CIRCULAR
Amending and supplementing some articles of Circular No. 13/2019/TT-BGTVT dated March 29, 2020 detailing the Civil Aviation Security Program and Quality Control of Civil Aviation Security in Vietnam
Pursuant to the Civil Aviation Law of Vietnam dated June 29, 2006; the Law amending and supplementing some articles of the Civil Aviation Law of Vietnam dated November 21, 2014;
Pursuant to Decree No. 92/2015/NĐ-CP dated October 13, 2015 of the Government on civil aviation security;
Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;
PURSUANT TO THE PROPOSAL OF THE DIRECTOR OF THE TRANSPORT DEPARTMENT AND THE DIRECTOR OF THE VIETNAM CIVIL AVIATION ADMINISTRATION;
The Minister of Transport hereby promulgates this Circular amending and supplementing some articles of Circular No. 13/2019/TT-BGTVT dated March 29, 2019 detailing the Civil Aviation Security Program and Quality Control of Civil Aviation Security in Vietnam.
Article 1. Amending and supplementing some articles of Circular No. 13/2019/TT-BGTVT dated March 29, 2019 detailing the Civil Aviation Security Program and Quality Control of Civil Aviation Security in Vietnam as follows:
1. Amend and supplement Clause 2, Article 3 as follows:
"2. A civil aviation security checkpoint is a working position of civil aviation security personnel established at gates, doors, passages between restricted areas or between restricted areas and other areas, aimed at conducting civil aviation security checks on persons, means of transport, and objects, maintaining security and order at the civil aviation security checkpoint."
2. Amending and supplementing Clause 17 of Article 3 as follows:
"17. Civil aviation security quality control involves implementing technical operations and supervisory measures to assess the current status of civil aviation security work, rectify deficiencies identified in civil aviation security work. Civil aviation security quality control includes activities such as regular monitoring, inspection, quality control testing, trials, evaluation, security investigation, statistics, data analysis, and other measures."
a) Civil aviation security quality control check involves inspecting compliance with regulations in the security program and civil aviation security rules approved or accepted by the Civil Aviation Administration of Vietnam for airport operators, airlines, and air service providers.
b) Civil aviation security trial involves performing simulated illegal interference in civil aviation activities openly or secretly to test the effectiveness of security measures.
c) Civil aviation security investigation involves investigating illegal interference actions, violations, or potential violations of civil aviation security.
d) Civil aviation security assessment involves evaluating compliance with certain or all international civil aviation organization standards and regulations, as well as those set by aviation authorities and airlines."
3. Supplementing Clause 20a of Article 3 as follows:
"20a. The public area of an airport is a zone determined specifically in the security program and rules by the entity authorized to operate that area, which passengers boarding aircraft, means of transport, senders, receivers, shippers, and recipients of goods and mail may access without undergoing civil aviation security screening. Public areas include the following specific zones:
a) Passenger terminal and cargo terminal areas that are not restricted and not exclusive to agencies or units;
b) Roadways and parking lots for passengers boarding aircraft;
c) Retail stores, shopping centers, and public entertainment areas adjacent to the airport, terminal, roadways, and parking lots for passengers boarding aircraft."
4. Supplementing Clause 27a of Article 3 as follows:
"27a. Autonomous vehicle is a self-propelled technical equipment."
5. Amending and supplementing Clause 1 of Article 5 as follows:
"1. Enterprises and units with a civil aviation security program and rules shall submit one set of documents (in Vietnamese for Vietnamese enterprises, in English for foreign airlines) directly or through postal services or other appropriate methods to the Civil Aviation Administration of Vietnam. The documents shall include:
a) A request letter according to the model prescribed in Appendix VI attached to this Circular;
b) The civil aviation security program and rules;
c) A table comparing the differences between the airline's security program and Vietnamese legal requirements, along with measures to address these differences for the approval of the foreign airline's security program."
6. Amending and supplementing Clause 3 of Article 5 as follows:
"3. Upon receiving complete documents as stipulated in Clause 1 of this Article, within ten working days (for approval procedures of security programs and rules) or five working days (for approval procedures of amended and supplemented security programs and rules) from the date of receipt, the Civil Aviation Administration of Vietnam shall be responsible for reviewing the documents and conducting on-site inspections if necessary:
a) If the civil aviation security program and rules comply fully with this Circular: issue a decision to approve or accept (for the security program of a foreign airline);
b) If the civil aviation security program and rules do not fully comply with this Circular: issue a document requesting the enterprise or unit to supplement or amend the program and rules."
7. Supplementing Clause 3 of Article 9 as follows:
"3. The provisions regarding security control permits for means of transport in this Circular only apply to autonomous vehicles and road traffic vehicles."
8. Amending and supplementing Point b Clause 2 of Article 10 as follows:
"b) Issuing short-term security control cards and permits for airports under the management of the Air Port Authority to the subjects specified in Clauses 6 and 8 of Article 14 of this Circular, except as provided in Clause 3 of this Article."
"9. Amend and supplement Clause 1 of Article 11 as follows:"
"1. Long-term security control cards and permits for airports have a maximum validity period of two years from the date they become effective."
10. Amending and supplementing Clause 3 of Article 11 as follows:
"3. The short-term security control permit for airports shall have an effective duration based on the request of the applicant and the result of the file review, including a permit to be used once within one day (24 hours) from the time the permit becomes effective and a permit to be used multiple times but not exceeding 30 days from the time the permit becomes effective."
