Guidelines for affixing energy labels
for passenger cars with electronic media in Vietnam seven seats to nine seats

Pursuant to the Law on Rational and Efficient Energy Use dated June 17, 2010;
Pursuant to Decree No. 21/2011/NĐ-CP dated March 29, 2011 of the Government detailing and providing implementation measures for the Law on Rational and Efficient Energy Use;
Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Pursuant to Decision No. 04/2017/QĐ-TTg dated 09 the 3 Article 2. The receipt, handling of reflections and petitions from individuals and organizations concerning administrative regulations shall be carried out in accordance with Decree No. 20/2008/NĐ-CP dated February 14, 2008 of the Government on the receipt, handling of reflections and petitions from individuals and organizations concerning administrative regulations (amended and supplemented by Decree No. 48/2013/NĐ-CP dated May 14, 2013 on amending and supplementing certain articles of decrees related to administrative procedure control and Decree No. 92/2017/NĐ-CP dated August 7, 2017 on amending and supplementing certain articles of decrees related to administrative procedure control).7 of the Prime Minister stipulating the list of vehicles and equipment required to affix energy labels, applying minimum energy efficiency levels, and implementing schedules;
At the proposal of the Director of the Department of Environment and the Director of the Vietnam Vehicle Inspection Agency;
The Minister of Transport issues this Circular guiding the affixing of energy labels for electronic media in Vietnam seven seats to nine seats.
Article 1. Scope of application
This Circular guides the affixing of energy labels for passenger cars with more than seven seats to nine seats (hereinafter referred to as cars) that are newly produced, assembled from parts, or imported without prior use.
Article 2. Applicability
1. This Circular applies to organizations and individuals related to the production, assembly, import, sale, testing of fuel consumption, and certification of energy label affixation for cars.
2. This Circular does not apply compulsorily to:
a) Vehicles produced, assembled, directly imported for national defense and security purposes of the Ministry of National Defense and the Ministry of Public Security;
b) Temporarily imported and re-exported cars; transit cars; diplomatic and consular cars;
c) Single imported cars not for business purposes;
d) Cars imported according to special regulations of the Prime Minister;
đ) Cars using fuels other than gasoline, diesel, liquefied petroleum gas (LPG), and natural gas (NG).
Article 3. Definitions
Some terms defined in this Circular are understood as follows:
1. The energy label of the car (hereinafter referred to as the energy label) is a label providing information related to the type of fuel used and the fuel consumption level of the car, helping consumers recognize and choose fuel-efficient cars.
2. The energy consumption level of the car (fuel consumption level) is the amount of fuel consumed by the car over a certain distance, corresponding to specified test conditions and cycles. The unit of measurement for fuel consumption is liters (l)/100 kilometers (km) (for gasoline, LPG, and diesel) or cubic meters (m³)/100 kilometers (km) (for NG).33. Passenger cars are defined in Clause 3.1.1 of Vietnam Technical Standard TCVN 7271:2003 - Road Traffic Vehicles - Passenger Cars - Classification According to Purpose.
4. Car models are defined in the following documents:
a) Clause 1.3.6 of National Technical Regulation QCVN 86:2015/BGTVT - National Technical Regulations on Exhaust Emissions of New Produced, Assembled, and Imported Motor Vehicles (hereinafter referred to as QCVN 86:2015/BGTVT);
b) Clause 3.2 of Vietnam Technical Standard TCVN 7792:2015 - Road Traffic Vehicles - Method for Measuring Carbon Monoxide Emissions and Fuel Consumption and/or Electric Energy Consumption for Passenger Cars Driven by Internal Combustion Engines or Hybrid Electric Drive Systems and Method for Measuring Electric Energy Consumption for Type M1 and N1 Vehicles Driven by Electric Drive Systems - Requirements and Test Methods published by the Ministry of Science and Technology (hereinafter referred to as TCVN 7792:2015);
c) Clause 3.2 of Vietnam Technical Standard TCVN 9854:2013 - Road Traffic Vehicles - Passenger Cars - Fuel Consumption Limits and Determination Methods published by the Ministry of Science and Technology (hereinafter referred to as TCVN 9854:2013);2 5. Production and assembly facilities are enterprises producing and assembling (hereinafter referred to as SXLR) new cars from parts, operating in accordance with the law;
6. Import facilities are organizations conducting car imports (hereinafter referred to as NK);
7. Car sales facilities are organizations and individuals selling and distributing cars to the market.
General guidelines for affixing energy labels
1. Cars within the scope regulated by this Circular must be affixed with energy labels in accordance with the provisions before being put on the market.
