THE MINISTER OF FINANCE

Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government stipulating the tasks, powers, and responsibilities for state management of ministries and ministerial-level agencies;

BASED ON DECREE NO. 178/CP DATED OCTOBER 28, 1994 OF THE GOVERNMENT ON THE TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF FINANCE;

Considering the proposal of the Director of the State Asset Management Agency, the Head of the Organization and Cadre Training Department;

 

DECISION:

Article 1: The State Asset Management Agency is a unit under the Ministry of Finance, with the function of assisting the Minister of Finance in performing state management functions over state assets in the administrative and public service sector, directly managing certain state assets according to the classification and management levels set by the State, and managing financial matters related to infrastructure assets and national resources in accordance with the provisions of the State and specific provisions of this Decision.

The State Asset Management Agency has legal personality, its own seal, and is entitled to open accounts at the National Treasury. Its headquarters is located in Hanoi City.

Article 2: The main tasks and powers of the State Asset Management Agency are as follows:

1- To draft policies and regulations on the management and utilization of state-owned assets, financial management systems for infrastructure assets and national resources, to be issued by the Minister of Finance within their authority or submitted to the Government for issuance.

2- To develop or coordinate with relevant departments to develop standards and norms for the use of state assets in administrative and public service units, to be issued by the Minister of Finance within their authority or submitted to the Government for issuance.

3- To organize, direct, guide, and inspect administrative and public service units in implementing policies and systems for state asset management and financial management of infrastructure assets and national resources; to recommend or handle according to their authority cases of violation in state asset management and financial management of infrastructure assets and national resources.

4- To organize statistics, compile, analyze, and report on the situation of state asset management and utilization, and financial management of infrastructure assets and national resources.

5- To organize and guide the inventory of state assets in the administrative and public service sector.

6- To take the lead in coordinating with relevant departments to recover state assets, land, and national resources, transfer state assets in the administrative and public service sector according to decisions of the Government, the Minister of Finance, and competent state authorities.

7- Based on the results of state asset management and current regulations, to review budget estimates for the following items of administrative and public service units to submit to the competent authority for inclusion in the annual state budget estimates of ministries, sectors, and central organizations benefiting from the state budget:

Procurement, maintenance, repair, and upgrading of state assets in the administrative and public service sector.

Maintenance, repair, and renovation of infrastructure assets.

Surveying, land registry establishment, land evaluation and classification, land planning and usage plans; investigation, exploration, and protection of natural resource sources.

National material and supply reserve work.

8- To review proposals for handling state assets that are no longer needed or usable by central administrative and public service units according to the division of management responsibility, to submit to the Minister of Finance for decision and to take the lead in organizing the implementation of such decisions.

9- To inspect according to their functional and delegated responsibilities the implementation of state budget expenditure estimates by administrative and public service units for needs related to changes in state assets.

10- To organize the receipt, storage, and coordination with relevant departments to process state assets that have been decided by authorized authorities to be confiscated and transferred to the state treasury or established as state-owned property according to the division of state asset management; to coordinate with relevant departments to track and compile state assets from aid that have been established as state-owned property.

11- To coordinate with relevant departments to value natural resources for organizations exploiting them according to the decisions of authorized authorities; to participate in formulating land revenue policies.

12- To manage and store files and documents related to state asset management and financial management of land and national resources.

13- To guide local financial agencies in managing state assets according to the Government's and the Ministry of Finance's regulations.

14- To directly transact with organizations and individuals to perform state asset management tasks.

15- To receive reports and necessary information on state assets and national resources, and request subordinate units of the Ministry to provide relevant documents on state assets and national resources.

16- To sign guiding and explanatory documents on the management and utilization of state assets and national resources according to the division of authority or delegation by the Minister of Finance.

Article 3: The State Asset Management Agency is headed by the Director. Deputy Directors assist the Director. The organizational structure of the State Asset Management Agency includes the following departments:

General Department.

State Asset Management Department for Administrative and Public Service Sector.

Infrastructure Asset Management Department.

Land and National Resource Management Department.

State-Owned Property Management Department.

Specific tasks of these Departments are defined by the Director of the State Asset Management Agency.

The staffing of the State Asset Management Agency is determined by the Minister of Finance.

The Director of the State Asset Management Agency is responsible for managing cadres and civil servants of the Agency according to the current regulations on cadre and civil servant management levels of the Ministry of Finance.

Article 4:

1- The operating funds of the State Asset Management Agency are provided from the Ministry of Finance's budget funded by the state budget.

2- The State Asset Management Agency is responsible for preparing and submitting to the Minister of Finance for approval the budget for serving annual state asset management tasks; to manage financial resources generated during the process of state asset management and disposal according to state regulations.

Article 5: This Decision shall take effect from July 1, 1997; all previous provisions of the Minister of Finance regarding the duties, powers, and organizational structure of the State Asset Management Department that conflict with this Decision are hereby abolished.

Article 6: The Director of the State Asset Management Department, Heads of units under the Ministry, organizations directly subordinate to the Ministry, Directors of Provincial Departments of Finance and Prices, Heads of the Cadre Organization and Training Department, and the Director of the Ministry of Finance's Office are responsible for implementing this Decision./.
