CIRCULAR

Regulations on recruitment, utilization, and training for vocational education teachers

Circular No. 06/2017/TT-BLDTBXH dated March 8, 2017, issued by the Minister of Labor, Invalids, and Social Affairs, regarding the recruitment, utilization, and training for vocational education teachers, shall take effect from May 1, 2017, amended and supplemented by:

Circular No. 28/2022/TT-BLDTBXH dated December 28, 2022, issued by the Minister of Labor, Invalids, and Social Affairs, amending and supplementing certain articles of circulars stipulating the recruitment, utilization, training, and working conditions for vocational education teachers, shall take effect from March 1, 2023.

Pursuant to the Law on Vocational Education dated November 27, 2014;

Pursuant to the Civil Servant Law dated November 15, 2010;

Pursuant to the Law Amending and Supplementing Certain Provisions of the Civil Servants and Public Officials Law and the Public Service Staff Law dated November 25, 2019;

Based on Decree No. 62/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

Pursuant to Decree No. 15/2019/NĐ-CP dated February 1, 2019, of the Government detailing certain provisions and measures to implement the Law on Vocational Education;

Based on Decree No. 115/2020/NĐ-CP dated September 25, 2020, issued by the Government, concerning the recruitment, utilization, and management of civil servants;

Based on the proposal of the Director General of the General Department of Vocational Education;

The Minister of Labor, Invalids, and Social Affairs issues this Circular stipulating the recruitment, utilization, and training for vocational education teachers1.

 

Chapter I. GENERAL PROVISIONS

 

Article 1. Scope of Regulation and Applicability2

1. This Circular stipulates the recruitment of vocational education teachers in public vocational education institutions; the utilization, standardization training, and advanced training of vocational education teachers in vocational education institutions, vocational education activity institutions, and vocational education and general education centers.

2. This Circular applies to vocational education teachers in vocational education institutions, vocational education activity institutions, and vocational education and general education centers; relevant agencies, organizations, and individuals.

3. This Circular does not apply to teachers teaching teacher training programs under the management authority of the Ministry of Education and Training. The provisions on recruitment and utilization in this Circular do not apply to teachers teaching at colleges and secondary vocational schools under the management authority of the Ministry of Public Security and the Ministry of National Defense.

Article 2. Duties and powers of teachers sent for training

1. Teachers sent for standardization training and advanced training (hereinafter referred to collectively as training) must fully implement the study program and plan during the training period; comply with state laws, internal regulations, and rules of the training institution; maintain and protect the property of the training institution.

2.3 Vocational education teachers in public vocational education institutions and vocational education and general education centers who are sent for training shall enjoy their full salary and other benefits as prescribed by law.

3. Teachers teaching in private vocational education institutions and vocational education institutions with foreign investment participating in training classes shall enjoy rights and benefits as prescribed by law.

4. Teachers participating in training courses must commit to working time at their managing unit after completing the training course as prescribed by law.

5. Teachers sent for training or internships at enterprises or specialized agencies must have the responsibility to store and report the outline and results of the training and internship.

Article 3. Funding for training activities4

1. For public institutions, funding for training activities shall be guaranteed from the following sources:

a) State budget funds according to the legal provisions on the financial autonomy mechanism of public institutions;

b) Income from tuition fees and service charges;

c) Other income as prescribed by law.

2. For private vocational education institutions and vocational education institutions with foreign investment, funding for training activities shall be guaranteed from the financial resources of the vocational education institution.

 

Chapter II. RECRUITMENT AND USE OF TEACHERS

 

Article 4. Recruitment of Teachers5

The recruitment of teachers in public vocational education institutions shall be carried out in accordance with the provisions of Chapter II of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, use, and management of civil servants.

Article 5. Use of Teachers6

1. Persons recruited to the position of vocational education profession civil servant must implement the probation period as stipulated in Article 21 of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, use, and management of civil servants.

2. Vocational education institutions, vocational education activity institutions, vocational education and general education centers must use qualified vocational education teachers according to the regulations, suitable for the trained professions, in accordance with the agreement in the employment contract or labor contract.

 

Chapter III. TRAINING FOR TEACHERS

 

Article 6. Types of Training

1. Standardization training is a type of training for teachers to meet the standards of professional knowledge and skills; occupational title qualifications, and other contents as prescribed by law.

2. Advanced training is a type of training for teachers to enhance their professional level, vocational skills, pedagogical expertise, foreign languages, information technology, scientific and technological progress, and other contents to meet the requirements of professional development.

3. Internship at enterprises or specialized agencies for teachers is a type of training to update knowledge, technology, methods of organizing production management, and practical skill training in production, business, and services.

Article 7. Requirements for Training Program Content

The content of the training program must ensure the following requirements:

1. Reflecting the training objectives; specifying the knowledge and skills that learners will acquire upon completion of the course; the scope and structure of the content, teaching methods, and formats; the method of evaluating learning outcomes after completing the course;

2. Ensuring scientificity, modernity, systematicness, practicality, and flexibility to adapt to changes in the labor market; ensuring the interconnection between different training programs;

3. Regularly reviewed and updated to be consistent with production, business, and service technologies.

Article 8. Organization for Building, Reviewing, and Issuing Training Programs

1. Establish a Steering Committee to develop a comprehensive outline, design a general program, and compile detailed programs. The tasks, authorities, structure, composition, and criteria for members of the Steering Committee are specifically defined according to each training program.