Article 4. 2. General provisions on affixing energy labels for cars shall be implemented in accordance with Clauses 2, 3, 4, 5, and 6 of Article 4 of the Joint Circular No. 43/2014/TTLT-BGTVT-BCT dated September 24, 2014 of the Ministers of the Ministry of Transport and the Ministry of Industry and Trade on affixing energy labels for passenger cars with up to seven seats (hereinafter referred to as Joint Circular No. 43/2014/TTLT-BGTVT-BCT).
1. Vehicles within the scope of regulation of this Circular must be affixed with energy labels in accordance with the provisions before being put on the market.
2. General provisions on affixing energy labels for vehicles shall be implemented in accordance with Clauses 2, 3, 4, 5, and 6 of Article 4 of Joint Circular No. 43/2014/TTLT-BGTVT-BCT dated September 24, 2014 of the Minister of Transport and the Minister of Industry and Trade on affixing energy labels for passenger cars up to seven seats (hereinafter referred to as Joint Circular No. 43/2014/TTLT-BGTVT-BCT).
Article 5. Self-disclosure of fuel consumption and energy labeling
1. Production and Import entities are entitled to self-disclose fuel consumption and affix energy labels in the following cases:
a) Motor vehicles produced that belong to vehicle types which have been issued a certificate of technical safety and environmental protection quality (hereinafter referred to as ATKT&BVMT) according to Circular No. 30/2011/TT-BGTVT dated April 15, 2011 of the Minister of Transport on the inspection of technical safety and environmental protection quality in motor vehicle production (hereinafter referred to as Circular No. 30/2011/TT-BGTVT) and Circular No. 54/2014/TT-BGTVT dated October 20, 2014 of the Minister of Transport amending and supplementing some articles of Circular No. 30/2011/TT-BGTVT (hereinafter referred to as Circular No. 54/2014/TT-BGTVT), before January 1, 2018.
b) Imported motor vehicles that belong to vehicle types which have been issued a certificate of technical safety and environmental protection quality according to Circular No. 31/2011/TT-BGTVT dated April 15, 2011 of the Minister of Transport on the inspection of technical safety and environmental protection quality of imported motor vehicles (hereinafter referred to as Circular No. 31/2011/TT-BGTVT) and Circular No. 55/2014/TT-BGTVT dated October 20, 2014 of the Minister of Transport amending and supplementing some articles of Circular No. 31/2011/TT-BGTVT (hereinafter referred to as Circular No. 55/2014/TT-BGTVT), before January 1, 2018.
2. The self-disclosure of fuel consumption and affixing of energy labels shall be carried out in accordance with Clause 2, Article 5 of Joint Circular No. 43/2014/TTLT-BGTVT-BCT.
Article 6. Implementation of Energy Labeling
1. Regulations on inspection, certification of fuel consumption and affixing of energy labels shall be implemented in accordance with Chapter II and Chapter III of Joint Circular No. 43/2014/TTLT-BGTVT-BCT.
2. Responsibilities of production and import entities, business entities, and relevant agencies subject to this Circular shall be implemented in accordance with Articles 15, 16, and 17 of Joint Circular No. 43/2014/TTLT-BGTVT-BCT.
Article 7. Effective Date
1. This Circular takes effect from January 1, 2018.
2. Implementation timeline for energy labeling:
a) Motor vehicles produced and imported from January 1, 2018 must affix energy labels.
b) Cases of self-disclosure of fuel consumption and affixing of energy labels as stipulated in Clause 1, Article 5 of this Circular shall be implemented until December 31, 2018.
3. In case the documents, materials, standards, and technical regulations referenced in this Circular are amended, supplemented, or replaced, they shall be applied according to the amended, supplemented, or replaced documents.
Article 8. Implementation organization
1. The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Vehicle Inspection Agency, the Heads of agencies, units, organizations, and individuals related to this matter are responsible for implementing this Circular.
2. During implementation, if any issues arise, relevant agencies, organizations, and individuals shall promptly report them to the Ministry of Transport for consideration and resolution within their authority./.
