CIRCULAR

AMENDING AND SUPPLEMENTING CIRCULAR NO. 257/1998/TT-BGTVT OF AUGUST 18, 1998, ISSUED BY THE MINISTER OF TRANSPORT TO GUIDE THE IMPLEMENTATION OF THE VIETNAM-LAO PEOPLE'S DEMOCRATIC REPUBLIC ROAD TRANSPORT AGREEMENT BETWEEN THE GOVERNMENTS OF THE SOCIALIST REPUBLIC OF VIETNAM AND THE LAO PEOPLE'S DEMOCRATIC REPUBLIC.

In order to concentrate on organizing management and rationalize the issuance of permits for automobile transport enterprises participating in Vietnam-Laos international transportation, the Ministry of Transport amends Clause 7 of Section "II. Specific Provisions for Implementing the Protocol"; Section "III. Issuing Authority for International Transport Permits"; and Section "IV. Implementation Organization" of Circular No. 257/1998/TT-BGTVT dated August 18, 1998, issued by the Minister of Transport, as follows:

II. SPECIFIC PROVISIONS FOR IMPLEMENTING THE PROTOCOL:

||| 7.2 Declaration for issuance of Vietnam-Laos Combined Transport Permit for each vehicle (Form No. 2).

7.1 Application for international transport permit (according to Form No. 1).

7.2 Inventory of each vehicle requiring an international transport permit (according to Form No. 2).

7.3 Certificate of Vehicle Ownership Registration (certified copy or photocopy with original for verification).

7.4 For transport businesses, they must have Business Registration Certificate and Transport Contracts, Joint Venture Contracts, Construction Contracts... (certified copy or photocopy with original for verification).

7.5 Certified copy of Business Registration Certificate (certified copy or photocopy with original for verification) or approval document from the Vietnam Highway Administration.

Transport units that are regularly assigned tasks for Vietnam-Laos transport by the Ministry of Transport or the Vietnam Highway Administration are exempted from the procedures specified in Clause 7.4 above.

III. AUTHORITY ISSUING INTERNATIONAL TRANSPORT PERMITS:

1. Types of Vietnam-Laos international transport permits:

- Type 1: Issued to road transport vehicles of specialized transport businesses for multiple crossings within a maximum period of one year.

- Type 2: Issued to road transport vehicles for a single crossing within a maximum period not exceeding thirty days.

||| 2.2 Provincial Departments of Transport and Transport Services to issue Permits to transport units with headquarters in their respective provinces (excluding those mentioned in Point 2.1 above).

2.1 The Vietnam Highway Administration issues all types of international transport permits to units and companies under its jurisdiction and units and companies under the Ministry of Transport with business offices located in Hanoi.

2.2 Provincial Departments of Transport (Public Works) issue all types of international transport permits to transport units with business offices located in their respective provinces (excluding those units and companies mentioned in Point 2.1 above).

The Vietnam Highway Administration and Provincial Departments of Transport (Public Works) may issue Vietnam-Laos international transport permits for vehicles crossing border gates throughout the country as prescribed.

||| The issuing authority is entitled to collect and use the fee in accordance with the regulations of the Ministry of Finance.

3. Fees for issuing Vietnam-Laos international transport permits

The authority issuing "Vietnam-Laos international transport permits" shall collect and use fees in accordance with regulations of the Ministry of Finance.

IV. Implementation Organization:

1. This Circular takes effect fifteen days from the date of signature. Previous provisions contrary to this Circular are abolished.

2. The Vietnam Highway Administration, the Department of Transport (Public Works) of the province and centrally governed city shall promptly organize the dissemination and implementation of this Circular.

3. By the fifth day of the following month, Provincial Departments of Transport (Public Works) of cities directly under the central government must prepare reports on the number of "Vietnam-Laos international transport permits" issued in the previous month and send them to the Vietnam Highway Administration for monitoring and reporting to the Ministry of Transport.

4. The Vietnam Highway Administration shall be responsible for organizing, inspecting, and monitoring the implementation of this Circular.
