Pursuant to the Law on Public Officials and Civil Servants dated November 13, 2008;

Pursuant to the Civil Servant Law dated November 15, 2010;

Pursuant to Decree No. 45/2010/NĐ-CP dated April 21, 2010 of the Government on organization, operation, and management of associations; Decree No. 33/2012/NĐ-CP dated April 13, 2012 of the Government amending and supplementing certain articles of Decree No. 45/2010/NĐ-CP;

Pursuant to Decree No. 12/2012/NĐ-CP dated March 1, 2012 of the Government promulgating the Regulation on registration and management of activities of foreign non-governmental organizations in Vietnam;

Pursuant to Decree No. 24/2010/NĐ-CP dated March 15, 2010 of the Government on recruitment, employment, and management of civil servants; Decree No. 06/2010/NĐ-CP dated January 25, 2010 of the Government stipulating persons who are civil servants;

Pursuant to Decree No. 29/2012/NĐ-CP dated April 12, 2012 of the Government on recruitment, use, and management of civil servants;

The Prime Minister issues this Decision on certain regimes and policies for the Vietnam Federation of Friendship Organizations.

Article 1. Position, role, and organization, operation

1. The Vietnam Federation of Friendship Organizations is a specialized political-social organization in the field of people's diplomacy in peace, unity, friendship, and people's cooperation; it operates under the leadership of the Party and state management according to the law; it is a member of the Vietnam Fatherland Front; its role is to coordinate as the focal point for some people's diplomacy activities and the focal point for non-governmental foreign aid work.

2. The Vietnam Federation of Friendship Organizations and the Federation of Friendship Organizations in provinces and centrally governed cities shall be organized tightly, operating and functioning according to the charter approved by the competent state authority and in accordance with the law.

Article 2. Staffing, regimes, and policies

1. The Vietnam Federation of Friendship Organizations and the Federation of Friendship Organizations in provinces and centrally governed cities shall be allocated staffing annually based on job positions suitable to their organizational model and scale of operations, balanced against the central and local annual staffing and budget.

2. For cadres and civil servants transferred or assigned to work at the headquarters of the Vietnam Federation of Friendship Organizations; the headquarters of the Federation of Friendship Organizations in provinces and centrally governed cities, in accordance with Article 12 of Decree No. 06/2010/NĐ-CP dated January 25, 2010 of the Government stipulating persons who are civil servants and those who were civil servants before (from when the Federation was established until the Civil Servant Law took effect on January 1, 2010), working in Party departments, mass organizations, and state agencies, transferred or rotated to work at the headquarters of the Vietnam Federation of Friendship Organizations, the headquarters of the Federation of Friendship Organizations in provinces and centrally governed cities within the allocated staffing quota, the management, utilization, regimes, and policies shall be implemented in accordance with the laws on cadres and civil servants.

3. Those recruited and appointed to work at the headquarters of the Vietnam Federation of Friendship Organizations, the headquarters of the Federation of Friendship Organizations in provinces and centrally governed cities within the allocated staffing quota by the competent state authority shall have their recruitment, utilization, management, regimes, and policies applied in accordance with the Civil Servant Law and guiding documents.

4. Those recruited and appointed to work in professional positions and job positions at units under the Vietnam Federation of Friendship Organizations and the Federation of Friendship Organizations in provinces and centrally governed cities shall have their recruitment, utilization, management, regimes, and policies applied in accordance with the Public Servant Law and guiding documents.

5. Retirees elected to hold specialized leadership positions within the allocated staffing quota of the Vietnam Federation of Friendship Organizations and the Federation of Friendship Organizations in provinces and centrally governed cities shall receive remuneration as prescribed by law.

6. The position allowance for specialized leadership of the Vietnam Federation of Friendship Organizations shall be examined and decided by the Prime Minister on a case-by-case basis.

The position allowance for the heads and deputy heads of regional departments, functional departments, offices, and representative offices of the Vietnam Federation of Friendship Organizations; the position allowance for specialized leadership, heads, and deputy heads of functional departments, and offices of the Federation of Friendship Organizations in provinces and centrally governed cities shall be implemented in accordance with the law.

Article 3. Operating funds

1. The Vietnam Friendship Association and the Friendship Associations in centrally governed cities and provinces shall be guaranteed operating funds from the state budget for people's foreign affairs activities, regular expenses, foreign information dissemination, research, construction of material facilities and working tools, and various systems and policies for cadres, civil servants, public officials, and workers in accordance with the provisions of the law.

2. The Vietnam Friendship Association and the Friendship Associations in centrally governed cities and provinces may accept and utilize financial support from organizations and individuals both within and outside the country in accordance with the provisions of the law.

3. Member organizations of the Vietnam Friendship Association operating nationwide shall be provided with funding linked to tasks assigned by competent authorities in accordance with the provisions of the law.

Article 4. Organization of Implementation

1. This Decision shall take effect from September 1, 2013.

2. The Chairman of the Vietnam Friendship Association, Ministers, Heads of ministerial-level agencies, Heads of government agencies, and Chairmen of People's Committees of centrally governed cities and provinces shall be responsible for implementing this Decision./.
