CIRCULAR

Provisions on utilization, standardization training, and advanced training

for primary level vocational teachers

Pursuant to the Law on Vocational Education dated November 27, 2014;

Pursuant to Decree No. 48/2015/NĐ-CP dated May 15, 2015, of the Government detailing certain provisions of the Vocational Education Law;

Pursuant to Decree No. 106/2012/NĐ-CP dated December 20, 2012, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

Pursuant to Decree No. 29/2012/NĐ-CP dated April 12, 2012 of the Government on recruitment, use, and management of civil servants;

At the proposal of the General Director of the Vocational Training Administration,

the Minister of Labor, Invalids and Social Affairs issues this Circular to stipulate provisions on utilization, standardization training, and advanced training for primary level vocational teachers.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular stipulates provisions on utilization, standardization training, and advanced training for primary level vocational teachers working at vocational education centers or vocational and general education centers, secondary technical schools, colleges, enterprises registered to operate primary level vocational education (hereinafter referred to as vocational education institutions).

2. This Circular applies to primary level vocational teachers working at vocational education institutions, vocational education institutions, and other relevant agencies, organizations, and individuals.

Article 2. Duties and rights of teachers participating in training

1. Primary level vocational teachers who are assigned to participate in training must complete the full training program and plan during the training period; comply with state laws, internal regulations, and rules of the training institution; maintain and protect the property of the training institution.

2. Primary level vocational teachers working at public vocational education institutions who are assigned to participate in training shall be entitled to their regular salary and other benefits as prescribed by law; primary level vocational teachers under labor contracts who are assigned to participate in training shall enjoy rights and benefits agreed upon in their contracts.

3. Primary level vocational teachers working at private vocational education institutions and vocational education institutions with foreign investment when participating in training classes shall enjoy rights and benefits as prescribed by law.

Article 3. Principles for utilizing teachers

1. Vocational education institutions must utilize primary level vocational teachers according to the provisions of Clause 4, Article 53 of the Vocational Education Law 2014 regarding occupational standards, and according to the provisions of Article 54 of the Vocational Education Law 2014 regarding standard qualifications.

2. Primary level vocational teachers currently teaching but not yet meeting the required professional and vocational standards as prescribed by law, within the training age, must be trained and further educated to meet the standards. The maximum time limit to achieve the standards is two years.

Article 4. Funding for training activities

1. For public vocational education institutions: Funding for training activities is sourced from the state budget and income generated by the unit. Other funding sources (if any) are allocated according to the law.

2. For private vocational education institutions and vocational education institutions with foreign investment: Funding for training activities is sourced from the income of the vocational education institution and included in the training costs.

Chapter III

UTILIZATION, STANDARDIZATION TRAINING, AND ADVANCED TRAINING

FOR PRIMARY LEVEL VOCATIONAL TEACHERS

Article 5. Internship content and duration upon recruitment

1. Individuals recruited to the position of primary level vocational teacher must undergo the internship period as stipulated in Clause 4, Article 20 of Decree No. 29/2012/NĐ-CP dated April 12, 2012, of the Government on Recruitment, Utilization, and Management of Civil Servants.

2. The internship period is as stipulated in Clause 2, Article 27 of the Civil Servant Law 2010.

Article 6. Types of Training

1. Standardization training is a type of training aimed at enabling primary level vocational teachers to meet the standards for job titles, professional knowledge, vocational skills, pedagogical expertise, foreign languages, information technology, and other contents as prescribed by law.

2. Advanced training is a type of training aimed at enhancing the professional qualifications, vocational skills, pedagogical expertise, foreign languages, information technology, scientific and technological advancements, and other contents necessary to meet the demands of professional development for primary level vocational teachers.

3. On-the-job training at enterprises is a form of training to update knowledge and practical skills through actual work experiences in enterprises to keep up with current production, business, and service practices.

Article 7. Requirements for Training Program Content

The content of the training program must ensure the following requirements:

1. Clearly define the objectives of training; specify the knowledge and skills that learners should acquire upon completion of the course; delineate the scope and structure of the training content, methods, and formats; establish criteria for evaluating learning outcomes after completing the course.

2. Ensure scientific, modern, systematic, practical, and flexible approaches to adapt to changes in the labor market; ensure connectivity between different training programs.

3. Regularly reviewed and updated to be consistent with production, business, and service technologies.

Article 8. Forms and methods of organizing supplementary training

1. Forms of organization: Concentrated, semi-concentrated, and distance learning.

2. Methods of organization: Seminars; workshops; specialized training; research and field surveys; study tours; advanced internships; and self-study to improve proficiency.

Article 9. Utilization of supplementary training results

Supplementary training results shall be used to evaluate primary-level teachers in their annual task performance, or as conditions for considering promotion in rank or taking promotion examinations; for recognizing qualification standards and other related policies and benefits.

Chapter III

IMPLEMENTATION

Article 10. Responsibilities of the Ministry of Labor, Invalids and Social Affairs

1. Guide vocational education institutions, ministries, sectors, and localities to develop plans for utilizing and standardizing supplementary training, as well as advanced supplementary training for primary-level teachers on an annual basis and by stages; approve and coordinate in organizing implementation.

2. Organize the development and issuance of supplementary training programs.

3. Monitor, inspect, and audit the implementation of regulations concerning the utilization and standardizing supplementary training, as well as advanced supplementary training for primary-level teachers.

Article 11. Responsibilities of Ministries, agencies at the level of ministries; People's Committees of provinces and centrally governed cities

1. Direct vocational education institutions under their management to implement this Circular.

2. Develop plans and budget estimates for supplementary training for primary-level teachers on an annual basis and by stages, and submit them for approval by competent authorities.

3. Manage, direct, and organize the implementation of plans for utilizing and supplementary training for primary-level teachers within their jurisdiction; report periodically and ad hoc on the implementation of supplementary training activities for teachers to the Ministry of Labor, Invalids and Social Affairs (General Department of Vocational Training) as prescribed.

Article 12. Responsibilities of vocational education institutions

1. Based on development requirements and the current qualifications of the primary-level teacher workforce, proactively develop plans for utilizing and standardizing supplementary training, as well as advanced supplementary training on an annual basis and by stages, and submit them for approval by competent authorities. Guide teachers assigned for supplementary training to develop plans and report on their implementation results. Ensure that teachers undergo supplementary training in rotation at least once every five years; intern at enterprises for two weeks annually. Report on implementation status to the supervising agency as prescribed.

2. Organize or collaborate with other institutions and enterprises meeting the necessary conditions to provide standardizing supplementary training and advanced supplementary training for primary-level teachers; assign teachers to attend supplementary training classes organized by authorized agencies and units.

3. Create favorable conditions and support for teachers to participate in supplementary training as stipulated by law.

4. Regularly inspect and evaluate supplementary training results; establish incentive mechanisms for self-supplementary training activities among primary-level teachers.

Article 13. Responsibilities of supplementary training organizations

1. Organizations providing supplementary training for primary-level teachers must ensure the required conditions for each type and content of supplementary training and obtain permission from authorized agencies to organize it.

2. Organizations providing supplementary training for primary-level teachers must develop supplementary training plans; manage the learning process, assess, and recognize learning outcomes; report supplementary training results and issue certificates to learners according to the regulations of the Ministry of Labor, Invalids and Social Affairs.

Chapter IV

IMPLEMENTING PROVISIONS

Article 14. Effective Date
