report on the implementation of the county new rural standards to solicit opinions and incorporate the participation opinions of the County Fatherland Front and its member organizations to perfect the report on the implementation of the county new rural standards;

b) The report on the implementation of the county new rural standards shall be published on mass media and on the website of the county People's Committee for ten days to solicit participation opinions from agencies, organizations, and residents within the county.

3. Completing the dossier:

a) The county People's Committee shall incorporate participation opinions, perfect the report on the implementation of the county new rural standards; convene a meeting (comprising members of the Steering Committee for the National Target Program on New Rural Development at the county level and representatives from the leadership of the People's Committees of communes within the county) to discuss and vote on proposing recognition of the county as meeting new rural standards; complete the file proposing recognition of the county as meeting new rural standards when the result of the consensus opinion at the meeting must reach 90% or more, and submit it to the provincial People's Committee before November 20th each year;

b) The file proposing recognition of the county as meeting new rural standards submitted by the county People's Committee directly or via postal service for verification (two sets of files) includes:

The report of the county People's Committee proposing verification and recognition of the county as meeting new rural standards (original - according to Form No. 2.3 in Appendix II issued together with this Circular);

Compilation of the list of communes meeting new rural standards within the county (original - according to Form No. 8.1 in Appendix VIII issued together with this Circular);

Report on the implementation of the county new rural standards (original - accompanied by detailed tables of the results of implementing the county new rural standards - according to Form No. 3.2 in Appendix III issued together with this Circular);

Report on the compilation of participation opinions from agencies, organizations, and residents within the county on the results of implementing the county new rural standards (original - according to Form No. 4.2 in Appendix IV issued together with this Circular).

Minutes of the meeting (comprising members of the Steering Committee for the National Target Program on New Rural Development at the county level and representatives from the leadership of the People's Committees of communes within the county) proposing recognition of the county as meeting new rural standards (original - according to Form No. 5.3 in Appendix V issued together with this Circular);

c) Receiving unit for the dossier: The provincial Standing Office of the Program.

Article 13. Organization of verification and proposal for recognition of counties meeting new rural standards

1. Review organization:

a) The Provincial People's Committee establishes a Verification Team (comprising members who are representatives of leaders from provincial departments responsible for new rural criteria) to verify the level of achievement of new rural county criteria for each county; The provincial Standing Office of the Program prepares a report on the results of verifying the dossier and the level of achievement of new rural county criteria for each county, reporting to the Provincial People's Committee;

b) Within ten days from the date of receipt of the dossier proposing recognition of counties meeting new rural standards submitted by the County People's Committee, the Provincial People's Committee responds in writing to the County People's Committee regarding the results of verifying the level of achievement of new rural county criteria for each county, clearly stating the reasons why the county has not been proposed for recognition as meeting new rural standards.

2. Soliciting opinions:

a) The Provincial People's Committee compiles a list of counties meeting the conditions for proposing recognition as meeting new rural standards and announces it at least three times through provincial radio and television channels to solicit public opinion within the province;

b) The Provincial People's Committee sends the report on the results of verifying the dossier and the level of achievement of new rural county criteria for each county to solicit opinions and incorporate the opinions of the provincial Vietnam Fatherland Front, its member organizations, and the County People's Committees within the province to complete the report on the results of verifying the dossier and the level of achievement of new rural county criteria for each county meeting the conditions for proposing recognition as meeting new rural standards.

3. Completing the dossier:

a) The Provincial People's Committee convenes a meeting (comprising members of the Steering Committee of the National Target Program on New Rural Development at the provincial level) to discuss and vote on proposals for recognizing counties meeting new rural standards for each county; Complete the dossier proposing recognition of counties meeting new rural standards when the consensus result of the meeting must reach 90% or more, and submit it to the Ministry of Agriculture and Rural Development before December 5th each year;

b) The dossier proposing recognition of counties meeting new rural standards submitted by the Provincial People's Committee for review and assessment (one set of dossiers) includes:

The request of the Provincial People's Committee for review and recognition of counties meeting new rural standards (original - according to Model No. 2.4 in Appendix II issued together with this Circular);

Report on the verification of the dossier and the results of achieving new rural county criteria for each county (original - accompanied by a detailed table of the level of achievement of new rural county criteria - according to Model No. 6.2 in Appendix VI issued together with this Circular);