11. Amend and supplement Point a Clause 1 Article 14 as follows:
“a) Staff of airlines, airport companies, service providers, and tour operators in restricted areas of airports who have fixed-term employment contracts or indefinite-term employment contracts in accordance with labor laws;”
12. Amend and supplement Point b Clause 6 Article 14 as follows:
“b) Individuals receiving short-term security control permits for airports must read and understand the usage regulations stipulated in this Circular and commit to disseminating these regulations to the users of the permit. The permit user is responsible for contacting someone to supervise and escort them into and operate within the restricted area as prescribed in Clause 4, Article 32 of this Circular;”
13. Amend and supplement Clause 9 Article 14 as follows:
“9. Vehicles specified in Clause 8 of this Article shall only be issued short-term security control permits for airports when the individual receiving the permit reads and understands the usage regulations stipulated in this Circular and commits to disseminating these regulations to the users of the permit. The permit user is responsible for contacting someone to accompany them or guide the vehicle as prescribed in Clause 6, Article 32 of this Circular.”
14. Amend and supplement Clause 3 Article 23 as follows:
“3. Within five working days from the date of issuance, the airport company must submit a list of vehicles applying for long-term security control permits for airports according to the form prescribed in Appendix IX attached to this Circular to the Civil Aviation Regional Office.”
15. Amend and supplement Clause 5 Article 30 as follows:
“5. The issuing authority of cards and permits must immediately notify in writing or update the aviation security database with the list of lost cards and permits issued by their unit for the aviation security forces operating in restricted areas indicated on the lost cards and permits, and the Civil Aviation Administration to promptly prevent the use of lost cards and permits; within fifteen days from the date of receipt of the lost cards and permits, the issuing authority must destroy the lost cards and permits.”
16. Amend and supplement Clause 6 Article 32 as follows:
“6. Vehicles entering and operating in restricted areas of airports must have aviation security staff or ground handling vehicle permit holders supervise or airport operators' vehicles guide under the following circumstances:
a) The vehicle operator is only issued a short-term security control card;
b) The vehicle operator does not have a certificate for controlling and operating vehicles in aircraft parking areas issued by the competent authority as prescribed;
c) The vehicle operates infrequently in the airfield.”
17. Amend and supplement Clause 9 Article 32 as follows:
“9. Audio and video recording in restricted areas as prescribed in Clause 1, Article 31 of this Circular or at security checkpoints or in the workplace of state management agencies at airports must be permitted in writing by the managing entity, except for the following cases:
a) Audio and video recording of information and documents classified as state secrets is carried out in accordance with regulations on protecting state secrets;
b) Recording audio and video in waiting rooms for boarding aircraft or collecting luggage that are not security checkpoints;
c) State management agencies and aviation security forces record audio and video for official duties within their assigned authority and responsibility.”
18. Supplement Clause 9a Article 32 as follows:
“9a. At locations where audio and video recording is not allowed and which passengers and the public can access, the managing entity must place warning signs in visible positions.”
19. Amend and supplement Clause 10 Article 32 as follows:
“10. In case of urgent tasks or rescue operations, the head of the agency or entity managing the personnel and vehicles participating in urgent tasks or rescue operations is responsible for coordinating with the aviation security force of the restricted area's managing entity to monitor the activities of personnel and vehicles without requiring aviation security control cards or internal security control permits.”
20. Amend and supplement Point a Clause 1 Article 34 as follows:
“a) At gates, doors, and passageways between restricted areas and other areas;”
21. Amend and supplement Clause 1 Article 36 as follows:
“1. Aviation security staff are responsible for inspecting and supervising security for individuals, vehicles, and items entering, exiting, and operating in restricted areas.”
“Article 38. Security inspection and supervision of public areas in civil airports, airfields, and adjacent facilities to terminals, airfields, and aviation works.
1. Persons, means of transportation, and activities in public areas must comply with road traffic laws, regulations of civil airports and airfields, and follow the guidance of aviation security control forces, abide by regulations on ensuring aviation security and social order, maintain civility and courtesy. maintain aviation security, comply with regulations on ensuring aviation security and safety, social order and civility.
2. The operator of the civil airport shall take the lead and coordinate with aviation security control forces, police forces (for airports with permanent police presence) and the Civil Aviation Port Authority to determine the number, location, and operating hours of aviation security checkpoints; route planning, stopping and parking times for vehicles, passenger pick-up and drop-off areas, service provision zones for businesses in public areas of the civil airport.
3. Aviation security control forces shall deploy personnel to conduct aviation security inspections, guide persons and means of transportation; regulate the number of people and means of transportation entering and operating in the parking area, internal port traffic lanes, check-in areas, and other public areas at civil airports and airfields; cooperate with police forces to maintain order in public areas of civil airports and airfields; collaborate with the Civil Aviation Port Authority, aviation security forces, police, military, and local authorities when additional aviation security and public order measures are required, or to address violations.
4. The deployment of patrol and surveillance forces, specialized equipment, and procedures for security inspections and supervision must ensure timely detection and handling of unclaimed items, luggage, goods, means of transportation, disruptive behavior, and law violations in public areas of civil airports and airfields, and must be described specifically in the aviation security regulations of the service provider.
5. Items, luggage, and assets of passengers traveling by aircraft or those accompanying them that are stored in public areas of passenger terminals must be subject to appropriate aviation security checks before acceptance.
6. For cargo terminals, cargo warehouses, the management and operation units of these facilities are responsible for organizing route planning; regulating the number of people and means of transportation entering and operating in the terminal and warehouse areas; defining areas for loading and unloading, parking, service provision zones for businesses, check-in areas and other public areas within their scope of responsibility;; cooperate with aviation security control forces, public security forces maintaining general order at airports; coordinate with relevant Civil Aviation Port Authorities, aviation security control forces, public security forces, military forces, local authorities when it is necessary to strengthen aviation security, public order, and handle violations.

