MINISTER OF INFORMATION AND COMMUNICATIONS
Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 187/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;
At the proposal of the Cadre and Civil Servant Organization Department Director and the Telecommunications Department Director.
DECISION:
Article 1. Position, Functions
The Telecommunications Department is the advisory body assisting the Minister in performing state management functions over telecommunications, Internet, and broadcasting transmission according to the law.
Article 2. Tasks and Powers
1. To take the lead or participate in research; participate in drafting or reviewing policy reports, strategies, plans, projects, programs on telecommunications, Internet, and broadcasting transmission;
2. To take the lead or participate in drafting; review the substantive content and submit to the Minister regulatory documents, mechanisms, and policies on telecommunications, Internet, and broadcasting transmission;
3. To propose to the Minister recommendations for suspending enforcement or amending and abolishing documents issued by other Ministries, People's Councils, People's Committees, Chairpersons of Provincial People's Committees that contravene regulatory documents on telecommunications, Internet, and broadcasting transmission;
4. To take the lead or participate in guiding the implementation of regulatory documents on telecommunications, Internet, and broadcasting transmission;
5. To take the lead or participate in guiding, directing, and organizing the implementation of approved planning in the field of telecommunications, Internet, broadcasting transmission, mechanisms and policies, investment conditions, resale services, public service programs, shared use of information and communication infrastructure in the field of telecommunications, Internet, and broadcasting transmission;
6. To take the lead in reviewing applications for permits regarding telecommunications and Internet; organize inspections and supervision of the implementation of issued permits;
7. To take the lead in formulating regulations on interconnection of telecommunications and Internet networks; be responsible for organizing and supervising the implementation of approved interconnection regulations;
8. To take the lead in drafting, revising, supplementing; take the lead in reviewing telecommunication resource planning, telecommunication resource management regulations; directly decide or submit to the Minister for decision on allocating and recovering telecommunications codes and numbers according to the Minister's classification;
9. To take the lead in resolving business disputes between enterprises in the provision and use of telecommunications and Internet services; participate in resolving complaints and accusations in the provision and use of telecommunications and Internet services;
10. To take the lead in guiding and directing work to ensure safety and security in telecommunications and Internet activities. Submit to the Minister solutions to ensure safety and security for national information and communication infrastructure;
11. To participate in drafting quality standards and regulations on the application of quality standards in the field of telecommunications and Internet;
13. To take the lead in researching, drafting, or reviewing for submission to the Minister a framework of tariffs or tariffs for telecommunications and Internet products and services;
14. To direct, urge, inspect, and supervise the operation of agencies implementing state management functions in the field of telecommunications and Internet according to the law and the Minister's classification;
15. To participate in inspection work, take the lead or participate in inspecting the implementation of policies, laws, and regulations on telecommunications and Internet by organizations and individuals;
16. To direct, guide, and inspect the implementation of tasks serving communication requirements of Party and State agencies, the Government, National Defense, Security, and major political, economic, and social events. Take the lead in guiding and directing the management of dedicated and exclusive information networks serving the guidance and management of Party and State agencies, National Defense, and Security;
17. To submit to the Minister for decision on measures to mobilize means, equipment, networks, and services of telecommunications and Internet for emergency situations concerning national security and natural disasters according to the law;
18. To manage the activities of associations and non-governmental organizations in the field of telecommunications and Internet according to the Minister's assignment;
19. To participate in international cooperation activities, conferences in the field of telecommunications and Internet both domestically and internationally; Participate in preparing technical content on telecommunications and Internet for the Minister to attend domestic and international telecommunications and Internet conferences;
20. To participate with units under the Ministry in training and issuing certificates on telecommunications and Internet;
21. To prepare content related to telecommunications and Internet to assist the Minister in participating in Boards, Steering Committees, Command Headquarters of the Ministry, inter-ministerial Steering Committees, and Command Headquarters of the Government assigned by the Minister;
22. To participate in researching and providing comments on draft regulatory documents of other Ministries and sectors related to telecommunications and Internet;
23. To manage organization, cadres, civil servants, assets, files, and documents according to the law and the Minister's classification;
24. To perform other tasks assigned by the Minister.
Article 3. Organizational Structure
The Telecommunications Department has a Director, Deputy Directors, and staff.
The Director is responsible to the Minister for organizing the implementation of assigned functions, tasks, and powers.
Deputy Directors assist the Director in directing and managing all aspects of the Department's work and are responsible to the Director for assigned tasks.
The duties and powers of staff in the Telecommunications Department are defined by the Director.
Article 4. Implementation Provisions
This Decision takes effect fifteen (15) days from the date of publication in the Official Gazette. Abolish Decision No. 29/2003/QĐ-BBCVT dated March 12, 2003 of the Minister of Posts and Telecommunications on the functions, tasks, powers, and organizational structure of the Telecommunications Department.
Article 5. Responsibilities for Implementation
The Head of the Office, the Director of the Cadre and Civil Servant Organization Department, the Director of the Telecommunications Department, and the Heads of other agencies and units under the Ministry shall be responsible for implementing this Decision./.
