Amending and supplementing certain Articles of Circular No. 25/2017/TT-BGTVT dated July 28, 2017 of the Minister of Transport on forms of certificates and logs for technical safety and environmental protection issued to ships, inland waterway vessels, and industrial products used for inland waterway vessels

Pursuant to the Vietnam Maritime Code dated November 25, 2015;

On the basis of The Law on Inland Waterway Transport dated June 15, 2004 and the Law Amending and Supplementing Certain Provisions of the Law on Inland Waterway Transport dated June 17, 2014;

Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

At the proposal of the Director of the Legal Department and the Director of the Vietnam Ship Survey Bureau;

The Minister of Transport promulgates this Circular amending and supplementing certain Articles of Circular No. 25/2017/TT-BGTVT dated July 28, 2017 of the Minister of Transport on forms of certificates and logs for technical safety and environmental protection issued to ships, inland waterway vessels, and industrial products used for inland waterway vessels.

Article 1. Amending and supplementing certain Articles of Circular No. 25/2017/TT-BGTVT dated July 28, 2017 of the Minister of Transport on forms of certificates and logs for technical safety and environmental protection issued to ships, inland waterway vessels, and industrial products used for inland waterway vessels.

1. Adding Clauses 25, 26, 27, and 28 to Article 4 as follows:

"25. Certificate of safe towing operation issued according to National Technical Regulation QCVN 73: 2019/BGTVT in Form No. 44 attached as Appendix 1 to this Circular."
"26. Certificate of towing force test at hook issued according to National Technical Regulation QCVN 73: 2019/BGTVT in Form No. 45 attached as Appendix 1 to this Circular."
"27. Certificate of technical safety for submarine issued according to National Technical Regulation QCVN 21: 2015/BGTVT and MSC/Circular.981 of the International Maritime Organization (IMO) in Form No. 46 attached as Appendix 1 to this Circular."
"28. Certificate of technical safety and environmental protection for cruise ship issued according to National Technical Regulation QCVN 81: 2014/BGTVT and Amendment 1 - 2017 QCVN 81: 2014/BGTVT in Form No. 47 attached as Appendix 1 to this Circular."

2. Adding Point d to Clause 2 of Article 5 as follows:

"d) Electronic logbook publication according to MARPOL for ships equipped with electronic logs according to Resolution MEPC.312(74) and Resolution MEPC.314(74) of the International Maritime Organization (IMO) in Form No. 48 attached as Appendix 1 to this Circular."

3. Amending the Appendices as follows:

a) Replacing Form No. 29 in the Appendix issued together with Circular No. 25/2017/TT-BGTVT dated July 28, 2017 with Form No. 29 in Appendix 2 issued together with this Circular.

b) Replacing Form No. 31 in the Appendix issued together with Circular No. 25/2017/TT-BGTVT dated July 28, 2017 with Form No. 31 in Appendix 2 issued together with this Circular.

c) Replacing Form No. 33 in the Appendix issued together with Circular No. 25/2017/TT-BGTVT dated July 28, 2017 with Form No. 33 in Appendix 2 issued together with this Circular.

d) Replacing Form No. 37 in the Appendix issued together with Circular No. 25/2017/TT-BGTVT dated July 28, 2017 with Form No. 37 in Appendix 2 issued together with this Circular.

đ) Replacing Form No. 38 in the Appendix issued together with Circular No. 25/2017/TT-BGTVT dated July 28, 2017 with Form No. 38 in Appendix 2 issued together with this Circular.

e) Replacing Form No. 39 in the Appendix issued together with Circular No. 25/2017/TT-BGTVT dated July 28, 2017 with Form No. 39 in Appendix 2 issued together with this Circular.

Article 2. Effectiveness

1. This Circular takes effect from July 1, 2020.

2. Certificates and logs for technical safety and environmental protection issued to ships, inland waterway vessels, and industrial products used for inland waterway vessels amended and supplemented by this Circular, if issued before July 1, 2020, shall continue to be valid until the expiration date of such certificates and logs.

Article 3. Implementation

The Director of the Office of the Ministry, the Inspector General of the Ministry, Heads of Departments, Directors of the Vietnam Maritime Administration Bureau, Directors of Provincial Departments of Transport, Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.
