DECISION OF THE MINISTER OF HOME AFFAIRS

Regarding the approval of the Charter (amended) Vietnam Youth Union

THE MINISTER OF THE MINISTRY OF HOME AFFAIRS

Based on Decree No. 102/SL-L004 dated May 20, 1957 regarding the right to establish associations;

Pursuant to the Government's Decree No. 45/2003/NĐ-CP dated May 9, 2003 on the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to the Government Decree No. 88/2003/NĐ-CP dated July 30, 2003 on organization, operation, and management of Associations;

Considering the proposal of the Vietnam Youth Union and the Director of the Department of Non-Governmental Organizations, Ministry of Home Affairs,

DECISION:

Article 1. Approves the Charter of the Vietnam Youth Union which was adopted at the Fifth National Congress on February 25, 2005.

Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 3. The Chairman of the Vietnam Youth Union, the Director of the Department of Non-Governmental Organizations, and the Head of the Office of the Ministry of Home Affairs shall be responsible for implementing this Decision.

 

 

CHARTER OF THE VIETNAM YOUTH UNION

(Adopted at the Fifth National Congress of the Vietnam Youth Union on

February 25, 2005)

The Vietnam Youth Union (VYU) is a broad social organization of patriotic Vietnamese youth following the thoughts of Ho Chi Minh and the ideals of the Communist Party of Vietnam. The VYU operates within the framework of the Constitution and laws of the Socialist Republic of Vietnam.

The VYU is a member of the Vietnam Fatherland Front and the World Federation of Democratic Youth.

Throughout its various periods of activity under different names, the VYU has built a glorious tradition: uniting all layers of youth to make worthy contributions to national independence, territorial unification, construction, and defense of the socialist fatherland.

Entering a new period, the VYU continues to promote the spirit of patriotism, pride in the nation, self-reliance, talent, and youthful vigor, uniting all Vietnamese youth both domestically and abroad to strive for the goals of national independence and socialism, aiming for prosperity, a strong country, a fair, democratic, and civilized society, happiness, and progress for the youth.

The VYU unites and develops friendly cooperative relations on an equal basis with progressive youth organizations and people from countries around the world, striving for peace, national independence, democracy, and social progress, for the future and happiness of the youth.

PART I

NAME, PURPOSE, FUNCTIONS, AND DUTIES OF THE UNION

Article 1.

- Name of the Union: Vietnam Youth Union (VYU).

- The headquarters of the VYU is located in Hanoi, the capital city.

- The VYU has a symbol.

- The official anthem of the VYU: On the Path.

Music: Luu Huu Phuoc.

Lyrics: Huynh Van Tiep.

- The traditional day of the VYU: October 15.

- The Union has uniforms and rituals guided by the Central Committee's Executive Board.

Article 2. The purpose of the VYU is:

To unite and mobilize a wide range of Vietnamese youth to contribute actively to the cause of building and defending the socialist fatherland firmly.

Article 3. The functions of the VYU are:

1. To unite, mobilize, and educate all layers of Vietnamese youth. Guide and create conditions for members to perfect their character, become good citizens, and contribute their talents and youthful vigor to the cause of building and defending the fatherland.

2. To represent and protect the legitimate interests of members, youth, and affiliated organizations before the law and public opinion.

Article 4. The duties of the VYU are:

1. To encourage and organize members and youth to participate actively in the industrialization and modernization of the country and activities beneficial to the nation and home, promoting goodness.

2. To organize practical activities contributing to meeting the legitimate needs of members and youth.

3. To propose and recommend promptly to state agencies and social organizations to care for and protect the legitimate rights and interests of members, youth, and collective organizations of the Union.

4. To unite and cooperate with youth organizations in the region and worldwide for peace, national independence, democracy, social progress, and a civilized and happy life for the youth.

5. To consistently care for the development of the Union, expand the front of unity and mobilization of youth, and actively participate in building the Ho Chi Minh Communist Youth Union.

Chapter II

MEMBERS

Article 5.

- Vietnamese citizens aged 15 to 35 who agree with the Union's Charter and voluntarily join the Union are recognized as members of the VYU.

- Those over 35 years old with a desire and positive influence on the Union's activities may participate in the Union's organizational activities.

Article 6. Members have the following rights:

1. To introduce their representatives to leadership bodies of the Union.

2. To propose, discuss, vote, and supervise the work of the Union.

3. To request the Union to protect their legitimate rights and interests before the law and public opinion.

4. To leave the Union when they no longer have the conditions to participate in Union activities.

Article 7. Members have the following duties:

1. To comply with the Union's Charter, actively participate in Union activities, promote the Union's influence, and help and introduce young people to join the Union.

2. To actively study, train, strive to achieve personal success, earn legitimate wealth for themselves, families, and society.

