Pursuant to the Law on Thrift and Combating Wastefulness dated November 26, 2013;
Pursuant to the Law on Fees and Charges dated November 25, 2015;
Pursuant to the Decree No. 120/2016/NĐ-CP dated August 23, 2016 of the Government detailing and guiding the implementation of certain articles of the Law on Fees and Stamp Duties;
Pursuant to Decree No. 16/2015/NĐ-CP dated February 14, 2015 of the Government stipulating the self-management mechanism of public service units;
Pursuant to Decree No. 141/2016/NĐ-CP dated October 10, 2016 of the Government stipulating the self-management mechanism for public service units in the economic sector and other services;
At the proposal of the Minister of Information and Communications;
The Prime Minister promulgates this Decision on the application of financial mechanisms for the Radio Frequency Management Agency under the Ministry of Information and Communications.
Article 1. The Radio Frequency Management Agency shall implement a financial self-management mechanism like that of public service units in the economic sector and other services that self-fund their regular expenses and investment costs as prescribed in Decree No. 16/2015/NĐ-CP dated February 14, 2015 of the Government stipulating the self-management mechanism for public service units and Decree No. 141/2016/NĐ-CP dated October 10, 2016 of the Government stipulating the self-management mechanism for public service units in the economic sector and other services, and guiding documents implementing these Decrees.
Article 2. The Radio Frequency Management Agency may use retained revenue from fees to fund its activities, including: investment costs; procurement costs; major repairs of assets, machinery, and equipment; supplementary income for employees; special tasks according to the functions, duties, and authorities of the Radio Frequency Management Agency.
Article 3. This Decision takes effect from November 15, 2017 and applies from the 2017 budget year; it replaces Decision No. 88/2008/QĐ-TTg dated July 4, 2008 of the Prime Minister stipulating the functions, duties, authorities, and organizational structure of the Radio Frequency Management Agency under the Ministry of Information and Communications.
The Ministers of Information and Communications, Finance, Planning and Investment, Home Affairs, the Director of the Radio Frequency Management Agency, and the Heads of related agencies are responsible for implementing this Decision./.
