DECISION
On the management mechanism and scientific research and technological development activities
PRIME MINISTER
Pursuant to the Government Organization Law dated September 30, 1992;
To encourage scientific research and application of scientific and technological achievements to production and daily life, while continuing to improve state management work for scientific research and technological development activities;
Considering the proposal of the Minister of Science, Technology, and Environment;
DECISION:
Article 1. Scientific research and application of scientific and technological achievements are the tasks of science and technology agencies, all levels and sectors at central and local levels, enterprises, social organizations, and private entities.
Investment for scientific and technological development is the responsibility of all levels, all sectors, and enterprises belonging to various economic components.
Heads of Ministries, sectors, levels of government; Directors of enterprises, scientific research institutions and technological development, universities have the responsibility to organize scientific and technological activities of their respective units and sectors.
Article 2:The Minister of Science, Technology, and Environment shall coordinate with the State Planning Commission and relevant Ministries to develop long-term and annual plans on scientific research and technological development for the Prime Minister's decision. These plans include tasks to build material infrastructure for scientific research and technological development institutions. Based on this, allocate the total budget expenditure of the State for scientific and technological activities.
Article 3:The establishment and approval of national scientific research and technological development tasks funded by the State shall be carried out as follows:
a. The Prime Minister decides on key national tasks in science and technology aimed at implementing important tasks for socio-economic development. The Ministry of Science, Technology, and Environment organizes the construction of several key science and technology programs and topics to submit to the Prime Minister for approval, then selects them to assign to relevant agencies and units to implement. There should be no overlap between key national programs and topics with regular research tasks of institutes, research centers, and universities.
National key tasks in scientific research and technological development must be developed into programs, topics, and projects and reviewed according to current regulations of the State.
b. After reaching consensus with the Ministry of Science, Technology, and Environment, heads of Ministries, sectors, and Chairmen of Provincial People's Committees decide on the plans and programs for scientific research and technology implementation in their respective sectors and localities, then assign them to subordinate agencies and provincial people's committees to implement. Funding for these tasks is included in the general budget of the Ministry, sector, and locality according to their regular functions.
National Research Centers decide on their scientific research and technological development tasks after reaching consensus with the Ministry of Science, Technology, and Environment. National Universities decide on their scientific research and technological development tasks after reaching consensus with the Ministry of Education and Training and the Ministry of Science, Technology, and Environment. The Ministry of Education and Training develops plans for scientific research and technological development of other universities.
Article 4. The organization and implementation of scientific research and technological development tasks from the State budget are conducted through the assignment method as stated in Article 3, or by selecting units to implement through contracts for scientific research and technological development orders.
The Minister of Science, Technology, and Environment is authorized by the Government to place orders for key national scientific research and technological development tasks.
Heads of Ministries, sectors, and Chairmen of Provincial People's Committees are responsible for placing orders for scientific research and technological development tasks in their respective sectors and localities.
Directors of enterprises are responsible for placing orders for development and application of science and technology tasks in their enterprises.
Scientific research and technological development institutions under various economic components registered to operate scientific and technological activities according to Article 15 of Decree No. 35-HĐBT dated January 28, 1992, and universities, if they meet the conditions, are eligible to participate in bidding for orders to implement scientific research and technological development tasks.
Institutions in charge of programs or topics are responsible for organizing implementation in accordance with the content and schedule recorded in the contract and using the budget in accordance with the regulations of the Ministry of Finance.
Article 5. All enterprises must have plans for research topics and programs and allocate their enterprise budgets to implement them; register these programs and topics with the competent state agency for science and technology management.
Relevant Ministries and Provincial People's Committees examine and select important technology deployment topics and projects in priority areas requiring state support; allocate part of their budget to support and encourage enterprises to conduct research and technological innovation.
Article 6. Based on the total State budget allocated for science and technology, the Minister of Science, Technology, and Environment has the responsibility to develop a balanced budget plan for the tasks mentioned in Article 3, coordinating with the State Planning Commission and the Ministry of Finance to allocate funds to each Ministry, sector, locality, National Research Centers, the Ministry of Education and Training, and National Universities.
Heads of Ministries, sectors, Chairmen of Provincial People's Committees, Directors of National Research Centers, and National Universities allocate funds to their subordinate units. The Minister of Education and Training allocates funds to other universities.
Allocation of scientific research and technological development funding, including for regular functional tasks and key national tasks, is carried out by the Ministry of Finance through the Treasury system.
After evaluation and acceptance of scientific results, the ordering agency and the implementing unit must conclude the contract and report to the Ministry of Science, Technology, and Environment and the Ministry of Finance.
Article 7. The Ministry of Science, Technology and Environment shall be responsible for issuing circulars guiding on:
The methods and procedures for developing plans, programs, and projects for scientific research and technological development at ministries, sectors, and localities.
The criteria for selecting units and scientists to undertake scientific research and technology tasks under commissioned contracts.
The procedures for acceptance and evaluation of results from research topics and programs in scientific research and technology.
The Ministry of Finance shall be responsible for coordinating with the Ministry of Science, Technology and Environment to guide and inspect ministries, sectors, localities, and units in fully implementing principles and regulations regarding budget preparation and settlement, creating favorable conditions for agencies and units to effectively perform scientific research and technological development tasks.
Article 8. Heads of ministries, government agencies, Directors of National Research Centers, Rectors of National Universities, Chairpersons of Provincial People's Committees directly under the Central Government shall be responsible for enforcing this Decision.
This Decision takes effect from the date of signature./.
