CIRCULAR
REGULATIONS ON MANAGEMENT OF COLLECTION AND TREATMENT OF WASTE FROM SHIPS IN PORT WATER AREAS
IN THE PORT SECTOR
BASED ON THE ENVIRONMENT PROTECTION LAW dated June 23, 2014;
BASED ON THE VIETNAM MARITIME CODE dated November 25, 2015;
Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Pursuant to Decree No. 38/2015/NĐ-CP dated April 24, 2015 of the Government on waste management;
BASED ON DECREE NO. 58/2017/NĐ-CP dated May 10, 2017 of the Government detailing certain provisions of the Vietnam Maritime Code on maritime activity management;
AT THE SUGGESTION OF THE DIRECTOR OF THE ENVIRONMENT DEPARTMENT AND THE DIRECTOR OF THE VIETNAM MARINE TRANSPORT DEPARTMENT;
THE MINISTER OF TRANSPORTATION ISSUES THIS CIRCULAR ON MANAGEMENT OF COLLECTION AND TREATMENT OF WASTE FROM SHIPS IN PORT WATER AREAS.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
1. THIS CIRCULAR REGULATES MANAGEMENT OF COLLECTION AND TREATMENT OF WASTE FROM SHIPS IN PORT WATER AREAS.
2. THE COLLECTION AND TREATMENT OF OZONE-DEPLETING SUBSTANCES GENERATED FROM SHIPS SHALL BE CONDUCTED IN ACCORDANCE WITH LAWS ON MANAGEMENT OF OZONE-DEPLETING SUBSTANCES AND ARE NOT WITHIN THE SCOPE OF REGULATION OF THIS CIRCULAR.
Article 2. Applicability
1. ORGANIZATIONS AND INDIVIDUALS INVOLVED IN THE ACTIVITY OF COLLECTION AND TREATMENT OF WASTE FROM SHIPS IN PORT WATER AREAS.
2. VIETNAMESE AND FOREIGN SHIPS OPERATING IN VIETNAM PORT WATER AREAS.
Article 3. Explanation of Terms
In this Circular, the following terms shall be understood as follows:
1. WASTE FROM SHIPS INCLUDES SOLID WASTE, DIRTY WATER, OILY MIXTURES, AND OTHER HAZARDOUS LIQUIDS GENERATED FROM SHIP OPERATIONS.
2. SOLID WASTE INCLUDES DOMESTIC WASTE, INDUSTRIAL SOLID WASTE, AND HAZARDOUS SOLID WASTE GENERATED FROM SHIP OPERATIONS. AMONG WHICH:
a) DOMESTIC WASTE IS WASTE SUCH AS FOOD SCRAPS, USED COOKING OIL, AND OTHER SOLID WASTE GENERATED FROM THE DAILY LIVING OF CREW AND PASSENGERS ON BOARD THE SHIP.
b) HAZARDOUS SOLID WASTE IS SOLID WASTE GENERATED FROM SHIP OPERATIONS CONTAINING HARMFUL COMPONENTS SUCH AS: OILED RAGS, PAINT, PAINT SCRAPS, EXHAUST FILTER RESIDUE, RESIDUE FROM DANGEROUS GOODS, AND OTHER SOLID WASTE LISTED IN ANNEX 1 OF CIRCULAR NO. 36/2015/TT-BTNMT DATED JUNE 30, 2015 OF THE MINISTRY OF NATURAL RESOURCES AND ENVIRONMENT ON HAZARDOUS WASTE MANAGEMENT.
c) INDUSTRIAL SOLID WASTE IS SOLID WASTE GENERATED FROM LOADING AND UNLOADING, OPERATING, MAINTENANCE, AND REPAIR OF SHIPS, EXCEPT FOR HAZARDOUS SOLID WASTE.