7. Appropriate barriers or suitable security measures based on aviation security risk assessments should be implemented to prevent unauthorized access by persons or means of transportation, or the illegal delivery or throwing of items into restricted areas.
8. Traffic routes in front of passenger and cargo terminals, motorcycle and car parking lots in front of passenger and cargo terminals must establish checkpoints to regulate motorcycles and cars entering and exiting, and conduct aviation security checks when necessary. Short-term motorcycle and car parking lots (allowing parking for less than 24 hours) cannot be located adjacent to terminals (except for vehicle parking lots for cargo and mail delivery to cargo terminals and warehouses), air traffic control towers, power supply stations for terminals, and power supply stations for air traffic control towers.
9. Traffic routes in front of passenger terminals and air traffic control towers must be at least 30 meters away from the terminal. Fixed or mobile obstacles must be placed adjacent to traffic routes in front of passenger and cargo terminals, motorcycle and car parking lots in front of passenger and cargo terminals to prevent the use of means of transportation to attack the terminal or airfield. This regulation applies to terminal and air traffic control tower construction projects approved after July 1, 2021."
23. Amend and supplement Clause 5 of Article 39 as follows:
"5. Aviation security forces of agencies and units shall cooperate with relevant local police forces to patrol areas adjacent to civil airports and airfields, and restricted areas outside civil airports and airfields upon request to detect and promptly handle law violations."
24. Amend and supplement Point a of Clause 1 of Article 40 as follows:
"a) Containers for cargo and mail, trays or baskets for loose cargo, lost baggage, unclaimed baggage, lockers, meal bags;"
26. Amend and supplement Clause 5 of Article 41 as follows:
"5. Passengers and carry-on baggage must undergo 100% aviation security screening using X-ray machines before entering restricted areas, except where exempted from such screening according to regulations; passengers who refuse aviation security screening will be denied transport."
27. Amend and supplement Point b of Clause 8 of Article 41 as follows:
"b) Passengers passing through metal detectors or body scanners (if available), if the metal detector or body scanner alarms or the passenger exhibits suspicious behavior, aviation security personnel shall use handheld metal detectors and visual inspections in combination;"

28. Amend and supplement Clause 13 of Article 41 as follows:
“13. Conduct random supplementary inspections of at least 10% (including visual inspections or inspections using equipment, devices, or explosive detection animals) after the initial aviation security inspection for passengers and carry-on luggage. Random visual inspections shall be carried out at the aviation security checkpoint or passengers may be brought into a search room upon request (by the passenger or authorized authority). The random visual inspections must ensure that the inspection ratio is evenly distributed and continuously conducted during the operational hours of the aviation security checkpoint on a given day. The methods and procedures for conducting random visual inspections of passengers and carry-on luggage are specified in the aviation security regulations of the service provider.”
29. Amend and supplement Clause 2 of Article 44 as follows:
“2. Checked baggage of departing and connecting passengers must be inspected using X-ray machines; if there are doubts, further visual inspections or inspections using equipment or devices to detect explosives or other appropriate measures must be conducted. In cases where there are signs or information threatening the security and safety of the flight, checked baggage must undergo aviation security searches.”
30. Amend and supplement Clause 5 of Article 50 as follows:
“5. Cargo and mail that have been inspected for aviation security and must be transported through non-restricted areas to reach the aircraft or means of transport must be accompanied by personnel or subject to continuous appropriate monitoring during transportation to prevent unauthorized dangerous items from being introduced into the cargo or mail.”
31. Amend and supplement Clause 7 of Article 50 as follows:
“7. Cargo and mail in transit or transfer do not need to be re-inspected for aviation security when a security declaration confirms that 100% of the cargo and mail has undergone aviation security inspection at the point of departure and falls under one of the following circumstances:
a) Cargo and mail in transit or transfer do not leave the aircraft or aircraft parking area or do not leave the restricted area and are subject to continuous appropriate aviation security supervision;
b) Cargo and mail in transit or transfer are transported from the aircraft parking area to the cargo storage area through non-restricted areas and back, sealed with security seals and subject to continuous appropriate aviation security supervision during transportation to prevent unauthorized dangerous items from being introduced into the cargo or mail.”
32. Supplement Clause 8 of Article 50 as follows:
“8. Airlines transporting cargo and mail in transit or transfer must provide a security declaration to the airport operator and the airline transporting the consignment at the transit or transfer point.”
33. Amend and supplement Clause 2 of Article 53 as follows:
“2. Production, processing, and supply areas for meals must be protected; entry and activities within these areas require aviation security control cards or permits. Transportation vehicles carrying meals from the supply location through non-restricted areas to the aircraft must implement appropriate security measures.”
34. Amend and supplement Clause 5 of Article 53 as follows:
“5. If meal containers or bags moving from other areas into restricted areas are not sealed with security seals or the security seals are broken, or the containers or bags are not intact, they must be inspected using X-ray screening or visual inspections before being brought into the restricted area at the airport to be loaded onto the aircraft and must be subject to continuous aviation security supervision.”
35. Amend and supplement Clause 3 of Article 55 as follows:
“3. Fueling ports of aircraft fueling vehicles after receiving fuel for aircraft refueling must be sealed with security seals; the vehicle must be escorted, guarded, or subject to appropriate security measures when traveling through non-restricted areas.”