Report summarizing the opinions of agencies, organizations, and people in the province on the results of verifying the level of achievement of new rural county criteria for each county (original - according to Model No. 7.2 in Appendix VII issued together with this Circular);

Minutes of the meeting (comprising members of the Steering Committee of the National Target Program on New Rural Development at the provincial level) proposing recognition of counties meeting new rural standards (original - according to Model No. 5.4 in Appendix V issued together with this Circular);

(Attached to the dossier submitted by the County People's Committee for verification as stipulated in point b, Clause 3, Article 12 of this Circular).

c) Receiving unit for the dossier: Ministry of Agriculture and Rural Development (Central Office for New Rural Development Coordination; No. 02 Ngoc Ha - Ba Dinh - Hanoi).

Article 14. Organization for Appraisal and Recognition of Rural Districts Meeting New Rural Standards

1. The Ministry of Agriculture and Rural Development shall organize the appraisal of the dossier, submit to the Prime Minister for consideration and decision on recognizing rural districts meeting new rural standards before December 15 each year.

2. In cases where rural districts do not meet the conditions stipulated for requesting recognition as meeting new rural standards, the Ministry of Agriculture and Rural Development shall reply in writing to the provincial People's Committee, district People's Committee, and clearly state the reasons for not being eligible for recognition within 15 days from the date of receipt of the dossier requesting recognition of rural districts meeting new rural standards from the provincial People's Committee.

Section 3

PROCEDURES, FORMALITIES, AND FILES FOR RECOGNIZING

REACHING NEW RURAL STANDARDS AT THE PROVINCE LEVEL

Article 15. Registration for Provinces Reaching New Rural Standards

1. The provincial People's Committee shall register provinces reaching new rural standards before December 20 of the year immediately preceding the evaluation year. The Ministry of Agriculture and Rural Development will only confirm registration for provinces that have 60% of their rural districts meeting the standards at the time of registration and have the necessary conditions to strive to reach the standards during the evaluation year.

2. The provincial People's Committee shall submit directly or send via postal service the registration document for provinces reaching new rural standards (two copies according to Model No. 1.3 attached as Appendix I of this Circular) to the Ministry of Agriculture and Rural Development for confirmation.

3. Within five days from the date of receipt of the registration from the provincial People's Committee, the Ministry of Agriculture and Rural Development shall reply in writing to the provincial People's Committee regarding the result of confirming the registration for provinces reaching new rural standards, clearly stating the reasons for provinces not being confirmed in the registration for provinces reaching new rural standards.

Article 16. Recognition of Provinces Reaching New Rural Standards

The procedures and formalities for recognizing provinces reaching new rural standards include the following steps:

1. The provincial People's Committee shall organize self-assessment of the results of implementing new rural province criteria.

2. The Ministry of Agriculture and Rural Development shall organize the appraisal of the dossier, submit to the Prime Minister for consideration and decision on recognizing provinces reaching new rural standards.

Article 17. Organization for Self-Assessment of Results of Implementing New Rural Province Criteria

The provincial People's Committee shall organize self-assessment of the results of implementing new rural province criteria as follows:

1. Organizing self-assessment:

a) For rural districts that have met the new rural standards: The provincial People's Committee shall compile a list of rural districts on the provincial territory that have been recognized as meeting new rural standards by the Prime Minister's decision.

b) For rural districts that have not yet met the new rural standards: The provincial People's Committee shall establish an Assessment Team (comprising members representing leaders of specialized agencies of the province responsible for new rural standards) to assess the actual level of achievement of new rural district criteria for each rural district on the provincial territory; the provincial Steering Committee Office shall prepare a report on the implementation of new rural province criteria, to be reported to the provincial People's Committee.

2. Soliciting opinions:

a) The provincial People's Committee shall submit the report on the implementation of new rural province criteria for comments and incorporate feedback from the Provincial People's Council and its member organizations to complete the report on the implementation of new rural province criteria.

b) The report on the implementation of new rural province criteria shall be published on mass media and the provincial People's Committee's website for ten days to solicit opinions from agencies, organizations, and residents in the province.

