Regarding the issuance of the Regulation on awarding the Commemorative Medal
"For the Cause of Vietnam's Finance"
THE MINISTER OF FINANCE
Pursuant to the Law on Competition and Reward which was adopted by the National Assembly of the Socialist Republic of Vietnam at its eleventh session, fourth meeting on November 26, 2003;
Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
At the proposal of the Director of the Cadre and Civil Servant Department, the Head of the Office of the Ministry of Finance.
DECISION:
Article 1. The attached Decision promulgates the Regulation on awarding the Commemorative Medal "For the Cause of Vietnam's Finance".
Article 2. This Decision takes effect 15 days from the date of publication in the Official Gazette and replaces Decision No. 44/2003/QĐ-BTC dated June 7, 2003 of the Minister of Finance. The Director of the Cadre and Civil Servant Department, the Head of the Office of the Ministry, and the Heads of units under the Ministry of Finance shall be responsible for implementing this Decision./.

REGULATIONS ON AWARDING THE COMMEMORATIVE MEDAL
"FOR THE CAUSE OF VIETNAM'S FINANCE"
(Issued together with Decision No. 42/2005/QĐ-BTC, July 7, 2005)
of the Minister of Finance)
PART I
GENERAL PROVISIONS
Article 1. The Commemorative Medal "For the Cause of Vietnam's Finance" (hereinafter referred to as the Commemorative Medal) is a form of award granted by the Minister of Finance to recognize and encourage the contributions of individuals who have made significant contributions to the cause of building and developing the finance sector.
The Commemorative Medal is awarded only once to an individual.
Chapter II
ELIGIBILITY AND CRITERIA FOR AWARD
Article 2. The recipients of the Commemorative Medal include:
- Individuals who are cadres, civil servants, and public officials (hereinafter referred to as cadres) who have worked and are currently working directly in units under the Ministry of Finance throughout various periods.
- Leaders of the Party and State, heads of central-level political social organizations (Vietnam Fatherland Front, Vietnam Women's Union, Vietnam General Confederation of Labor, Ho Chi Minh Communist Youth Union, Vietnam Veterans Association, Vietnam Farmers' Union).
- Leaders of Ministries, sectors; localities; enterprises; and individuals outside the sector who have achieved remarkable results in financial work.
- Foreign individuals who have made significant contributions to the construction and development of Vietnam's finance sector.
Article 3. Criteria for awarding the Commemorative Medal:
1. For cadres in units under the Ministry of Finance, provincial and municipal finance departments directly under the central government; district and county finance offices; village and ward finance boards:
a) General criteria:
Cadres (including those currently serving, retired, or deceased) must have a minimum of 20 years (non-transferable) of service in the finance sector for males and 15 years (non-transferable) for females, and must have satisfactorily completed their assigned tasks. The period of service in the finance sector for current cadres is calculated up to June 30 each year; for retired cadres, it is calculated up to the retirement date; for deceased cadres, it is calculated up to the date of death.
The Commemorative Medal will not be awarded to cadres who have been dismissed due to disciplinary action, are currently being prosecuted by judicial authorities, or have served time in prison or are currently undergoing disciplinary sanctions. In cases where cadres previously violated regulations but were later rehabilitated (excluding those mentioned above), the period of disciplinary action will be deducted when considering eligibility, and they may only be considered for the award three years after rehabilitation.
b) Other provisions:
- Cadres who have directly worked in units within the finance sector since its inception (such as ATK, the Vietnamese Banknote Printing Agency, Rice Storage Departments, Salt Departments...) during the anti-French resistance period.
- Cadres in the finance sector who died while performing their duties and were recognized as Martyrs.
- Cadres in the finance sector who were transferred to work in other sectors or served military service and then returned to work in the finance sector, the time spent working in other sectors or serving military service is counted as part of their service in the finance sector.
- Cadres who have worked in the finance sector for 15 years (for males) or 12 years (for females), then transferred to work in other agencies outside the sector, and continue to work in financial accounting until the time of application for the award.
- Cadres in tax systems, state treasury, enterprise financial management... who were transferred from other sectors, the time spent working in financial accounting in previous units is also counted as part of their service in the finance sector.