3. DIRTY WATER IS WATER THAT HAS BEEN ALTERED IN CHARACTERISTICS AND IS DISCHARGED FROM: TOILETS, URINALS; SINKS, BATHTUBS, DRAINAGE HOLES IN MEDICAL ROOMS; ANIMAL HOUSING COMPARTMENTS ON SHIPS AND OTHER MIXTURES OF WATER WHEN COMBINED WITH THE ABOVE MENTIONED WATER.
4. OILY MIXTURES ARE LIQUID WASTE CONTAINING OIL COLLECTED FROM THE ENGINE ROOM DRAINAGE SYSTEM, CLEANING WATER FROM THE CARGO HOLD OF OIL CARRIERS, CLEANING WATER FROM FUEL TANKS, USED OIL, OIL SLUDGE, LEAKED OIL, WATER FROM BALLAST TANKS CONTAINING OIL, DRAINAGE WATER FROM THE CARGO HOLD CONTAINING OIL.
5. OTHER HAZARDOUS LIQUIDS ARE SLUDGE FROM HAZARDOUS LIQUIDS AND LIQUID WASTE FROM CLEANING CARGO TANKS OR BALLAST TANKS ON SHIPS CARRYING LIQUID HAZARDOUS MATERIALS OF TYPES X, Y, Z AS PER ANNEX II OF THE INTERNATIONAL MARINE POLLUTION PREVENTION CONVENTION 1973 AND ITS AMENDMENTS IN 1978, 1997 (HEREINAFTER REFERRED TO AS THE MARPOL CONVENTION). 6. COLLECTION AND TREATMENT OF WASTE FROM SHIPS ARE ACTIVITIES RELATED TO THE COLLECTION, TEMPORARY STORAGE, TRANSPORTATION, AND TREATMENT OF WASTE FROM SHIPS.
7. RECEIVING EQUIPMENT IS SPECIALIZED EQUIPMENT USED FOR THE COLLECTION, TEMPORARY STORAGE OF WASTE FROM SHIPS, COMPLYING WITH VIETNAMESE LAWS ON WASTE MANAGEMENT AND STANDARDS FOR CONNECTIONS AS PER THE MARPOL CONVENTION.
8. OIL IS PETROLEUM IN ANY FORM, INCLUDING CRUDE OIL, FUEL OIL, OIL SLUDGE, USED OIL, AND PETROLEUM PRODUCTS THAT HAVE BEEN FILTERED, INCLUDING ITEMS LISTED IN ANNEX I OF THIS CIRCULAR.
MANAGEMENT OF COLLECTION AND TREATMENT OF WASTE FROM SHIPS
Chapter II
IN PORT WATER AREAS
FROM THE VESSEL IN THE PORT WATER AREA
Article 4. Management, collection, and treatment of waste from vessels in port waters
1. Hazardous solid waste, oily water, and other harmful liquids from vessels must be managed, collected, and treated in accordance with the provisions set forth in Chapter II of Decree No. 38/2015/ND-CP dated April 24, 2015 of the Government on waste management and scrap materials (hereinafter referred to as Decree No. 38/2015/ND-CP), Circular No. 36/2015/TT-BTNMT dated June 30, 2015 of the Minister of Natural Resources and Environment on hazardous waste management (hereinafter referred to as Circular No. 36/2015/TT-BTNMT), and relevant laws.
2. Domestic waste from vessels must be managed, collected, and treated in accordance with the provisions set forth in Chapter III of Decree No. 38/2015/ND-CP and relevant laws.
3. Industrial solid waste from vessels must be managed, collected, and treated in accordance with the provisions set forth in Chapter IV of Decree No. 38/2015/ND-CP and relevant laws.
4. Dirty water from vessels must be managed, collected, and treated in accordance with the provisions set forth in Chapter V of Decree No. 38/2015/ND-CP and relevant laws.
5. Port enterprises that provide waste collection and treatment services for vessels in port waters must comply with the provisions set forth in Decree No. 38/2015/ND-CP, Circular No. 36/2015/TT-BTNMT, and relevant laws.