3. Completing the dossier:

a) The provincial People's Committee shall incorporate opinions received, complete the report on the implementation of new rural province criteria; convene a meeting (including members of the provincial Steering Committee for the National Target Program on Building New Rural Areas and representatives of the district People's Committees) to discuss and vote on requesting recognition of the province as meeting new rural standards; complete the dossier for requesting recognition of the province as meeting new rural standards when the consensus rate at the meeting must be 90% or higher, and submit it to the Ministry of Agriculture and Rural Development before December 15 each year.

b) The dossier for requesting recognition of the province as meeting new rural standards submitted by the provincial People's Committee shall include (one set):

A request for appraisal and recognition of the province as meeting new rural standards from the provincial People's Committee (original - according to Model No. 2.5 attached as Appendix II of this Circular);

A compilation of the list of rural districts that have met new rural standards on the provincial territory (original - according to Model No. 8.2 attached as Appendix VIII of this Circular);

A report on the implementation of new rural province criteria (original - accompanied by detailed tables of the implementation results of new rural province criteria - according to Model No. 3.3 attached as Appendix III of this Circular);

A summary of opinions from agencies, organizations, and residents in the province on the implementation of new rural province criteria (original - according to Model No. 4.3 attached as Appendix IV of this Circular);

Minutes of the meeting (including members of the provincial Steering Committee for the National Target Program on Building New Rural Areas and representatives of the district People's Committees) requesting recognition of the province as meeting new rural standards (original - according to Model No. 5.5 attached as Appendix V of this Circular);

c) The entity receiving the dossier: The Ministry of Agriculture and Rural Development (Central Office for New Rural Development Coordination; No. 2 Ngoc Ha - Ba Dinh - Hanoi).

Article 18. Organization for Appraisal and Recognition of Provinces Meeting New Rural Standards

1. The Ministry of Agriculture and Rural Development shall organize the appraisal of the dossier, submit to the Prime Minister for consideration and decision on recognizing provinces meeting new rural standards before December 25 each year.

2. In cases where the province does not meet the conditions stipulated for requesting recognition as meeting new rural standards, within 15 days from the date of receipt of the dossier requesting recognition as meeting new rural standards from the provincial People's Committee, the Ministry of Agriculture and Rural Development shall reply in writing to the provincial People's Committee and clearly state the reasons for not being eligible for recognition.

Chapter III

ANNOUNCEMENT AND RECOGNITION OF COMMUNES, DISTRICTS, AND PROVINCES MEETING NEW RURAL STANDARDS

PROVINCE MEETS THE NEW RURAL STANDARDS

Article 19. Announcement of Communes, Districts, and Provinces Meeting New Rural Standards

1. The Chairman of the Provincial People's Committee shall organize the announcement of the decision recognizing communes meeting new rural standards and publicize it on newspapers, radio, television, and the provincial electronic information website.

2. The Prime Minister shall announce districts and provinces meeting new rural standards.

Article 20. Re-recognition of Communes, Districts, and Provinces Meeting New Rural Standards

The procedures, formalities, and dossiers for re-recognition of communes, districts, and provinces meeting new rural standards are as follows:

1. Re-recognition of Communes Meeting New Rural Standards

a) The commune People's Committee shall organize the review and assessment of criteria that have been met as follows:

Organizing the review and assessment: The commune People's Committee shall establish an Assessment Team (comprising members representing the commune Steering Committee, Management Board, and Village Development Committees) to review and assess the level of achievement of each criterion within the commune; the Management Board shall prepare a report on the results of implementing the criteria and report to the commune People's Committee.

Soliciting opinions: The commune People's Committee shall send the report on the results of implementing the criteria to solicit the opinions of the Vietnam Fatherland Front at the commune level, its affiliated organizations, and publicly announce it through the commune's radio system for ten days so that the people can be informed and provide their opinions; incorporate the received opinions to supplement and perfect the report on the results of implementing the criteria.

Completing the dossier: carried out in accordance with Clause 3 of Article 6 of this Circular.

b) The district People's Committee shall organize the verification and propose the re-recognition of communes meeting new rural standards in accordance with Article 7 of this Circular.

c) The provincial People's Committee shall organize the appraisal, and the Chairman of the provincial People's Committee shall decide on the re-recognition of communes meeting new rural standards in accordance with Article 8 of this Circular.