- Cadres who have worked in customs, price control, national reserves, securities commissions from central to local levels, the time spent working in these agencies before transferring to the Ministry of Finance is added to their service time in the finance sector for the purpose of awarding the Commemorative Medal.
- Provincial and municipal leaders of finance departments (finance, state treasury, tax, national reserves, customs) who have been appointed to leadership positions in local party and administrative bodies and have worked in the finance sector for 15 years.
2. For individuals outside the finance sector who have made significant contributions to financial work and are eligible for the Commemorative Medal, including:
a) Central-level leaders of the Party, State, and heads of central-level political social organizations (Vietnam Fatherland Front, Vietnam Women's Union, Vietnam General Confederation of Labor, Ho Chi Minh Communist Youth Union, Vietnam Veterans Association, Vietnam Farmers' Union).
b) Current leaders of ministries and sectors (including Ministers and Deputy Ministers in charge of finance).
c) Directors and Deputy Directors of Financial Accounting Departments in ministries and sectors, central-level party committees, and mass organizations who have worked in financial accounting for 20 years (for males) or 15 years (for females) and are still holding these positions without violating financial discipline.
d) Current local leaders (including Secretaries of Provincial and Municipal Party Committees, Chairpersons of People's Councils, Chairpersons of Provincial and Municipal People's Committees).
D) Deputy Chairpersons of Provincial and Municipal People's Committees who have been in office for five years in charge of finance.
e) Chief Accountants of enterprises who have worked in financial accounting for 15 years or more and are still holding these positions, with satisfactory performance in financial accounting tasks, ensuring full payment of state budget obligations, and without violating financial discipline.
g) Individuals in related fields: journalists, radio, television... with at least 10 years of work experience directly participating in supporting the construction of the Finance sector during the performance of their duties.
3. For foreign individuals:
Foreign individuals working in diplomatic agencies and international organizations in Vietnam, upon completion of their term of service, who have made significant contributions to the Vietnamese Finance sector in various aspects such as expanding financial cooperation relations with other countries and international financial organizations; mobilizing support from international organizations and financiers in terms of spirit, material, or large advisory, training, technical assistance, etc., consistent with the policy of expanding foreign relations and international financial cooperation of the Vietnamese Government to assist the Vietnamese Finance sector in fulfilling its assigned tasks.
- Other special cases of a diplomatic nature.
4. In special circumstances, the Minister of Finance decides on the awarding of the Commendation Medal based on the proposal of the Director of the Cadre Organization Department and the Head of the Ministry's Office.
Chapter III
PROCEDURE FOR IMPLEMENTATION
Article 4. The specific procedure for awarding the Commendation Medal is as follows:
1. At the Central Level:
a) For officials currently working in units under the Ministry of Finance:
The head of the unit under the Ministry bases on the criteria stipulated in Article 2 and Article 3 to prepare a list of individuals (in accordance with Form No. 1 attached) who meet the criteria for receiving the Commendation Medal to submit to the Minister.
b) For officials under the Ministry of Finance who have retired or become incapacitated:
The head of the unit managing the officials before retirement or incapacity coordinates with the Retirement Association of the Ministry of Finance to prepare a list of individuals meeting the criteria for receiving the Commendation Medal to be sent to the Ministry of Finance (in accordance with Form No. 1).
c) For Party and State leaders:
The Ministry's Office prepares the procedures for awarding the Commendation Medal according to the Central Regulations.
d) For Ministries, sectors, enterprises:
- The Administrative Financial Affairs Department and specialized financial departments exchange opinions with relevant Ministries and sectors so that these agencies can issue formal requests for lists of individuals meeting the criteria stipulated in points a, b, and c of Article 3 to be submitted to the Ministry of Finance for consideration.
đ) For individuals in related fields mentioned in point g of Article 3: The Ministry's Office coordinates with relevant units to introduce a list and complete the procedures for nominating individuals for the Commendation Medal.
e) For foreign individuals:
The heads of units having working relationships with international financial organizations and foreign projects review the achievements of foreign individuals contributing to the Finance sector, lead coordination with the International Cooperation Department and the External Financial Affairs Department to provide evaluation opinions. After reaching consensus with the Ministry of Foreign Affairs, the International Cooperation Department compiles the list to report to the Ministry of Finance for consideration of the Commendation Medal.
