ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE NATIONAL ASSEMBLY SECRETARIAT

Based on the Law on the Organization of the National Assembly;

Pursuant to the Operation Regulations of the Standing Committee of the National Assembly, the Operation Regulations of the National Ethnic Council, the Operation Regulations of the National Assembly Committees, the Operation Regulations of the National Assembly Deputies and the National Assembly Delegation, and the Resolutions No. 368, 369, 370 dated March 17, 2003 of the Standing Committee of the National Assembly on the establishment of the Representative Work Committee, the Legislative Work Committee, and the Public Petition Committee;

Considering the proposal of the Director of the National Assembly Secretariat;

RESOLUTION:

Article 1. Functions of the National Assembly Secretariat

The National Assembly Secretariat is the assisting body of the National Assembly, having the function of researching, advising comprehensively, and organizing services for the activities of the National Assembly, the Standing Committee of the National Assembly, the President of the National Assembly, the Vice Presidents of the National Assembly; the activities of the National Ethnic Council, the National Assembly Committees, and the Standing Committee of the National Assembly's Committees.

Article 2. Tasks of the National Assembly Secretariat

1. Serving the National Assembly, the Standing Committee of the National Assembly, the National Ethnic Council, and the National Assembly Committees in legislative work; coordinating to serve the Standing Committee of the National Assembly in interpreting the Constitution, laws, and ordinances.

2. Serving the National Assembly in deciding fundamental policies and promulgating resolutions and decisions on economic-social issues, state budget, national important projects, national defense, security, foreign affairs, organization and personnel matters within the jurisdiction of the National Assembly.

3. Serving the National Assembly in exercising its highest supervisory power over the compliance with the Constitution, laws, and resolutions of the National Assembly; serving the Standing Committee of the National Assembly in supervising the implementation of the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly; supervising the activities of the Government, the Supreme People's Court, and the Supreme People's Procuracy; serving the supervisory activities of the National Ethnic Council and the National Assembly Committees.

4. Coordinating to serve the Standing Committee of the National Assembly in supervising and guiding the activities of the People's Councils at all levels.

5. Serving the Standing Committee of the National Assembly in announcing and chairing the election of National Assembly deputies; announcing the election of People's Council deputies at all levels.

6. Serving the external relations work of the National Assembly, the Standing Committee of the National Assembly, the President of the National Assembly, the National Ethnic Council, the National Assembly Committees, and the Standing Committee of the National Assembly's Committees.

7. Coordinating in handling public complaints, petitions, and citizens' requests; serving the Standing Committee of the National Assembly in supervising the resolution of citizens' complaints and petitions; compiling opinions and proposals from voters sent to the National Assembly.

8. Researching and serving the Standing Committee of the National Assembly in directing, coordinating, and coordinating the activities of the National Ethnic Council and the National Assembly Committees; ensuring conditions for the activities of National Assembly deputies and National Assembly Delegation; assisting the Standing Committee of the National Assembly in studying and organizing the implementation of systems and policies for National Assembly deputies; assisting the President of the National Assembly in maintaining contact with National Assembly deputies.

9. Serving the activities of the President of the National Assembly and the Vice Presidents of the National Assembly, the Standing Committee of the National Assembly Members. Serving the Standing Committee of the National Assembly in managing the general operations of the National Assembly, ensuring the implementation of the Rules of Procedure of the National Assembly sessions, the Operation Regulations of the National Assembly's bodies, and the National Assembly Delegation.

10. Proposing improvements to the working system of the National Assembly, the Standing Committee of the National Assembly, the National Ethnic Council, the National Assembly Committees, the Standing Committee of the National Assembly's Committees, and the specialized National Assembly deputies according to the directives of the Standing Committee of the National Assembly.

11. Coordinating to serve the Standing Committee of the National Assembly in determining staffing and establishing policies and systems for the Supreme People's Court, the Supreme People's Procuracy, and the National Assembly Secretariat.

12. Drafting and organizing the service for National Assembly sessions, Standing Committee of the National Assembly meetings, other meetings of the Standing Committee of the National Assembly, meetings of the National Ethnic Council, National Assembly Committees, Standing Committee of the National Assembly's Committees, and specialized National Assembly deputies' meetings; drafting and helping to organize the implementation of the work programs of the National Assembly, the Standing Committee of the National Assembly, the National Ethnic Council, National Assembly Committees, and Standing Committee of the National Assembly's Committees.

13. Preparing draft projects, plans, reports assigned by the Standing Committee of the National Assembly, the President of the National Assembly, and the Vice Presidents of the National Assembly; preparing work reports of the National Assembly, the Standing Committee of the National Assembly, the National Ethnic Council, National Assembly Committees, and Standing Committee of the National Assembly's Committees.

14. Urging the preparation and ensuring procedures for submitting draft projects, plans, reports, and proposals to the National Assembly and the Standing Committee of the National Assembly from relevant agencies and organizations.

15. Organizing and managing information, computer science, scientific research, press, publication, library work of the National Assembly.

16. Assisting the Standing Committee of the National Assembly in maintaining relations with the State President, the Government, the Central Committee of the Vietnam Fatherland Front, the Supreme People's Court, the Supreme People's Procuracy, and related agencies and organizations.

17. Serving the President of the National Assembly in directing and implementing the operational budget of the National Assembly. Organizing and managing material-technical assurance work of the National Assembly, managing National Assembly assets; organizing administrative, documentation, printing, archival, security, and reception work of the agency.

Article 3. Establishment and abolition of departments and units

The National Assembly Secretariat shall be organized into departments and equivalent units; offices directly under the Director of the National Assembly Secretariat and offices directly under departments or equivalent units.