6. Port enterprises that do not provide waste collection and treatment services for vessels in port waters must enter into contracts with organizations and individuals providing waste collection and treatment services for vessels in port waters that meet the regulations on waste collection and treatment stipulated in Decree No. 38/2015/ND-CP, Circular No. 36/2015/TT-BTNMT, and relevant laws.
7. The activity of collecting waste from vessels in port waters must be ensured by port enterprises to be carried out within four hours from when the Maritime Branch receives the request from the person handling procedures for the vessel.
8. The service fee for waste collection and treatment from vessels in port waters shall be implemented according to current laws on pricing and relevant laws.
Article 5. Announcement of Waste Collection and Treatment Services for Vessels in Port Waters
1. Port enterprises have the responsibility to publicly display and post the list of organizations and individuals who have signed contracts to supply waste collection and treatment services at ports and the service fees for waste collection and treatment on their official website and at the main office of the port in accordance with Model No. 1 of Appendix II issued together with this Circular.
2. The provision of waste collection and treatment services at anchorage areas and transshipment zones managed by the State shall be carried out as follows:
a) The Maritime Branch shall publish information about the demand for waste collection and treatment from vessels at anchorage areas and transshipment zones managed by the State on its official website.
b) Organizations and individuals wishing to participate in supplying waste collection and treatment services at anchorage areas and transshipment zones managed by the State shall submit registration documents to the Maritime Branch in accordance with Model No. 2 of Appendix II issued together with this Circular.
c) The Maritime Branch shall publicly display and post the list of organizations and individuals registered to participate in supplying waste collection and treatment services at anchorage areas and transshipment zones managed by the State and the service fees for waste collection and treatment on its official website and at its main office in accordance with Model No. 1 of Appendix II issued together with this Circular.
Article 6. Declaration of Waste Treatment Needs from Vessels in Port Waters
1. For vessels requiring waste treatment from vessels in port waters, the person handling vessel procedures shall coordinate with the port enterprise or organizations and individuals providing waste collection and treatment services that have been announced by the port enterprise and declare specifically the type of waste, quantity of waste in kilograms (hereinafter abbreviated as kg) or cubic meters (hereinafter abbreviated as m³), and the location for waste collection and treatment with the Maritime Branch at item 21 of the General Declaration Form according to Model No. 42 issued together with Decree No. 58/2017/ND-CP dated May 10, 2017 of the Government detailing certain provisions of the Vietnam Maritime Code on maritime activity management (hereinafter abbreviated as Decree No. 58/2017/ND-CP).3), the location for waste collection and treatment with the Marine Port Office at Section 21 of the General Declaration according to Model No. 42 issued together with Decree No. 58/2017/NĐ-CP dated May 10, 2017 of the Government detailing certain provisions of the Vietnam Maritime Code on maritime activity management (hereinafter referred to as Decree No. 58/2017/NĐ-CP).
2. In cases where it is necessary to pump out dirty water, oil sludge, and other hazardous liquids from vessels for collection and treatment, in addition to the provisions of Clause 1 of this Article, the person handling vessel procedures shall declare to the Maritime Branch according to Model No. 35 issued together with Decree No. 58/2017/ND-CP.
3. In cases where vessels operating for extended periods in a maritime area managed by a single Maritime Branch require waste collection and treatment, the person handling vessel procedures shall coordinate with organizations and individuals providing waste collection and treatment services and declare specifically the type of waste, quantity of waste in kg or m³, location, and organizations and individuals responsible for collection and treatment, and request pumping transfer of waste to the Maritime Branch according to Model No. 35 issued together with Decree No. 58/2017/ND-CP.3, location and organization or individual responsible for collecting and treating, requirements for transferring waste with the Marine Port Office according to Model No. 35 issued together with Decree No. 58/2017/NĐ-CP.