3. To build a civilized and healthy lifestyle; to unite and help each other; to preserve the cultural identity and fine traditions of the nation.

Article 8. The VYU recognizes political, social, educational, cultural, and artistic activists; scientists, entrepreneurs, and philanthropists who voluntarily support the Union and its activities spiritually and materially as honorary members.

Chapter III

COLLECTIVE MEMBERS OF THE UNION

Article 9. Collective members of the Union:

1. The Ho Chi Minh Communist Youth Union, the Vietnam Student Union, and the Vietnam Young Entrepreneurs Association are collective members of the Union; youth organizations by profession, interest; volunteer youth teams; groups of Vietnamese youth studying, working, and residing abroad in compliance with the laws of the host country, permitted by the host country to establish organizations, agreeing with the Union's Charter, and submitting applications to join the Union are recognized as collective members of the Union by the Central Committee's Executive Board.

2. Relations between collective members of the Union are based on consultation, coordination, and unified action towards common goals. The Ho Chi Minh Communist Youth Union plays a core role in the organization and activities of the Union.

Article 10. Collective members of the Union have the following rights:

1. To discuss and propose issues related to the activities of the Union's committees at various levels.

2. To introduce their representatives to the Union's committees at various levels.

3. Request the Association to organize cooperative activities with other collective members based on its own initiative for common goals.

Article 11. Collective member has the duty

1. To implement the Charter of the Association and decisions, programs of activities that have been agreed upon.

2. To organize and urge members of their organization to participate in the Association's activities and fulfill membership duties.

3. To contribute financially and provide material and spiritual support to the Association.

Chapter IV

PRINCIPLES AND ORGANIZATIONAL STRUCTURE OF THE ASSOCIATION

Article 12. The Vietnam Youth Union organizes and operates according to the following principles:

- Voluntary and self-management.

- Democratic consultation.

- Unity and mutual respect.

- Equal cooperation, coordination, and unified action.

Article 13. The Vietnam Youth Union is organized at:

- Central level.

- Provincial and centrally governed city levels and equivalents.

- District, town, urban district, provincial city levels and equivalents.

- Commune, ward, town, and equivalents.

The establishment and dissolution of these organizations must comply with current laws.

Article 14. The grassroots organization of the Association includes branch associations, clubs, teams, groups, and other forms of youth gatherings established by the Association's committees at the local community, school, workplace, enterprise, profession, interest, and other legitimate needs of young people.

The Association's committees at all levels can establish grassroots organizations.

 

Article 15. Duties and limitations of the Association's grassroots organizations:

1. To organize activities and implement common programs of the Association.

2. To care for, represent, and protect the legitimate rights of members.

3. To assist and create conditions for members and young people to develop and make contributions.

4. To recognize new members and introduce outstanding members to the League for admission.

Article 16. The Congress or General Meeting of the Vietnam Youth Union at each level is the highest consultative body of that level, convened by the Association's committee at that level.

1. Congresses or General Meetings from commune level and above are held every five years.

2. The number of delegates attending Congresses or General Meetings at each level is decided by the Association's committee at that level.

Delegates to Congresses or General Meetings include incumbent members of the Association's committee at the same level; representatives elected by lower-level Association organizations; representatives selected by collective member organizations through consultation; outstanding individuals or individuals representing various sectors introduced by agencies and units through consultation, and appointed representatives.

3. At commune level and equivalents, Congresses or General Meetings may be organized or all-member meetings may be held, as decided by the Association's committee there.

Article 17. Duties of Congresses or General Meetings of the Vietnam Youth Union at each level:

1. To discuss and approve reports summarizing the term of the Association's committee at the same level.

2. To decide on policies and programs for the new term.

3. To elect the Association's committee at the same level through consultation.

4. To discuss and contribute to draft documents and elect representatives to attend higher-level Congresses or General Meetings (if applicable).

Article 18. The Association's committee is the executive body between two Congresses at each level. The number of members of the Association's committee at each level is determined and elected through consultation by Congresses or General Meetings at that level.

1 Between two Congresses, the removal, cancellation, or addition of members of the Association's committee at each level is discussed and agreed upon by the committee at that level and proposed to the direct superior for recognition. The number added shall not exceed two-thirds (2/3) of the total number of committee members decided by the first Congress of the term. When necessary, the superior Association allows an increase in the number of committee members at the subordinate level but ensures the number of committee members does not exceed the limit set by the Central Committee of the Association.

2. When a member of the Association's committee representing a member organization or a lower-level Association committee no longer holds a position in their organization, they automatically lose their status as a committee member. The member organization or the lower-level Association committee will select a new representative through consultation and propose them to the direct superior Association committee for recognition.

3. The Association's committees at all levels have the following responsibilities:

- To organize the implementation of decisions made by Congresses or General Meetings and policies and programs of the Association.