36. Amend and supplement Article 57 as follows:
“Article 57. Security Check and Supervision for Passengers Refused Entry
1. The airline shall be responsible for passengers carried by the airline who are refused entry to Vietnam and shall have the following obligations:
a) Transporting passengers out of Vietnam at the earliest time possible;
b) Cooperating with border police to temporarily hold personal documents of passengers and to process other necessary documents issued by the immigration management agency for the purpose of transporting such passengers out of Vietnam if they do not possess valid personal documents;
c) Notifying border police and civil aviation port authorities of the list of passengers, the time and location of managing passengers refused entry, and the flight transporting passengers out of Vietnam;
d) Accepting personal documents or other documents provided by the immigration management agency and only returning such documents when the passenger has been handed over to the competent authority of the country where the aircraft arrives.
2. In cases where the airline transports passengers refused entry from abroad back to Vietnam, the airline shall be responsible for cooperating with the competent authority of the host country to obtain personal documents of the passengers or other documents issued by the competent authority of the host country for the purpose of transporting the passengers.
3. In cases where passengers refused entry are managed and supervised at airports, air security forces shall manage and supervise such passengers. If passengers refused entry do not voluntarily return to their home country, the airline must arrange security personnel to escort them on the flight, with a minimum of one security officer for each passenger.
4. The airline shall bear all costs related to passengers refused entry, except as provided for in Clause 6 of this Article.
5. The airline representative must notify the aircraft commander of the seating position of passengers refused entry and the escort personnel along with any accompanying support equipment. The aircraft commander shall notify the air security force at the airport or foreign authorities where the aircraft is scheduled to land about any necessary assistance.
6. In cases where a foreign national passenger who has entered Vietnam subsequently exits to a third country but is refused entry and forced to return to Vietnam, the airline shall be responsible for transporting the passenger back to Vietnam, handing them over to border police, and the airline shall cooperate with border police to verify the passenger's travel history, personal information, and nationality so that relevant authorities can take appropriate measures.
37. Amend and supplement Article 58 as follows:
“Article 58. Security Check and Supervision for Passengers Unable to Control Their Behavior
1. A passenger unable to control their behavior is a passenger in a state of loss of cognitive ability or loss of control over their actions due to mental illness or the consumption of alcohol or stimulants.
2. The acceptance of transportation of mentally ill passengers shall be evaluated and decided by the airline representative. In cases where the airline accepts transportation, it must fulfill the following requirements:
a) Mentally ill passengers must be accompanied by a doctor or relative capable of controlling the passenger's abnormal behavior. In necessary cases, mentally ill passengers may need to be sedated before boarding the aircraft, with the drug's effect lasting longer than the flight duration;
b) Mentally ill passengers and their luggage and items must undergo visual inspection; the inspection may be conducted in a separate area;
c) In necessary cases, upon request of the airline representative, air security personnel must escort mentally ill passengers onto the aircraft and vice versa;
d) The airline representative must notify the aircraft commander of the seating position of mentally ill passengers. The aircraft commander shall notify the airport operator of the intended landing airport about any necessary assistance if deemed necessary.
3. The acceptance of transportation of passengers who have consumed alcohol, beer, or stimulants but have not lost control of their behavior shall be evaluated and decided by the airline representative. When transporting such individuals, the airline must apply appropriate air security measures.
38. Amend and supplement Clause 3 of Article 60 as follows:
"3. The Civil Aviation Administration of Vietnam shall issue a decision to prohibit air transport for a limited period or permanently for passengers who violate laws; based on the nature and severity of the violation, the Civil Aviation Administration of Vietnam shall consider and decide to apply mandatory visual inspections for persons who violate air security and discipline on board aircraft or at airports."
39. Amend and supplement Article 61 as follows:
“Article 61. Re-inspection of aviation security
1. Re-inspection of aviation security shall be conducted for restricted areas, persons, means of transport, and objects in the following cases:
a) Passengers and carry-on baggage that have been inspected for aviation security but leave the restricted area and return must undergo re-inspection of aviation security.
b) Restricted areas, persons, means of transport, and objects within restricted areas that come into contact or mix with persons or objects not yet inspected for aviation security.
c) Restricted areas, persons, means of transport, and objects within restricted areas that come into contact or mix with persons suspected of carrying dangerous items or means of transport and objects suspected of containing dangerous items.
2. The re-inspection of aviation security for passengers and carry-on baggage as stipulated in point a, Clause 1 of this Article shall be carried out as follows:
a) All passengers and carry-on baggage must be transferred to another area and the entire related restricted area must be re-inspected.
b) A full re-inspection of aviation security for all passengers and carry-on baggage must be conducted before boarding the aircraft.
c) In case passengers have boarded the aircraft, a full re-inspection of aviation security must be conducted for all passengers, carry-on baggage, and the passenger cabin of the aircraft.
3. In cases where the security seal is not intact or checked-in baggage, cargo, mail, onboard service items, food containers are torn or broken, they must undergo re-inspection of aviation security before being loaded onto the aircraft. luggage, goods, mail, items served on aircraft, food containers that are torn or broken must be re-screened for aviation security before being loaded onto the aircraft.
4. The re-inspection of aviation security as prescribed in Clauses 1 and 3 of this Article must be recorded in a report.
40. Amend and supplement Clause 3 of Article 64 as follows:
"3. Operating aircraft must implement the measures prescribed in Clause 1 of this Article, and the aircraft operator shall be responsible for organizing the control of persons and objects boarding and disembarking from the aircraft."
