Amending and supplementing certain Articles of Circular No. 19/2016/TT-NHNN dated June 30, 2016 of the Governor of the State Bank of Vietnam on bank card activities
Article 1. Amending and supplementing certain Articles of Circular No. 19/2016/TT-NHNN dated June 30, 2016 of the Governor of the State Bank of Vietnam on bank card activities
Pursuant to the Law on the State Bank of Vietnam dated June 16, 2010;
Pursuant to Government Decree No. 16/2017/NĐ-CP dated February 17, 2017 on the functions, tasks, powers, and organizational structure of the State Bank of Vietnam;
At the proposal of the Payment Department Director;
The Governor of the State Bank of Vietnam promulgates Circular amending and supplementing certain provisions of Circular No. 19/2016/TT-NHNN dated June 30, 2016, issued by the Governor of the State Bank of Vietnam on bank card activities.
Article 1. Amending and supplementing certain Articles of Circular No. 19/2016/TT-NHNN dated June 30, 2016 of the Governor of the State Bank of Vietnam on bank card activities
1. Supplement Clause 26 to Article 3 as follows:
"26. The basic standard for domestic chip cards is the Basic Standard TCCS 01:2018/NHNNVN on Technical Requirements for Domestic Contact Chip Payment Cards in Vietnam and Basic Standard TCCS 02:2018/NHNNVN on Technical Requirements for Domestic Contactless Chip Payment Cards in Vietnam, announced by the Governor of the State Bank of Vietnam pursuant to Decision No. 1927/QĐ-NHNN dated October 5, 2018."
2. Supplement Clause 5 to Article 9 as follows:
"5. Issuing organizations must comply with the basic standard for domestic chip cards when issuing cards with BINs issued by the State Bank of Vietnam according to the transition schedule specified in Article 27b of this Circular."
3. Supplement Clause 1a to Article 22 as follows:
"1a. Acquiring organizations must comply with the basic standard for domestic chip cards applicable to ATMs and acceptance devices at points of sale of acquiring organizations according to the transition schedule specified in Article 27a of this Circular."
4. Supplement Clause 6 to Article 24 as follows:
"6. Card switching organizations and electronic settlement organizations for card transactions shall upgrade their switching systems and electronic settlement systems to ensure connection with issuing organizations and acquiring organizations during the transition period specified in Chapter IVa of this Circular."
5. Supplement Chapter IVa after Chapter IV as follows:
"Chapter IVa
TRANSITION SCHEDULE
Article 27a. For payment card organizations
1. By December 31, 2019, at least 35% of ATMs and 50% of acceptance devices at points of sale currently operating in Vietnam of acquiring organizations must comply with the basic standard for domestic chip cards.
2. By December 31, 2020, 100% of ATMs and acceptance devices at points of sale currently operating in Vietnam of acquiring organizations must comply with the basic standard for domestic chip cards.
Article 27b. For card issuing organizations
1. By December 31, 2019, at least 30% of cards with BINs issued by the State Bank of Vietnam currently in circulation of issuing organizations must comply with the basic standard for domestic chip cards.
2. By December 31, 2020, at least 60% of cards with BINs issued by the State Bank of Vietnam currently in circulation of issuing organizations must comply with the basic standard for domestic chip cards.
3. By December 31, 2021, 100% of cards with BINs issued by the State Bank of Vietnam currently in circulation of issuing organizations must comply with the basic standard for domestic chip cards.
Article 27c. Responsibilities of card issuing organizations and payment card organizations
During the transition period, issuing organizations and acquiring organizations must ensure continuous, stable, safe operation of cards and protect the legitimate rights and interests of cardholders."
6. Clause 2 of Article 32 (amended and supplemented by Circular No. 26/2017/TT-NHNN dated December 29, 2017 of the Governor of the State Bank of Vietnam on amending and supplementing certain Articles of Circular No. 19/2016/TT-NHNN dated June 30, 2016 of the Governor of the State Bank of Vietnam on bank card activities) is amended and supplemented as follows:
"2. Clause 2 of Article 24 of this Circular shall take effect from January 1, 2020."
Article 2. Responsibility for Implementation
The Director of the Office, Heads of Departments under the State Bank of Vietnam, Heads of relevant units under the State Bank of Vietnam, Governors of the State Bank of Vietnam branches in provinces and centrally-administered cities, Chairmen of Boards of Directors, Chairmen of Boards of Members, General Managers (Directors) of credit institutions, foreign bank branches, card switching organizations, and electronic settlement organizations for card transactions are responsible for organizing the implementation of this Circular.
Article 3. Effectiveness
1. This Circular takes effect from February 18, 2019.
2. Clause 6 of Article 1 of this Circular takes effect from January 1, 2019./.