2. Re-recognition of Districts Meeting New Rural Standards

a) The district People's Committee shall organize the review and assessment of criteria that have been met for new rural districts as follows:

Organizing the review and assessment: The district People's Committee shall establish an Assessment Team (comprising members representing the heads of specialized agencies of the district responsible for the new rural criteria) to review and assess the level of achievement of the new rural district criteria within the district; the Program's Permanent Office at the district level shall prepare a report on the results of implementing the new rural district criteria and report to the district People's Committee.

Soliciting opinions: The district People's Committee shall send the report on the results of implementing the new rural district criteria to solicit the opinions of the Vietnam Fatherland Front at the district level and its affiliated organizations to complete the report on the results of implementing the new rural district criteria.

Completing the dossier: carried out in accordance with Clause 3 of Article 12 of this Circular.

b) The provincial People's Committee shall organize the verification and propose the re-recognition of districts meeting new rural standards in accordance with Article 13 of this Circular.

c) The Ministry of Agriculture and Rural Development shall organize the appraisal of the dossier, submit to the Prime Minister for consideration and decision on re-recognition of districts meeting new rural standards in accordance with Article 14 of this Circular.

3. Re-recognition of Provinces Meeting New Rural Standards

a) The provincial People's Committee shall organize the review and assessment of criteria that have been met for new rural provinces as follows:

Organizing the review and assessment: The provincial People's Committee shall establish an Assessment Team (comprising members representing the heads of specialized agencies of the province responsible for the new rural criteria) to specifically review and assess the actual level of achievement of the new rural province criteria within the province; the Program's Permanent Office at the provincial level shall prepare a report on the results of implementing the new rural province criteria and report to the provincial People's Committee.

Soliciting opinions: The provincial People's Committee shall send the report on the results of implementing the new rural province criteria to solicit the opinions of the Vietnam Fatherland Front at the provincial level and its affiliated organizations to complete the report on the results of implementing the new rural province criteria.

Completing the dossier: carried out in accordance with Clause 3 of Article 17 of this Circular.

b) The Ministry of Agriculture and Rural Development shall organize the appraisal of the dossier, submit to the Prime Minister for consideration and decision on re-recognition of provinces meeting new rural standards in accordance with Article 18 of this Circular.

Chapter IV

IMPLEMENTATION

Article 21. Responsibility for Implementation

1. Responsibilities of the People's Committees of Provinces and Central Cities Directly Under the Central Government:

a) Assign specialized management agencies under the provincial People's Committee to take the lead and coordinate with relevant sectors to provide specific guidance on the implementation of the assessment, verification, and appraisal of the level of achievement of new rural criteria within their administrative jurisdiction based on central-level guiding documents but adjusted to local conditions without lowering the standards set forth in this Circular;

b) Assign the Program's Permanent Office at the provincial level to receive dossiers and take the lead in coordinating with related agencies to complete the procedures for appraisal, submit to the Chairman of the provincial People's Committee for decision on recognition and announcement of communes meeting new rural standards; simultaneously assist the provincial People's Committee in completing the dossier for appraisal and recognition of districts and provinces meeting new rural standards.

2. The National Coordinating Office for New Rural Areas:

Receive dossiers and take the lead in coordinating with related agencies to complete the procedures and assist the Ministry of Agriculture and Rural Development in appraising dossiers, submitting to the Prime Minister for consideration and decision on recognition and announcement of districts and provinces meeting new rural standards.

Article 22. Effectiveness

1. This Circular takes effect from December 29, 2014.

2. For communes that have been recognized and announced as meeting the new rural area standards before the date this Circular takes effect, the recognition results shall be retained; the re-recognition process shall be carried out in accordance with the provisions of this Circular.

3. For communes currently undergoing the procedures and formalities for recognizing and announcing them as meeting the new rural area standards according to the temporary regulations of the provincial People's Committee, if they have not been recognized and announced at the time this Circular takes effect, they shall continue to implement the subsequent steps as provided for in this Circular.

4. During the implementation process, if any issues arise or difficulties occur, localities shall report to the Ministry of Agriculture and Rural Development for research, amendment, and supplementation to ensure appropriateness./.