2. At localities:
- Heads of units under the Ministry of Finance with vertical systems in provinces and centrally-administered cities are responsible for disseminating the Regulations on awarding the Commendation Medal "For the Cause of Vietnamese Finance" to grassroots units within their management system, compiling lists of civil servants meeting the criteria for receiving the Commendation Medal to be sent to the Ministry of Finance through the General Taxation Department (for provincial and municipal Tax Bureaus); State Treasury (for provincial and municipal State Treasuries); National Reserve Administration (for regional National Reserves); General Customs Department (for local Customs Bureaus and other units under the General Customs Department located in localities);
- Directors of Provincial Finance Departments in provinces and centrally-administered cities are responsible for disseminating the Regulations on awarding the Commendation Medal to grassroots units and compiling lists of officials under their management meeting the criteria for receiving the Commendation Medal to be sent to the Ministry of Finance for consideration of awards.
- Directors of Provincial Finance Departments in provinces and centrally-administered cities are responsible for proposing lists to report to local leadership to prepare procedures for requesting the Ministry of Finance to award the Commendation Medal to local leaders mentioned in points d and đ of Article 3.
- The Chairperson of the Retired Cadres Association and the Chairperson of the Anti-Frontline Cadres Association of the Ministry of Finance are responsible for compiling lists of retired officials meeting the criteria for receiving the Commendation Medal to be submitted to the Ministry (through the Cadre Organization Department).
Article 5. The awarding of the Commendation Medal "For the Cause of Vietnamese Finance" is conducted annually. Units nominating for the Commendation Medal must complete the submission of files to the Ministry (Cadre Organization Department) by June 30th, the Cadre Organization Department will collect the files and coordinate with the Ministry's Office to complete the procedures for submitting to the Ministry of Finance's Commendation Council for approval of the list of recipients and announcement of the award on the occasion of the anniversary of the establishment of the Finance sector on August 28th each year.
Chapter IV
RIGHTS OF RECIPIENTS OF THE COMMENDATION MEDAL
Article 6. Recipients of the Commendation Medal are awarded the Commendation Medal and a Certificate of the Commendation Medal.
Chapter V
ORGANIZATION OF AWARDS
Article 7. Based on the Decision awarding the Commendation Medal, the Minister of Finance organizes the presentation of the Commendation Medal to Party and State leaders, and leaders of central political-social organizations on the occasion of the anniversary of the establishment of the Finance sector every even-numbered year.
Leaders of the Ministry of Finance organize the presentation of the Commendation Medal to leaders of the Ministry, sectors, and localities.
The Ministry of Finance requests leaders of Ministries, sectors, and localities to organize the presentation of the Commendation Medal to individuals under their management.
The Ministry of Finance delegates the responsibility to the heads of units under the Ministry to announce and present the Commendation Medal to officials under their management.
Chapter VI
VIOLATION HANDLING AND COMPLAINT AND DENUNCIATION RESOLUTION
REGARDING THE AWARDING OF THE COMMENDATION MEDAL
Article 8. Handling violations in the awarding of the Commendation Medal
1. Any individual who reports inaccurately about the criteria stipulated to be eligible for the awarding of the Commendation Medal shall have the Commendation Medal, certificate, and name removed from the award decision.
2. The Ministry of Finance's Commendation Council is responsible for reviewing and reporting to the Minister of Finance to decide on the revocation of the Commendation Medal.
Article 9. Resolving complaints and reports regarding the awarding of Commemorative Plaques
The procedures, formalities, deadlines, and authority for resolving complaints and reports regarding the awarding of Commemorative Plaques shall be carried out in accordance with the provisions of the law on complaints and reports.
Chapter VII
IMPLEMENTATION
Article 10. The Director of the Cadre and Civil Servant Organization Department, the Head of the Ministry's Office, and the Heads of units under the Finance Sector are responsible for organizing the implementation of the provisions of this Regulation./.