Article 7. Procedure for Collection and Treatment of Domestic Waste, Industrial Solid Waste, and Dirty Water from Vessels in Port Waters
1. For ports that self-implement the collection and treatment of domestic waste, industrial solid waste, and dirty water from vessels in port waters:
a) The port enterprise shall arrange receiving equipment to collect waste from vessels; transport, temporarily store, and treat waste in accordance with Decree No. 38/2015/ND-CP and relevant laws;
b) After completing waste collection, the port enterprise shall issue a Waste Collection Confirmation Certificate from Vessels according to Model No. 3 Appendix II issued together with this Circular and send it to related parties for recordkeeping.
2. In cases where organizations and individuals providing waste collection and treatment services implement the collection and treatment of domestic waste, industrial solid waste, and dirty water from vessels in port waters:
a) Organizations and individuals providing domestic waste, industrial solid waste, and dirty water collection and treatment services from vessels shall arrange receiving equipment to collect waste from vessels; transport, temporarily store, and treat waste in accordance with Decree No. 38/2015/ND-CP and relevant laws;
b) After completing waste collection, organizations and individuals providing waste collection and treatment services shall issue a Waste Collection Confirmation Certificate from Vessels according to Model No. 3 Appendix II issued together with this Circular and send it to related parties for recordkeeping.
3. Receiving equipment for dirty water from vessels must have standard flanges to connect with vessel flanges and are specified as follows:
a) Outer diameter size is 210 mm;
b) Inner diameter size corresponds to the outer diameter of the pipe;
c) Diameter of the circle passing through the center of the bolts is 170 mm;
d) Flange groove: includes four holes with a diameter of 18 mm evenly distributed along a circle passing through the center of the bolt holes with the aforementioned diameter and grooves reaching the outer edge of the flange. The width of the groove is 18 mm;
đ) Flange thickness is 16 mm;
e) Bolts, nuts: there are four pieces, each with a diameter of 16 mm and appropriate length;
g) Flanges for pipes with an inner diameter up to 100 mm must be made of steel or equivalent material with a flat surface. These flanges, together with suitable gaskets, must be suitable for use at a pressure of 600 kPa;
h) For vessels with a theoretical side height of 5 m or less, the inner diameter of the flange can be 38 mm;
i) For specialized vessels, passenger ferries: other suitable flanges or quick couplings may be used for pumping dirty water.
4. Domestic waste, industrial solid waste, and dirty water collected from vessels must be classified, temporarily stored, and transported using equipment and devices in compliance with legal regulations on waste management.
Article 8. Procedure for collecting and treating hazardous solid waste, oily water, and other harmful liquids generated from vessels within the port waters
1. For ports that collect and treat hazardous solid waste, oily water, and other harmful liquids from vessels within the port waters themselves:
a) The port enterprise shall arrange receiving equipment to collect waste from vessels; transport, temporarily store, and treat the waste in accordance with Decree No. 38/2015/NĐ-CP, Circular No. 36/2015/TT-BTNMT, and relevant laws;
b) After collecting waste from vessels within the port waters, the port enterprise shall prepare a Waste Collection Confirmation Form for vessels according to Model No. 3 of Appendix II issued together with this Circular, issue hazardous waste documentation in accordance with Circular No. 36/2015/TT-BTNMT, and send copies to related parties for record keeping;
c) After completing the treatment of collected waste from vessels within the port waters, the port enterprise shall send a certified copy of Link No. 4 of the hazardous waste documentation to the Maritime Port Authority of the region for record keeping and supervision.
2. In cases where organizations or individuals providing waste collection and treatment services collect and treat hazardous solid waste, oily water, and other harmful liquids from vessels within the port waters:
a) Organizations or individuals providing waste collection and treatment services shall arrange receiving equipment to collect waste from vessels; transport, temporarily store, and treat the waste in accordance with Decree No. 38/2015/NĐ-CP, Circular No. 36/2015/TT-BTNMT, and relevant laws;
b) After collecting waste from vessels within the port waters, organizations or individuals providing waste collection and treatment services shall prepare a Waste Collection Confirmation Form for vessels according to Model No. 3 of Appendix II issued together with this Circular, issue hazardous waste documentation in accordance with Circular No. 36/2015/TT-BTNMT, and send copies to related parties for record keeping;
c) After completing the treatment of collected waste from vessels within the port waters, organizations or individuals providing waste collection and treatment services shall send a certified copy of Link No. 4 of the hazardous waste documentation to the Maritime Port Authority of the region for record keeping and supervision.