41. Amend and supplement Clause 1 of Article 65 as follows:
"1. Responsibilities for aviation security inspection
a) For operating aircraft, in cases where there is no change in the flight crew and continuous control of persons and objects boarding and disembarking from the aircraft by the flight crew, before accepting passengers, baggage, cargo, and mail on board the aircraft, the aircraft operator must conduct an aviation security inspection of the aircraft according to the list for each type of aircraft to detect hidden dangerous items or stowaways on the aircraft.
b) For operating aircraft, in cases where there is a change in the flight crew or no continuous control of persons and objects boarding and disembarking from the aircraft by the flight crew, before accepting passengers, baggage, cargo, and mail on board the aircraft and after all passengers, baggage, cargo, and mail have disembarked from the aircraft, the aircraft operator must conduct an aviation security inspection of the aircraft according to the list for each type of aircraft to detect hidden dangerous items or stowaways on the aircraft.
c) For non-operating aircraft, when put back into operation, before accepting passengers, baggage, cargo, and mail on board the aircraft, the aircraft operator must conduct an aviation security inspection of the aircraft according to the list for each type of aircraft to detect hidden dangerous items or stowaways on the aircraft.
d) The aircraft operator must detail the procedures and processes for conducting aviation security inspections of aircraft in the airline's aviation security program."
42. Amend and supplement Clause 2 of Article 76 as follows:
"2. The Civil Aviation Authority of Vietnam, airport authorities, airport operators, airlines, and units providing air security services shall publicize hotlines to receive information related to plots to illegally interfere with civil aviation activities."
43. Amend and supplement Article 77 as follows:
“Article 77. Scope of Application of Enhanced Air Security Control
1. Based on information about the situation, threats, and air security risks, the Director of the Civil Aviation Administration of Vietnam decides to apply, revoke the enhanced level of air security control nationwide or at specific airports. 2. The Civil Aviation Administration considers approving the application of alternative enhanced air security measures from other countries for international flights arriving in Vietnam that have similar effects.
3. The Civil Aviation Administration considers applying enhanced air security measures according to the requirements of foreign authorities in accordance with international treaties to which the Socialist Republic of Vietnam is a member.
44. Supplement Clause 3 of Article 82 as follows:
"3. Agencies and units managing and using workers in restricted areas, important projects related to national security, political, economic, diplomatic, scientific and technological, cultural, and social targets must comply with the law and bear responsibility if the workers under their management violate the law during work."
45. Amend and supplement Clause 7 of Article 84 as follows:
"7. Air traffic control units and enterprises with aviation security forces must equip themselves with video recorders, audio recorders, cameras, binoculars, and other appropriate devices to promptly prevent violations and accurately, fully document and collect all developments of the violation incident to serve rapid, correct handling according to the current laws."
46. Amend and supplement Clause 2 of Article 87 as follows:
"2. The enterprise managing the service provision facility for flight operations must develop an emergency plan for the operation assurance facility. The emergency plan must be consistent with the overall emergency response plan against illegal interference issued by the Prime Minister and the emergency plan of the provincial, city, and island district air emergency command board."

49. Amend and supplement Clause 2 of Article 91 as follows:
"2. The Civil Aviation Administration directs airport operators, airlines, and enterprises managing service provision facilities for flight operations to coordinate with relevant agencies and units to organize base-level drills at each airport, airline, and air navigation service facility at least once every two years."
50. Amend and supplement Article 97 as follows:
Article 97. Air Security Management System of Airlines
“1. The air security management system of airport operators, airlines, air navigation service providers, aircraft manufacturing, maintenance, and repair enterprises, and general aviation businesses must meet the following requirements:
a) Independence in function and tasks; the air security advisory body does not concurrently perform other tasks and has administrative authority equivalent to other advisory bodies within the same enterprise;
b) The head of the air security management system is responsible to the enterprise's executive board (for airports, this is the executive board of the airport operator) for air security;
c) Vietnamese airlines operating regular flights abroad must designate a person responsible for the airline's air security work in that country and include it in the airline's air security program;
d) The person responsible for air security, the deputy responsible for air security, security officers, and security supervisors in the air security management system must meet business service licensing conditions and receive training commensurate with their positions, tasks, and responsibilities as stipulated in the Vietnamese Air Security Training Program issued by the Minister of Transport;
đ) The person responsible for air security must have sufficient authority, responsibility, and resources to effectively implement the air security program and regulations, and these must be specifically defined in the enterprise's organizational and operational charter;
e) The heads of agencies and units with air security programs and regulations must define the specific functions and tasks of the air security management system to ensure it has sufficient authority, responsibility, and resources to effectively implement the air security program and regulations.
2. Foreign airlines operating regular flights to Vietnam must designate and notify the Civil Aviation Administration in writing the person responsible for air security of the airline in Vietnam.
51. Amend and supplement Clause 2 of Article 98 as follows:
"2. The air security officer license is valid for eight years. The validity period of the identification officer certification is twelve months; mobile security officer and security check officer certifications are twenty-four months. In cases where the holder does not perform the certified job continuously for more than six months, the certification becomes invalid, and upon resuming work, they must pass a recertification examination."
52. Amend and supplement Clause 9 of Article 98 as follows: "9. A person whose air security officer license is revoked under Clause 8 of this Article must pass a re-examination to obtain a new license and certification when resuming work.".”
53. Amend and supplement Article 101 as follows:
“9. Persons whose aviation security officer licenses have been revoked under Clause 8 of this Article, upon returning to work, must retake the licensing examination and be certified as aviation personnel.”