- To manage operations between two Congresses.

- To review and recognize lists of committee members and leadership positions, and the Inspection Board of the directly subordinate Association committee.

- To protect the legitimate rights of members.

- To inspect the implementation of policies and programs of the Association and the Charter by Association staff, members, and lower-level Association committees.

The Central Committee of the Association convenes at least once a year; provincial and equivalent level committees convene twice a year; district, commune, and equivalent level committees convene four times a year.

Article 19. Responsibilities of the Central Committee of the Association:

1. To organize the implementation of programs set out by Congresses or General Meetings and decide on the annual work program of the Association.

2. To prepare content and convene Congresses or General Meetings of the Vietnam Youth Union.

Article 20. The Central Committee of the Association elects the Executive Board consisting of the Chairperson, Vice-Chairpersons, and Executive Board members through consultation. The Executive Board is the management body of the Central Committee of the Association between two sessions. The Executive Board has a Standing Body consisting of the Chairperson, Vice-Chairpersons, and dedicated Executive Board members who represent the Executive Board in managing daily operations of the Association.

Article 21.

1. The provincial and equivalent level committees elect the Secretariat consisting of the Chairperson, Vice-Chairpersons, and some Secretariat members through consultation. The Secretariat is the management body of the committee between two sessions. The Secretariat has a Standing Body consisting of the Chairperson, dedicated Vice-Chairpersons, and dedicated Secretariat members who represent the Secretariat in managing daily operations of the Association.

2. The district and equivalent level committees; commune and equivalent level committees elect the Chairperson and Vice-Chairpersons to manage daily operations of the committee.

3. Branch associations, teams, groups, clubs elect leaders and deputy leaders to manage daily operations.

Article 22. Relationships between Association committees at different levels are implemented according to the principle: The higher-level committee unifies policies, action programs, and guides the lower-level committee in implementation; the lower-level committee builds programs consistent with overall policies and regularly reports to the higher-level committee.

The higher-level Association unifies the guidelines, program of action, and directs the lower-level Association's Committee to implement; the lower-level Association's Committee develops a program consistent with the overall guidelines and reports regularly to the higher-level Association's Committee. Article 23. Inspection Work of the Association

1. The Inspection Board of the Association shall be established at the central level and at the provincial level, equivalent to the level of the Association's Committee, through mutual agreement and election among the members of the Committee of the Association within the term of office of the corresponding level of the Association's Committee. The number of members of the Inspection Board at each level shall be determined by the Central Committee Chairmanship of the Association.

2. The Association's Committees at the district level and equivalent, and at the commune level and equivalent, shall appoint one member of the Association's Committee responsible for inspection work.

3. The tasks of the Inspection Boards at all levels:

- Advising the Association's Committees at all levels on the implementation of the Charter and Resolutions of the Association; protecting the legitimate rights and interests of members and youth.

- Inspecting the collection and utilization of membership fees and financial resources of the corresponding level of the Association's Committee.

Chapter V

REWARD AND DISCIPLINE

Article 24. Individuals and organizations with outstanding achievements in performing the tasks of the Association shall be rewarded by the Association.

The forms of reward of the Association shall be stipulated by the Central Committee Chairmanship of the Association.

The Central Committee of the Association and the Provincial-level and equivalent Committees of the Association shall establish necessary awards to recognize and encourage collectives and individuals with outstanding achievements.

Article 25. Individuals and organizations violating the Charter of the Association shall be reprimanded, warned, or removed from their positions in the Association's Committee, or deprived of their status as members or collective members of the Vietnam Youth Federation, depending on the severity of the violation.

Chapter VI

ASSOCIATION FINANCES

Article 26. The sources of financial resources of the Association include:

- State subsidies.

- Membership fees contributed by members and organizational members.

- Contributions from affiliated units.

- Income from economic and social programs and projects in which the Association participates.

- Donations from individuals and organizations both domestically and internationally.

Article 27. The expenditures of the Association include:

- Expenses for the Association's activities.

- Rewards.

- Construction, repair of the Association's material facilities and welfare works, purchase of working equipment.

Financial resources at each level shall be managed and utilized by the corresponding level of the Association's Committee in accordance with current state regulations and policies.

Chapter VII

IMPLEMENTATION OF THE ASSOCIATION'S CHARTER

Article 28.

All cadres, members, Association organizations, and collective members of the Association must have the responsibility to implement the Charter of the Vietnam Youth Federation.

- The Central Committee Chairmanship of the Vietnam Youth Federation has the responsibility to guide the implementation of the Association's Charter.

- The Charter of the Association consists of an introduction and seven chapters, twenty-eight articles, adopted by the Fifth National Congress of the Vietnam Youth Federation on February 25, 2005./.