3. The collection of hazardous solid waste, oily water, and other harmful liquids generated from vessels must ensure that there is no spillage, dispersion, or leakage of waste.
4. Receiving equipment and transportation equipment for hazardous solid waste, oily water, and other harmful liquids from vessels must comply with the provisions of Decree No. 38/2015/NĐ-CP and technical requirements and management procedures specified in Appendix 2 (B) issued together with Circular No. 36/2015/TT-BTNMT.
5. Receiving equipment for bilge oil and liquid waste containing oil from the engine room drainage system must have standard flanges to connect with those on vessels and be specified as follows:
a) Outer diameter size of 215 mm;
b) Inner diameter size corresponds to the outer diameter of the pipe;
c) Diameter of the circle passing through the center of the bolts of 183 mm;
d) Flange groove: consisting of six holes with a diameter of 22 mm evenly distributed along a circle passing through the center of the bolt holes with the aforementioned diameter, and grooves cut to the outer edge of the flange. Groove width of 22 mm;
đ) Flange thickness of 20 mm;
e) Bolts, nuts: six pieces each with a diameter of 20 mm and suitable length;
g) Flanges for pipes with an inner diameter up to 125 mm must be made of steel or equivalent material with a flat surface. These flanges, together with appropriate sealing gaskets, must be suitable for use at a pressure of 600 kPa.
Chapter III
RESPONSIBILITIES OF THE STATE ADMINISTRATIVE AUTHORITIES AND
RELATED UNITS
Article 9. Responsibilities of the Vietnam Maritime Administration
1. Directs maritime port supervision units to organize the implementation of the provisions of this Circular.
2. Takes the lead in organizing inspections on the collection and treatment of waste generated from vessels within port waters.
Article 10. Responsibilities of maritime port supervision units
1. Organizes and supervises the collection and treatment of waste from vessels at ports in accordance with this Circular and Decree No. 58/2017/NĐ-CP.
2. Guides and facilitates organizations, individuals, and vessels in implementing activities related to the collection and treatment of waste from vessels.
3. Keeps records of waste collection and treatment certificates from vessels to be ready to provide them to competent state agencies upon request (for waste collection and treatment from vessels at anchorage areas and transshipment zones managed by the State).
Article 11. Responsibilities of port enterprises
1. Fully implement the provisions of this Circular.
2. Keeps records of waste collection and treatment certificates from vessels to be ready to provide them to competent state agencies upon request.
Article 12. Responsibilities of organizations and individuals providing waste collection and treatment services
1. Fully implement the provisions of this Circular and relevant laws regarding waste collection and treatment.
2. Keeps records of files and documents related to waste collection and treatment from vessels to be ready to provide them to competent state agencies upon request.
Article 13. Responsibilities of ship captains and vessel owners
1. Fully implement the provisions of this Circular.
2. Proactively carry out waste collection and treatment from vessels when the capacity of waste storage equipment or tanks is insufficient for the next voyage.
Chapter IV
IMPLEMENTING PROVISIONS
Article 14. Effective Date
This Circular takes effect from January 1, 2018, and replaces Circular No. 50/2012/TT-BGTVT dated December 19, 2012, issued by the Minister of Transport, concerning the management of waste reception and treatment from vessels at Vietnamese ports.
Article 15. Implementation Organization
1. The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, the Director of the Vietnam Maritime Administration, and other relevant organizations and individuals are responsible for implementing this Circular.
2. In cases where regulations cited in this Circular are supplemented, amended, or replaced, the new provisions shall apply according to the supplementary, amended, or replacement document.
3. During the implementation of this Circular, if difficulties or obstacles arise, organizations and individuals should report to the Ministry of Transport for timely consideration and resolution./.