2. Establish a Review Board to approve the training program. The tasks, authorities, structure, composition, and criteria for members of the Review Board are specifically defined according to each training program.

3. The approval results of the Review Board serve as the basis for issuing the training program.

Article 9. Forms and Methods of Organizing Training

1. Forms of organization: Concentrated, semi-concentrated, work-study, and distance learning.

2. Methods of organization: Seminars; workshops; specialized training; research and field surveys; study tours; advanced internships; and self-study to improve proficiency.

Article 10. Utilization of Training Results

The results of training shall be used to evaluate teachers in the annual performance review or as conditions for considering promotion in rank, taking promotion exams for civil servants; recognizing standards and other related policies and benefits.

 

Chapter IV. IMPLEMENTATION ORGANIZATION

 

Article 11. Responsibilities of the Ministry of Labor, Invalids and Social Affairs

1. Issuing vocational teacher training programs; certificate templates, and regulations on managing and issuing vocational education certificates for teaching at various levels of vocational training.

2. Issuing standard attainment programs for occupational titles; certificate templates, and regulations on managing and issuing certificates of standard attainment for occupational titles for vocational education teachers as prescribed.

Article 12. Responsibilities of the General Department of Vocational Education and Training

1. Guiding vocational education institutions, ministries, sectors, and localities to develop training plans for vocational education teachers in each phase and annually, and coordinating to implement them.

2. Establishing Steering Committees and Evaluation Boards to organize the development, evaluation, and acceptance of training programs and materials for teachers.

5. Directing, inspecting, and supervising the implementation of the provisions stipulated in this Circular.

Article 13. Responsibilities of Ministries, agencies equivalent to ministries; People's Committees of provinces and centrally-run cities

1.9 Directing vocational education institutions, entities engaged in vocational education activities, vocational education and general education centers under their jurisdiction to implement the provisions of this Circular.

2. Developing plans and budget estimates for teacher training in each phase and annually and submitting them to the competent authority for approval.

3.10 Managing, directing, inspecting, and supervising the recruitment of teachers in public vocational education institutions; using and training vocational education teachers in vocational education institutions, entities engaged in vocational education activities, vocational education and general education centers under their jurisdiction; reporting annually and periodically on the implementation of teacher training to the Ministry of Labor, Invalids and Social Affairs (General Department of Vocational Education and Training).

Article 14. Responsibilities of the Department of Labor, Invalids and Social Affairs

1.11 Assisting the People's Committee of the province or centrally-run city in directing and guiding vocational education institutions, entities engaged in vocational education activities, vocational education and general education centers under their jurisdiction to implement the provisions of this Circular.

2. Developing plans and budget estimates for teacher training in vocational education institutions under their jurisdiction in each phase and annually and submitting them to the People's Committee of the province or centrally-run city for approval.

3.12 Inspecting and supervising the organization of teacher recruitment in public vocational education institutions under their jurisdiction; using and training vocational education teachers in vocational education institutions, entities engaged in vocational education activities, vocational education and general education centers. Reporting annually and periodically on the implementation of teacher recruitment, usage, and training to the People's Committee of the province or centrally-run city.

Article 15. Responsibilities of vocational education institutions, vocational education activity institutions, and vocational education - general education centers13

1.14 Develop plans for recruiting teachers in public vocational education institutions; plans for using and training vocational education teachers in vocational education institutions, vocational education activity institutions, and vocational education - general education centers for each phase and annually to submit for approval by the competent authority.

2. Guide teachers assigned for training to develop plans, outlines, and reports on the results of implementation. Ensure that teachers are rotated for training at least once every five years; intern at enterprises or specialized agencies: four weeks within one year for teachers teaching college and intermediate levels, and two weeks within one year for teachers teaching basic levels.

3. Organize or cooperate with other educational institutions, enterprises, or specialized agencies meeting the required conditions to provide training for teachers.

4. Assign and create favorable conditions for teachers to participate in training courses organized by authorized agencies and units; have mechanisms to encourage self-training activities for teachers.

5. Report on the results of teacher recruitment, utilization, and training work according to each phase and annually as prescribed.

Article 16. Responsibilities of training organizations

1. Training organizations providing training for teachers must ensure the conditions required for each type and content of training and be permitted by the competent authority to organize and implement.

2. Training organizations providing training for teachers must develop training plans; manage the learning process, evaluate, and recognize learning outcomes of learners; report on training results, issue certificates to learners in accordance with the regulations of the Ministry of Labor - Invalids and Social Affairs (General Department of Vocational Education).

 

Chapter V. IMPLEMENTATION PROVISIONS15

 

Article 17. Effective Date

1. This Circular takes effect from May 1, 2017.

2. Decision No. 57/2008/QĐ-BLĐTBXH dated May 26, 2008, issued by the Minister of Labor - Invalids and Social Affairs regarding the use and training of vocational teachers; Circular No. 41/2015/TT-BLĐTBXH dated October 20, 2015, issued by the Minister of Labor - Invalids and Social Affairs regarding the use, standardization training, and advanced training for teachers teaching basic levels shall cease to be effective from the date this Circular takes effect.

3. During the implementation process, if there are difficulties, please reflect them to the Ministry of Labor, Invalids, and Social Affairs for guidance./.
