Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Investment Law on November 26, 2014;

Pursuant to Decree No. 29/2008/NĐ-CP dated March 14, 2008 of the Government on industrial zones, export processing zones and economic zones, and Decree No. 164/2013/NĐ-CP dated November 12, 2013 of the Government amending and supplementing certain articles of Decree No. 29/2008/NĐ-CP dated March 14, 2008 of the Government on industrial zones, export processing zones and economic zones;

Pursuant to Decision No. 52/2008/QĐ-TTg dated April 25, 2008 of the Prime Minister approving the Master Plan for the Development of Border Gate Economic Zones in Vietnam until 2020;

Pursuant to Decision No. 1531/QĐ-TTg dated August 30, 2013 of the Prime Minister approving the Adjustment Plan for the Master Plan for the Development of Border Gate Economic Zones in Vietnam until 2020 with a vision to 2030;

Pursuant to Decision No. 1636/QĐ-TTg dated September 22, 2015 of the Prime Minister approving the adjustment of the Comprehensive Plan for Socio-Economic Development of Lao Cai Province until 2020 with a vision to 2030;

Based on the proposal of the Minister of Planning and Investment and the Chairman of the People's Committee of Lao Cai Province;

The Prime Minister issues this Decision on the expansion of the Lao Cai Border Gate Economic Zone, Lao Cai Province.

Article 1. Expansion of the Lao Cai Border Gate Economic Zone

Article 1. The Lao Cai Border Gate Economic Zone is a defined geographic area within the national territory and sovereignty, having a separate economic space.

After adjustment, the Lao Cai Border Gate Economic Zone has a total area of 15,929.8 hectares, with specific administrative boundaries as follows:

- City of Lao Cai: Ward Lao Cai; Ward Phố Mới; Ward Duyên Hải; villages Hong Son, Son Man 1, Son Man 2 in Van Hoa Commune; villages Lang Den, Kim Thanh, Luc Cau in Dong Tuyen Commune.

- Ba Thang District: Villages Nam So, Km8, Ban Quan in Ban Phiet Commune.

- Bat Xat District: Villages Kim Thanh 1, Kim Thanh 2, Lang Hang, An Quang in Quang Kim Commune; Tan Hong, Chau Giang, Hai Khe, Ban Qua, Ban Ven, Ban Vai, Cooc Cai in Ban Qua Commune; Km0, Muong Do, Team 1, Team 2, Team 3 in Ban Vuoc Commune; Tan Tien, Pho Moi 1, Pho Moi 2 in Trinh Tuong Commune; Minh Trang, Tan Giang, Ban Trang in Coc My Commune; Ngam Xa, Ma Co, Cuoi Suoi in Nam Chac Commune; Nam Mit, Tung Sang, Lung Po 1, Lung Po 2, Pac Ta, Sa Pa in A Mu Sung Commune; Seo Phin Chu, Khu Chu Lin in A Lu Commune; Chin Chu Lin in Ngai Thu Commune; Hong Ngai, Sim San 1, Sin Chai 1 in Y Ty Commune.

- Muong Khuang District: Town Muong Khuang; villages Lao To, Vu Xa, Na Mang, Lung Thang in Ta Gia Khau Commune; Din Chin 2, Ngai Thu 2, Lung San Cho in Din Chin Commune; Lo Co Chin, Ta Lung Thang, Xa Chai, Sin Chai, Pha Long 1, Pha Long 2, Lao Tao in Pha Long Commune; Sin Chai A, Sin Chai B, Thang Chu Pen, Lung Vui, Ban Pho in Ta Ngai Cho Commune; Seo Tung, Can Ho, Tung Chung Pho in Tung Chung Pho Commune; Pac Po, Na Loc 1, Na Loc 2, Na Loc 3, Na Loc 4, Coc Phuong in Ban Lau Commune; Lao Chai, Thon Moi, Gia Khau B, San Pan in Nam Chay Commune; Coc Lay in Lung Vai Commune.

- Si Ma Cai District: villages Hoa Chu Phung, Lung Chong, Sang Chai 5 in Nan San Commune; Na Cang, Sin Chai in Si Ma Cai Commune; Lu Di San in San Chai Commune.

Article 2. The Lao Cai Border Gate Economic Zone shall be organized into functional areas including: Duty-free zone; border gate area; industrial parks and small-scale industrial clusters; entertainment, tourism, urban, residential areas, and other functional areas in accordance with the provisions of the law and the characteristics of the locality. The scale and location of each functional area shall be determined in the general planning, sectoral planning, and detailed planning of the Lao Cai Border Gate Economic Zone.

Article 2. Mechanisms and policies for the Lao Cai Border Gate Economic Zone

Article 1. The Lao Cai Border Gate Economic Zone operates in accordance with current laws on economic zones, border gate economic zones, and other relevant legal regulations.

Article 2. The assurance of business investment for investors due to changes in geographical boundaries as stipulated in Clause 1, Article 1 of this Decision shall be implemented in accordance with Article 13 of the Investment Law 2014 and Article 3 of Decree No. 118/2015/NĐ-CP dated November 12, 2015 of the Government detailing and guiding the implementation of certain provisions of the Investment Law.

Article 3. Implementation Provisions

Article 1. This Decision takes effect from November 15, 2016.

This Decision abolishes Decision No. 44/2008/QĐ-TTg dated March 26, 2008 of the Prime Minister on the issuance of the Operation Regulations of the Lao Cai Border Gate Economic Zone, Lao Cai Province, and abolishes provisions in other legal regulations that conflict with this Decision.

Article 2. Ministers, Heads of ministerial-level agencies, Heads of governmental agencies, and the Chairman of the People's Committee of Lao Cai Province are responsible for implementing this Decision./.