53. Amend and supplement Article 101 as follows:
“Article 101. Facilities for ensuring aviation security
1. Facilities for ensuring aviation security at airports include:
a) Airport security facilities: security fences separating restricted areas from other areas, patrol routes, intrusion alarm systems, lighting systems, guard posts, gates, doors, security checkpoints, lighting systems for aircraft parking positions at night;
b) Gates, doors, security checkpoints on pathways between restricted areas with exclusive use and those without exclusive use; pathways from other areas to restricted areas;
c) Emergency centers; isolated aircraft parking positions; bomb disposal shelters; passenger, baggage, and cargo assembly areas in case of illegal interference with aircraft;
d) Surveillance camera systems monitoring the entire terminal, aircraft parking areas, adjacent traffic routes, and control rooms for these systems;
đ) Security checkpoints for passengers, baggage, and cargo including search rooms and visual inspection rooms at the terminal;
e) Control rooms for aviation security forces and airport authorities at the terminal; rooms for managing passengers refused entry at international terminals.
2. Facilities for ensuring aviation security outside the terminal and airport include:
a) Lighting systems around the perimeter; surveillance camera systems monitoring all restricted areas; security fences separating restricted areas from other areas;
b) Guard posts, gates, doors, security checkpoints at entrances to restricted areas from other areas.
3. Requirements for facilities for ensuring aviation security:
a) Aviation security facilities must be inspected, maintained, and serviced according to legal standards and regulations and must have complete documentation; any damage must be repaired promptly;
b) Security fences between restricted areas and other areas must have the ability to prevent and warn against unauthorized entry;
c) The number of gates and doors leading to restricted areas from other areas must be limited to the minimum necessary;
d) Ensure separation between passengers, baggage, and cargo that have been screened and those that have not;
đ) Emergency center locations; isolated aircraft parking positions; bomb disposal shelters; passenger, baggage, and cargo assembly areas in case of illegal interference with aircraft must be convenient for handling emergency situations and implementing emergency plans;
e) Ensure separation between departure, arrival, connecting, and transit passenger flows; international and domestic passenger and cargo flows;
g) Areas designated for security checkpoints for passengers and baggage must have sufficient space to avoid congestion and facilitate passenger and baggage screening and scanning;
h) Isolation zones must be separated from non-restricted areas by durable materials and from other restricted areas by appropriate materials;
i) Use suitable materials to minimize losses and damages to people and terminal and airport equipment in case of fire or explosion;
k) By December 31, 2025, airports that have been constructed but lack appropriate aviation security facilities must comply fully with the provisions of Clause 1 of this Article.
4. Requirements and standards for security fences, gates, doors, barriers, lighting systems, surveillance camera systems, guard posts, and patrol routes at airports and air service facilities are specified in Appendix XII issued together with this Circular.
54. Amend and supplement Point a Clause 1 Article 102 as follows:
"a) X-ray machines, metal detectors, body scanners, aviation security surveillance cameras, intrusion detection devices, handheld metal detectors; specialized equipment and tools for detecting explosives, weapons, and dangerous items;"
55. Amend and supplement Point b Clause 2 Article 102 as follows:
"b) X-ray machines, metal detectors, body scanners, and handheld metal detectors must have test samples consistent with their technical specifications and manufacturer instructions;"
56. Amend and supplement Point đ Clause 2 Article 102 as follows:
"đ) When investing in new aviation security equipment, it must ensure that the equipment meets advanced global technology standards. By December 31, 2025, security checkpoints requiring body scanners must be fully equipped according to regulations."
57. Amend and supplement Clause 3 Article 103 as follows:
"3. X-ray machines, metal detectors, body scanners, and handheld metal detectors must be tested using test samples consistent with their technical specifications and manufacturer instructions.
a) For X-ray machines: testing requirements, steps for conducting tests, recording test results according to the model specified in Appendix XVIII issued together with this Circular;
b) For metal detectors: testing requirements, methods for conducting tests, recording test results according to the model specified in Appendix XIX issued together with this Circular;
c) For handheld metal detectors: testing requirements, methods for conducting tests, recording test results according to the model specified in Appendix XX issued together with this Circular;
d) For body scanners: testing requirements, methods for conducting tests, recording test results according to manufacturer instructions."
58. Amend and supplement Clause 4 Article 103 as follows:
"4. X-ray machines, metal detectors, body scanners, handheld metal detectors, explosive detection devices, aviation security surveillance cameras, and intrusion alarm systems must be regularly maintained according to manufacturer regulations to ensure stable operation. Security equipment that fails inspection standards must cease operation. Inspection, regular maintenance, and emergency repair logs must be clearly and accurately recorded and must include the following information:
a) Equipment name, location, installer, installation date;
b) The date, month, year of inspection and maintenance; the content, results of inspection and maintenance; the name of technical staff conducting the inspection and maintenance.
59. Amend and supplement Clause 2 of Article 104 as follows:
“2. Subjects permitted to equip and use security support tools:
a) Subjects mentioned in Points a, b, d, and đ of Clause 1 of this Article are allowed to equip and use one or more of the following security support tools: bulletproof helmets, bulletproof vests; shields, electric gloves; tear gas grenades; pepper spray guns, rubber bullets; various types of tear gas spraying devices, sedatives; electric batons, rubber batons, handcuffs;
b) Team-level and squad-level officers, security control personnel when performing patrol and guard duties at airport runway areas, taxiways, gates, entrances and exits adjacent to airports, restricted areas, public areas (terminals, parking lots) are allowed to equip and use one or more of the following security support tools: pepper spray guns, rubber bullets; electric batons, rubber batons, handcuffs; adjacent to the airport, restricted areas, public areas (terminal, parking lots) may be equipped and used with one or more of the following support tools: pepper spray guns, rubber bullet guns; electric batons, rubber batons, handcuffs;
c) Team leaders, aviation security officers performing enhanced security duties for flights, enforcing and escorting disruptive passengers, passengers refused entry, may be equipped and use one or more of the following support tools: pepper spray guns, rubber bullet guns; electric batons, rubber batons, handcuffs;
c) Team-level and squad-level officers, aviation security control personnel when performing enhanced security assurance tasks for flights, coercive measures, escorting disruptive passengers, passengers refused entry are allowed to equip and use one or more of the following security support tools: pepper spray guns, rubber bullets; electric batons, rubber batons;
d) Shift leaders when performing security check tasks for passengers, baggage, cargo are allowed to equip and use one or more of the following security support tools: pepper spray guns; electric batons, rubber batons;
đ) Team-level and squad-level officers, aviation security control personnel when performing inspection, supervision, and escorting cargo outside the airport premises are allowed to equip and use one or more of the following security support tools: electric batons, rubber batons.”