The establishment or abolition of departments and equivalent units shall be decided by the Standing Committee of the National Assembly.

The establishment or abolition of rooms under the Director of the National Assembly Office, rooms in departments, and common service units shall be decided by the Director of the National Assembly Office. The establishment or abolition of rooms under departments directly assisting the National Ethnic Council, Committees of the National Assembly, and the three Boards of the Standing Committee of the National Assembly shall be decided jointly by the Standing Body of the National Ethnic Council, the Standing Bodies of the Committees, and the Heads of the Boards in coordination with the Director of the National Assembly Office; the Director of the National Assembly Office shall issue the decision.

Article 4. Organizational structure of the National Assembly Office

The National Assembly Office includes the following departments and units equivalent to department level:

- Departments directly assisting the National Ethnic Council, Committees of the National Assembly:

- Ethnic Affairs Department;

- Legal Affairs Department;

- Economic and Budget Department;

- Defense and Security Department;

- Culture, Education, Youth, Adolescents, and Children's Affairs Department;

- Social Issues Department;

- Science, Technology, and Environment Department;

- Foreign Relations Department;

- Departments directly assisting the three Boards of the Standing Committee of the National Assembly:

- Representative Work Department;

- Legislative Work Department;

- Petitions Department;

- Common Service Departments and Units:

- Comprehensive Department;

- Administrative Department;

- Organization and Cadre Department;

- Planning and Finance Department;

- Information, Library, and Scientific Research Center;

- Computing Center;

- Management Bureau;

- Southern Region Work Department;

- People's Representative Newspaper;

- Legislative Research Magazine.

Article 5. Leadership and Direction

The Director of the National Assembly Office is the head of the National Assembly Office, accountable to the Standing Committee of the National Assembly for the work of the National Assembly Office. The Standing Body of the National Ethnic Council, the Standing Bodies of the Committees of the National Assembly, and the Heads of the Boards of the Standing Committee of the National Assembly are accountable to the Standing Committee of the National Assembly for the work of the National Assembly Office concerning related issues. Deputy Directors assist the Director in performing tasks as assigned by the Director.

Department heads and heads of units equivalent to department level manage the work of their departments or units. Assistant department heads and assistant heads of units equivalent to department level may have one or more deputy department heads or deputy heads of units equivalent to department level.

Room heads manage the work of their rooms, and room assistants may have one or two deputy room heads.

Article 6. Staffing

The staffing of the National Assembly Office is decided by the Standing Committee of the National Assembly.

Annually, the Standing Body of the National Ethnic Council, the Standing Bodies of the Committees of the National Assembly, and the Heads of the Boards of the Standing Committee of the National Assembly propose the staffing for their respective assisting departments; the National Assembly Office compiles the overall proposed staffing and submits it to the Standing Committee of the National Assembly for consideration and decision.

Article 7. Leadership and Direction of the Work of Departments and Units

1. The Standing Body of the National Ethnic Council, the Standing Bodies of the Committees of the National Assembly, and the Heads of the Boards of the Standing Committee of the National Assembly coordinate with the Director of the National Assembly Office to define the functions and responsibilities of departments directly assisting the National Ethnic Council, Committees, and Boards.

For departments directly assisting the National Ethnic Council, Committees of the National Assembly, and the Boards of the Standing Committee of the National Assembly, the Standing Body of the National Ethnic Council, the Standing Bodies of the Committees, and the Heads of the Boards directly direct all aspects of work.

2. The Director of the National Assembly Office defines the functions and responsibilities and directs all aspects of work of common service departments and units.

Article 8. Organizational and Cadre Work

1. The Director and Deputy Directors of the National Assembly Office are appointed, relieved, or dismissed by the Standing Committee of the National Assembly.

2. The selection of cadres and civil servants, appointment, dismissal of department heads and deputy department heads and equivalent positions; room heads and deputy room heads and equivalent positions for departments directly assisting the National Ethnic Council, Committees of the National Assembly, and the Boards of the Standing Committee of the National Assembly are decided jointly by the Standing Body of the National Ethnic Council, the Standing Bodies of the Committees, and the Heads of the Boards in coordination with the Director of the National Assembly Office; the Director of the National Assembly Office issues the decision. The Standing Body of the National Ethnic Council, the Standing Bodies of the Committees, and the Heads of the Boards coordinate with the Director

of the National Assembly Office in managing and implementing systems and policies for cadres and civil servants in departments directly assisting the National Ethnic Council, Committees, and Boards.

3. The selection, management, and implementation of systems and policies for cadres and civil servants; appointment, relief of department heads and deputy department heads and equivalent positions, room heads and deputy room heads and equivalent positions in common service departments and units are decided by the Director of the National Assembly Office.

Article 9. Management of Financial Implementation

1. The Director of the National Assembly Office assists the Chairman of the National Assembly in organizing the implementation of financial resources for the operation of the National Assembly.

2. The Standing Body of the National Ethnic Council, the Standing Bodies of the Committees of the National Assembly, and the Heads of the Boards of the Standing Committee of the National Assembly decide on the use of allocated financial resources for the National Ethnic Council, Committees, and Boards.

3. The National Assembly Office implements procedures according to state financial management regulations and guidelines from the Standing Committee of the National Assembly.

Article 10. Implementation Provisions

1. This Resolution replaces Resolution No. 02-NQ/UBTVQH9 dated October 17, 1992 of the Standing Committee of the Ninth National Assembly; all provisions contrary to this Resolution are abolished.

2. The Standing Body of the National Ethnic Council, the Standing Bodies of the Committees, the Heads of the Boards, and the Director of the National Assembly Office are responsible for enforcing this Resolution.
