DECISION

Establishing the Basin Council for the Srepok River

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to the Water Resources Law No. 08/1998/QH10 adopted by the National Assembly of the Socialist Republic of Vietnam on May 20, 1998;

Pursuant to the Government Decree No. 86/2003/NĐ-CP dated July 18, 2003 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Government Decree No. 179/1999/NĐ-CP dated December 30, 1999 stipulating the implementation of the Water Resources Law;

Pursuant to the proposal of the People's Committees of Dak Lak, Dak Nong, Gia Lai, and Lam Dong Provinces at Document No. 01/2005/TT-UBND-LT dated November 22, 2005 regarding the establishment and approval of the operational regulations of the Basin Council for the Srepok River of the four provinces;

At the proposal of the Director of the Water Resources Department and the Head of the Organization and Cadre Affairs Department,

Pursuant to …;

Article 1. Establish the Basin Council for the Srepok River to coordinate activities related to the comprehensive exploitation, utilization, and protection of water resources of the Srepok River within the four provinces of Dak Lak, Dak Nong, Gia Lai, and Lam Dong.

Article 2. The Basin Council for the Srepok River shall have the following tasks:

1. Advising on strategies and policies for water use;

2. Basin planning;

3. Projects for water protection, exploitation, and utilization; flood prevention and mitigation measures; and addressing adverse effects caused by water;

4. Participating in the management, protection, exploitation, and utilization of downstream water resources outside the border according to international treaties and resolving arising disputes;

5. Resolving disputes over water resources within the basin of the four provinces.

Article 3. The composition of the Basin Council for the Srepok River includes:

- Chairman of the Council: The leader of the People's Committee of Dak Lak Province;

- Vice Chairmen of the Council: Three vice chairmen of the Council are the leaders of the People's Committees of Dak Nong, Gia Lai, and Lam Dong Provinces;

- Standing members: The leader of the Department of Agriculture and Rural Development of Dak Lak Province;

- Regular members: Including the leaders of the Departments of Agriculture and Rural Development, Natural Resources and Environment, Planning and Investment, Finance, Water Resources Branches, Heads of the Office of the Flood Control and Disaster Mitigation Command of the four provinces of Dak Lak, Dak Nong, Gia Lai, and Lam Dong, and the leaders of the Water Resources Department, the Mekong River Commission of Vietnam, and the Management Board of Hydropower Project 5;

- Non-standing members: Including representatives from relevant departments and sectors; People's Committees of cities, districts, and towns within the Srepok River basin; representatives from central and local agencies and organizations and individuals invited by the Chairman of the Council when necessary to resolve related matters;

Members of the Basin Council for the Srepok River work on a part-time basis.

Article 4. The appointment of the Chairman of the Council and the Standing Members of the Basin Council, and the issuance of the Regulations on the organization and operation of the Basin Council for the Srepok River shall be decided by the Minister of Agriculture and Rural Development.

Article 5. The Basin Council for the Srepok River has its office located at the Department of Agriculture and Rural Development of Dak Lak Province. The Head of the Council's Office shall be concurrently held by a Standing Member.

The Branch Chiefs of the Water Resources Branches of Dak Lak, Dak Nong, Gia Lai, and Lam Dong Provinces shall concurrently hold the position of Deputy Head of the Council's Office.

The Basin Council for the Srepok River shall use its own seal and open an account at a bank or state treasury for its operations in accordance with current regulations.

The Basin Council for the Srepok River has three branches located at the Departments of Agriculture and Rural Development of Dak Nong, Gia Lai, and Lam Dong Provinces. The Deputy Heads of the Council's Offices in Dak Nong, Gia Lai, and Lam Dong Provinces shall concurrently hold the positions of Branch Chiefs.

The operating funds of the Basin Council for the Srepok River and its Office shall come from agreed contributions of the People's Committees of Dak Lak, Dak Nong, Gia Lai, and Lam Dong Provinces and other sources of support and sponsorship.

Article 6. Ministry of Transport issues this Circular regulating The Water Resources Department shall be responsible for guiding and supervising the activities of the Basin Council to assist the Ministry of Agriculture and Rural Development in managing the Srepok River water resources.

Article 7. This Decision shall take effect fifteen days after its publication in the Official Gazette.

Article 8. The Head of the Office, the Head of the Organization and Cadre Affairs Department, the Director of the Water Resources Department, the Director of the Dike Management and Flood Control Department, the Head of the Financial Department, the members specified in Article 3, the Heads of units under the Ministry, and the Directors of the Departments of Agriculture and Rural Development of Dak Lak, Dak Nong, Gia Lai, and Lam Dong Provinces are responsible for implementing this Decision./.