“60. Amend and supplement Article 106 as follows:
Article 106. General Provisions on Aviation Security Quality Control
1. The Civil Aviation Administration of Vietnam shall conduct open and covert inspections, testing, investigations at all civil aviation airports, airfields, service providers, airlines, and equipment within the country. Air Traffic Control Units shall carry out regular supervision, open and covert inspections, testing, and investigations at airports, airlines, and service providers within their jurisdiction. Airport operators shall conduct internal open and covert inspections, testing, and investigations at airports under their management. Enterprises with aviation security programs shall implement internal open and covert inspections, testing, and evaluations according to regulations.
2. Regular supervision, inspection, testing, evaluation, and investigation activities for aviation security shall be carried out according to annual quality control activity plans or on an ad hoc basis. Covert testing shall not be conducted on aircraft in flight or special aircraft flights.
3. The annual aviation security quality control activity plan includes regular supervision, inspection, testing, and evaluation activities, which are based on aviation security risk assessments, resources of agencies and units, and must ensure consistency across the industry and confidentiality for covert testing activities. The plan shall be developed as follows: a) Before October 15 each year, Air Traffic Control Units shall develop the next year's aviation security quality control plan and submit it to the Civil Aviation Administration of Vietnam;
b) Before October 30 each year, the Civil Aviation Administration of Vietnam shall issue the next year's aviation security quality control plan for the Civil Aviation Administration of Vietnam and Air Traffic Control Units, and send it to relevant units and enterprises with aviation security programs;
c) Before November 30 each year, based on the aviation security quality control plans of the Civil Aviation Administration of Vietnam and Air Traffic Control Units, airport operators, airlines, and enterprises with aviation security programs shall develop and issue their internal aviation security quality control plans, and submit them to the Civil Aviation Administration of Vietnam and Air Traffic Control Units for monitoring.
4. Inspection, testing, evaluation, and sudden investigation activities shall be decided by authorized persons when deemed necessary.
5. The Civil Aviation Administration of Vietnam shall issue a manual for effective and consistent implementation of aviation security quality control throughout the industry.
6. Agencies and units managing individuals who violate regulations or equipment that does not meet aviation security standards shall be responsible for suspending the activities of violators and non-compliant equipment according to the requirements of the inspection, testing, and investigation team leader.
7. Through regular supervision, inspection, testing, and investigation activities for aviation security and data exchange and reports from agencies, units, and Air Traffic Control Units, statistical analysis of quality control data shall be compiled and updated into the aviation security database as stipulated in Article 112 of this Circular at a frequency of once every month or upon the occurrence of aviation security inspection, testing, evaluation, and investigation activities.”
61. Amend and supplement the title of Article 107 as follows:
“Article 107. Requirements for aviation security inspection, testing, evaluation, and investigation activities”
62. Amend and supplement Clause 1 of Article 107 as follows:
“1. Requirements for the inspection, evaluation, testing, and investigation activities of the Civil Aviation Administration of Vietnam and Air Port Control Units:
a) There must be a decision to establish a team issued by an authorized person. The inspection, evaluation, testing, and investigation plan must be approved by the person issuing the decision to establish the team;
b) The team leader is responsible for developing the inspection, evaluation, testing, and investigation plan and reporting the results to the person who issued the decision to establish the team no later than ten working days from the end date of the inspection, testing, and investigation activities;
c) The aviation security inspection activities of the Civil Aviation Administration of Vietnam and air port control units on enterprises shall be carried out at frequencies specified in Point d and đ of this Clause, except in cases of emergency;
d) Inspections of airport operators, airlines, and air service providers shall be conducted at least once a year;
đ) Testing of airport operators shall be conducted at least once a year; Vietnamese airlines at least once every two years.”
63. Amend and supplement Clause 2 of Article 107 as follows:
“2. Requirements for the inspection, testing, investigation, and evaluation activities of airport operators, airports, airlines, and other enterprises with aviation security programs and regulations:
a) There must be an inspection, testing, investigation, and evaluation plan approved by the head of the organization responsible for aviation security. The content of the inspection, testing, and evaluation should focus on key areas and be appropriate to aviation security risks;
b) Evaluation activities of Vietnamese airlines at foreign airports, which are funded by the airlines, must involve the Civil Aviation Administration of Vietnam. Evaluation activities in Vietnam by foreign regulatory authorities and airlines must be permitted by the Civil Aviation Administration of Vietnam, and the results must be reported back to the Civil Aviation Administration of Vietnam after completion;
c) Airport operators and airport authorities must conduct inspections and tests at least once every quarter, except in cases of emergency;
d) Enterprises with other aviation security control forces must conduct internal inspections and tests at least once a year, except in cases of emergency.”
64. Amend and supplement Article 112 as follows:
“Article 112. Organization of building an aviation security database
1. The Civil Aviation Administration of Vietnam organizes statistics and builds a unified aviation security database throughout the civil aviation industry. The aviation security database must be protected against unauthorized access; only organizations and individuals permitted by the Civil Aviation Administration of Vietnam may access and utilize it.
2. The aviation security database includes information on:
a) Illegal interference acts and incidents violating aviation security;
b) Individuals subject to mandatory visual inspection, refused transport due to security reasons, prohibited from air transport;
c) Weaknesses and deficiencies identified through monitoring activities and security inspections, tests, evaluations, and investigations;
d) Security control identification cards and permits;
đ) Infrastructure systems, equipment, weapons, and support tools;
e) Organizational systems, security control forces, and security control personnel permits.
3. The Civil Aviation Administration of Vietnam manages the aviation security database; Air Port Control Units and enterprises with aviation security programs and regulations must regularly update the contents specified in Clause 2 of this Article into the database.
4. The Civil Aviation Administration of Vietnam guides the statistical reporting, updating, utilization, management, and use of the aviation security database.”
65. Amend and supplement Clause 1 of Article 114 as follows:
“1. Implement aviation security quality control within the scope of authority. Inspect and supervise compliance with laws and regulations on aviation security assurance, aviation security programs and regulations, implementation of aviation security measures and provision of aviation security services at airports, handling of aviation security violations and public order incidents at airports. Participate in responding to illegal interference at airports according to regulations. Participate in assessing aviation security programs and regulations upon request of the Civil Aviation Administration of Vietnam.”
66. Amend and supplement Clause 11 of Article 115 as follows:
“11. Comply with regulations on issuance and management of aviation security control identification cards and permits. In cases where airport enterprises have updated information on issued aviation security control identification cards and permits into the aviation security database system within five days from issuance, there is no need to submit lists of issued cards and permits in writing to Air Port Control Units as stipulated in Clause 2 of Article 20, Clause 2 of Article 21, Clause 3 of Article 23, and Clause 3 of Article 24 of this Circular.”
67. Amend and supplement Clause 9 of Article 116 as follows:
“9. Carry out escorting and accompanying of special persons and means that pose a threat to aviation security as prescribed or when requested. Manage and monitor passengers refused entry according to the law.”
68. Amend and supplement Clause 2 of Article 117 as follows:
“2. Organize aviation security assurance according to this Circular; enterprises providing air navigation services, enterprises providing airline catering services, enterprises providing aviation fuel services, and aircraft maintenance and repair enterprises organize aviation security control forces to perform aviation security assurance tasks in areas under their responsibility.”
69. Amend and supplement Point b of Clause 5 of Article 118 as follows:
“b) Establish an aviation security management system as prescribed in Articles 92, 93, 96, and 97 of this Circular;"
70. Amend and supplement Point k of Clause 5 of Article 118 as follows:
"k) Report to the Civil Aviation Administration of Vietnam any differences in the airline's aviation security program presented to foreign aviation authorities compared to Vietnamese law. Be subject to the direction and guidance on aviation security provided by the Civil Aviation Administration of Vietnam."
71. Amend and supplement Clause 7 of Article 118 as follows:
“7. When processing ticket sales for flights, airlines must require passengers to provide personal information as prescribed in Appendix XIV attached hereto. When processing cargo and mail registration procedures, airlines must inform customers of the company's different policies regarding the transportation of special items as stipulated in Article 52 of this Circular or dangerous goods, diplomatic pouches, consular pouches (if applicable).”
72. Amend and supplement Point 11 of Chapter III of Appendix II as follows:
“11. Ensuring the security of charter flights, joint venture flights, wet lease operations without flight crews, wet lease operations with flight crews, and non-scheduled air transport flights with off-airport stops.

"3.1. Increase the number of aviation security personnel assigned to inspect and monitor by 10%."
"1.17. Enhance internal reporting. Implement daily hotline reports from units to the Civil Aviation Authority of Vietnam. The aviation security force should increase its on-duty personnel by 20% compared to the regular shift to be ready for duty."
"2.17. Units within the industry must organize 24/24 shifts and implement a 12-hour reporting system, and report immediately when seeking guidance from the Civil Aviation Authority of Vietnam. The aviation security force should increase its on-duty personnel by 30% compared to the regular shift to be ready for duty."
"3.17. Units must organize 24/24 shifts and implement a four-hour reporting system, and report immediately when seeking guidance from the Civil Aviation Authority of Vietnam. The aviation security force should organize 100% on-duty personnel."
87. Amend and supplement Point 4 of Section II of Appendix XVIII as follows:
"4. Test 3: Single-layer penetration
Requirement: The image of the lead sheet must be visible through a steel plate 14 millimeters thick.
This test aims to determine the machine's ability to penetrate steel thickness. Steel plates in the CTP sample set start at 12 millimeters thick, increasing by two millimeters up to 24 millimeters. A lead sheet runs along the length of the steel plates to test the machine's capability."
88. Amend and supplement the note at Sections A, B, C of Appendix XXIV as follows:
"Aviation Security Unit (Center, Department, Division...)"
Article 2. Effective Date
1. This Circular takes effect from March 15, 2021.
2. Airlines and fuel suppliers providing air catering services that have not organized aviation security forces due to the impact of the COVID-19 pandemic must complete the organization of aviation security forces before January 1, 2023.
This Circular takes effect from December 25, 2025/.
The Head of the Ministry’s Office, the Inspector General of the Ministry, the Directors of the Departments, the Director of the Civil Aviation Administration of Vietnam, the Heads of relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
